EPA’s proposed change to the Clean Air Act’s New Source Review (NSR) rules could let some non-emitting construction work—such as building a cement pad—proceed before a major air permit is issued. The potential schedule gain comes from overlapping eligible site or structural work with permit review, not from eliminating the permit or relaxing cement plants’ emissions requirements. EPA has not provided a measured estimate of time saved on cement projects, and the proposal’s practical effect will depend on the work, the project’s location and the applicable state or federal permitting program.
What the proposed reform would change
The issue is when certain physical work may begin—not whether a project needs an air permit at all. EPA’s New Source Review program generally requires preconstruction permits for qualifying new stationary sources and major modifications to existing sources. A permit sets out what may be built, emissions limits, and often operating conditions. Under the proposed approach, certain components or structures that do not emit air pollution could potentially be built before a major NSR permit is issued.

For a cement-related project, that distinction may matter when a work package includes foundations, pads, buildings or other structures as well as equipment that will emit pollutants. If an activity qualifies as non-emitting and is not part of an emissions unit, it may be possible to sequence it earlier while the permit application is under review. The proposal concerns how EPA defines “begin actual construction”; it is not a blanket authorization to start every part of a project.

The agency also said it planned a rulemaking to clarify which construction activities require an NSR permit and which may take place without one. On May 11, 2026, EPA proposed revising the definition of “begin actual construction” and adding a definition of “pollutant-emitting activities.” EPA described the potential scope as including non-emitting components or structures at certain power-generation, data-center and manufacturing projects.

The May 2026 action was identified as a proposed rule on EPA’s regulatory-actions page when its status was checked. A proposal is not a final rule, so project teams should not treat the proposed definition as an established nationwide permission. Check the current rulemaking status and the relevant permitting authority’s requirements before relying on it for a schedule.
How earlier eligible work could affect a project schedule
Potential benefit: overlap instead of waiting
Without a permitted path to start a particular construction activity, a project may have to wait for the air-permit process to finish before beginning work that is tied to construction. If a distinct, non-emitting work package qualifies to proceed earlier, the team could potentially complete it in parallel with permit review. That may improve construction sequencing and allow later work to start sooner once the permit is issued.

For example, an industrial project that needs a cement pad could assess whether pad construction is eligible to proceed while the review of equipment that emits pollutants continues. The possible benefit is not that the pad itself shortens the regulator’s review. It is that some physical work might no longer have to sit idle until permit issuance. The actual schedule effect depends on whether the work is separable, what the permit application covers, and how the responsible authority applies the rules.

In its proposal, EPA said the flexibility could improve planning and management, expedite project completion, and streamline the time between construction and operation. Those are projected benefits, not a quantified result. The available EPA material does not give a cement-project estimate for days or months saved, show how many projects would qualify, or establish a reduction in total permit-review time.

Earlier construction activity also does not necessarily move the project’s operating date by the same amount. If a pad or structure is not on the project’s critical path, completing it earlier may have little effect on the final schedule. If other approvals, equipment delivery, financing, utility work or permit conditions remain outstanding, those steps can still control when the facility is ready to operate. The proposal is therefore best understood as a potential sequencing tool rather than a guaranteed project acceleration.
Which permit and project details matter
NSR requirements depend on the source, its emissions and location. EPA describes three categories: Prevention of Significant Deterioration (PSD) for major sources or major modifications in areas meeting National Ambient Air Quality Standards; nonattainment NSR for major sources or modifications in areas failing one or more standards; and minor-source permits. Most NSR permits are issued by state or local air-pollution-control agencies under programs that must meet federal requirements, although EPA issues some permits.

States can tailor their programs to local air-quality needs as long as their rules are at least as stringent as EPA’s requirements. That means a federal proposal does not answer every project-specific question by itself. The project’s state, permitting authority, source classification, emissions, proposed work and permit conditions can all affect what may proceed and when.

| Project or permitting question | Why it matters to sequencing |
|---|---|
| PSD, nonattainment NSR or minor NSR | The permit category depends on whether the source or modification is major and whether the area meets air-quality standards. |
| Attainment or nonattainment location | Location helps determine which major-source NSR requirements apply. |
| State or local agency versus EPA | The responsible authority administers the applicable permit program and requirements. |
| Non-emitting structural or site work versus emissions-unit construction | The proposed distinction concerns qualifying non-emitting work; it does not make emissions-unit work generally eligible to begin early. |
| Proposed versus final rule | The May 2026 definition was proposed, so it should not be assumed to be final or available as a settled rule. |
| Construction sequencing versus emissions-reduction credits | These are separate timing issues; the credit guidance applies to certain nonattainment NSR permits. |
Separate issue: emissions-reduction credits
On July 1, 2026, EPA said permitting authorities may issue certain nonattainment NSR permits before required emissions-reduction credits are secured, if enforceable conditions apply. EPA said uncertainty over when credits must be acquired had delayed permitting. This may matter to projects in nonattainment areas, but it is not a general waiver of the credit requirement and is distinct from the proposal about “begin actual construction.” A team should not conflate a possible change in when credits are secured with permission to start non-emitting construction work.

What the change does not mean for cement projects
- It does not eliminate NSR. Qualifying new sources and major modifications remain subject to applicable preconstruction permitting requirements.
- It does not make all pre-permit construction permissible. The proposed distinction is tied to certain non-emitting components or structures; the status of a specific activity depends on the facts and applicable requirements.
- It does not guarantee faster permit review. The potential gain is from overlapping eligible work and permitting, not a demonstrated reduction in regulator review time.
- It does not repeal cement-sector air rules. EPA identifies particulate matter, nitrogen oxides and sulfur dioxide among pollutants regulated under Portland cement manufacturing standards. Its cement NESHAP overview describes the kiln as the main source of air toxics and identifies controls for particulate matter, organic hazardous air pollutants, metals, mercury, acid gases and dioxin/furan.
These continuing requirements matter because construction sequencing and pollution control address different questions. A project may be able to build a qualifying structure earlier while still needing the required permit, emissions limits, controls and operating conditions before the relevant equipment is constructed or operated.
How project teams can assess the potential schedule effect
A useful assessment begins with the scope of work and the permit pathway rather than the phrase “cement permitting reform.” The goal is to identify whether a discrete activity could proceed under the applicable rules, and whether starting it early would actually affect the project’s critical path. The following steps are a planning framework, not a substitute for a determination by the permitting authority or project counsel.
- Identify the air-permit pathway. Determine whether the project involves a new source or a major modification, whether PSD, nonattainment NSR or minor NSR may apply, and which agency administers the permit. Confirm the area’s air-quality classification with the responsible authority.
- Break the construction scope into work packages. Separate site preparation and structural work—such as a proposed cement pad—from equipment and activities that emit pollutants. Document what each package includes and how it relates to any emissions unit.
- Ask whether the specific activity fits the applicable definition. EPA’s 2025 guidance and 2026 proposal address certain non-emissions-related work, but the proposed rule is not a universal exemption. Seek a project-specific interpretation from the permitting authority rather than assuming that an activity qualifies because it is a foundation or structure.
- Check the rule’s status and local implementation. A proposed federal rule may change before it is finalized, and state or local requirements remain relevant. Verify the current federal action and ask the authority issuing the permit what it will accept for the project and when.
- Map the permit and construction schedule together. Identify which activities can be completed independently, what must wait for permit issuance, and whether any early work would affect later design, access or construction. Compare the possible start date of eligible work with the project’s actual critical path.
- Keep other permit conditions and approvals visible. An air-permit sequencing change does not by itself resolve other approvals or authorize operation. Track the project’s applicable emissions limits, control requirements, enforceable conditions and non-air approvals separately.
- Revisit the schedule if the permitting basis changes. If a proposed rule is revised, finalized or not finalized, or the permitting authority applies different requirements, update the construction sequence and avoid treating an earlier planning assumption as a permit authorization.
What the cement-sector context can—and cannot—tell you
EPA reported 91 cement plants operating in the United States in 2023. That is useful as dated sector context, but it does not indicate how many plants will undertake projects affected by the proposed change, how many will qualify for early work, or how much time any project could save. It should not be used as a proxy for demand for permits or for the scale of schedule benefits.

The core question for a particular project is narrower: does the work qualify under the applicable permitting framework, and would performing it before permit issuance meaningfully change the project sequence? Those answers require the project’s location, emissions and work scope, plus the current requirements of the agency with jurisdiction.
