How to Choose a Civil Engineering Firm for a Commercial Construction Project

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Choose a civil engineering firm with a qualifications-first process: define the site and deliverables, request comparable qualifications and proposals, verify licenses and named staff, check directly relevant references, test workload and availability, and compare every offer against one scope matrix. Negotiate the fee only after you know which team best fits the project’s technical and approval risks.

This approach prevents a low, non-comparable fee from concealing missing survey work, geotechnical coordination, permitting, drainage design, utility coordination, or construction-phase services.

1. Define the project before contacting firms

Engineers cannot price or staff an undefined assignment consistently. Prepare a written scope brief that every shortlisted firm receives unchanged. The brief does not need to be a finished design; it needs to state the decisions, constraints, interfaces, and outputs the engineer will own.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Include the site and jurisdiction

  • Street address, parcel limits, municipality, county or district, and every authority with approval power.
  • Intended use, gross building area, number of phases, anticipated construction sequence, and target occupancy or opening dates.
  • Known zoning, floodplain, environmental, transportation, utility, easement, access, or right-of-way constraints.
  • Whether the project is privately funded, publicly funded, or subject to public procurement rules.

Describe existing information

List the surveys, title documents, utility records, environmental reports, geotechnical reports, flood studies, traffic information, and existing-condition drawings already available. Identify their dates, limits, coordinate systems, and known gaps. A firm should not assume that an old boundary survey or a desktop utility map is adequate for design.

State the technical scope

Specify which of the following are required and at what level of detail:

  • Topographic, boundary, utility, tree, and existing-condition surveys.
  • Site layout, grading, paving, loading, parking, fire access, and accessibility features.
  • Water, sanitary sewer, fire service, gas, power, communications, and utility-owner coordination.
  • Drainage, detention or retention, infiltration, water-quality treatment, outfalls, and stormwater modeling.
  • Erosion and sediment control, construction-phase inspections, and stabilization documentation.
  • Geotechnical investigation, laboratory testing, pavement recommendations, earthwork criteria, and foundation coordination.
  • Environmental, wetlands, floodplain, subsidence, seismic, or contaminated-soil services where applicable.
  • Traffic studies, driveway permits, off-site improvements, and transportation-agency coordination.

Define deliverables and standards

List drawing packages, specifications, calculations, reports, permit forms, agency responses, BIM or CAD formats, layering and naming standards, review milestones, and file-transmittal requirements. State whether the owner expects a model, native CAD files, signed and sealed PDFs, quantity schedules, or cost-estimating support.

Define construction-phase services

Say how many site observations, coordination meetings, submittal reviews, requests-for-information responses, pay-application reviews, testing visits, punch-list inspections, as-built reviews, and closeout documents are required. If these services are optional, ask firms to price them separately rather than silently excluding them.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Put assumptions and exclusions in writing

Include decision dates, budget assumptions, owner-furnished information, anticipated construction contract, and known exclusions. The U.S. Federal Acquisition Regulation, Part 36, section 36.302, states: “The agency shall develop, either in-house or by contract, a scope of work that defines the project and states the Government’s requirements.” Private owners benefit from the same discipline even when the regulation does not govern their procurement.

2. Build a shortlist with a written scorecard

Send the same scope brief and response instructions to each candidate. Score evidence, not presentation quality. A five-point scale works well: 1 means no demonstrated evidence, 3 means acceptable and relevant evidence, and 5 means directly comparable, recent, and supported by outcomes or references. Record the reason for every score.

Criterion What to verify Evidence to request
Professional qualifications and licensing Disciplines covered, jurisdictions in which the firm may practice, and who will seal or approve each deliverable Registration details, discipline list, proposed signatories, and identified specialty subconsultants
Specialized experience Commercial type, site complexity, scale, delivery method, and approval environment comparable to yours Three to five project sheets with scope, size, jurisdiction, dates, role, and measurable outcomes
Capacity and schedule Ability to start and sustain work through peak design and permitting periods Named project manager, discipline leads, current workload, start date, peak staffing, and substitution plan
Past performance Cost control, quality, schedule reliability, responsiveness, change management, and permit results Three client references who can discuss those topics directly
Local and authority knowledge Recent work with the planning, building, transportation, stormwater, utility, and environmental authorities that affect the site Relevant approval examples, agency comments resolved, and local project contacts
Technical approach Investigation sequence, design reviews, coordination, risk management, permitting, construction support, and handover A concise work plan, schedule, risk register, quality-control process, and deliverable list

These criteria mirror the U.S. Federal Acquisition Regulation’s selection framework: professional qualifications; specialized experience and technical competence; capacity to accomplish the work in the required time; past performance in cost control, quality, and performance schedules; and relevant locality knowledge when it matters to the project.

3. Use qualifications-based selection before negotiating price

Do not rank firms by fee before confirming that their scopes, teams, and risk assumptions are comparable. The American Water Works Association describes qualifications-based selection as evaluating the firm’s relevant experience, capabilities, expertise, and workload, together with the proposed personnel’s capability, availability, experience, education, and training, before preliminary selection and negotiation.

Apply that logic to a privately funded commercial project:

  1. Screen mandatory requirements such as licensing, insurance, conflicts, and ability to serve the jurisdiction.
  2. Score the technical qualifications and named personnel against the same matrix.
  3. Interview the highest-scoring teams about site risks, interfaces, schedule, and decision points.
  4. Select the preferred team or a short final group.
  5. Negotiate scope, assumptions, schedule, fee, reimbursables, and change procedures with the preferred firm.
  6. If negotiations fail, document why and move to the next qualified team without changing the evaluation rules.

Price remains important. It becomes useful only after the owner fixes what is included, who performs it, which assumptions apply, and how additional services will be authorized.

4. Test the firm’s fit for site, geotechnical, and stormwater risk

Ask how information will be obtained and used

Require a written plan for surveys, utility locating, environmental screening, flood review, and geotechnical exploration. The proposal should identify the investigator, the professional responsible for interpretation, the design decisions that depend on each investigation, and the action if field conditions differ from assumptions.

EPA engineering guidance calls for preliminary subsurface exploration by a professional geotechnical engineer licensed in the state, independent testing laboratories, and analysis of site-specific conditions such as soft soils, non-native fill, unstable surfaces, subsidence, and earthquake-related features. Ask whether the firm will procure those services, manage a specialist subconsultant, or rely on owner-furnished information. Those are different scopes and should not carry the same fee.

Check whether the portfolio matches the actual site

A general roadway portfolio does not prove competence in commercial-site drainage, difficult soils, constrained utility corridors, or phased occupied-campus work. Ask for examples with the same combination of building type, impervious area, grading constraints, soil conditions, flood exposure, and approval agencies. Confirm what the candidate actually performed rather than what another consultant on the project delivered.

Demand a specific stormwater design basis

For drainage, require the proposal to state:

  • Applicable rainfall data, design storms, water-quality criteria, and authority standards.
  • Modeling software or calculation methods and the information needed to build the model.
  • Detention, retention, infiltration, underdrain, outfall, and emergency-overflow assumptions.
  • How downstream capacity, utility conflicts, easements, and maintenance access will be checked.
  • Who prepares, signs, submits, and responds to stormwater permits.
  • Construction inspection, testing, record drawings, and operation-and-maintenance handover responsibilities.

Make changed conditions a contract issue

Ask for a decision tree covering unsuitable soil, undocumented utilities, groundwater, contaminated material, failed infiltration, or an agency requirement that changes the design. The contract should distinguish included redesign from additional services and identify the notice, documentation, and authorization process for each.

5. Compare proposals on one scope matrix

Require every bidder to complete the same comparison table. If a cell is not applicable, the bidder should say so and explain why; if it is not included, the proposal should state the exclusion explicitly.

Comparison row Questions for every bidder
Relevant projects What commercial project type, size, delivery method, jurisdiction, and site risks are comparable?
Proposed staff Who is the project manager, who leads each discipline, who seals the work, what are their licenses, and how much workload do they carry?
Investigations Are survey, geotechnical, environmental, utility locating, traffic, and testing services included, subcontracted, or owner-furnished?
Permits and authorities Which applications, meetings, responses, fees, and revisions does the firm own, and which remain with the owner or architect?
Design deliverables What drawings, calculations, specifications, models, quantities, and review milestones will be issued, and in which formats?
Construction support How many observations, submittal reviews, RFI responses, tests, meetings, punch-list visits, as-builts, and closeout tasks are included?
Schedule What are the start date, design durations, agency dependencies, review turnaround times, and critical path?
Fee basis Is the fee lump sum, hourly with a cap, cost-plus, or another basis? What rates, reimbursables, allowances, and escalation assumptions apply?
Exclusions and changes Which tasks trigger additional services, what notice is required, and who may authorize a change?
Quality control Who performs interdisciplinary coordination, independent checking, constructability review, and final sign-off?
References and outcomes Can clients verify budget performance, quality, schedule, responsiveness, change management, and approvals?

Normalize each fee into the same scope before comparing totals. A lower number may simply omit field visits, agency revisions, testing, or closeout. A higher number may include a fuller investigation and construction-phase service. Compare the included hours, deliverables, assumptions, and risk allocation—not just the headline price.

6. Ask questions that reveal how the team will work

Questions for the proposed project manager

  • What are the first three unknowns you would resolve on this site, and how would each affect design or schedule?
  • Which decisions must be made by the owner, architect, geotechnical engineer, utility owners, or authorities?
  • How will you track scope, budget, RFIs, submittals, agency comments, and changes?
  • What is your planned response time for urgent design or construction questions?
  • What happens if you are unavailable, leave the firm, or need a specialist not listed in the proposal?

Questions for technical leads

  • What survey control, utility verification, and geotechnical information is required before the first design milestone?
  • How will grading, accessibility, fire access, drainage, utilities, and building thresholds be coordinated?
  • How will you test infiltration assumptions and respond to soft soils, fill, groundwater, or unsuitable material?
  • Which stormwater model or calculations will support the permit, and who will independently check them?
  • What construction observations and tests are needed to confirm that the design assumptions were met?

Questions for references

Call the client yourself, rather than relying only on letters supplied by the firm. Ask whether the named staff actually worked on the project, whether fees and schedules were controlled, how quickly problems were addressed, how agency comments were handled, and whether the client would hire the team again. Ask for a specific example of a change or field surprise and how the firm managed it.

7. Complete due diligence before award

  • Verify each professional registration and the firm’s right to practice in the project jurisdiction.
  • Obtain certificates of professional liability, general liability, automobile, and workers’ compensation insurance as appropriate; have the owner’s broker or counsel confirm that limits and conditions fit the project.
  • Confirm the exact people assigned, their availability, and the written substitution process.
  • Review one anonymized plan set, calculation package, technical report, permit response, or closeout package comparable to your needs.
  • Identify every permitting, utility, survey, geotechnical, environmental, traffic, and testing interface and assign one accountable owner.
  • Check conflicts of interest and request litigation or claims disclosures where proportionate and lawful.
  • Assess financial capacity relative to the project’s size, duration, and payment terms.
  • Confirm that the contract includes deliverables, review cycles, site visits, construction services, testing, as-builts, and closeout.

UK Health and Safety Executive guidance says commercial clients must ensure designers and contractors have the “skills, knowledge, experience and organisational capability” for the project. Even where UK rules do not apply, that is a useful competency test: verify capability at both firm and individual level.

8. Negotiate scope, fee, and risk after selecting the team

Use the preferred firm’s proposal as a starting point, then turn every material assumption into contract language. The agreement should identify:

  • Scope by phase, discipline, deliverable, and responsible person.
  • Design criteria, codes, authority standards, and owner-furnished information.
  • Schedule milestones, review periods, response times, and dependencies outside the firm’s control.
  • Fee basis, hourly-rate schedule, reimbursables, subcontractor markups, allowances, and payment milestones.
  • Included agency meetings, redesign rounds, construction observations, testing coordination, and closeout.
  • Change-order triggers, written authorization, notice periods, and records required to support additional fees.
  • Quality-control, independent-checking, document-retention, insurance, indemnity, and professional-standard provisions reviewed by counsel.
  • Ownership and permitted use of drawings, models, calculations, survey data, and other instruments of service.

Ask the firm to identify the three assumptions with the greatest cost or schedule exposure. Resolve those assumptions before signing rather than accepting a low base fee and discovering the exclusions during permitting or construction.

9. Recognize proposal and interview red flags

  • A very low fee that excludes survey, geotechnical coordination, permitting, stormwater work, or construction support.
  • Portfolio examples that do not name the staff who will actually be assigned.
  • References that cannot discuss cost, schedule, quality, responsiveness, or permit performance.
  • Unclear responsibility for utility conflicts, stormwater approvals, agency comments, or off-site improvements.
  • No independent check, interdisciplinary review, quality-control plan, or response to changed site conditions.
  • Claims of local expertise without recent projects, authority interactions, or verifiable contacts.
  • Assumptions that transfer core civil risk to the owner, architect, contractor, or an unidentified subconsultant.
  • A schedule that shows design dates but omits survey, investigation, agency review, resubmittal, procurement, or construction dependencies.
  • Reluctance to identify workload, substitution plans, rates, exclusions, or the person authorized to make technical decisions.

10. Make the final decision transparently

Prepare a one-page decision record after interviews. List the mandatory requirements, each firm’s score by criterion, material exceptions, reference findings, negotiated scope changes, and the reason the selected team offers the best risk-adjusted value. Keep the original proposals and clarification answers with the record.

When two firms appear technically equal, use the remaining differences deliberately: named-person availability, quality-control strength, authority familiarity, geotechnical and stormwater depth, responsiveness, schedule confidence, and total cost for an equivalent scope. Do not let a small fee difference override a material gap in licensing, relevant experience, or capacity.

11. Set the project up during the first month

Hold a kickoff with the owner, civil engineer, architect, geotechnical engineer, surveyor, contractor if selected, and key utility or authority contacts. Confirm the responsibility matrix, file standards, design criteria, survey control, investigation plan, decision log, risk register, meeting cadence, and approval calendar.

Require an early information-gap report. It should identify missing records, field investigations, owner decisions, third-party reviews, and long-lead approvals. Resolve the highest-impact gaps before detailed grading, utility design, or stormwater calculations make assumptions expensive to change.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Jurisdiction and procurement notes

Licensing, sealing, stormwater criteria, insurance requirements, public-procurement rules, and authority names vary by location. Confirm requirements with the relevant licensing boards, permitting agencies, owner’s counsel, and insurer before award. The federal and AWWA frameworks cited above are useful selection models; they do not replace the law or procurement procedure governing your project.
