Compare the company and its delivery plan, not its passport. A domestic-owned contractor is not automatically safer, cheaper, or better suited to a project, and a foreign-owned contractor is not automatically more capable or more expensive. Ownership becomes decisive only when the project’s jurisdiction, funding source, security rules, local-content requirements, or tender documents attach a legal consequence to it.
Project owners should therefore use one evidence-based scorecard for every bidder: legal eligibility, financial capacity, technical capability, relevant experience, proposed personnel, equipment and supply chain, local execution capacity, integrity, contract terms, and risk-adjusted value. Apply the same evidence standard to domestic companies, foreign-invested local entities, branches, and joint ventures, while separately checking any ownership or control test required by law.

First define what “domestic” and “foreign-owned” mean for this project
Ownership labels are often used loosely. A company can be incorporated in the project country but controlled by an overseas parent; a foreign company can operate through a locally registered branch; a joint venture can combine domestic and foreign participants; and a locally owned company can subcontract most specialist work to an overseas firm. Those structures can have different legal and practical consequences.
Use four separate descriptors
- Place of incorporation: Where the bidding legal entity is registered and licensed.
- Ownership and control: Who ultimately owns voting rights, appoints directors, or controls the entity.
- Operating presence: Whether the bidder has a staffed office, equipment, permits, bank accounts, and established subcontractors near the site.
- Contracting structure: Whether the bidder performs directly, through a branch, or through a joint venture and named subcontractors.
Do not treat any one descriptor as a substitute for the legal test in the procurement documents. A tender may ask for beneficial-ownership disclosure, local registration, a minimum domestic share, a security clearance, or evidence that a particular entity—not merely its parent—can sign and perform the contract.

Start with the governing procurement and ownership rules
Before comparing prices or technical proposals, identify the rules that control eligibility. Record the project country and subnational jurisdiction, whether the owner is public or private, the funding source, contract form, sector, security classification, and the edition of the tender documents. Public procurement, donor-financed procurement, private contracting, and defense work can apply materially different tests.
Questions to answer before issuing or evaluating a tender
- Which law and procurement regulations govern the award?
- Does the funding agreement impose a particular procurement framework or eligible-country rule?
- Are there current licensing, registration, tax, labor, immigration, or professional-certification requirements?
- Do local-content, domestic-preference, joint-venture, or subcontracting provisions apply?
- Does the project involve protected information, critical infrastructure, export controls, sanctions, or national-security review?
- What ownership, control, and beneficial-ownership disclosures must each bidder provide?
- Which edition of the solicitation and standard conditions will govern the contract?
Eligibility is a threshold issue. A company may have excellent references and still be ineligible under the applicable regime. Conversely, a local preference may affect evaluation without proving that a domestic company will deliver better performance.
Use one project-owner scorecard for every bidder
| Comparison axis | Evidence to request | Owner’s decision question |
|---|---|---|
| Eligibility and law | Registration, licenses, ownership and control disclosures, local-content evidence, funding conditions, security restrictions, sanctions or debarment checks | Can this exact legal entity lawfully bid, contract, and perform? |
| Financial capacity | Audited statements, liquidity, credit facilities, bonding capacity, performance security, concurrent-work schedule, project cash-flow forecast | Can the bidder absorb mobilization costs, delay, variations, and payment timing without weakening performance? |
| Technical capability | Comparable completed projects, methods, design coordination, quality records, schedule history, testing and commissioning capability | Has the proposed organization delivered work with this complexity, interface risk, and consequence of failure? |
| People and management | Named project director, superintendent, engineers, safety and quality leads, availability confirmations, certifications, language and reporting plan | Will the actual team—not just the corporate profile—be available and competent? |
| Equipment and supply chain | Plant ownership or leases, facilities, material sources, logistics plan, specialist subcontractors, alternatives for constrained items | Can required resources arrive, operate, and be replaced if a supplier or machine fails? |
| Local execution | Permitting relationships, site knowledge, labor plan, local subcontractors, authority coordination, emergency response arrangements | Does the delivery plan convert local presence into measurable schedule or risk benefits? |
| Integrity and transparency | Beneficial ownership, conflicts declarations, litigation and termination history, sanctions and debarment checks, compliance program | Can the owner understand who controls the bidder and identify unacceptable integrity risk? |
| Price and contract risk | Price breakdown, exclusions, escalation assumptions, allowances, change process, warranties, delay provisions, dispute terms, lifecycle cost | What is the expected total cost after realistic risks, not merely the tender total? |
Compare financial strength in the context of this contract
Ask for the same financial information from every bidder and normalize accounting periods and currencies. Review audited statements, current management accounts where permitted, committed credit lines, bonding limits, working-capital requirements, parent support, and the bidder’s other projects. A large global balance sheet is not useful if the contracting subsidiary cannot access it; a smaller domestic company may be financially strong for the project if its cash flow and security package are credible.
Tests that reveal capacity gaps
- Calculate the cash required for mobilization, early procurement, payroll, retention, and the longest expected payment cycle.
- Compare the project’s peak cash need with unrestricted liquidity, not total assets.
- Check whether current and pending work would consume bonding capacity or key management resources.
- Require a clear explanation of parent guarantees, letters of credit, or other support: issuer, amount, conditions, governing law, expiry, and enforceability.
- Stress-test the forecast for delayed certification, a major variation, a three-month schedule slip, and an imported-material price increase.
Singapore’s Ministry of Finance has stated that higher-value construction contracts generally require higher standards for financial capacity, technical capability, personnel, certifications, and relevant track record. That is a statement about Singapore’s government procurement regime, not a universal threshold. Put the actual financial requirements and evidence in the project’s tender.
Test technical capability against the project’s real complexity
“Built many projects” is not equivalent to “built this project.” Compare experience by scope, scale, delivery method, site conditions, interfaces, regulatory environment, and consequence of failure. Require project names, contract values, dates, the bidder’s exact role, self-performed versus subcontracted work, client contacts, completion status, defects history, and the names of personnel who will transfer relevant knowledge.
Make references comparable
- Use at least one reference with similar structural, civil, mechanical, electrical, or process demands.
- Separate projects completed by the bidding entity from projects completed by a parent or affiliate.
- Verify that the proposed team held the roles claimed on the reference projects.
- Ask for schedule baselines, approved extensions, major claims, quality nonconformities, safety events, and commissioning results.
- Assess experience coordinating designers, utilities, authorities, neighbors, and other contractors when those interfaces exist on the new project.
The World Bank’s Project Procurement Framework describes tailoring the market approach to project needs and local realities and provides works procurement documents. For a World Bank-financed project, check the Procurement Regulations edition applicable to the procurement; the framework page lists the September 2025 regulations and related resources. Do not import those rules into an unrelated private or national procurement.

Evaluate the proposed people, not the corporate brochure
Require named personnel and written availability commitments for the project director, construction manager, discipline leads, planner, commercial manager, safety manager, quality manager, and commissioning lead where relevant. Compare qualifications, comparable experience, authority to make decisions, language capability, reporting lines, and planned time on site.
Questions for a domestic bidder
Local familiarity can shorten permitting and authority coordination, but ask who will actually perform specialist design, commissioning, and high-risk work. A domestic headquarters does not prove that the proposed team has experience with the project’s technology or scale.
Questions for a foreign-owned bidder
Identify which experts will be resident, how long they can remain in the country, who handles visas and work permits, and how knowledge will transfer to local staff. Confirm that language, time-zone, and reporting arrangements support rapid decisions rather than creating an approval bottleneck at the parent company.
Verify equipment, facilities, materials, and logistics
U.S. Federal Acquisition Regulation Subpart 9.1 lists having necessary equipment and facilities—or the ability to obtain them—as part of prospective-contractor responsibility. Use the same practical test regardless of ownership.

Evidence to compare
- Equipment lists showing ownership, location, age, capacity, maintenance status, and backup arrangements.
- Binding rental, lease, or supplier commitments where equipment is not owned.
- Manufacturing slots, long-lead purchase orders, approved alternatives, and inspection plans.
- Customs, transport, storage, and inland-delivery assumptions for imported plant or materials.
- Subcontractor identities, scope, capacity, licenses, and replacement options.
- Site facilities, laboratories, testing equipment, temporary utilities, and digital project-control systems.
For a foreign-owned company, do not assume that equipment available somewhere in its group is available to this contract. Require an allocation commitment, delivery date, customs responsibility, and contingency if the item is delayed. For a domestic company, do not assume local suppliers are unconstrained; verify capacity and lead times.
Separate local presence from formal local preference
A local office, workforce, and supplier network can improve response time, authority coordination, and understanding of site conditions. Those are operational benefits to be evidenced in the execution plan. They are different from a legal preference for domestic ownership or a required local share.

Score local execution through measurable commitments: days to mobilize, named local managers, labor availability, permitting responsibilities, emergency response time, local subcontractor capacity, and training or handover obligations. Give credit only where the tender permits it and where the bidder’s evidence supports it.
Understand what different official regimes actually establish
| Regime or source | What it says | What a project owner should not infer |
|---|---|---|
| World Bank-financed procurement | The Project Procurement Framework governs goods, works, non-consulting services, and consulting services for Investment Project Financing and allows the market approach to be tailored to project needs and local realities. The applicable Procurement Regulations and solicitation documents control the specific procurement. | It is not a worldwide rule for private projects or every government contract. |
| Singapore government construction procurement | A 2016 Ministry of Finance response described an open regime in which suppliers compete on their ability to meet tender requirements “regardless of nationality.” It also said higher-value contracts generally require higher standards for capacity, capability, personnel, certifications, and track record. | Singapore’s approach does not establish eligibility rules in another country. The response is dated 2016. |
| U.S. federal procurement | FAR Subpart 9.1 includes responsibility considerations such as equipment, facilities, qualifications, and legal eligibility. It cautions that awarding on lowest evaluated price alone can be a false economy when default, late delivery, or unsatisfactory performance creates additional costs. | It is not a finding that foreign-owned or domestic-owned firms perform better. |
| U.S. defense procurement | DFARS Part 209 treats foreign-government ownership or control as material in defined circumstances, including access to proscribed information, and describes a possible national-security waiver. The cited page shows DFARS Change 5/7/2026. | It is not a blanket prohibition on foreign-owned construction companies or ordinary civilian projects. |
| Philippine public procurement | GPPB guidance, including Resolution No. 018-2005 and NPM No. 044-2007, describes ownership thresholds and conditions for local and foreign contractors and joint ventures, with exceptions. | Those historical guidance documents must be checked against the current law and solicitation before reliance. |
| China government procurement | An October 13, 2021 Ministry of Finance circular directs equal treatment of domestic and foreign-invested enterprises in government procurement, including qualifications and evaluation, subject to stated national-security and state-secrets exceptions. It says suppliers should not face limitations based on ownership, organizational or shareholding structure, investor nationality, or product brand through unreasonable conditions. | It addresses government procurement in China; it does not decide private procurement or another country’s rules. |
Normalize bids before comparing price
Price comparisons fail when one bid excludes items another bidder has priced. Build a bid-comparison schedule that brings all offers to the same scope, currency, tax basis, schedule assumptions, and risk allocation.
| Item to normalize | Check |
|---|---|
| Scope | Are design, temporary works, testing, commissioning, permits, utility connections, training, and handover included? |
| Taxes and duties | Are VAT, withholding, customs duties, exemptions, and import responsibilities treated consistently? |
| Escalation | Which labor, fuel, material, and currency movements are fixed, indexed, capped, or excluded? |
| Schedule | Do milestones, access dates, working hours, weather allowances, and liquidated damages use the same assumptions? |
| Allowances and provisional sums | Are uncertain quantities identified and priced on the same basis? |
| Warranties and lifecycle | Are warranty periods, spare parts, maintenance, energy use, and replacement obligations comparable? |
| Security and insurance | Do bonds, guarantees, professional indemnity, workers’ compensation, and liability limits meet the same requirements? |
Only after normalization should the owner compare evaluated price. A low initial number can be offset by exclusions, weak contingencies, expensive logistics, or a contract that leaves the owner exposed to delay and defects.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Choose on risk-adjusted value, not lowest bid alone
Value for money is the relationship between expected cost and the performance the owner is likely to receive. Add the consequences of delay, rework, financing carry, lost revenue, emergency procurement, interface failures, and disputes to the price analysis. The U.S. federal rule’s warning about lowest evaluated price is a useful principle: an apparently cheap award can cost more after default or unsatisfactory performance.
An illustrative evaluation model
The percentages below are a starting model an owner may adapt; they are not a legal requirement. Set pass/fail gates for eligibility, then score only bidders that pass.
| Category | Illustrative weight | Examples of scored evidence |
|---|---|---|
| Technical solution and comparable experience | 25% | Methods, interfaces, quality history, relevant references |
| Project team and management plan | 15% | Named people, availability, controls, reporting, safety leadership |
| Schedule and delivery certainty | 15% | Logic, procurement path, contingencies, recovery plan |
| Financial and bonding capacity | 15% | Liquidity, guarantees, concurrent work, security package |
| Price and lifecycle cost | 20% | Normalized price, exclusions, escalation, operating implications |
| Local execution and supply-chain resilience | 10% | Permits, labor, logistics, subcontractors, alternatives |
Document the scoring rationale, evidence received, clarifications, conflicts checks, and any arithmetic adjustment. If a bidder receives a local-content or other statutory preference, show the mechanism separately from technical scoring so the procurement record remains understandable.

Run ownership and control due diligence where it matters
Request a current organization chart, legal-entity documents, shareholder information, ultimate beneficial owners, directors, signing authority, parent relationships, and any government ownership or control. Confirm whether the entity named in the bid will receive payment, employ the workforce, hold permits, and bear warranty obligations.
Escalate the review when the project is sensitive
- Protected information or critical infrastructure may trigger security, ownership, or access restrictions.
- Government funding may impose eligible-country, sanctions, or debarment requirements.
- Foreign investment or local-content rules may require a specific ownership percentage, joint venture, or subcontracting plan.
- Parent guarantees may need legal review for enforceability in the issuer’s jurisdiction.
- Complex ownership chains, nominee shareholders, undisclosed affiliates, or unexplained changes in control require clarification before award.
DFARS Part 209 illustrates why ownership and control can become material in a defined U.S. defense context when access to proscribed information is required. Treat that as a project-specific security rule, not as evidence that foreign ownership predicts construction performance.
Check integrity, sanctions, and conflicts consistently
Apply the same checks to every bidder: debarment databases required by the procurement, sanctions restrictions, litigation and termination disclosures, conflicts of interest, beneficial ownership, anti-bribery controls, and related-party subcontractors. The World Bank’s procurement and sanctions resources specifically include beneficial-ownership disclosure and sanctions-system materials for its financed operations.
Ask bidders to identify government officials, owner representatives, designers, or consultants with whom they have a financial or family relationship. Require disclosure of commissions, agents, and contingent fees. A clean ownership profile does not replace performance diligence, but an opaque profile can prevent the owner from assessing who is responsible for delivery.

- Map the rules. Create a one-page register of jurisdiction, owner type, funding source, security classification, current regulations, and tender documents.
- Define the legal entity. State whether the bid is from a local company, foreign company, branch, foreign-invested local entity, or joint venture, and identify the contracting party.
- Set pass/fail gates. Cover licenses, eligibility, mandatory experience, security, bonds, disclosures, and required local-content conditions.
- Issue identical evidence requests. Use the same forms, reference requirements, financial period, clarification deadlines, and scoring definitions.
- Verify high-risk evidence. Contact references, inspect key facilities when practical, validate guarantees, confirm personnel availability, and test supply-chain commitments.
- Normalize bids. Adjust scope, taxes, logistics, escalation, schedule, allowances, and lifecycle obligations before price scoring.
- Score and challenge. Record why each score was awarded, then hold clarification meetings focused on ambiguities rather than allowing informal redesign of the bid.
- Document the award. Preserve the compliance matrix, ownership analysis, evaluation sheets, conflicts checks, clarifications, approvals, and reasons for accepting or rejecting material deviations.
Red flags and practical responses
| Red flag | Why it matters | Response |
|---|---|---|
| Only the parent company has comparable references | The bidding entity may lack the staff, systems, or contractual responsibility behind those results. | Require a legally binding performance commitment, named transferred personnel, and evidence of the bidder’s role. |
| Unusually low price with broad exclusions | The bid may shift cost into variations, claims, or owner-furnished work. | Issue a written clarification and normalize every exclusion before scoring. |
| Key experts are “available” but unnamed | The proposal may depend on people who are not committed or cannot obtain permits. | Require names, résumés, availability confirmations, and replacement rules. |
| Imported equipment has no customs or backup plan | Border delays or a single failed machine can move the critical path. | Require logistics dates, responsible party, alternative sources, and recovery measures. |
| Ownership disclosures are incomplete | The owner cannot assess eligibility, security, conflicts, or control. | Make disclosure a condition of evaluation or award as permitted by the rules. |
| Local presence is asserted but not resourced | A nominal office may not provide labor, permits, or emergency response. | Score measurable local commitments and verify them. |
What the evidence does not prove
There is no reliable cross-market statistic establishing that domestic-owned contractors have lower cost, better schedule performance, higher quality, safer sites, or fewer failures than foreign-owned contractors, or vice versa. The available official examples describe eligibility, responsibility, openness, security, and evaluation rules; they do not establish an ownership-based performance advantage.
Singapore’s Ministry of Finance reported in 2016 that, among construction contracts above S$200 million awarded during the three years covered by its parliamentary response, two-thirds went to the lowest-price bidder. That historical figure is limited to the stated Singapore period and contract scope. It is not a performance comparison and does not show that low bids, domestic firms, or foreign firms perform better.
Final decision test for project owners
Select the bidder that is legally eligible and presents the strongest verified probability of delivering the defined scope at an acceptable total risk. Ownership should appear in the decision only where a governing rule, security requirement, funding condition, or evidenced execution advantage makes it relevant. A domestic company may win because its team, permits, suppliers, and cash flow fit the project. A foreign-owned company may win for the same reason, provided its legal entity, people, logistics, guarantees, and local arrangements are equally credible.
The defensible award record is therefore not “domestic” or “foreign.” It is a documented comparison showing who can perform, under which legal conditions, with what resources, at what normalized price, and with which protections if the plan fails.
