Contractor Deposit Rules: What Homeowners Should Know

Contractor deposit rules depend on the state and type of project. See how California and Massachusetts differ and how to check a proposed payment schedule before paying.

There is no single U.S. rule that sets a “standard” contractor deposit. Some states limit how much a contractor may collect up front, and the applicable limit can depend on where the property is and what kind of work the contract covers. Before paying, check the rule for your state and locality, then make sure the written payment schedule ties each payment to a clear project milestone or identified materials.

How much deposit can a contractor ask for?

It depends on the law where the property is located and whether that law covers the particular project. The Federal Trade Commission (FTC) says some states limit contractor down payments and advises homeowners to contact their state or local consumer agency for information. A percentage that is lawful in one state—or common in a particular trade—is not a nationwide legal limit.

Check the relevant consumer-protection agency or contractor-licensing board before agreeing to a deposit. Also confirm which contract and work categories the rule covers. The California and Massachusetts examples below illustrate different approaches; they are not a survey of state laws or a substitute for checking current law where your home is.

What do California and Massachusetts require?

The rules in these two states show why homeowners should look beyond a single “reasonable deposit” percentage. California sets a low ceiling on the initial down payment for covered home-improvement work and limits later payments by the value of work or materials. Massachusetts generally uses a one-third threshold but recognizes a narrow exception for certain special-order items.

State Advance-payment rule Payment-schedule rule
California For covered home-improvement jobs and swimming pools, excluding finance charges, “The down payment cannot be more than $1,000 or 10 percent of the contract price, whichever is less, for a home improvement job or swimming pool, excluding finance charges.” The written schedule must state payment amounts in dollars and tie them to work or services and materials or equipment. Except for the down payment, payments cannot exceed the value of work performed or materials delivered.
Massachusetts The advance deposit generally cannot exceed the greater of one-third of the total contract price or the actual cost of qualifying special-order or custom-made materials or equipment that must be ordered in advance to keep the project on schedule. Each scheduled payment amount must be stated in dollars. State sample language says full payment cannot be demanded until the contract is completed to both parties’ satisfaction.

The formulas illustrate how different jurisdictions can produce different results. For example, under California’s stated formula, a $8,000 covered contract has a 10% amount of $800, so the lower limit is $800; on a $20,000 covered contract, 10% is $2,000, so the $1,000 limit is lower. In Massachusetts, one-third of a $9,000 contract is $3,000. A higher advance amount is not automatically justified by ordinary supplies: the exception concerns qualifying special-order or custom-made items that must be ordered in advance to keep the project on schedule, and uses their actual cost.

California: a capped down payment and value-based progress payments

The California Contractors State License Board (CSLB) states that covered home-improvement work and swimming pools are subject to the down-payment cap shown above. California law also requires a detailed written payment schedule. It must identify amounts in dollars and connect them to the work or services and materials or equipment they cover. After the down payment, a contractor generally cannot collect more than the value of work performed or materials delivered. These rules are not a blanket statement about every construction contract; check whether the law applies to your specific contract and confirm current requirements with the CSLB or another appropriate authority.

That distinction matters when reviewing the whole schedule: the initial down payment is treated differently from later progress payments. A later installment should not simply be a large amount due on a calendar date if the applicable rule limits collection to the value of completed work or delivered materials. Read the stated trigger alongside the amount and ask how it matches the project’s actual progress.

Massachusetts: one-third is not the only calculation

Massachusetts General Laws chapter 142A, section 2, generally limits an advance deposit to the greater of one-third of the contract price or the actual cost of qualifying special-order or custom-made materials or equipment that must be ordered in advance to keep the project on schedule. The exception is narrow: it is not general permission to collect a larger deposit for ordinary supplies. The law also requires a payment schedule with each amount stated in dollars. Massachusetts state sample language says full payment cannot be demanded until the contract is completed to both parties’ satisfaction.

If a contractor says the special-order exception applies, ask which item is being ordered, what its actual cost is, and why it must be ordered in advance for the schedule. Those questions help you compare the requested amount with the contract terms and the narrow statutory exception; they do not replace checking the law or the authority responsible for your project.

Is a 50% contractor deposit legal?

There is no nationwide yes-or-no answer. A 50% deposit would exceed California’s stated down-payment limit for a covered home-improvement job or swimming pool. In Massachusetts, a deposit at that level would need to be assessed under the statutory calculation, including whether qualifying special-order or custom-made items ordered in advance support a higher amount; ordinary materials do not qualify for that exception simply because the contractor expects to buy them. Other states may have different rules, so check the law where the project is located rather than relying on a percentage that someone calls “standard.”

Can a contractor ask for money up front?

A contractor may request an advance payment, but the amount and terms must comply with applicable law and the contract. The FTC identifies a demand for all project money up front as a warning sign. Be especially cautious if the contractor also pressures you to decide immediately or refuses to provide a written agreement.

For disaster-repair work, the FTC recommends paying by credit card or check rather than by wire transfer, gift card, payment app, cryptocurrency, or cash. That payment-method advice is specifically given in the disaster-repair context; it should not be mistaken for a universal rule governing every home-improvement transaction.

What is a reasonable deposit for home repairs?

“Reasonable” is not one legally established national percentage. A sound payment plan is one that is lawful for the project, written in the contract, and tied to defined work or materials rather than vague promises. Compare the proposed terms against the rule in your jurisdiction and ask what each payment will fund or mark as complete.

  • Identify the property’s state and local jurisdiction, then confirm which deposit rule applies to the type of work.
  • Ask for a dollar amount for the deposit and every progress payment, along with the milestone or delivered materials that trigger each one.
  • Make sure the written scope identifies the work, materials, price, estimated start and completion dates, and promises made outside the contract.
  • Require approved changes to the work or price to be documented in writing.
  • Do not agree to pay the full project price up front.

When comparing estimates, compare the same scope and payment triggers, not just the deposit percentage or total price. If one proposal requests a large early payment while another spreads payments across defined work or deliveries, ask each contractor to explain the difference in writing. A lower deposit by itself does not establish that a contract is better, and a higher one does not establish that it is lawful; the local rule and the complete schedule are what matter.

How to evaluate the contract before paying

A clear payment schedule is only one part of a dependable agreement. The FTC recommends getting a written estimate and contract that describe the work, materials, price, dates, contractor identity, license number where applicable, and relevant promises. Obtain multiple estimates so you can compare scope and payment terms—not just the total price.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Check credentials. Verify the contractor’s license with the relevant state or county authority where licensing is required. Ask for proof of insurance, and consult local consumer-protection resources for complaint information.
  2. Match payments to the schedule. Read each payment amount and trigger. Avoid vague entries such as “materials” or “start-up” unless the contract identifies what is covered and when payment is due.
  3. Review exclusions and changes. Make sure the written scope describes included work and materials. Agree in writing on any change to scope, price, or schedule before paying for it.
  4. Keep the record. Save the signed contract, estimates, change orders, invoices, receipts, payment records, and written communications.

The exact legal requirements differ by jurisdiction. California and Massachusetts, for example, both require dollar-specific payment schedules, but their advance-deposit rules are not the same. A schedule that looks detailed is not enough if the initial payment exceeds a local cap or a later payment is due before the work or materials specified by law.

Before signing, check that the written version includes promises made during conversations and that the person or business named in the contract matches the contractor whose credentials you checked. Keep copies of the signed agreement and any later change orders. If the scope, price, or dates change, putting the change in writing gives both sides a record of what was agreed rather than leaving the payment trigger unclear.

When can you cancel a contractor contract?

Do not assume every home-improvement contract can be cancelled within three days. FTC guidance says a written statement of the right to cancel within three business days should be provided when the contract was signed in the homeowner’s home or somewhere other than the seller’s permanent place of business. The availability and application of cancellation rights depend on the circumstances and applicable law; read the contract and verify the rule for your location.

Can I get my contractor deposit back?

There is no universal refund answer for every cancellation, breach, or type of project. The outcome can depend on your contract, the reason the work did not proceed, the work already performed or materials ordered, and the law in your jurisdiction. Review the written terms and contact your state or local consumer agency or contractor-licensing authority if you cannot resolve the question with the contractor.

Keep in mind that a deposit question and a cancellation question are not necessarily the same issue. The contract may address what happens if either party ends the project, while local law may provide additional rights or requirements. Check both rather than assuming the word “deposit” alone determines whether money must be returned.

What to do if a payment dispute arises

The FTC suggests trying first to resolve a home-improvement dispute with the contractor. Keep the discussion factual and refer to the contract, schedule, receipts, and any approved change orders. If the issue remains unresolved, document follow-up in writing and contact the relevant state or local consumer authorities for next steps.

For project protection, retain all payment and project records from the start. A complete record can show what was promised, what work or materials were delivered, what was paid, and how the parties handled changes. Include estimates, the signed contract, dated invoices and receipts, payment confirmations, change orders, and written messages about delays or disagreements.

How does California calculate its home-improvement down-payment limit?

For covered home-improvement jobs and swimming pools, excluding finance charges, the CSLB says the down payment cannot exceed $1,000 or 10% of the contract price, whichever is less. Later payments are subject to separate value-of-work or delivered-material limits.

Can a contractor keep my deposit if I cancel?

There is no universal refund rule for every cancellation or project. Review the contract and the law that applies where the work is located, including any relevant cancellation rights, and contact a local consumer agency if you cannot resolve the issue.

Does a three-business-day cancellation right apply to every home-improvement contract?

No. FTC guidance says a written cancellation statement should be provided when the contract is signed in the homeowner’s home or somewhere other than the seller’s permanent place of business. The specific right depends on the circumstances and applicable law.

The Bottom Line

Before paying, verify the rule for the property’s state and locality, check the contractor’s credentials, and get a written schedule with dollar amounts and clear work or materials triggers. Do not treat any percentage as a nationwide standard or pay the full project price up front.
