Usually, the property owner where the tree lands arranges removal from that property and contacts their own insurer for covered damage. Your neighbor is not automatically responsible just because the tree grew in their yard. Fault—such as ignoring a known dead or diseased tree—can change the result, and state law and policy wording control.
Start with where the tree landed and what it damaged
In the common storm-fall situation, each owner’s insurance generally addresses damage to that owner’s insured property. The owner whose land receives the tree normally arranges removal from that side. Georgia consumer guidance explains that the receiving owner generally does not have to remove debris from the neighbor’s property; other states may apply different rules. When your neighbor may be legally responsible
A natural storm fall usually does not make the tree owner liable. Texas and Virginia insurance guidance say a neighbor’s policy generally will not pay for a storm-fallen tree without fault or proven negligence. The analysis can change when the owner reasonably should have known of a dangerous condition—for example, visible decay, disease or a documented warning—and failed to address it. Georgia describes that type of possible exception, but its test is not a nationwide rule.
Preserve dated photographs, messages, letters, inspection reports and witness information showing the condition or notice. Ask your insurer whether it will pursue the neighbor (subrogation) and consult a lawyer familiar with your state if the evidence suggests a known hazard.

What homeowners insurance may pay
Damage to the home and removal
Many policies cover damage to a house caused by a fallen tree and may cover reasonable removal when the tree damaged the house or blocks a driveway. Virginia’s consumer guidance notes that removal generally requires damage to the home or other covered property, with possible limited driveway-blockage coverage. Your deductible and any debris-removal sublimit still apply.
State examples are not national guarantees
- North Carolina: The Department of Insurance says policies pay reasonable removal expense up to $500 per loss when the tree damaged a structure or blocked the driveway. This is North Carolina guidance, not a national limit: North Carolina Department of Insurance FAQs.
- Maryland: The Insurance Administration says many policies may provide a limited removal amount, commonly $500 to $1,000, but the actual policy controls: Maryland Insurance Administration advisory.
When there is no covered damage
If the tree is lying in the yard without damaging insured property or blocking covered access, cleanup may be your expense. Ask the insurer to identify the exact debris-removal provision rather than relying on a general promise that “tree removal” is covered.

What to do immediately
- Make the area safe. Stay clear of trees under tension, unstable limbs, structures and utility lines. Do not climb or cut a dangerous tree yourself; have a qualified local professional assess hazardous removal.
- Document before moving anything, if safe. Photograph the tree, points of impact, visible damage, property-line context and any decay. Texas guidance recommends photographs before moving the tree or repairing damage: Texas Department of Insurance.
- Notify your insurer promptly. Ask specifically about structural damage, tree removal, driveway access, your deductible and the policy’s debris-removal sublimit. Virginia’s guidance is available at State Corporation Commission of Virginia.
- Prevent further damage. Use reasonable temporary measures, keep receipts and photograph the work. When feasible, wait for the insurer’s direction before permanent repairs; do not leave an opening exposed when an emergency repair is needed.
- Handle a damaged vehicle through auto insurance. Contact the auto insurer about comprehensive or Other Than Collision coverage, rather than assuming homeowners insurance applies.
- Coordinate access and removal. Tell the neighbor where the trunk and limbs lie, but do not concede liability or sign a release before understanding the insurance and legal position.
Questions that determine the outcome
- Which state and local rules apply?
- Did the tree damage a structure, other insured property, driveway, vehicle or only the lawn?
- Was the cause an ordinary storm, or was there a known pre-existing hazard?
- What deductible, coverage conditions and debris-removal limit does your policy contain?
- Can you prove the neighbor knew, or reasonably should have known, about the dangerous condition?
Because these factors can produce different results, treat the general storm-fall rule as a starting point—not a promise that your neighbor, your insurer or a particular contractor must pay.

Document the scene, protect people and property, and confirm coverage and limits with your insurer before authorizing final removal.
