How to Verify Land Ownership and Development Permissions Before Buying a Plot

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Before paying a deposit for a plot, prove three separate facts: the seller has authority to sell the identified parcel, the legal parcel matches the ground you intend to buy, and your proposed development can obtain every required approval. A title search alone does not answer the planning question, and a zoning map or planning application does not prove ownership.

The exact records and terminology depend on the country, state or region and municipality. The sequence below uses official guidance from England and Wales, England planning authorities, New South Wales, Victoria and Singapore as illustrations. Begin with the rules and authorities for your own jurisdiction, then have a property lawyer or conveyancer review the transaction and use a planning consultant or licensed surveyor where the issue requires specialist judgment.

What you must establish before committing to a plot

Keep ownership, physical identity and development permission as separate workstreams. A plot can be correctly registered to the seller yet be unusable for your project because of an access easement, restrictive covenant, hazard, overlay or lack of required consent. Conversely, a planning application can be submitted by someone who does not own the land; in England, anyone may apply for permission to develop any plot, regardless of ownership.

1. The seller can transfer the legal interest

The official land register or title service should identify the registered owner and the parcel description. Compare that information with the seller’s legal name, identity documents and the sale contract. Check whether the interest is freehold, leasehold or another form recognised locally, and whether a mortgage, charge, trust, probate issue or co-owner could prevent an unqualified transfer.

2. The land in the documents is the land on the ground

Match the registry parcel number, address, dimensions and plan to fences, buildings, access tracks and other visible features. A title plan may show only general boundaries. In England and Wales, HM Land Registry states that its title plans show general boundaries rather than the exact legal line, so a plan that appears to align with a fence is not conclusive evidence in a boundary dispute.

3. Your exact project is lawful and feasible

Describe the intended use, floor area or scale, building position, access, servicing and any subdivision before asking the planning authority for advice. Determine the zoning, overlays, planning policies, hazards and risks applying to the parcel, then identify every permit or consent needed for that specific proposal. Ownership, zoning and planning permission are different questions.

Step 1: Pin down the parcel and the correct authorities

Start a due-diligence file containing:

  • the complete street address and any lot, block, folio, cadastral or parcel identifier;
  • the seller’s exact legal name and contact details;
  • a copy of the sales particulars, contract or heads of terms;
  • your intended use, approximate size, height, access arrangement and servicing assumptions;
  • the land registry or title office responsible for the location; and
  • the local planning authority or council responsible for development controls.

Use the same identifier in every search and request. A neighbouring lot, a parent parcel or a similarly named road can produce a convincing but irrelevant result. If the seller gives only a marketing plan, ask for the formal parcel reference before relying on any statement about ownership or buildability.

Jurisdiction examples

HM Land Registry covers registered land in England and Wales. The UK government directs searches in Scotland to Registers of Scotland and in Northern Ireland to Land and Property Services. Singapore’s Land Authority identifies OneMap and INLIS as routes for checking whether land is State or private land. These are local systems, not interchangeable parts of one global registry; follow the system used where the plot sits.

Step 2: Verify ownership through the official title record

  1. Order the official record. Search the competent registry or title service using the parcel identifier and obtain the current title, register extract or equivalent record, not just a seller-supplied scan.
  2. Compare the registered owner. Check spelling, corporate identity, trustee capacity and any joint owners against the seller and the contract. Ask for evidence of authority from an executor, attorney, company director or agent when someone signs for the registered owner.
  3. Read the entire record. Do not stop at the proprietor’s name. Review tenure, charges, restrictions, notices, leases, rights and references to separate deeds or filed plans.
  4. Resolve a missing match. Land can be unregistered or recorded under a historic description. A failed online search is not proof that the seller owns the land or that the land is ownerless; ask the local property lawyer or registry about the jurisdiction’s procedure for unregistered title.

In England and Wales, the public registered information includes owner names, but the title plan’s general-boundary limitation means the register is a starting point for identity, not a substitute for a boundary determination. Have a conveyancer interpret the register and any documents referred to in it.

Step 3: Examine restrictions, rights and the sale documents

Ownership does not mean unrestricted use. Give the complete register, deeds, contract and seller disclosures to a qualified local property lawyer or conveyancer. Ask for a written explanation of each item that could affect transfer, access, financing or construction.

  • Charges and mortgages: establish how a lender’s charge will be discharged or released at completion.
  • Easements and rights of way: confirm the legal route for vehicles, pedestrians, drainage, utilities and construction access, and whether the route is wide and strong enough for the proposed works.
  • Covenants and restrictions: identify limits on building type, materials, height, trade, subdivision, nuisance or the number of dwellings. Determine who can enforce a covenant and whether consent is available.
  • Leases, options and occupation: check whether another party has a lease, licence, purchase option or right to occupy any part of the parcel.
  • Access and service rights: verify rights to connect water, sewer, electricity, gas, telecommunications and stormwater where services cross neighbouring land.
  • Contract and disclosure terms: ensure the legal description, included land, exclusions, completion conditions and representations match the title record and your inspection.

England’s planning guidance distinguishes land ownership and private restrictions from planning matters; a planning authority generally cannot decide whether a restrictive covenant or access right permits your work. That is a legal issue for your adviser. Victoria’s consumer checklist similarly directs buyers to title encumbrances, the section 32 statement and a thorough reading of the contract and disclosure statement.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Step 4: Check boundaries, access and physical constraints

Compare the title plan with the site

Walk the whole parcel with the title plan, sale plan and any survey. Note fences, walls, gates, buildings, driveways, streams, retaining walls and apparent occupation by neighbours. Measure only as an initial comparison; a consumer measuring tool cannot establish a legal boundary.

If the area, access route or boundary position affects the price or design, commission a licensed local surveyor. Victoria’s buyer checklist advises comparing title measurements with actual fences and buildings and speaking with a lawyer or conveyancer or obtaining a site survey when concerned. A survey is especially important when a fence is offset from the title line, a structure crosses the boundary, or the seller’s plan differs from the registry plan.

Confirm practical access

Trace the route from a public road to the buildable area. Check that the route is legally available, physically passable for construction vehicles, and not dependent on a neighbour’s informal permission. Confirm who maintains it, whether gates are locked, and whether drainage or bridge weight limits could prevent construction. A right of way that serves pedestrians may not permit heavy vehicles or utility installation.

Investigate site and environmental constraints

Before treating a plot as buildable, ask the relevant authority and specialist advisers about contamination, flooding or other hazards, heritage requirements, protected trees, drainage and service availability. Victoria’s checklist specifically flags contamination, potential heritage requirements, services that may not be connected or available, and planning controls. Record whether each service is physically at the boundary, has capacity, and requires a third-party easement or infrastructure contribution.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Step 5: Obtain parcel-specific planning information

Ask the local planning authority or council for the formal records available for the exact parcel. Do not infer permission from a listing, a colour on a map or a seller’s assurance.

Location example Official check Information it can provide
England Local planning authority records and applicable national and local guidance Whether permission is required, relevant planning controls, existing applications or permissions, and conditions that govern development
New South Wales Section 10.7(2) planning certificate Zoning, relevant planning instruments and policies, controls, hazards and risks; it must be attached to a contract of sale
New South Wales Section 10.7(5) planning certificate The section 10.7(2) information plus other relevant information held by the council
Victoria Local council planning scheme, zoning, overlays and permit records Whether the use and development are affected by the council scheme, overlays, proposed or issued permits and associated controls
Singapore Singapore Land Authority ownership routes, including OneMap and INLIS Whether the land is recorded as State or private land; planning and development checks still require the competent planning authorities

Request written clarification when a map, certificate or online record is ambiguous. Ask the authority to identify the relevant zone, overlays, policy clauses, hazard layers, minimum lot or frontage rules, setbacks, height or floor-space limits, parking and access standards, and whether a proposal would be prohibited, permitted with consent or subject to a discretionary application.

Step 6: Test the exact development proposal

Planning answers are proposal-specific. Supply a clear sketch or written description showing the use, dimensions, number of units, building position, access, parking, servicing, tree removal, earthworks and any subdivision. A statement that a parcel is “residential” does not establish that your intended dwelling, extension, workshop, holiday use or subdivision is allowed.

England: identify the permission route

GOV.UK guidance explains that development may be authorised by a planning application, permitted development rights or certain local orders. In other cases, an application to the local planning authority is required. Ask which route applies to the precise proposal and whether conditions, contributions or infrastructure requirements would attach to an approval.

Even where a planning application is unnecessary, other consents may still apply, including listed-building, protected-tree, environmental, hazardous-substances or building-regulation approvals. The developer is responsible for obtaining required permissions and consents; carrying out development without one can lead to enforcement action.

Lawful development certificates in England

A lawful development certificate can address whether an existing use or development, or a specified proposed use or operation, is lawful for planning purposes. The application must describe the land and proposal precisely enough for the authority to decide it. The certificate does not remove building-regulation duties or separate licences and permits, and it does not prove ownership. Treat it as evidence of planning status for the described use, not as an all-purpose guarantee that construction can proceed.

Other jurisdictions

In New South Wales, use the planning certificate and council advice to identify the instruments, controls and hazards that apply, then confirm the development pathway under the current local scheme. In Victoria, zoning and overlays within the council planning scheme affect both permitted uses and the ability to develop; councils can also advise about proposed or issued permits nearby. Terminology and approval thresholds differ elsewhere, so obtain the equivalent parcel-specific planning record rather than importing an English, NSW or Victorian assumption.

Step 7: Verify existing and proposed approvals

For any permission the seller mentions, obtain the complete decision notice, approved plans, conditions, amendments, commencement or expiry information, inspection records and completion or occupancy documents where relevant. Verify the documents with the issuing authority. Check that the approval covers the same parcel, owner or applicant, use, footprint and access shown in your proposal.

Read every condition. A permission may require road works, drainage, landscaping, contamination remediation, contributions, tree protection or staged approvals before building can start or a building can be occupied. Confirm whether a condition has been discharged, whether a variation is needed and whether an approval transfers with the land under local law.

Do not treat a pending application as permission. Do not treat a planning approval as evidence that the applicant owned the land. The title search and planning verification must remain independent.

Step 8: Resolve uncertainty before signing or paying

Put unresolved issues on a written schedule and make the transaction conditional where local law and the contract permit. Typical conditions include satisfactory title, survey, finance, planning due diligence, service availability and approval of a defined development proposal.

  • Ask the registry, council or planning authority for written clarification or a formal certificate where available.
  • Have a property lawyer or conveyancer explain title defects, restrictions, contract remedies and completion requirements.
  • Use a planning consultant when the proposal involves overlays, heritage, hazards, subdivision, change of use or several approval regimes.
  • Use a licensed surveyor when boundaries, area, levels, access or encroachments affect the decision.
  • Obtain specialist environmental, heritage, arboricultural or engineering advice when the site records indicate those risks.
  • Do not release a deposit or waive due-diligence conditions merely because the seller is pressing for speed.

If ownership, the legal description, access or permission status still cannot be established, treat the matter as unresolved and obtain jurisdiction-specific advice before relying on the plot for your project.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Documents to collect in a due-diligence file

  • Current official title, register extract or equivalent ownership record.
  • Title plan, cadastral plan and every deed or document referred to in the register.
  • Signed contract, disclosure statement, seller representations and the full sales particulars.
  • Identity and authority documents for the registered owner, trustee, company, executor or agent.
  • Survey, boundary report, access plan and photographs showing the physical parcel.
  • Planning certificate, zoning and overlay extracts, planning scheme provisions and council correspondence.
  • Copies of all planning applications, decisions, approved drawings, conditions, amendments and completion records.
  • Evidence about utilities, road access, drainage, contamination, flood or other hazards and heritage constraints.
  • A written description and sketch of the development you actually intend to build.

How to compare two plots objectively

When choosing between sites, score both against the same decision axes and attach the supporting document to each score. A cheaper plot can become the riskier purchase if it needs an easement, road upgrade, contamination treatment or a difficult discretionary approval.

Common traps and the correct response

“The seller’s name is on a document, so title is proven.”

Seller documents can be outdated, incomplete or refer to a different parcel. Order the official record, reconcile the identity and have the conveyancer investigate discrepancies.

“The online plan gives the exact boundary.”

Some registries, including HM Land Registry, show general boundaries. Commission a licensed survey when the line, area or encroachment affects value or design.

“Residential zoning means I can build my planned house.”

Zoning is only one control. Overlays, setbacks, access, hazards, servicing, heritage and proposal-specific standards can alter the outcome. Obtain parcel-specific planning advice for the actual design.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“A planning application proves the applicant owns the land.”

It does not. In England, anyone may apply for permission to develop any plot. Verify ownership separately and ask the authority for the permission documents and conditions.

“No planning application is needed, so no other approval is needed.”

Permitted development or a lawful development certificate does not remove building regulations or separate environmental, tree, heritage, hazardous-substances or licensing requirements. List every consent and confirm it with the relevant authority.

“A neighbour’s permission is enough for access.”

Informal permission is fragile and may disappear on a sale. Establish a registered or otherwise legally enforceable right, its permitted users, maintenance obligations and suitability for construction traffic.

Who should sign off each question?

  • Property lawyer or conveyancer: title, ownership authority, contract, charges, covenants, easements, leases and completion conditions.
  • Planning consultant or local planning officer: zoning, overlays, planning pathway, existing permissions, conditions and the exact development proposal.
  • Licensed boundary or cadastral surveyor: boundary position, area, levels, encroachments, access alignment and site survey.
  • Environmental, heritage, arboricultural or engineering specialists: contamination, hazards, protected features, drainage, services and technical design constraints.

Use the professional whose discipline matches the unanswered question. A surveyor cannot decide whether a covenant permits a dwelling, and a planning officer cannot cure a defective title.

Final pre-commitment checklist

  1. Identify the jurisdiction, parcel identifier, seller and exact intended development.
  2. Obtain and reconcile the official title or land-register record.
  3. Read all restrictions, easements, charges, covenants, leases and referenced deeds with a conveyancer.
  4. Compare the legal plan with the physical land and commission a survey if anything conflicts.
  5. Prove legal and practical access, utility rights and construction-route feasibility.
  6. Obtain the parcel-specific planning certificate, zoning, overlays, hazard and risk information available locally.
  7. Ask the planning authority which permissions and other consents the exact proposal requires.
  8. Verify every existing approval, plan, condition, expiry, completion record and transfer requirement.
  9. Price professional work, infrastructure and remediation needed to make the site usable.
  10. Make the contract conditional on satisfactory due diligence where possible, and do not proceed while a material ownership, boundary, access or permission issue remains unresolved.
