A general contractor can face legal responsibility connected to subcontractor workers, but there is no single joint-employer test for every construction claim. OSHA construction rules expressly assign safety responsibilities across contracting tiers; FLSA wage liability and NLRA bargaining duties involve separate legal tests. The answer depends on the law involved, the applicable jurisdiction, and what each company actually does—not just what the subcontract says.
Which law is involved? The answer changes by claim
| Legal regime | Question it addresses | Potential consequence | Key qualification |
|---|---|---|---|
| OSHA construction standards | Who is responsible for compliance with construction safety requirements on the work? | OSHA enforcement for safety violations, with responsibilities potentially applying to both the prime contractor and subcontractor(s). | 29 CFR 1926.16 is a construction-safety allocation rule, not a universal test for wages, discrimination, or bargaining. |
| Fair Labor Standards Act (FLSA) | Are multiple entities employers of the same worker for wage-and-hour purposes? | Potential shared responsibility for statutory wages and other relief; hours worked for joint employers in a workweek are counted together when determining overtime. | Federal appellate circuits apply differing standards to vertical contractor-subcontractor cases, according to the U.S. Department of Labor (DOL). |
| National Labor Relations Act (NLRA) | Do entities share or codetermine essential terms and conditions of employment for labor-relations purposes? | Potential obligations concerning collective bargaining and other NLRA matters. | The National Labor Relations Board (NLRB) standard has been affected by litigation and rulemaking; confirm current agency and court status. |
These regimes can concern the same project and workers, but one finding does not automatically answer the others. A prime contractor’s OSHA responsibilities, for example, do not by themselves establish that it is a joint employer under the FLSA or NLRA.

OSHA: construction safety duties can extend across tiers
The prime contractor retains overall responsibility
Under 29 CFR 1926.16, a prime contractor that contracts for the full performance of a construction project assumes the employer obligations imposed by the construction standards, whether or not it subcontracts some of the work. The rule also assigns each subcontractor responsibility for complying with the standards as to the part of the work it agreed to perform. For subcontracted work, the prime contractor and subcontractor or subcontractors have joint responsibility and may be subject to enforcement.

Some project suppliers may fall within the construction rule’s scope
OSHA’s interpretation in 29 CFR 1926.13 describes a subcontractor as a person who agrees to perform part of the labor or material requirements of a construction contract. Depending on the circumstances, the interpretation can reach suppliers where construction work occurs on or near the site or where goods are fabricated specifically for a project. Ordinary stock supply is treated differently. This scope question concerns the construction standards; it does not decide whether a supplier employs a worker jointly with a contractor for FLSA purposes.
FLSA: when a contractor may share wage responsibility
Joint employment can affect wages and overtime
DOL describes joint employment as two or more employers sharing legal responsibility for the same employee’s statutory benefits and protections. In a construction chain, the relevant possibility is often vertical joint employment: a worker employed through a subcontractor performs services that benefit another business in the structure, such as a general contractor. If entities are joint employers under the applicable FLSA standard, they may be jointly and severally liable for wages, damages, and relief. Hours worked for the joint employers during a workweek are combined when determining overtime.

The applicable vertical test depends on jurisdiction
DOL’s April 22, 2026 Q&A states that federal appellate circuits vary in the standards they apply to vertical joint-employment cases, and that the Department applies precedent that may govern the particular case. The project’s state and federal circuit therefore matter, as do the facts about the relationship. The cited agency Q&A does not establish one controlling nationwide test for every case.
DOL’s 2026 four-factor framework is a proposal, not settled nationwide law
On April 22, 2026, DOL announced a proposed rule that would consider whether an entity:

- Has the power to hire or fire the worker;
- Substantially supervises or controls the worker’s schedule or conditions of employment;
- Determines the worker’s rate or method of payment; or
- Keeps the worker’s employment records.
Those are proposed factors, not a binding nationwide test simply because they appear in the proposal. DOL’s Q&A also says the Department has not maintained generally applicable FLSA joint-employer regulatory guidance since rescinding its earlier rule in July 2021. Before relying on a particular test, check for later rulemaking and the precedent controlling in the relevant jurisdiction.
NLRA: a separate question about labor relations
The NLRA joint-employer analysis concerns labor relations and collective bargaining, not OSHA safety enforcement or the FLSA’s wage-and-hour rules. The NLRB’s status page reports that a district court vacated the Board’s 2023 joint-employer rule on March 8, 2024, before it took effect. The Board returned to the prior regulatory language in a February 27, 2026 Federal Register update. The agency describes that standard in terms of an employment relationship and sharing or codetermining essential terms and conditions of employment.

Because litigation and rulemaking have recently affected this area, a contractor evaluating an NLRA issue should verify the Board’s current position and any controlling court decisions for the relevant jurisdiction. Do not assume that descriptions of the vacated 2023 rule state the current standard.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsWorker classification is a different question
Before asking whether a contractor and subcontractor jointly employ someone, determine whether that worker is an employee or an independent contractor under the statute at issue. For the FLSA, DOL Fact Sheet 13, revised March 2024, describes an economic-realities analysis using six factors:
Best Value
- Low profile design
- Tested and marked for reverse donning
- Shell constructed from high density polyethylene materials
- The Package Weight Of The Product Is 3 Pounds
- The worker’s opportunity for profit or loss based on managerial skill;
- The worker’s investments compared with the potential employer’s investments;
- The permanence of the relationship;
- The nature and degree of control;
- Whether the work is integral to the potential employer’s business; and
- The worker’s skill and initiative.
No single factor determines status. DOL’s fact sheet includes a skilled welder providing services for a construction firm as an example. Classification and joint employment should be analyzed separately: a contract label or the placement of a worker on a subcontractor’s payroll does not, by itself, resolve either inquiry.
How contractors and subcontractors can assess a project
- Identify the claim first. Determine whether the issue concerns OSHA safety, FLSA wages or overtime, NLRA labor relations, or another law. Do not carry one regime’s test over to another.
- Confirm the governing jurisdiction and current rules. For an FLSA vertical case, identify the federal circuit and check its controlling precedent. For an NLRA issue, check current NLRB materials and court decisions. Confirm whether agency action has changed since the rules and agency pages described above.
- Map the actual working relationship. Record who recruited and hired the worker, who can remove the worker from the job, who sets schedules and pay, who directs daily tasks, who maintains employment records, and which entity controls the worksite and specific safety practices. These facts may matter differently under each law.
- Trace time and pay across the workweek. Establish which entity records hours, how hours are shared or reconciled, and how overtime is calculated where FLSA joint employment may be at issue. Keep records that let the responsible parties verify the worker’s full hours.
- Check the business behind the subcontract. Determine whether the subcontractor is operating an independent business or is functioning mainly as a crew intermediary. Identify who actually performs the work and who directs it; the contract’s labels are not a substitute for those facts.
- Review safety responsibilities for each tier. Identify which party performs each required safety task, how hazards are reported and corrected, and how the prime contractor oversees subcontracted work. Documenting assigned tasks supports coordination but does not erase duties imposed by 29 CFR 1926.16.
- Get advice tied to the claim and project facts. A case-specific assessment needs the state, federal circuit, statute or claim, project arrangements, and the worker’s actual employment conditions. The rules summarized here do not determine liability for a particular job.
What the subcontract can—and cannot—do
A subcontract can allocate operational responsibilities between businesses, set reporting and recordkeeping procedures, and require cooperation with safety or wage compliance. Those provisions can help the parties manage their work. They do not conclusively determine employment status, displace statutory duties, or prevent an agency or court from examining how the parties actually operate.
