How to Check Whether Building Work in Hong Kong Requires Approval

Hong Kong renovation approval depends on the work’s exact scope. Learn how to check exemptions, minor works requirements, structural involvement and building-management permissions.

Whether renovation work in a Hong Kong flat needs Buildings Department (BD) approval depends on what the work physically involves—not on whether it is called “renovation.” Plastering, tiling and some sanitary-fitment repairs are generally exempt from prior approval and consent, but structural alterations and other work may require plans and approval before it starts. Minor works follow a separate system that can still require qualified people, notices and completion documents. Use the steps below to identify the likely route, then check building-management permissions separately.

Start with the work itself, not its label

Write down exactly what the proposal will remove, add, penetrate, relocate or attach. Include its location, dimensions and construction details. “Kitchen renovation,” for example, is not specific enough to determine the statutory route: changing finishes is different from altering a structural member or other regulated building feature. The same broad project description can cover several different kinds of work, each of which may need to be checked separately.

The Buildings Department’s guidance for domestic premises says household renovation and simple work such as plastering, laying tiles, and repairing or replacing sanitary fitments are generally exempt from prior approval and consent. That exemption is conditional: the work must still meet applicable requirements, including structural safety, fire safety and drainage standards. It does not make every job described as household renovation exempt. Buildings Department: alteration and addition works in domestic premises.

In the BD’s words, these examples of ordinary household work can generally be carried out without prior BD approval and consent or appointment of registered building professionals or registered contractors. That is a general statement about the described exempt work, not a blanket rule for every renovation project. If a project includes both ordinary finish work and a structural alteration, do not assume the finish-work exemption covers the structural part.

Use this sequence to check the likely approval route

  1. Describe the proposed work precisely. Record what will change, where it is, and the relevant dimensions and materials. Note what will be removed, penetrated, moved or fixed to the building. Do not rely on a project name such as “refurbishment” or “open-plan conversion.” The item definition, dimensions, location and relationship to the building may affect classification.
  2. Check for structural involvement or another regulated feature. If the proposal affects a structural wall, beam or column—or you cannot tell whether it does—pause and get advice from an appropriate registered building professional. The BD gives removal of a structural wall, beam or column as an example requiring professional feasibility advice, plan submission, and approval and consent before work proceeds. This is a warning example, not a complete list of work that may require approval. Buildings Department domestic-premises FAQ.
  3. Search the official Minor Works Control System list. Check whether the exact work matches a listed item, including its conditions and class. The BD’s list contains 187 minor works items and was last updated on 30 January 2026. Similar-sounding work is not enough: compare the actual proposal against the item’s full scope and limits. Buildings Department: minor works items.
  4. If it is minor work, check the item’s requirements. Find out whether the item calls for a prescribed building professional or registered contractor, and what commencement notice, submission or completion documentation applies. The simplified process removes prior approval and consent; it does not necessarily remove other duties. Do not wait for an “approval” that the relevant simplified route does not require, but do not begin until you have checked and arranged the actual item-specific steps.
  5. Check the designated exempted works list separately. The BD identifies 30 designated exempted works. Confirm that the proposal fits the defined item and its conditions; a similar-sounding task is not enough. This is a separate listed route, so do not confuse it with ordinary exempt household renovation or with a minor works item. Buildings Department: designated exempted works.
  6. If no exemption or minor-works route fits, verify the approval process before starting. Consult the BD and an appropriately qualified professional about the plans, appointments, approval and consent required for the particular proposal. For new building works, the BD describes appointment of an authorized person, a registered structural engineer where necessary, and a registered geotechnical engineer where geotechnical elements are involved, as well as a registered contractor. Consent to commence is required before work starts. Buildings Department: new building works.
  7. Check private building permissions independently. Review the deed of mutual covenant (DMC), lease and building-management requirements. Obtain owners’ corporation or property-management consent where applicable. BD approval, when required, does not replace these permissions, and private consent does not replace statutory approval. Buildings Department domestic-premises FAQ.

Know the difference between the main categories

Route What it means What to verify
Ordinary exempt building work Some ordinary domestic renovation and simple works can be done without prior BD approval and consent. Examples in BD guidance include plastering, laying tiles, and repairing or replacing sanitary fitments. Confirm the work genuinely fits the exemption and still complies with applicable building standards, including structural safety, fire safety and drainage requirements. Do not extend the example to other work just because it is part of the same renovation.
Minor works Work that matches an item in the Minor Works Control System (MWCS). The simplified system removes prior BD approval and consent, but requirements vary by item and class. Check the item definition and conditions, required prescribed professionals or registered contractors, notices and completion documents. The current BD list contains 187 items and was last updated 30 January 2026.
Designated exempted works Work defined on a separate BD list of designated exempted works. Check that the proposal matches a listed definition and its conditions. The BD list identifies 30 items.
Approval-required building works Work that does not qualify for an applicable exemption or minor-works route may require plans, approval and consent before commencement. Ask the BD or a suitable registered building professional what appointments, submissions and approvals apply to this specific work. Do not begin while required approval or consent is outstanding.

These routes are not alternative labels for the same process. They differ in whether prior Building Authority approval and consent are required, whether the work must match a defined item, and whether a prescribed professional or registered contractor, notices or completion records are needed. A project’s room, price or contractor’s description does not decide the category. A particular proposal may also raise separate DMC, lease or management conditions.

Minor works still have a process

The MWCS groups work by its nature, scale, complexity and safety risk. The BD’s current list contains 187 items; each item has its own scope and conditions. A task that resembles an item but falls outside its dimensions or other requirements should not be treated as covered merely because the work seems small. Check the relevant item and class rather than trying to classify the work by everyday meaning of “minor.”

For Class I and Class II minor works under the simplified requirements, the BD says prior approval from the Building Authority is not required. The BD’s minor works FAQ states: “No approval from the Building Authority (i.e. the Buildings Department) is required under the simplified requirements for the commencement of Class I or Class II minor works.” That is not the same as a blanket waiver of submissions or other steps. Depending on the item, a prescribed professional or registered contractor may need to carry out or supervise the work, give notice, and submit completion documentation. Check the item and the BD’s requirements rather than waiting for an approval that the simplified process does not call for. Buildings Department: prescribed professionals and contractors FAQ.

The practical distinction is important: “no prior approval” does not mean “no statutory requirements.” Find out who is allowed or required to undertake or supervise the particular work, whether notice is required and when it must be given, and what record or completion submission must follow. The Buildings Department’s minor works requirements do not establish a single notice timetable or document set for all minor works; the applicable item and class control what to check.

  • Power drill cordless with 1/2" single sleeve ratcheting chuck provides tight bit gripping strength, making bit changes faster and more secure

Do not infer that a BD acknowledgment letter is itself an approval under the simplified process. The operative questions are whether the work fits a listed item and whether the required people, notices and records have been handled. Likewise, if the work does not fit the simplified route, do not rely on the fact that a similar item exists elsewhere on the list.

When professional advice is the safer next step

Ask a suitable registered building professional or contractor to help classify the proposal if you are unsure about structural involvement, the work’s dimensions, its relationship to the building, or whether it matches a listed item. If structural work is contemplated, do not rely on a general renovation description or an informal assurance that it is minor. The BD specifically identifies removal of a structural wall, beam or column as requiring professional feasibility advice and the approval route described in its domestic-premises FAQ.

For work outside an exemption or MWCS item, seek confirmation of the applicable submission and approval process before scheduling commencement. For new building work, BD guidance states that consent to commence is required from the Building Authority before work starts. The guidance describes an authorized person, a registered structural engineer where necessary, a registered geotechnical engineer when geotechnical elements are involved, and a registered contractor as part of the new-building-works route. The exact appointments depend on the proposal; do not assume every role is needed for every project. Buildings Department: new building works.

Professional advice is a classification and compliance step, not a substitute for the relevant statutory process. Ask the professional to explain which route applies and what still has to happen before work begins. If the answer depends on an item’s scope, dimensions or relationship to structural elements, provide those details rather than asking only whether “renovation” is allowed.

What can happen if required approval is missing?

The BD says building work that requires approval but proceeds without it can be unauthorised building work and may be subject to enforcement. Its domestic alteration FAQ states a maximum fine of HK$400,000 and imprisonment of up to two years for a person convicted of carrying out building works without prior approval where required. This is the penalty stated in that FAQ for the described offence; it should not be read as an automatic outcome for every breach. Check the current statutory position for a specific case. Buildings Department domestic-premises FAQ; Buildings Department: alterations and additions.

The key is to determine the route before commencement, not after a contractor has started. The fact that a work item is small, commonly done, or approved informally by building management does not establish that it falls within a statutory exemption. Conversely, do not seek a prior approval that the simplified minor-works process expressly does not require; check the actual item-specific obligations instead.

Costs, timing and permissions: what to confirm

The BD material used here explains categories, roles, submissions and consent, but does not provide a project-specific fee, contractor quotation or universal processing timetable. The cost of professional advice or carrying out a particular job therefore cannot be inferred from the category alone. Ask the relevant professional or registered contractor for a scope and fee quotation, and verify any statutory submission requirements with the BD. Do not treat an assumed cost or a contractor’s estimate of approval time as a regulatory rule.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Also keep statutory and private permissions distinct. The DMC, lease, owners’ corporation and property manager may impose conditions or require consent even where BD prior approval and consent are not required. Equally, obtaining a management or owners’ corporation sign-off does not satisfy a Buildings Ordinance requirement. Check both tracks early enough that private permission does not become a surprise after you have arranged the work.

Final checks before work begins

  • Have a written description of the actual work, including location, dimensions, materials and what will be removed, penetrated, moved or attached.
  • Resolve any uncertainty about structural members or regulated building features before work starts.
  • Match the proposal to the precise BD exemption, minor-works item and class, or designated exempted work definition, if applicable.
  • For minor works, confirm the required professional or contractor, notice timing and completion records for that item; remember the simplified route does not require prior approval for Class I and II work.
  • For approval-required works, confirm the required appointments and submissions and obtain necessary plans, approval and consent before commencement.
  • Check the DMC, lease and management rules separately and secure any applicable private consent.
  • Keep the relevant classification advice and required records with the project documents so you can verify what route was followed.

Frequently Asked Questions

Can I renovate a domestic flat in Hong Kong without BD approval?

Sometimes. The BD says ordinary household renovation such as plastering, laying tiles, and repairing or replacing sanitary fitments is generally exempt from prior approval and consent. The work must still comply with applicable building standards, and the exemption does not cover every job called renovation. Classify the actual work, especially if it affects a structural member or another regulated feature.

Does minor work mean no approval or paperwork is needed?

No. Under the simplified requirements, prior Building Authority approval is not required for Class I or Class II minor works, but a listed item can still require a prescribed professional or registered contractor, notice and completion documentation. Check the exact item, class and conditions in the BD list.

What should I do if I am unsure whether a wall, beam or column is structural?

Pause and seek advice from an appropriate registered building professional. The BD identifies removal of a structural wall, beam or column as an example requiring professional feasibility advice, plan submission, and approval and consent before the work proceeds. Do not assume a structural change is minor based on its size or a contractor’s informal description.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Are designated exempted works the same as ordinary exempt renovation?

They are separate routes. The BD maintains a list of 30 designated exempted works. Check the exact defined item and its conditions; a similar-sounding task does not automatically qualify. Ordinary household renovation examples such as plastering and tiling are discussed separately in the BD’s domestic-premises FAQ.

Does owners’ corporation or property-management permission replace BD approval?

No. Check the DMC, lease and building-management requirements separately, and obtain owners’ corporation or property-management consent where applicable. Private consent does not replace statutory approval or consent when the Buildings Ordinance requires it, and BD approval does not remove private building conditions.

What is the penalty for starting work without required approval?

The BD’s domestic alteration FAQ states a maximum fine of HK$400,000 and imprisonment of up to two years for a person convicted of carrying out building works without prior approval where required. The FAQ’s statement is not an automatic outcome for every breach; check the current statutory position for a particular case.

How much will approval or professional advice cost, and how long will it take?

The BD sources covered here do not set a universal project cost or processing time. Costs and timing depend on the proposal and applicable route, so ask the relevant registered professional or contractor for a project-specific quotation and verify submission requirements with the BD. Do not infer that all work needs a paid approval application; simplified minor works do not require prior approval.

The Bottom Line

Classify the physical work before it starts: ordinary exemption, a listed minor works item, designated exempted work, or a route requiring plans, approval and consent. Check the exact item conditions, people, notices and records, and verify DMC, lease and management permissions separately. If structural involvement or classification is uncertain, pause and get advice from a suitable registered building professional.
