Do not disturb the conservation cover or plant until FSA confirms what the contract allows and when field work may begin. Early termination is not automatic and may involve repayment; an expiring contract may have a transition option, depending on current eligibility and enrollment timing.
Start with the CRP contract and its status
CRP is a voluntary USDA program in which participants receive annual payments in exchange for maintaining conservation cover on enrolled land. Contracts are typically 10 to 15 years, but your own contract—not the typical term—determines the expiration date and obligations. USDA FSA’s CRP program page directs participants to FSA for contract- and land-specific details.
- Locate the signed contract and any amendments.
- Confirm the exact acres enrolled, the conservation practice, contract expiration date, and all signatories using the contract and FSA records.
- Determine whether the contract is active or approaching expiration before arranging field work, a lease, or a sale.
These details matter because returning land after a contract expires is different from requesting release while it is still active.
Choose between waiting for expiration and requesting early termination

Can you break a CRP contract early?
Ask the county FSA office whether your contract and circumstances qualify for early termination, whether the request can cover all or only some enrolled acres, and what approvals and effective date would apply. Do not rely on a general assumption that an active contract can be ended without consequence. Request the determination in writing before disturbing the cover or making field-work commitments.
A USDA announcement dated May 26, 2022 described a one-time flexibility under which certain participants in the final year of their contracts could request voluntary termination after the applicable primary nesting season, with no repayment if approved under that specific flexibility. - WHEN TO APPLY: Spring and fall, between 60°F and 80°F, are the best times to seed but can be used anytime during the growing season, applicable to your region. Grass seed germinates when soil temperatures are consistently above 50°F. This roughly corresponds to daytime air temperatures between 60°F and 75°F. If grass seed is applied in fall, any ungerminated grass seeds will remain dormant throughout winter, then germinate when soil temperatures reach 50°F in spring.
Will you have to repay CRP payments?
Do not assume repayment is waived. Before deciding to terminate early, ask FSA what repayment, fees, or other contract consequences may apply to your particular acres and circumstances, and whether any exception is available. The 2022 flexibility applied only to certain final-year participants under its stated conditions; it does not establish a current general exemption. Get the applicable determination from FSA before acting.
What if your CRP contract is expiring?
Ask FSA whether the Transition Incentives Program (TIP) applies before making a sale or lease arrangement. TIP describes eligible transitions of expiring CRP land to beginning or veteran farmers or ranchers. Eligible participants may receive up to two additional annual rental payments, subject to program rules; that maximum is not a guaranteed payment. USDA FSA’s TIP page

The same page states that FY 2026 TIP enrollment closed early and that no further enrollments will be accepted for that fiscal year. Do not treat FY 2026 enrollment as open; contact FSA directly about current-year availability, deadlines, and eligibility.

There is no universal tillage, herbicide, seeding, or equipment prescription for converting CRP land. The appropriate approach depends on the conservation practice, vegetation, soil, slope, drainage, erosion risk, acreage, and intended crop. Once FSA has clarified contract obligations and timing, coordinate with the Natural Resources Conservation Service (NRCS) on conservation planning where needed, and consult a local agronomist about the field and crop.

- Confirm the contract. Gather the contract, amendments, enrolled-acre information, practice details, and expiration date.
- Get FSA’s direction. Ask whether the contract is active, whether partial or full early termination is available, what repayment may be due, and the earliest date work can begin. Request the determination in writing.
- Check conservation and timing conditions. Ask whether the practice, location, or other conservation requirements impose restrictions. Coordinate with NRCS when planning is needed.
- Check transition options before agreements. If the contract is nearing expiration, confirm TIP eligibility and deadlines with FSA before signing a lease or sale arrangement.
- Plan the agronomic work. After requirements are clear, get local advice on vegetation management, soil and erosion risks, crop choice, and suitable field methods.
