PerthNow reported on 2 December 2024 that the Shire of Peppermint Grove council supported Paul and Zara Holmes a Court’s request to remove a peppermint tree in the driveway/verge area of their property. The reported arrangement required a $2,500 bond before driveway reconfiguration and two replacement peppermint trees elsewhere along the property’s verge. The reports do not confirm that the work was completed.
What did the Shire support?
The council’s reported position was to support removing the tree and reconfiguring the driveway, subject to a $2,500 bond and planting two replacement peppermint trees elsewhere along the verge. PerthNow attributed this description of the arrangement to councillor Douglas Jackson: “I think it meets both the owners’ wants, or expectation, but also matches the council’s needs at the same time by ensuring that there is tree cover on the verge of that property.”
This was reported as council support, not proof that the tree was removed or that replacement planting took place. The report did not reproduce the formal resolution.
Why did the owners seek removal?
PerthNow’s earlier report said the tree made reversing out difficult and obstructed the view of cars approaching around the corner from Bay View Terrace. Zara Holmes a Court was quoted as saying: “I’m quite a reasonable and rational person, but a tree in the middle of the driveway makes it quite tricky to reverse out.” The reported case concerned access and visibility, not a claim that the tree was dead or diseased.

How did the driveway come to run around the tree?
The tree was described as a young peppermint. PerthNow reported that the driveway had been split around it as a condition of development approval intended to preserve the tree. The approval document itself was not available in the reports, so that account is attributable to the newspaper rather than independently verified planning records.
What changed between the earlier report and the council outcome?
Before the reported outcome, the officer recommendation described by PerthNow had opposed removing the tree. The 2 December 2024 outcome report said the council supported removal under the bond and replacement-planting arrangement. The news reports do not provide the meeting minutes or formal resolution text, so they establish the reported change in position but not the exact wording or legal effect of the decision.

What is known about the property?
PerthNow reported that the couple bought the property in 2024 for $20.1 million and described it as a 2,793-square-metre block overlooking Freshwater Bay. The reports differ on the purchase month: one says August and the outcome report says September. Neither figure has been independently verified here against sale or property records.

The reported arrangement balanced the owners’ stated driveway and visibility concerns against the council’s interest in maintaining verge tree cover through replacement planting. It is a decision about one property and does not establish a general rule that a verge tree can be removed whenever it affects a driveway. The available reports also do not establish whether the tree was ultimately removed, whether the new trees were planted, or what current Shire policy applies to other applications.
