Clean Water Act

How Construction Permits Protect Rivers, Wetlands, and Groundwater

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Construction permits protect water in two different ways under the federal Clean Water Act. A construction stormwater permit controls polluted runoff from qualifying land-disturbing work such as clearing, grading, and excavation. A Section 404 permit regulates the discharge of dredged or fill material into covered waters, including many wetlands. A project can need both.

The protection is not absolute, and it is not a general groundwater-contamination guarantee. Permits set enforceable limits, require planning and controls, and provide oversight before and during construction. Whether a permit is required depends on the site, the work, the water affected, the project’s common plan, and the state, Tribal, or federal authority with jurisdiction.

What each permit protects

Construction changes how water moves across land. Exposed soil, stored materials, concrete residue, fuel, and waste can be carried by rain into a storm drain or directly into a river, lake, wetland, or coastal water. Separately, placing soil, sand, gravel, or other material into a wetland or stream can bury habitat, obstruct flow, and change water storage. The Clean Water Act addresses these pathways through different permit programs.

Question Construction stormwater (NPDES) Section 404
Regulated activity Discharge of stormwater associated with qualifying construction activity Discharge of dredged or fill material into covered waters
Typical trigger At least 1 acre of disturbance, or a smaller site that is part of a common plan ultimately disturbing at least 1 acre, when a regulated discharge occurs Placement of dredged or fill material in a jurisdictional water or wetland; coverage, exemptions, and jurisdiction must be checked
Main protection method Erosion and sediment controls, pollution-prevention practices, stabilization, and managed dewatering Avoid impacts, minimize unavoidable impacts, and compensate for remaining unavoidable impacts
Typical federal authority EPA or an authorized state or Tribal NPDES program U.S. Army Corps of Engineers in most locations, with EPA and approved state or Tribal programs sharing responsibilities
Permit form Often a general permit, such as EPA’s Construction General Permit (CGP), when its conditions are met General permit for qualifying categories with minimal adverse effects, or an individual permit for potentially significant impacts
Can it replace the other permit? No No

These programs overlap in environmental purpose but not in legal coverage. A stormwater authorization does not authorize filling a wetland, and a Section 404 authorization does not by itself authorize a construction-site stormwater discharge.

When a construction stormwater permit is required

The acreage and common-plan test

EPA generally requires a Clean Water Act stormwater permit for construction sites disturbing 1 acre or more. A site smaller than 1 acre can also be covered when it is part of a common plan of development or sale that will ultimately disturb at least 1 acre. Clearing, grading, and excavation count as earth-disturbing work. The threshold is a starting point, not a substitute for checking the operative permit and the authority that regulates the discharge.

Coverage also depends on the discharge and jurisdiction. A project team should identify where runoff will leave the site, whether it will reach a storm sewer or a water of the United States, and which agency issues NPDES authorizations in that location. State, Tribal, and federal requirements can differ.

What runoff can carry

Rainfall can mobilize loose sediment and pollutants from exposed ground and outdoor storage areas. EPA identifies common construction-site pollutants including sediment, solid and sanitary wastes, phosphorus, nitrogen, pesticides, oil and grease, concrete washout, construction chemicals, and debris. Sediment can cloud water and smother aquatic habitat; nutrients can contribute to excessive plant and algae growth; oils, solvents, and concrete residues can harm organisms or alter water chemistry.

Controls required by the permit

Federal construction and development effluent rules require effective erosion and sediment controls and pollution-prevention measures. Depending on the applicable permit, the site plan and inspections address measures such as:

  • Containing disturbed soil so rainfall does not carry it off site.
  • Stabilizing disturbed areas when work has ceased and will not resume for more than 14 days, where that requirement applies.
  • Managing dewatering so pumped water is not discharged as an uncontrolled sediment plume.
  • Providing designated concrete-washout areas and preventing wash water from entering drains or surface waters.
  • Handling vehicle fuels, oils, soaps, solvents, chemicals, and waste to prevent spills and releases.
  • Maintaining controls, correcting failures, and documenting inspections and corrective actions as required by the permit.

Products such as silt fence can be one component of an erosion and sediment-control system, but no single product is universally sufficient. The permit’s stormwater pollution prevention plan, site conditions, slopes, soils, drainage pattern, and professional design determine what controls are appropriate.

EPA’s federal Construction General Permit

For areas where EPA is the permitting authority, operators of new sites beginning construction on or after February 17, 2022 generally submit a complete Notice of Intent at least 14 calendar days before beginning construction under the federal CGP. EPA may delay or deny authorization. The CGP is not the permit used everywhere: an authorized state or Tribal program may apply its own general permit and submission system.

Limited small-site waivers

Under EPA’s federal CGP, sites disturbing 5 acres or less can qualify for a waiver only in three limited circumstances described by EPA. A waiver is not an automatic exemption for every small project. The operator must check the current waiver conditions and retain the required support for the determination. State or Tribal programs may use different rules.

How Section 404 protects wetlands and waterways

What Section 404 regulates

Section 404 generally requires authorization before dredged or fill material is discharged into waters of the United States, including covered wetlands. Construction fill may be soil, sand, gravel, or similar material physically placed in a stream, wetland, lake, or other jurisdictional water. Roads, utilities, foundations, levees, and other infrastructure can involve this issue when they place material in a covered water.

The word “wetland” alone does not answer the legal question. Jurisdictional status, the exact activity, exemptions, and current federal interpretations matter. A wet area on a site may be regulated, excluded, or subject to a different authority; the Corps district or another responsible agency should make or confirm the determination before fill is placed.

The avoid–minimize–compensate sequence

EPA describes the program’s basic premise: “The basic premise of the program is that no discharge of dredged or fill material may be permitted if: (1) a practicable alternative exists that is less damaging to the aquatic environment or (2) the nation’s waters would be significantly degraded.” The practical framework is:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Avoid. Evaluate site layouts, access routes, building footprints, and construction methods that keep work out of covered waters where a less damaging practicable alternative exists.
  2. Minimize. Reduce the area, duration, and severity of unavoidable impacts through narrower crossings, staged work, protective barriers, timing limits, and other conditions.
  3. Compensate. Address remaining unavoidable impacts through compensatory mitigation required by the authorization, such as restoration, enhancement, preservation, or approved mitigation banking arrangements.

A permit is therefore a design and impact-review process, not merely a filing fee. The application must give the agency enough information to evaluate alternatives, affected waters, proposed fill, construction methods, and mitigation.

General versus individual permits

General permits can cover categories of activities expected to have minimal adverse effects when every condition is met. An individual permit may be required when impacts could be significant or the activity does not fit a general permit. The Corps is the federal issuer in most places. EPA retains important oversight, and some states or Tribes have approved assumption programs for certain waters.

Exemptions are narrow and fact-dependent

EPA lists exemptions for specified ongoing farming, ranching, silviculture, maintenance, and other activities, subject to statutory and regulatory limits. Discharges associated with converting a wetland to upland are generally not exempt. An owner should obtain a jurisdictional and exemption determination before relying on an agricultural or maintenance exception; labeling a project “maintenance” does not itself make it exempt.

What permits can—and cannot—do for groundwater

The connection through wetlands

Healthy wetlands perform functions that benefit both surface water and groundwater. EPA identifies groundwater recharge alongside drinking-water purification, flood control, and pollution control. Protecting wetland hydrology and preventing sediment or fill from destroying wetland functions can therefore help preserve recharge areas and connected water systems.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The Clean Water Act’s limit

That ecological connection does not make a Clean Water Act permit a general groundwater-contamination permit. EPA states: “The CWA does not specifically address contamination of groundwater resources, a subject addressed by provisions in other laws including the Safe Drinking Water Act; the Resource Conservation and Recovery Act; and the Comprehensive Environmental Response, Compensation, and Liability Act.”

Construction-related discharges to surface waters and impacts to covered wetlands may be controlled through NPDES and Section 404 conditions. Direct contamination of an aquifer, private well, or groundwater plume may instead involve federal laws such as those named by EPA, plus state and local requirements. The applicable rules depend on the substance, pathway, facility, wellhead or source-water protections, and jurisdiction. Do not advertise a permit as a guarantee that groundwater is clean.

How to determine which approvals a project needs

  1. Map the work and water. Mark the total disturbance footprint, phases, access roads, stockpiles, drainage outlets, streams, wetlands, ponds, ditches, wells, and nearby sensitive areas.
  2. Test the common-plan footprint. Add reasonably related phases and parcels that form one development plan. A first phase under 1 acre may still fall within the stormwater threshold if the completed plan reaches 1 acre.
  3. Identify the discharge pathway. Determine whether rainwater or dewatering will leave the site to a storm sewer or surface water, and identify whether the project will place dredged or fill material in a potentially covered water.
  4. Confirm the authority and permit version. Ask the state or Tribal NPDES agency, EPA regional office, or other local authority which construction stormwater permit applies. Contact the Corps district or approved state or Tribal Section 404 authority about wetland and water jurisdiction.
  5. Check exemptions and related approvals. Review agricultural, silvicultural, maintenance, and other claimed exemptions, along with floodplain, coastal, drinking-water, wetlands, wastewater, spill-prevention, and local erosion-control requirements.
  6. Build controls into the design. Prepare the stormwater pollution prevention plan, sequencing, stabilization schedule, dewatering method, washout and spill controls, inspection process, and any Section 404 alternatives and mitigation information before mobilization.
  7. File before the applicable start date. For EPA’s federal CGP, the general rule is a complete Notice of Intent at least 14 calendar days before construction begins, subject to EPA review and any different requirement in the controlling permit.
  8. Maintain coverage during construction. Inspect controls, repair failures promptly, update plans when the site changes, keep records, and comply with permit-specific reporting, notice, and final-stabilization requirements.

Common mistakes and how to correct them

“The site is under an acre, so no permit is needed.”

This overlooks the common-plan rule and the discharge requirement. Recalculate the full plan, include roads and related parcels, and ask the NPDES authority before earthwork starts.

“A stormwater permit covers the wetland crossing.”

It does not. If soil or other fill will be discharged into a jurisdictional wetland or water, seek the Section 404 determination and authorization separately.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“The map calls it a wetland, so Section 404 definitely applies.”

Coverage is jurisdiction-specific. Obtain the responsible agency’s determination, document the delineation or other basis, and review exemptions before relying on the label.

“A permit means groundwater is protected.”

Permit conditions can reduce pollutant releases to surface waters and preserve wetland functions, but the Clean Water Act does not specifically regulate groundwater contamination as such. Screen for other statutes and state or local groundwater rules.

“Controls can wait until a rainstorm is forecast.”

Controls are preventive requirements. Install and maintain them before disturbance, stabilize qualifying inactive areas after 14 days, and manage dewatering and material storage continuously.

Questions to put to the permitting agencies

  • Which NPDES authority and construction permit apply at this address?
  • Does the project belong to a common plan that reaches the 1-acre threshold?
  • What Notice of Intent, waiver, stormwater pollution prevention plan, inspection, and final-stabilization deadlines apply?
  • Will any excavation, embankment, road, utility, or temporary access place dredged or fill material in a covered water?
  • Has the water been delineated and its jurisdiction confirmed by the Corps, EPA, or an approved state or Tribal authority?
  • Do any exemption, nationwide/general-permit, individual-permit, mitigation, floodplain, source-water, or local requirements apply?
  • Could fuels, solvents, concrete washout, dewatering, or other activities trigger separate environmental obligations?

For current federal program information, consult EPA’s construction stormwater program page, CGP coverage and waivers guidance, Section 404 permit-program explanation, Section 404 and agriculture guidance, Section 404 enforcement information, and EPA’s Clean Water Act and federal facilities explanation. These sources describe federal frameworks; the agency with jurisdiction must confirm the requirements for a particular site.
