How Railway Land Boundaries, Easements and Access Rights Affect Nearby Property Owners

A railway fence rarely settles a property boundary. Learn how title records, easements and local access laws determine what owners and railways may do.

A fence or strip of vegetation beside a railway does not, by itself, show where railway ownership ends—or whether you or the railway may use the land beside your property. The answer depends on the official title records, deeds and applicable law. Railway land and access rules vary by jurisdiction, so examples from England and Wales, Canada and New Zealand must not be treated as universal rules.

What determines where railway land ends?

The legal boundary is the line that divides ownership. It may not coincide with the railway fence, track edge, ditch, hedge or other visible feature. A railway may own land beyond its fence, or a neighboring owner may hold land subject to rights that allow railway-related access. The only reliable answer for a particular property comes from its land records and the instruments that created or changed the relevant interests.

It is also important to separate ownership from use. A railway corridor could be held through ownership, a lease, an easement, statutory acquisition or another legal arrangement. An easement can grant a limited right to use land without transferring ownership of the affected strip. Conversely, a neighbor’s deed might grant or reserve rights over land that appears to belong to the railway. The legal instrument—not the appearance of the site—sets the starting point for understanding those rights.

Visible features are evidence, not a legal answer

In England and Wales, HM Land Registry describes the legal boundary as an invisible line and explains that most registered title plans show only general boundaries. The red edging on a title plan identifies the general extent of the registered property; it is not a survey-quality measurement of the precise dividing line. Measuring the plan or following a fence on the ground cannot, by itself, establish the legal boundary.

Physical features can still help make sense of older documents and the history of a boundary. They should be considered alongside the conveyances, transfer plans, later deeds and other relevant evidence. Where the precise line has practical consequences—for example, for a proposed fence or construction—obtain advice before treating a visible feature as conclusive.

Which records should you check?

Start with the official land records for the country where the property sits. In England and Wales, read the title register and title plan together, then obtain and review the deeds or other documents referred to in the register or filed at HM Land Registry. A plan may identify land affected by rights or covenants, but not every right is necessarily drawn as a separately marked feature. A right of way, for example, may be described in words in the register.

Look for the nature of the railway’s interest and the rights that benefit or burden each property. Search the register and referenced instruments for descriptions such as a railway corridor, right of way, easement, access or maintenance right, restrictive covenant, reservation, or permission condition. The terminology is only a clue: the operative wording, route, purpose, beneficiaries and conditions need to be read in context.

  • Referenced deeds and plans: Read the instrument that created the relevant interest. It may describe a route or obligation not fully depicted on the current title plan.
  • Railway records and applicable law: Identify the infrastructure owner or railway entity and check whether a statute adds access, safety or permission requirements.

Do not assume that an unmarked route means no easement exists, or that a railway-related label proves the railway owns the land. A record may describe a right of use rather than a transfer of the underlying property.

What can an easement allow?

An easement or right of way can affect a property without transferring full ownership of the land concerned. Its scope depends on the deed or other instrument and the governing law. Relevant questions include who may use it, what route it covers, what purpose it serves, whether it is limited by conditions, and which property benefits from or is burdened by it. A map label or a history of informal use alone may not answer those questions.

Do not infer a right to use a railway-side strip simply because it seems convenient or has been accessible. Nor should a railway-side right be assumed to permit every kind of work. A right to pass, an access right for maintenance, and permission to construct or place something on railway infrastructure can be legally distinct.

New Zealand: written permission for specified activity

New Zealand’s Railways Act 2005, section 75, provides that a person may not exercise a right under an easement, or construct or carry out work on, over or under railway infrastructure or railway premises, without first seeking and obtaining written permission from the licensed access provider or railway premises owner. This is a New Zealand statutory example, not a general rule for other countries. Anyone considering access or work there should check the current law and identify the relevant provider or owner before proceeding.

When may a railway enter adjoining property?

A railway operator may have statutory powers to enter neighboring land for defined purposes, but the existence and limits of those powers depend on the jurisdiction. Do not assume an operator has unrestricted access to a neighboring property, or that a right shown in a deed is the only possible source of authority.

Canada: railway-safety entry powers

Canada’s Railway Safety Act, section 25, provides specified entry powers for railway-safety purposes. The examples include entry at any time to maintain or alter railway works or remove obstructions when no other access to the line is reasonably available, and entry to deal with a fire. The provision has purpose and circumstance limits; it should not be read as permission for any railway to enter any adjoining property for any reason.

Transport Canada’s right-of-way access policy, dated 13 July 2006, addresses the federal role in railway safety and unauthorized access while recognizing the involvement of adjacent landowners and municipalities. It is a Canadian policy source, not a statement of property law that applies elsewhere. For a particular entry or access dispute, the relevant statute, property instrument and facts all matter.

How to clarify a boundary in England and Wales

If the uncertainty is about the exact line, distinguish between reviewing existing evidence, agreeing a boundary with the adjoining owner and applying to have a determined boundary entered on the register. These are not interchangeable: an agreement depends on cooperation, while a formal determined-boundary application seeks to establish and record a more exact line.

Approach What it can clarify Cooperation and precision Practical consideration
Review existing records and physical evidence What the register, title plan, deeds and site evidence indicate about the ownership and rights Does not itself create agreement or determine a more exact registered line A sensible first step; title-plan measurements are not a substitute for a survey
Boundary agreement A line agreed between the owners of adjoining properties Requires the owners’ agreement Consider whether the agreement should be recorded and how it relates to the title documents
Determined-boundary application A precisely identified boundary for registration Requires an exact line and suitable plan; HM Land Registry says the plan will almost always need to be produced by a chartered land surveyor Can be expensive and may provoke a dispute

HM Land Registry’s guidance cautions that an application can lead to a dispute. Before choosing a route, gather the original conveyance and transfer plans, later deeds and relevant physical evidence. A property solicitor or licensed conveyancer can help interpret the documents; a chartered land surveyor can prepare the precise plan where required. The determined-boundary procedure is specific to England and Wales and should not be assumed to apply in another country.

A practical sequence before using or altering railway-side land

  1. Identify the jurisdiction and railway entity. Find out which country’s land-registration system and railway laws apply, and establish who owns or operates the relevant infrastructure. A railway company, infrastructure owner and licensed access provider may not be interchangeable.
  2. Obtain current official records. Get the property register and plan and the deeds or instruments they refer to. In England and Wales, review the register, title plan and filed or referenced documents as a set.
  3. Identify the interest and its scope. Determine whether the railway’s position is based on ownership, a lease, an easement, statutory acquisition or another instrument. Then check the route, purpose, beneficiaries, conditions and any reserved rights.
  4. Check permission and entry rules. Review any railway-specific statutory requirements and the limits on an operator’s power to enter adjoining property. Do not assume that a general access right permits construction, drainage, fencing, planting or utility work.
  5. Get the right kind of help if the line or wording is uncertain. A property solicitor or licensed conveyancer can interpret title documents and rights. A qualified surveyor can assess the boundary evidence and produce a suitable plan where a precise line is needed.
  6. Wait for clarity before acting. Do not cross railway land or start work on, over or under railway infrastructure until you have checked the governing documents and permission requirements. In New Zealand, section 75 expressly requires written permission for the specified easement exercise or work.

What this means for a specific property

Without the location, title number, deeds and railway instrument, it is not possible to determine where a particular railway boundary lies, who owns a particular strip, whether an owner has a right of access, or what notice or remedy applies. The examples above illustrate different approaches: HM Land Registry guidance and boundary procedures apply to England and Wales; the Railway Safety Act and Transport Canada policy are Canadian; and section 75 of the Railways Act 2005 is a New Zealand rule.

For a property-specific answer, the key is to connect the official title record to the instrument that created the railway interest and then apply the local law. If the exact line affects a planned project or a disagreement, pause work and have the documents and physical evidence reviewed before relying on a fence, plan edge or informal practice.
