The October 7, 2026, court order does not reveal the detailed construction plans themselves. It orders a short renovation presentation unsealed in full and requires the government to justify any proposed redactions to a separate 163-page construction report. The report’s eventual public contents depend on further filings and a later ruling.
What the court ordered released
The records informed the Kennedy Center board’s August 13, 2026, discussion of whether to close the main building for renovations. The government said the board considered a short PowerPoint from Delta Construction Group and a 163-page construction-details report prepared by JLL. In its October 7 opinion and order, the U.S. District Court for the District of Columbia set different disclosure terms for each:

The ruling is about public access to judicial records, not approval of a construction design or a decision about whether the Kennedy Center should close.
Why the JLL report may contain redactions
The government argued that releasing parts of the JLL report could expose sensitive building information. Its opposition described the report as containing structural schematics, floor plans, entrance and exit points, utility and maintenance infrastructure, and details about restricted-access areas. Those are the defendants’ asserted security concerns—not a court finding that every category will be withheld.

Judge Christopher R. Cooper rejected keeping the entire report sealed, writing: “Defendants have not met their burden to rebut the presumption of disclosure.” The opinion emphasized that the report related to a public trust’s deliberations about public funds and a public building, and that the defendants relied on it in their case. The judge nevertheless gave them an opportunity to propose narrowly tailored redactions backed by specific, substantial written justifications.
When the plan will be available
The order sets the next steps, but the proposed redactions and the court’s final decision determine what version of the JLL report the public can inspect.

- October 19, 2026: Rep. Joyce Beatty may respond to those proposals.
- After the response: The court will review the proposals and issue a separate order. The October 7 order does not settle which passages, if any, will be redacted.
The Delta presentation was ordered unsealed in full, but the October 7 opinion does not reproduce it. The order alone therefore cannot establish what its slides show. The same caution applies to the JLL report: its length and the government’s description of sensitive categories are not substitutes for the released pages.
What earlier court records say about the renovation
A separate May 29, 2026, opinion in the DC Preservation League case provides earlier context, not the contents of the JLL report newly addressed in October. It described declarations in that case as referring to internal work that included demolishing and rebuilding stages and seats, reconfiguring structural steel, and replacing historic marble. An official declaration cited by the court said there would be no new structure on the campus and that the main building’s exterior would not be materially affected. The opinion also said most grounds directly around the building would be behind a construction fence and some memorial and education functions were expected to move to the REACH.

That May ruling enjoined the closure decision made at the March 16, 2026, board meeting because of deficiencies in the board’s decision-making and harms associated with a two-year closure. It did not prevent planned capital repair work from proceeding. This is a different case and a different legal question from the October 7 order about public access to records.

- Which portions of that report, if any, will ultimately be redacted.
- The contents of the Delta presentation’s slides.
- A current construction budget, completion date, or final project scope.
To answer what the released records actually reveal, readers will need the unsealed presentation, the JLL report as cleared by the court, and the court’s subsequent redaction ruling—not the October 7 order alone.
