How to Document Construction Defects So They Get Fixed: A Step-by-Step Owner’s Guide

The most effective defect record is specific, dated, organised and tied to a written request for action. Number every problem, describe its exact location and observable condition, photograph it with both context and detail, preserve the contract and communications, then give the contractor a documented opportunity to inspect and repair. If the work is not corrected, the same file should be ready for a warranty provider, regulator, tribunal or lawyer.

Procedures and deadlines differ by country, state and contract. The examples below illustrate current official guidance from Western Australia, Victoria, New South Wales and Texas; verify the rules that apply to your project before sending a formal notice or allowing a limitation period to expire.

What makes defect documentation persuasive

A complaint such as “the workmanship is poor” is difficult to inspect, price or resolve. A useful record lets another person identify the exact condition without guessing what you saw. Every entry should answer five questions:

  • What is wrong? Describe the visible or measurable condition, not a conclusion about blame.
  • Where is it? Name the room, elevation, level, gridline, fixture or other permanent reference.
  • When was it observed? Record the discovery date and the dates of later inspections.
  • What evidence supports it? Link photographs, measurements, plans, reports and messages to the same item number.
  • What correction is requested? Ask for inspection and a proposed repair, replacement, test or completion date.

Western Australia’s building dispute guidance puts the evidentiary responsibility plainly: “When dealing with building disputes relating to regulated building services, the onus is on the parties to provide sufficient evidence to substantiate their respective positions.”

Stay with observable facts. “Water pools on the bathroom floor beside the shower after normal use” is stronger than “the waterproofing failed” unless a qualified report has established that cause. “A 6 mm gap is visible between the wall frame and ceiling cornice in the north bedroom” is more useful than “bad finish.”

Build a numbered defect register

Use one master schedule for the entire project. Give each issue a permanent number such as D-001, D-002 and D-003. Do not renumber items when new defects are found; preserving the original identifier makes the communication trail auditable.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Fields to include for every item

Field What to record
Item number A unique identifier used in every photo, email, report and repair entry.
Location Room, floor, wall orientation, exterior elevation, fixture or other precise reference.
Observed condition Plain, measurable description of what is visible, audible, loose, incomplete or malfunctioning.
Date first observed The date you first noticed it, plus dates of subsequent changes.
Impact For example, water entry, inability to use a room, safety concern, cosmetic damage or incomplete work.
Evidence links Photo filenames, video filename, drawing detail, invoice, test result or expert report section.
Requested response Inspection, explanation, repair, replacement, completion, testing or a written proposal.
Status Open, inspection scheduled, repair proposed, repaired, retested, disputed or unresolved.

Example of a strong entry

Item Example
D-014 — ensuite floor After a normal shower, water remains pooled along the tile joint at the shower entry and does not drain toward the waste. First observed 17 October 2026. Photos D-014-01 to D-014-04 show the room and the pool. Request: contractor to inspect the falls and waterproofing, explain the proposed remedy and provide a repair date.

Keep separate items separate. A cracked render panel, a leaking window and an incomplete flashing detail may have the same suspected cause, but combining them into one vague complaint makes inspection and close-out harder. You can add a “possible related items” note without losing individual identifiers.

Photograph each defect so its location and detail are clear

Take photographs before cleaning, moving, covering or repairing the condition, unless immediate action is required to prevent injury or further damage. Use a consistent file naming system that mirrors the register, such as D-014-01_ensuite-establishing_2026-10-17.jpg.

Use an establishing image and detail images

  1. Establishing image: Show enough of the room, elevation or circulation path to prove where the defect is.
  2. Mid-range image: Narrow the view to the relevant wall, floor, ceiling, opening or fixture.
  3. Detail image: Fill the frame with the crack, gap, stain, distortion or unfinished joint. Include a ruler, level, coin or other scale only when it helps and does not hide the condition.
  4. Reference image: Where useful, show the same feature from the opposite direction or beside a matching, correctly finished feature.

Use the original files rather than screenshots or heavily compressed copies. Preserve the capture date and keep an untouched master folder. If your phone changes filenames or time zones, record the actual observation date in the register and do not rely only on file metadata.

Label and organise the images

Put the defect number and location in the filename and in a photo log. A simple log can record filename, date and time, photographer, viewpoint and a one-sentence description. The Victorian Building and Plumbing Commission specifically calls for labelled photos linked to the corresponding item in a notice. The establishing-plus-detail sequence is a practical way to satisfy that requirement clearly; it is not a universal statutory formula.

When video, measurements or tests help

  • Use a short, continuous video for intermittent leaks, movement, noise, drainage or equipment operation. State the date, location and event at the start of the recording.
  • Record measurements with the instrument and method: crack width, floor fall, moisture reading, clearance or temperature. Do not present a consumer meter reading as an expert diagnosis.
  • Retain relevant test certificates, commissioning records and inspection reports. A test that was not performed, or whose conditions are unknown, should not be represented as proof of compliance.

Do not stage a defect. If you must operate a tap, shower, door or appliance to reproduce it, write down exactly what you did and under what conditions.

Keep one complete project file

Make a digital folder with a predictable structure and a backup in a separate location. Keep originals and a read-only copy of anything sent to the contractor or an authority. Your file should include:

Export messages to PDF where possible, but retain the native message or email as well. Do not edit a sent message to correct a mistake; send a dated clarification instead. If a conversation happens by phone or on site, write a contemporaneous note and email it to the participants as a confirmation of your understanding.

Use a chronology, not just a pile of documents

A chronology turns scattered evidence into a sequence: work completed, defect discovered, notice sent, inspection offered, response received, repair performed and result observed. Include the person involved, the document or photo that proves the event and the next promised action. This is especially important when a warranty period or pre-suit notice period is running.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Send a written notice that can be acted on

After the register and evidence are ready, send a concise notice with the numbered schedule attached. State the contract or job address, the date of completion if known, the defects, the requested response and a reasonable way to arrange access. Ask the contractor to confirm receipt, propose inspection dates and give a written repair schedule.

Suggested notice structure

  1. Identify the owner, contractor, project address and contract reference.
  2. State that the attached schedule lists observed defects or incomplete work.
  3. For each item, give the number, exact location, condition, discovery date and evidence filenames.
  4. Request inspection and a written proposal describing the remedy, responsible trade and target date.
  5. Offer reasonable access windows and ask the contractor to identify any required preparation.
  6. Reserve your rights under the contract, warranty and applicable law without making unsupported accusations.
  7. State how the contractor should respond and keep proof of delivery.

Victoria’s guidance identifies email with a read receipt or registered post as delivery options in its process. That is not a universal rule. Texas Property Code Chapter 27, for covered claims, requires notice by certified mail, return receipt requested, no later than the 60th day before filing suit or initiating arbitration. Use the method and timing required by the governing contract and local law, not a generic internet template.

Give access and an opportunity to inspect when required

Do not demolish or permanently alter disputed work before the contractor, insurer or appointed expert has had the required chance to inspect, unless emergency protection is necessary. Photograph the pre-repair condition and explain any urgent step. Texas Chapter 27 includes an inspection and cure process when requested; other jurisdictions and contracts may impose different requirements. An offer of reasonable access, documented in writing, is different from allowing unrestricted entry at any time.

Track every response and repair

Update the register after each contact. Record whether the contractor acknowledged the item, denied it, requested more information, attended an inspection, proposed a repair or failed to respond. Put agreed dates and scope in writing before work starts.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

During the repair

  • Photograph the condition immediately before work begins.
  • Record who attended, what was opened or removed and any new finding.
  • Keep delivery dockets, product information, test results and subcontractor reports supplied for the repair.
  • Note delays, missed appointments, changed scope and any damage caused during access.

After the repair

  1. Photograph the completed area from the same establishing and detail viewpoints.
  2. Operate or observe the feature under the conditions that originally revealed the problem.
  3. Record the date, result and any test or commissioning evidence.
  4. Write whether the item appears resolved, partly resolved or still outstanding. Avoid signing a broad satisfaction statement if unrelated items remain open.

Victoria’s Building and Plumbing Commission advises confirming repair schedules and satisfaction in writing. A close-out note should identify the exact item, not merely say “all defects fixed.” If the repair is inadequate, send a prompt, factual update with new evidence and keep the original item number.

Decide when photographs are enough and when to obtain an expert

Photos and a clear register may be sufficient for a visible incomplete item, damaged finish or straightforward adjustment. More complex or disputed conditions often need a technically qualified inspection. Western Australia’s guidance says the evidence required depends on complexity and may include photographs or a building expert report. New South Wales advises owners who need a technically qualified general inspection to arrange an appropriately qualified private consultant.

Consider an expert when

  • The suspected cause is hidden behind finishes or involves structure, waterproofing, fire safety, services or compliance.
  • The contractor disputes the existence, cause or cost of the defect.
  • The condition is worsening and you need advice on safe temporary measures.
  • You need a report for a regulator, warranty insurer, tribunal or court.
  • Repair options have materially different costs or consequences.

Before commissioning a report, ask what the inspection covers, what access is needed, whether destructive testing is proposed, which standard or contract requirement will be assessed, and whether the consultant can provide photographs, measurements and a reasoned conclusion. Keep the engagement letter and invoice with the report. A report should distinguish observed facts, testing performed, assumptions and opinions.

Use the correct escalation route and deadline

If the contractor does not respond, refuses a reasonable repair, or leaves the work defective, identify the route that governs your project: contractual dispute procedure, builder warranty insurer, licensing regulator, consumer agency, tribunal, arbitration or court. Preserve the opportunity to use that route; do not assume a complaint automatically stops a limitation period.

Illustrative jurisdiction rules

Jurisdiction and source Illustrative requirement What to preserve
Victoria — Building and Plumbing Commission guidance, page updated 25 August 2026 For defective or non-compliant work, claims generally must be made within 12 months after the owner first became aware, or reasonably should have become aware, of the issue; other timeframes and circumstances can differ. The guidance says a builder still trading usually must first receive a written complaint notice, subject to specified serious events. It gives a general 28-day limit for accommodation, removal and storage costs after those costs are incurred. Contract, variations, plans and specifications, payment records, photos or reports, correspondence, cover details and the complaint notice with delivery proof.
New South Wales — Building Commission NSW guidance reviewed 2026 Statutory warranties are six years for major defects and two years for other defects, measured from completion. A further six months may apply where a breach is found in the final six months. The guidance recommends applying to NCAT before the period expires when necessary to preserve rights. Owner and contractor details, completion evidence, contract and plans, correspondence, reports and photographs. Check the current process before relying on any period.
Texas — Property Code Chapter 27, reflecting amendments effective 1 September 2023 For a covered claim, prescribed notice by certified mail, return receipt requested, must be provided no later than 60 days before suit or arbitration. The notice must refer to Chapter 27 and describe the defect. If requested, the claimant must allow inspection and cure. The claimant must prove the defect existed at completion and proximately caused damages. Certified-mail receipt, notice and defect description, inspection requests, access offered, repair proposal, completion evidence and causation evidence.
Western Australia — building dispute guidance Each party must provide sufficient evidence to substantiate its position; depending on complexity, photographs or an expert report may be needed. Original photos, measurements, qualified reports and a chronology showing how each item is supported.

These are jurisdiction-specific illustrations, not a combined rule. A different state, country, contract type, apartment scheme or warranty policy may set different recipients, forms, notice methods and deadlines. Check the current official source and your contract promptly, especially if the project is near completion or the warranty period is ending.

Account for apartments and common property

In a multi-unit building, determine whether the defect is inside your lot, affects common property or arises from building services shared by several owners. Notify the owners corporation, strata manager, body corporate or equivalent entity when its authority is needed. Photograph the affected private area and the shared element, and record which party controls access. Do not assume an individual owner can authorise testing or repairs to a roof, façade, riser, basement, fire system or other common asset.

Ask for the approved repair process and keep copies of meeting resolutions, maintenance requests and insurer correspondence. If several lots show the same symptom, give each location its own item number while noting the pattern as a possible related issue.

Common documentation failures and how to correct them

Failure Why it weakens the claim Correction
One vague complaint The contractor cannot identify scope, location or remedy. Split it into numbered, observable items.
Only close-up photographs The condition cannot be located in the building. Add an establishing image and a mid-range view.
Undated or renamed files Timing and linkage become disputable. Use stable filenames, a photo log and the actual observation date.
Phone calls with no written follow-up Promises and deadlines are hard to prove. Send a same-day confirmation and log the call.
Repair before inspection Evidence of the original condition may be lost. Give the required inspection opportunity, except for documented emergencies.
Assuming a deadline is universal Rights can expire under a different local rule. Verify the jurisdiction, contract and current official guidance.
Signing a global release at handover It may affect unresolved or latent issues. Read the document carefully and obtain advice before signing.

A practical owner’s checklist

  • Create one permanent number for every defect or incomplete item.
  • Describe the condition and exact location in observable language.
  • Capture establishing, mid-range and detail photographs before disturbance.
  • Use filenames and a photo log that match the register.
  • Back up original files and preserve sent and received communications.
  • Collect the contract, variations, plans, specifications, payments and completion evidence.
  • Maintain a dated chronology of calls, emails, inspections, access and repairs.
  • Send a written notice with the schedule and retain delivery proof.
  • Offer the inspection and cure opportunity required by the applicable process.
  • Record the repair scope and dates before work begins.
  • Photograph and test the result, then close or reopen each numbered item in writing.
  • Check local warranty, complaint and tribunal deadlines immediately.
  • Obtain a qualified report when the cause is hidden, technical or disputed.

A disciplined file does not guarantee that a contractor will agree with you, but it removes avoidable uncertainty: what happened, where, when, what was requested, what response was offered and whether the repair worked. That is the record a fair repair discussion—and, if necessary, a formal claim—can use.
