Framework Agreement vs Open Tender: Which Route Is Better for a UK Construction Project?

A framework can offer a suitable, established route for a construction call-off; an open tender can widen supplier access. The better choice depends on project fit and the procurement rules that apply.

Neither route is automatically better. For a UK public construction project, an existing framework can be suitable when its scope, terms, eligible buyers, supplier pool and call-off process fit the work. An open tender can be preferable when no suitable framework exists or the buyer needs broader supplier access. The right choice depends on the project and the procurement rules that apply.

This guide focuses on UK public procurement. The legal regime can depend on when and how a procurement or framework was established, so check the applicable rules and any transitional arrangements before choosing a route.

What is the difference?

Framework agreement and call-off

A framework is an agreement between a contracting authority and one or more suppliers that sets the terms for future contracts for goods, services or works. A contract awarded under it is called a call-off contract. The framework is established first; the buyer then awards a particular project contract using the call-off method set out in the framework documents.

The framework and the construction contract are therefore distinct stages. Establishing a framework creates the arrangement and identifies the suppliers and rules that will govern future awards. A call-off is the later award for a particular requirement, such as the works in the project being procured. The project still needs to fit the framework’s scope and the buyer must use the relevant call-off process; the existence of a framework alone does not establish that it is suitable for every construction requirement.

A call-off is not necessarily a direct award. The framework may require the buyer to run a competition among its suppliers. An award without further competition is possible only where the governing law and framework terms allow it and the conditions for doing so are met. The Cabinet Office’s framework guidance explains the framework rules under the Procurement Act 2023.

That distinction matters when comparing competition and effort. A call-off competition is still competition, although it takes place within the framework’s supplier pool and follows the method the framework specifies. If the framework permits an award without further competition in the relevant circumstances, the buyer must still establish that the terms and applicable law allow that route. Do not assume that every framework permits direct award, or that a call-off must always be competed.

Open tender

In the Procurement Act 2023 guidance, the open procedure is one of the competitive tendering procedures. It starts with publication of a tender notice, as does the competitive flexible procedure. Public contracts generally use a competitive tendering procedure, subject to limited exceptions, and the procedure should be proportionate to the contract’s nature, complexity and cost. See the Cabinet Office’s competitive tendering guidance.

“Open tender” can also be used informally. Under the Public Contracts Regulations 2015, the open procedure is described as allowing any interested economic operator to submit a tender. Confirm that this regime applies before relying on that description; the applicable rules are not determined by the project being construction work alone.

For route selection, it is useful to distinguish the everyday phrase from the formal procedure that applies to a particular procurement. The title of a route or a buyer’s informal description does not by itself tell you which legal rules govern it. Identify the applicable regime first, then check what its procedures require for this procurement. The Procurement Act 2023 guidance and the Public Contracts Regulations 2015 are not interchangeable labels for one universal process.

How the routes compare

Decision point Framework call-off Open tender
Project fit Works, location, value, buyer eligibility and requirements must fall within the framework’s scope and documents. The buyer defines a procurement for the project, subject to the applicable law and a proportionate procedure.
Supplier access Competition is limited to the framework’s supplier pool and follows its stated selection method. Under the Procurement Act, open frameworks can admit suppliers when reopened. Under the Public Contracts Regulations 2015 open procedure, any interested economic operator may submit a tender, if that regime applies.
Competition The framework may require a competition among its suppliers or permit an award without further competition in defined circumstances. The buyer invites tenders through the published notice and procurement documents under the chosen competitive procedure.
Process and timing Earlier due diligence and agreed terms may make a call-off significantly quicker, but speed is not guaranteed. The buyer runs a procurement exercise for the project; the procedure should be proportionate to its nature, complexity and cost.
Checks Confirm the authority can use the framework and follow its call-off rules and governing legislation. Comply with the applicable procedure, notice, documents and award rules.

The comparison is not simply “fast but restricted” versus “slow but open.” The relevant questions are what the framework actually permits, who can use it, which suppliers are in its pool, and whether its call-off method fits this project. An open tender can give interested suppliers access to the particular procurement under the rules that apply, but it also means the buyer is running the procurement for that contract rather than relying on an existing framework arrangement.

Nor does the word “framework” settle how much competition there will be. Some call-offs are competed among framework suppliers; an award without further competition depends on the framework’s terms and applicable law. Conversely, the open procedure’s broad access is not a reason to disregard proportionality or the procurement documents. Compare the real options available for this project, not just the names of the routes.

When a framework may suit a construction project

A framework is worth considering when an appropriate one already exists and the buyer, project and proposed contract fit its terms. The supplier pool and call-off mechanism must also work for the project: a narrow pool or unsuitable competition method can outweigh the convenience of using an established arrangement.

Start by testing the framework against the actual requirement rather than deciding on it because it is described as a construction framework. Check whether the buyer is eligible to use it and whether the framework covers the proposed works, location, value and requirements. A mismatch in any of these areas can make an otherwise familiar arrangement unsuitable. The source material does not establish a universal value threshold or a standard list of eligible buyers; those details must be checked in the actual framework documents and against the governing rules.

  • Verify that the framework covers the specific construction works, geography, contract value and buyer.
  • Read the framework documents to establish whether the call-off requires a further competition or permits an award without one, and what conditions apply.
  • Check that the listed suppliers can cover the work and that the selection method can identify the right contractor for this project.
  • Allow for the call-off process itself. A framework can reduce duplicated preliminary work, but it does not remove the need to follow its rules or complete project-specific procurement steps.

Supplier coverage needs more than a count of names. The practical issue is whether the relevant suppliers and the framework’s selection method can serve this requirement. If the framework pool does not offer adequate coverage for the project, the potential process advantage may not compensate for that limitation. If the framework includes a competition, assess that competition as part of the route; do not treat the framework as automatically less competitive simply because the pool was set in advance.

Timing is also a potential benefit, not a promise. Earlier due diligence and agreed terms may mean less duplicated preliminary work, and the call-off may be significantly quicker than a new procurement exercise. But the actual time depends on the framework’s process and the particular project. The buyer still has to carry out the call-off steps required by the documents and applicable law. There is no reader-facing basis for assigning a number of days or guaranteed saving to every construction project.

Under the Procurement Act 2023, open frameworks can admit suppliers when reopened. That point may be relevant when considering supplier access, but it does not mean suppliers can enter at any time or that every framework has this structure. Check the specific framework’s status, supplier pool and terms rather than assuming that the possibility of reopening resolves a current project’s coverage needs.

When an open tender may be the better fit

An open tender is a plausible route when no suitable framework is available, when the project cannot be accommodated within an existing framework’s scope or process, or when the buyer needs wider supplier access than the framework pool provides.

The case for a new procurement is strongest when the framework options fail the project-fit test. That may be because the buyer is not eligible to use them, their scope does not cover the works or location, their terms do not fit the requirement, or their supplier pool and call-off method do not provide the access or competition the buyer needs. In that situation, the existence of a framework is not enough to make a call-off the right route.

Under the current Cabinet Office guidance, the buyer should select a competitive tendering procedure proportionate to the contract’s nature, complexity and cost. That means designing the procurement around the project rather than assuming that one procedure is right for every construction contract. The applicable regime may also affect the procedure and the notices or documents required.

Open access should be understood in the context of the applicable legal regime. Under the Public Contracts Regulations 2015, the open procedure is described as allowing any interested economic operator to submit a tender. That description should not be presented as applying automatically to every procurement today: the buyer must establish which regime applies, including whether transitional rules are relevant. In the Procurement Act 2023 guidance, the open procedure is one of the competitive tendering procedures, alongside the competitive flexible procedure; both begin with publication of a tender notice.

An open tender does not mean the buyer can design a process without regard to the project. The Cabinet Office guidance says the competitive procedure should be proportionate to the nature, complexity and cost of the contract. The buyer must use the applicable procedure and comply with the relevant notices, documents and award rules. No universal timetable, cost comparison or claim that an open tender always attracts more bids is established; those outcomes depend on the specific procurement and cannot be assumed from the route name.

A practical decision sequence

  1. Identify the governing rules. Establish the jurisdiction and applicable procurement regime, including whether transitional rules matter. Procurement Act 2023 guidance and the Public Contracts Regulations 2015 do not apply interchangeably to every procurement.
  2. Check framework availability and eligibility. Find out whether the buyer is entitled to use a framework that is in force and whether the framework covers the buyer and the project.
  3. Test scope and terms. Compare the proposed works, location, value and requirements with the framework documents. A framework that is broadly construction-related is not necessarily suitable for a particular project.
  4. Assess the supplier pool and call-off method. Confirm the relevant suppliers can deliver the work and determine whether the framework requires a mini-competition or allows an award without further competition under its terms and the applicable law.
  5. Compare competition and timetable needs. Consider whether the framework’s pool and procedure provide adequate competition and whether any potential process-time advantage matters. Do not treat faster completion as assured.
  6. If no framework fits, design the tender. Use the applicable competitive procedure and make its requirements proportionate to the project’s nature, complexity and cost.
  7. Record the rationale and verify the documents. Check the live rules and the actual framework or tender documents before making a decision for a live procurement.

For a practical review, keep the checks tied to the proposed contract. First describe the works and the buyer’s need in terms specific enough to compare with a framework’s scope. Then confirm buyer eligibility and the framework’s status, terms and call-off method. Next, evaluate whether the suppliers and selection process are adequate for the project. Finally, compare that route with a proportionate competitive procurement for the contract. This sequence helps avoid choosing a route based on a general claim about speed or openness before establishing that the route is available and fits.

The decision should account for both the route and the process inside it. “Framework call-off” is not a complete description until the buyer knows whether it must compete and how the framework says to select a supplier. “Open tender” is not a complete description until the buyer has established the applicable procedure and the relevant notice, documents and award rules. Those details can change the practical comparison, so verify them in the governing sources before using the route in a live procurement.

What determines the better route?

The decision turns on facts that vary by project: the buyer’s eligibility, project scope and value, available frameworks, framework terms and supplier coverage, the competition needed, and the delivery timetable. A framework is not inherently less competitive, because its call-off can involve competition; an open tender is not inherently preferable simply because it offers wider access. Compare the actual procedures available to the buyer under the rules that govern the procurement.

The Cabinet Office’s competitive tendering guidance identifies effective competition and transparency as key enablers of value for money and integrity. In practice, route selection should preserve those objectives while remaining within the applicable legal framework and fitting the construction requirement.

There is no construction-specific figure in the available information that establishes the number of frameworks in the market or proves that one route is more common or more successful. A parliamentary committee result mentioned around 8,000 construction frameworks, but the context and date were not suitable as a current market count. It should not be used to support a current claim about market availability. The evidence also does not provide a universal cost saving, award duration or performance comparison between frameworks and open tenders.

For that reason, the sound conclusion is conditional. A suitable framework can be an efficient route when the buyer can use it, the scope and terms fit, the supplier pool is adequate, and its call-off method meets the project’s competition and timing needs. A new open tender can be a better fit when those conditions are not met or broader supplier access is needed. Before a live decision, check current official guidance, transitional rules and the actual procurement documents.

Frequently asked questions

Is a framework agreement the same as a call-off contract?

No. A framework sets provisions for future contracts between a contracting authority and one or more suppliers. A call-off contract is a particular contract awarded under that framework. The buyer establishes or uses the framework arrangement first, then awards the project contract according to the framework’s call-off rules.

Does a framework call-off always require a mini-competition?

No universal answer applies. The framework documents set the call-off selection process. A call-off may involve competition among framework suppliers, or an award without further competition may be possible where the governing law and framework terms allow it and the relevant conditions are met. Read the actual documents rather than assuming either method.

Is using a framework always faster?

No. Earlier due diligence and agreed terms may make a call-off significantly quicker by reducing duplicated preliminary work, but this is a potential advantage, not a guaranteed time saving. The buyer must still complete the process required for the call-off, and the time depends on the framework and project. The reviewed sources do not establish a standard number of days saved.

Does an open tender let any supplier bid?

Under the Public Contracts Regulations 2015, the open procedure is described as allowing any interested economic operator to submit a tender. Confirm that this regime applies to the procurement before relying on that description. Under the Procurement Act 2023 guidance, open procedure is a competitive tendering procedure that starts with publication of a tender notice.

Which route is better for a construction project?

Neither is categorically better. A framework may fit when the buyer is eligible, the works and terms are within scope, the supplier pool is adequate and the call-off process suits the project. An open tender may fit when no suitable framework exists, the framework does not accommodate the work, or broader supplier access is needed. The legal regime and project facts determine the answer.

Can a buyer use any construction framework?

No. Check that the buyer is eligible, the framework is available for use, and its scope and documents cover the particular works, geography, value and requirements. A general construction label is not proof that a framework fits a specific project.

Which legal rules apply to a UK procurement?

The title or construction nature of the project does not determine the legal regime by itself. The applicable rules can depend on when and how the procurement or framework was established, including transitional arrangements. Check the current official guidance and the procurement’s actual documents before making a live route decision.

Frequently Asked Questions

Does a framework call-off always require a mini-competition?

No. The framework documents establish the call-off method. A call-off may be competed among framework suppliers, or an award without further competition may be possible where the applicable law and framework terms permit it and the relevant conditions are met.

Is using a framework always faster?

No. Earlier due diligence and agreed terms may make a call-off significantly quicker, but speed is not guaranteed. The buyer must still complete the required call-off process, and the time depends on the framework and project.

Does an open tender let any supplier bid?

Under the Public Contracts Regulations 2015, the open procedure is described as allowing any interested economic operator to submit a tender. Confirm that this regime applies. The Procurement Act 2023 guidance also describes an open procedure, which begins with publication of a tender notice.

Which route is better for a construction project?

Neither route is universally better. A framework can fit when the buyer, project, terms, supplier pool and call-off method align; an open tender may suit when no framework fits or broader supplier access is needed. Check the applicable procurement regime.

The applicable regime can depend on when and how the procurement or framework was established, including transitional rules. Check current official guidance and the actual procurement documents; construction work alone does not determine the rules.

The Bottom Line

Bottom line: Choose the route that fits the actual project and the rules that govern it. Use a framework only after confirming buyer eligibility, scope, supplier coverage, terms and call-off method. Consider an open tender when no suitable framework exists or broader supplier access is needed. A framework may save duplicated work, but it is not automatically faster, and neither route is universally better.
