He asked the council to reduce the verge to its 2018 levels and make it comparable with adjoining verges. The available records describe allegations and a council process—not a finding that the work was unlawful.
What the councillor alleged
PerthNow reported on May 26, 2022, that Mangano presented his motion at a City of Nedlands council meeting the previous Tuesday. His motion sought “to reduce the height of the verge at 52 Jutland Parade to the 2018 levels and comparable with the adjoining verges”.
In the motion’s justification, Mangano alleged that the adjoining owner “has illegally placed fill on the verge and mounded up, and presents a trip hazard and run-off issues also.” The report attributes these claims to the councillor; it does not report a court or regulator finding that the fill was illegal or that a hazard had been formally established. PerthNow’s May 26, 2022 report is the contemporaneous account.
What the neighboring household said
Arif Valibhoy addressed council on behalf of his parents, who owned the neighboring property. He said trailers began depositing sand on January 31; the year is not specified in the reported passage. He described the altered contour and alleged effects on a boundary wall, streetscape, riverscape and sewerage. Those statements are his claims as reported, not independently established findings.

A City of Nedlands council-minutes search excerpt for July 26, 2022 says Zenith Surveying undertook a feature survey at No. 52 Jutland Parade that year, confirming existing ground levels. The excerpt also says a warrant was not required for the surveyor’s entry. It does not disclose the ultimate council decision or establish the legal status of the verge work. The City’s council-meetings page is the source of the minutes search excerpt.
The available reporting and minutes excerpt do not establish whether Mangano’s motion passed, what the later legal advice concluded, whether the verge was subsequently altered, or whether a court or regulator found a breach.

Keep the later planning application separate
The City’s planning portal lists an application at 52 Jutland Parade for additions and alterations described as a pet enclosure. The portal marks consultation closed and gives April 27, 2026 as the comment deadline. That application is a separate planning matter; the listing does not resolve or establish a connection to the 2022 verge dispute. City of Nedlands planning portal.
