Set local-hiring and procurement targets only after you have defined the project’s legal authority, geographic boundary, eligible workers and businesses, and an auditable denominator. A defensible clause normally combines a numeric outcome (such as local craft hours or local subcontract spend), a contractor plan, subcontractor flow-down, periodic evidence, audit rights, and a proportionate remedy. The percentage is an output of the project baseline and governing law—not a universal benchmark.
Before issuing the contract, confirm the funding conditions, labor and equal-employment rules, competition requirements, and any applicable public policy with project-specific legal counsel. Then state every definition, calculation, deadline, exception and record requirement in the contract rather than leaving them to a bid meeting or informal promise.

1. Establish the project boundary and legal authority
Begin with a short applicability statement. Identify the owner, project location, funding source, contract value, construction tiers covered, and the policy or statute that authorizes the requirement. A target can be mandatory under a grant, project labor agreement, procurement ordinance or tender condition, while another project may support only a voluntary good-faith goal.

- For qualifying United States federally funded highway or transit construction, Section 25019(a) of the Bipartisan Infrastructure Law authorizes state and local agencies to use local, geographic or economic hiring preferences for labor on projects funded under Title 23 or 49 U.S.C. Confirm that your project falls within the statutory scope and that the agency has adopted an implementing policy.
- Federal contracts can also carry labor and subcontracting requirements. FAR 52.222-27 requires covered construction-subcontracting clauses to include solicitation participation goals and directs recruitment toward community, school, and minority and female training organizations.
- In Victoria, Australia, Local Jobs First requires agencies to incorporate model clauses into both market-approach and contract documents for applicable projects. The model clauses, rather than an invented percentage, tell bidders what obligations apply.
- Other jurisdictions may impose local-business participation, Indigenous employment, apprenticeship, disadvantaged-worker or small-business rules. Identify the exact instrument and its effective date in the contract schedule.
Have counsel check equal-employment, anti-discrimination, labor, public-funding and competition rules before adopting a preference or set-aside. A geographic preference that is lawful for one funding stream may be invalid for another.

Define the covered tiers and work
State whether the requirement applies to the prime contractor only, all first-tier subcontractors, lower tiers, suppliers, or selected trades. Specify whether temporary labor, professional services, off-site fabrication, trucking, equipment rental and material-only purchases count. Exclusions should be explicit and justified by the project scope; otherwise bidders will price and report different things.
2. Define “local” and the target population
Use a boundary that can be verified from records. Options include a list of ZIP codes, the municipality, county, project-area boundary, or a named region. Put the actual list or map in an exhibit and state the worker’s qualifying date. For example, eligibility might require permanent residence in a listed ZIP code when hired and during the reporting period, while a supplier might qualify by maintaining its principal place of business in the area for a specified period.
Worker definitions
Define each category separately:
- Local worker: an employee whose permanent address is inside the stated project area and who performs covered work.
- Targeted worker: a local person who also meets a lawful economic, unemployment, public-assistance, veteran, Indigenous, disability or other program criterion.
- Apprentice or trainee: a person enrolled in a recognized program, with the required registration and supervision.
- Covered labor: the craft, field, operating and support classifications included in the denominator.
Do not treat a worker’s temporary lodging near the site as permanent residence unless the governing program says so. State how address changes, remote work, joint employment, leased labor and workers employed by a subcontractor are handled.
Business definitions
Define local supplier, local subcontractor, small or diverse enterprise, and the covered tier. A business may qualify by registration, principal office, tax location, ownership, workforce or performance location; choose the test required by the governing program and require documentary proof. Prohibit a sham pass-through in which an ineligible firm receives credit without performing a commercially useful function.
Evidence of eligibility
List acceptable evidence in the contract: worker address records or a verification form, payroll and time sheets, apprenticeship registration, business-registration records, tax or licensing documents, invoices, purchase orders, executed subcontracts and proof of payment. Protect personal information by limiting access, stating retention and deletion rules, and allowing redaction of irrelevant data.
3. Choose an auditable denominator
Every percentage needs a numerator and denominator that can be reproduced from project records. Use one basis for each target and state inclusions, exclusions, rounding and treatment of changes. Never switch from hours to dollars mid-project without a written amendment.
| Basis | What it measures | When it works well | Risks to address |
|---|---|---|---|
| Total construction craft hours | Local craft hours divided by all covered craft hours | Field labor is the policy objective and timekeeping is reliable | Clarify overtime, foremen, apprentices, rework, travel and off-site fabrication |
| Total labor hours | Local hours across specified employee classifications | The project has a broad workforce goal beyond craft trades | Administrative and professional hours can dilute a field-labor goal |
| Payroll dollars | Local wages and allowances divided by covered payroll | Programs measure economic benefit through wages | Different wage rates can make a small headcount appear large |
| Subcontract value | Eligible local subcontract awards or payments divided by covered subcontract value | Supplier and subcontractor participation is the objective | Define change orders, self-performance, retainage, taxes and pass-throughs |
| Procurement spend | Eligible local purchases paid divided by covered procurement spend | Materials, equipment or services are the focus | Set rules for bundled purchases, distributors and delivery location |
Headcount can be useful as a supplementary indicator, but it is usually a poor sole denominator: one worker employed for one day counts the same as one worker employed for a year. If you use headcount, specify a full-time-equivalent method and reporting period.

4. Set targets from a documented baseline
Estimate demand before selecting a percentage. Break the schedule into phases and trades, then compare expected demand with local labor supply, apprenticeship capacity, supplier availability, licensing, safety qualifications and the time needed to recruit and train. Record assumptions so the owner can distinguish an honest shortfall from inadequate effort.
Use separate targets for different outcomes
A single “local participation” number can hide important results. Consider separate, non-duplicative targets for local craft hours, targeted workers, apprentices or trainees, local or diverse subcontract spend, local materials, and training completions. State whether hours performed by a local apprentice count toward both the local-hour and apprentice targets; double counting may be acceptable, but it must be disclosed.
Named program examples are not universal benchmarks
| Program or document | Example requirement | Qualification |
|---|---|---|
| City of San Diego project labor agreement example | At least 30% of total construction craft hours for local workers | Current agency example; applies to the covered projects and definitions in that agreement |
| Los Angeles Metro PLA/Construction Careers Policy pilot | 40% economically disadvantaged-area workers, 10% disadvantaged workers, and 20% apprentices | Policy page describes the May 21, 2021–May 21, 2025 pilot period; do not transplant the figures |
| South African Department of Public Works tender example | 30% mandatory subcontracting to SMMEs | Tender-specific requirement effective July 27, 2022 |
| South African public-works tender example | R5,000 excluding VAT per working day reduction for missing a minimum targeted local skills-development goal | Subject to an employer-accepted finding that non-achievement was beyond the contractor’s control |
These figures demonstrate possible methods, not a cross-jurisdiction “right” percentage. A target should be lower, higher or structured differently when the baseline, law or project risk requires it.
5. Put the target in a clear contract schedule
Use a table that lets a bidder calculate compliance before submitting a price. Include the population, geography, denominator, target, measurement period, evidence and responsible party.
| Outcome | Eligible population | Denominator | Target | Measurement and evidence |
|---|---|---|---|---|
| Local craft employment | Workers permanently residing in the listed project-area ZIP codes | Total covered construction craft hours | Project-specific percentage established by the baseline | Monthly time sheets, payroll, address verification and subcontractor roll-up |
| Apprentices or trainees | Registered apprentices or approved trainees in covered classifications | Total covered craft hours or a stated apprentice-hour basis | Separate project-specific percentage | Registration, supervision records, hours and completion status |
| Local subcontracting | Eligible local firms performing a commercially useful function | Covered subcontract awards or payments | Project-specific percentage | Executed subcontracts, invoices, payment records and ownership/location evidence |
| Local procurement | Eligible local suppliers in listed categories | Covered procurement spend | Project-specific percentage | Purchase orders, invoices, delivery records and supplier eligibility documents |
Specify whether the target is a condition of contract, a good-faith effort, a contract-participation goal or a mandatory set-aside. Those labels have different legal and enforcement consequences.
6. Require a pre-mobilization compliance plan
Make plan approval a condition of mobilization or the first progress payment. The plan should be updated when the schedule, scope or labor market changes.
- Assign responsibility. Name a contractor compliance manager, provide contact details, and identify equivalent personnel for each covered subcontractor.
- Map demand. Submit a trade-by-trade labor forecast, hiring dates, expected hours, apprenticeship openings, procurement packages and anticipated subcontract awards.
- Advertise locally. Describe the positions, qualifications, pay classification, application method and closing date. Use local workforce intermediaries, community organizations, schools and construction-apprenticeship referral channels where appropriate.
- Build the supplier pipeline. Conduct a local-business census or use a verified supplier directory. Advertise scopes early enough for firms to obtain insurance, bonding, licenses and capacity.
- Explain selection. Record the objective criteria, interviews or bids, reasons an eligible applicant or business was not selected, and any safety or qualification constraint.
- Plan training. Identify orientation, safety, pre-apprenticeship, apprenticeship and upgrade training, with dates and completion evidence.
- Flow down obligations. Attach the definitions, targets, reporting forms, audit rights and remedies to every covered subcontract and purchase order.
- Protect records. Describe the data owner, access controls, retention period and method for correcting an eligibility record.
Anglo American’s Social Way toolkit calls for “realistic local employment, training and contracting requirements and targets in the contract,” together with a contractor plan. Toronto’s Community Benefits Framework likewise emphasizes definitions, timelines and measurable targets. Use those principles to make the plan operational rather than aspirational.

7. Design procurement rules that preserve competition
List the spend categories and tiers covered by the procurement goal. Decide whether credit is based on award value, paid value or both; paid value is harder to manipulate but lags the award decision. State treatment of change orders, materials bought through distributors, equipment rental, freight, taxes, retainage and self-performed work.
Require documented outreach
For each covered package, require reasonable notice, a scope description, bid instructions, a contact person, sufficient response time and assistance with clarification. Keep a record of firms contacted, bids received, follow-up, award rationale and any capacity, price, schedule, bonding or safety issue that prevented selection.
Use good-faith exceptions carefully
If the target cannot be met, require a written request before the relevant award or purchase. It should identify the unmet amount, outreach performed, responses received, alternatives considered and a corrective plan. The owner—not the contractor alone—should approve or reject the exception in writing. An exception is not a waiver of recordkeeping.
Prevent sham participation
- Require the eligible firm to perform a commercially useful function and identify its actual labor, equipment and management role.
- Exclude mere pass-through fees unless the governing program expressly allows them.
- Reconcile awards, invoices and payment records to detect credit for work never performed.
- Reserve audit rights over lower-tier arrangements and related-party transactions.
Toronto describes local and diverse procurement clauses as conditions in agreements with vendors, developers and contractors. South African tender examples show that mandatory subcontracting or contract-participation goals can be used, but their percentages and definitions are program-specific.
8. Build a reporting and audit system
Require a monthly report during active construction, or quarterly reporting only where the project’s workforce and purchasing cycle justify it. The report should show both the current period and cumulative totals so a late surge cannot conceal an early failure.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteMinimum monthly report contents
- Contract value, approved changes and the denominator used for each target.
- Local, targeted and apprentice hours by trade; headcount as a supplementary measure if required.
- Covered payroll, wages and allowances when payroll is a denominator.
- Subcontract awards, payments, change orders and lower-tier roll-up.
- Procurement spend by supplier, category, location and eligibility class.
- Address, registration, ownership and commercially useful function evidence.
- Vacancies, applicants, referrals, hires, separations, training starts and completions.
- Outreach events, advertisements, supplier contacts and bid responses.
- Variance from the target, explanation, forecast to completion and corrective action.
Require the prime to certify the report and retain supporting records for the period stated in the contract. Give the owner, funding agency and authorized auditor access to payroll, timekeeping, invoices, subcontracts, applications and outreach records, subject to privacy and confidentiality law. South African public-works tender language illustrates the value of monthly reports backed by audited documentation; Toronto’s framework similarly treats measurable reporting as an accountability mechanism.
9. Set proportionate remedies and a relief process
Write the consequence before the work starts. A practical ladder is:

- Notice of variance with a short response deadline.
- Corrective-action plan identifying additional recruitment, training, rebidding or outreach.
- Owner review of progress at the next reporting period.
- Payment withholding, reduction or other contract remedy only where authorized and tied to the clause.
- Escalation for material or repeated noncompliance, including default remedies where lawful.
Liquidated damages should be used only after legal review and only when the amount is a reasonable estimate of loss rather than a penalty. The South African example of a R5,000 (excluding VAT) reduction per working day for a missed local skills-development goal demonstrates one possible mechanism; its employer-accepted beyond-control exception is essential, and the figure is not a default for other projects.
Define relief for circumstances beyond control
Allow a contractor to request relief for documented events such as a shortage of qualified applicants, a canceled training intake, a permit delay, a strike, a disaster or an owner-caused schedule change. Require prompt notice, evidence, mitigation and an alternative target or timetable. Do not grant relief merely because the contractor failed to advertise, pay prevailing wages, order materials early or flow down the clause.
10. A worked clause structure
The following sequence can be adapted to the governing program and inserted into a contract schedule:
- Purpose and authority: identify the policy, funding condition or agreement and state the covered work.
- Definitions: attach the geography, worker and business eligibility tests, covered tiers and commercially useful function rule.
- Targets: provide a table with numerator, denominator, percentage or dollar amount, measurement period and whether the obligation is mandatory, good-faith or participation-based.
- Contractor plan: require the approved pre-mobilization plan, named manager, labor forecast, supplier map, advertising, training and selection records.
- Outreach and selection: prescribe notice, response time, objective evaluation and written good-faith exception requests.
- Flow-down: require identical obligations in covered subcontracts and purchase orders, with prime responsibility for the roll-up.
- Reports and evidence: set the monthly deadline, form, certification, current and cumulative calculations, attachments and privacy controls.
- Audit and access: permit inspection, interviews and electronic-record review by the owner, funder and authorized auditor.
- Corrective action and remedies: state notice, cure period, payment adjustment, damages or escalation, each subject to applicable law.
- Relief and change control: define beyond-control events, notice, mitigation, approval and amendment procedure.
- Retention: state how long records must be kept and how subcontractor records are transferred at closeout.
11. Implementation checklist for owners and contractors
- Confirm the funding source, jurisdiction, effective date and legal authority.
- Publish the exact project boundary and eligibility evidence.
- Choose a denominator that the project’s payroll and purchasing systems can produce.
- Run a trade, phase, apprenticeship and supplier-capacity baseline.
- Separate local, targeted, apprentice, supplier and training outcomes where they serve different purposes.
- Label every percentage with its program, geography and date; never present a named-program figure as a universal standard.
- Approve the contractor plan before mobilization and update it after material scope or schedule changes.
- Flow the clause to covered subcontractors and verify lower-tier reporting.
- Reconcile reports to payroll, time sheets, invoices, purchase orders and proof of payment.
- Document outreach and reasons for non-selection before granting any exception.
- Use a cure process and lawful, proportionate remedies.
- Obtain project-specific legal review before publishing the final percentage, preference, set-aside or penalty.
12. Common drafting failures and fixes
“Hire locally” with no boundary
Failure: bidders cannot tell who qualifies. Fix: attach the ZIP-code list, municipality, county or project-area map and an address-verification rule.
A percentage without a denominator
Failure: one contractor counts people while another counts hours. Fix: state the formula, inclusions, exclusions, period and rounding.
One blended goal
Failure: a large local-material purchase masks weak local hiring. Fix: use separate targets for labor, training and procurement.
Quick wins for a faster PC:
Repair Windows errors before they cause bigger problemsFix Now →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →No subcontractor flow-down
Failure: the prime cannot obtain evidence from the firms doing most of the work. Fix: attach the clause to every covered tier and make the prime accountable for consolidation.

Unrealistic or copied percentages
Failure: a target copied from another city or tender ignores local supply, schedule and qualifications. Fix: document the baseline and obtain legal and market review.
Remedy without relief
Failure: a contractor is penalized for a documented event outside its control. Fix: define notice, evidence, mitigation and owner-approved alternative performance.
Frequently Asked Questions
Can one contract use different denominators for hiring and procurement?
Yes. Craft or total labor hours can measure employment while subcontract value or procurement spend measures business participation. State a separate formula and evidence set for each target, and do not switch bases without a written amendment.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Should the target be based on headcount or hours?
Hours generally provide a fairer measure of sustained employment because headcount gives equal credit for very different employment durations. If headcount is required, define a full-time-equivalent method and reporting period.
What if the local labor or supplier pool is too small?
Require the contractor to document the baseline, advertise, contact workforce and supplier organizations, record responses, and request a written exception before the relevant work is awarded. The owner should approve any revised target or relief.
Who is responsible when a subcontractor fails to report?
Make the prime contractor responsible for collecting and consolidating covered-tier records, while requiring each subcontract to contain the same definitions, reporting duties and audit rights.
Are the San Diego, Los Angeles and South African percentages safe to copy?
No. They are examples tied to named programs, tenders and dates. A new project needs its own legal review, market baseline, geography and denominator.
