The dispute over two proposed openings at Elders Wool Stores in Fremantle changed after the council’s initial recommendation: JDAP reportedly voted on October 15, 2025, to remove the condition requiring the openings to stay closed. What was the dispute about?
Human Urban’s proposed redevelopment of the heritage-listed Elders Wool Stores at 38 Cantonment Street includes six openings facing Cantonment Street. The openings became contentious because they intersect with a skateboarding ledge along the building’s street edge. PerthNow described the ledge as about 110 metres long; a separate Fremantle Herald Interactive report called it 100 metres, so the published descriptions are not identical.
The planning question was whether two of those six openings should remain closed to preserve an uninterrupted section of ledge, or whether all six could function as part of the ground-floor access design. The disagreement brought together public-realm and heritage considerations, skating use, tenancy access and the project’s viability.
What did Council ask for, and who made the decision?
The City of Fremantle reported that Council supported recommending approval, despite planning officers’ advice to refuse the proposal because demolition would affect internal structures of cultural heritage significance. Council’s alternative motion added a condition intended to reduce conflict between pedestrians and skateboarders near the ledge. It was a recommendation, not the final planning decision: the Metro Inner Development Assessment Panel (JDAP) determined the application.

In May 2025, JDAP approved the redevelopment subject to a condition that two of the six Cantonment Street openings remain closed. The condition was aimed at preserving the continuity of the ledge. The City described the project as providing more than 200 dwellings, while PerthNow reported 39 multiple dwellings and 174 units. Those descriptions may use different categories; they should not be added together or treated as a reconciled total without consulting the approved plans.
Why did the developer appeal the condition?
Human Urban appealed the condition in August 2025, arguing that it compromised the building’s access arrangements. As reported by Fremantle Herald Interactive, the developer’s community development lead, Sarah Booth, said ground-floor tenants needed direct street access to their premises, particularly given the building’s long period of inactivity. The developer’s position was that closing the openings would require changes to the access design.

Why did skaters oppose removing the condition?
Skaters and their supporters argued that openings through the ledge would interrupt a feature they considered important to skating. The WA Skating Association objected that the openings would compromise how the ledge worked. International skateboarder Sylvain Tognelli described it as “one of the best on the planet, certainly the best in Australia,” according to PerthNow. That is an attributed assessment, not the result of an independent study of the ledge or its use.
The competing priorities were therefore practical as well as symbolic: the developer emphasized direct access for ground-floor businesses, while skaters emphasized an unbroken ledge. The City’s planning position also involved heritage significance and pedestrian-skater conflict at the street edge.

Did JDAP change its decision?
Yes, according to PerthNow’s October 17, 2025 report: JDAP voted 4-1 on October 15 to remove the condition, with reported concerns about the development’s viability. That means the May requirement for two openings to remain closed was subsequently removed in the decision reported by that publication. The panel’s vote does not establish that the developer’s viability argument or the community’s assessment of the ledge was independently proven.
The available reporting does not include primary JDAP minutes or a later panel record confirming the legal status after October 2025. For the definitive current condition, consult the panel’s decision record and approved plans rather than relying on the news reports alone.
