Vietnam Electricity’s power-trading arm has reportedly asked some renewable developers to negotiate the lowest possible electricity prices for periods when their projects were operating without written approval of construction-acceptance inspections. The request, reported by The Investor on October 5, 2026, is an ongoing negotiation—not a confirmed tariff cut for every project or a final government ruling.
The dispute concerns whether missing acceptance paperwork can affect a project’s commercial-operation date and the price payable under its power purchase agreement (PPA), particularly when the project began operating before later documentation requirements took effect.
What EVN’s trading company is asking developers to negotiate
The Investor reported on October 5, 2026 that EVN’s Electricity Power Trading Company (EPTC) had asked affected renewable developers to seek the maximum possible reduction in electricity prices for periods when projects were already in commercial operation but lacked written approval for construction-acceptance inspections. The report says negotiated prices should not exceed the ceiling tariffs set for transitional renewable projects.
The report attributes the request to a recent EPTC notice, but the notice itself was not independently available for review. The reported request should therefore be understood as a negotiating position, not proof that a particular project’s tariff has already changed or that all affected projects will receive the same treatment.

Why construction-acceptance documents are at the center of the dispute
Developers’ position on earlier operating dates
According to The Investor, developers argue that the rules in effect when some plants began operating did not make written construction-acceptance approval a condition of commercial operation. They say Circular 10/2023 later introduced acceptance documentation as a prerequisite for an electricity operating licence, after many affected plants had already begun commercial operation in 2021 or earlier.
On that basis, developers want their existing commercial-operation dates recognized, the rules applied without retroactive effect, and payments made under their existing PPAs. These are the developers’ reported arguments; they are not an independently established legal conclusion.

What developers say should happen if requirements were not met
The developers’ reported position is that a failure to meet construction-acceptance rules should be addressed through penalties and corrective measures, rather than by changing a project’s commercial-operation status or contractual payment rights. The available reporting does not resolve this disagreement.
Inspection findings and a proposed review
The Investor also reported that a 2023 government inspection concluded the issue had caused losses for EVN, and that some projects subsequently faced delayed or partial PPA payments. The report describes a ministry proposal for EVN and developers to review FIT eligibility and, where projects did not meet requirements, determine and approve revised tariffs so payment differences could be addressed. The underlying inspection and ministry documents were not available for independent review, so these points remain attributed to The Investor’s account.

How the reported ceiling tariffs differ for solar and wind
The Investor attributes the following ceilings to the Ministry of Industry and Trade’s Decision 21/2023. The figures exclude value-added tax (VAT); the applicable ceiling depends on project type. The report says each plant’s actual tariff is determined through negotiation, so a ceiling is not a guaranteed or automatic project price.

What determines the outcome for an individual project
The reports do not provide project-level records that would establish how the negotiation should apply to a named plant. The issues to distinguish are:
- Acceptance and licensing status: what construction-acceptance inspection documents exist, when they were issued, and how they relate to the operating licence.
- Commercial-operation date: the date recognized for the project, and whether that date is disputed because of acceptance documentation.
- Applicable tariff: the relevant project type and ceiling, alongside the actual price negotiated for that plant.
- PPA and payment history: the existing contractual terms and any delayed, partial, or disputed payments.
Without those project-specific facts and the applicable documents, the reported ceiling ranges and EPTC request do not establish an individual project’s entitlement or final payment amount.

What remains unresolved
The Investor’s October 5, 2026 account leaves the negotiation outcome open. The EPTC notice, the text of Decision 21/2023 and Circular 10/2023, and the underlying inspection and ministry documents were not independently available for review here. Consequently, the reporting supports describing a request and a dispute, but not a definitive conclusion about the legal effect of acceptance paperwork, the tariff for a particular plant, or whether a retroactive adjustment is valid.
