David Letizia Fined $35,000 Over Underground Bunker Development Without Council Approval

The Echo Newspaper reported a $35,000 planning-scheme fine over development at a High Wycombe property. WA Police separately told Parliament that 17 registered firearms seized in a 2022 raid were not returned.

David Anthony Letizia was reportedly fined $35,000 in Midland Magistrates Court after pleading guilty to development in breach of a local planning scheme, according to an April 2023 report by the Echo Newspaper. The report describes an underground tunnel beneath his High Wycombe property as part of the development. It does not establish that a separate shooting-range offence was the basis of the $35,000 fine.

Why was Letizia fined $35,000?

The Echo Newspaper reported that Letizia pleaded guilty to carrying out development contrary to provisions of the local planning scheme and was fined $35,000 in Midland Magistrates Court. The report says the City of Kalamunda brought the charges following a police investigation. The court judgment and the specific planning-scheme provision were not available in the cited material, so the account of the plea and sentence rests on the newspaper report rather than an independently reviewed court record. What did the report say was built?

The newspaper described a 50-metre tunnel under the property and said it had been rectified by filling it with concrete. It also reported that the bunker was originally an underground wine cellar. These details are the newspaper’s account; the available material does not provide a building approval file, inspection report or court finding explaining the structure’s precise construction or permitted use.

What happened in the firearms matter?

The Echo Newspaper also described a firearms-related matter as separate from the planning prosecution. It reported that Letizia pleaded guilty in September, was fined $2,600, had items subject to those charges confiscated, and had his firearms licence revoked. The report does not state the year for that September plea, and the firearms case record was not available here. This reported $2,600 outcome should not be conflated with the $35,000 planning fine.

What did WA Police say was seized?

In a response published by the Parliament of Western Australia, the Western Australia Police Force said officers raided the High Wycombe property on 6 May 2022. Police reported that they seized 17 firearms, all of which were legal and appropriately registered; none were illegal and unregistered. How the reported events fit together
