Labor rules do not attach to every construction project just because public money is involved. Start with the project contract, funding statute or program, applicable wage determination, and jurisdiction; then identify the requirements that flow through each tier. Federal prevailing-wage, trafficking, safety, and worker-classification rules have different triggers and scopes, and state or local requirements may apply alongside them.
Does Davis-Bacon apply to every publicly funded construction project?
No. Davis-Bacon requirements apply when the contract or funding program is covered by the Davis-Bacon Act or a Related Act—not automatically to every project receiving a federal grant, loan, or other public funds. The U.S. Department of Labor’s Building Infrastructure with Jobs (BIL) construction FAQ says coverage depends on whether legislation specifically imposes prevailing-wage requirements or funds an already covered program. Confirm the governing statute and contract rather than relying on the funding source alone.

For a covered Davis-Bacon prime contract, the FAQ identifies a $2,000 threshold. When the prime contract meets coverage requirements, its subcontracts and task orders are covered even if their individual values are below $2,000. In some circumstances, multiple contracts may be treated together when they are closely related in purpose, time, and place.
Which workers and work are covered?
Davis-Bacon generally covers laborers and mechanics performing construction work at the site of the work on a covered project. Coverage follows the work and applicable law, not simply the label on a worker’s tax form or contract. The DOL FAQ says a worker paid on Form 1099 may still be subject to Davis-Bacon wage and certified-payroll requirements.

How do contractors determine the right wage?
Use the wage determination applicable to the project and pay covered workers the prevailing wage for the classification matching the work they actually perform. Wage determinations are project-specific and may change, so verify the applicable determination in the contract and check for updates.
If the applicable determination does not list a classification needed for the work, use the Department of Labor’s conformance process to request an appropriate classification and rate. Do not substitute a rate from a different wage determination.

What payroll records and reports are required?
On covered work, contractors and subcontractors must furnish required weekly payroll information and keep supporting records. Payroll monitoring should allow the contractor to verify that each worker’s reported classification matches actual duties and that the applicable rate was paid.
- Record worker identity, classification, hours, rates, deductions, and wages paid as required by the applicable rules.
- Include covered workers paid on Form 1099 when required; that payment arrangement alone does not remove Davis-Bacon obligations.
- Compare reported classifications and rates with the project wage determination, and investigate discrepancies or missing classifications.
Funding agencies and recipients may review records, visit sites, or interview workers, and program rules govern retention. Consult the contract and program requirements for the records, reporting format, and retention period that apply to a particular project.

What must primes pass down to subcontractors?
For covered Davis-Bacon work, include required labor-standards clauses and the applicable wage determination in subcontracts, and require the same requirements to flow down to lower tiers. The DOL’s October 2023 fact sheet describes these obligations but is explanatory guidance, not a document with the force and effect of law; the governing regulations and contract clauses control.
The prime contractor remains responsible for subcontractor and lower-tier compliance and should oversee performance, including payrolls and prevailing-wage payments. Inadequate flow-down can expose an upper-tier or prime contractor to consequences such as back-wage liability or debarment in appropriate circumstances.

What if state or local prevailing-wage laws also apply?
A project can be subject to federal and state or local prevailing-wage rules at the same time. The DOL BIL FAQ says that, classification by classification, contractors should pay whichever applicable rate is higher and meet whichever requirements are more protective when both regimes apply. Check the project documents and the rules of each relevant jurisdiction; federal guidance does not replace a jurisdiction-specific review.

The Federal Acquisition Regulation (FAR) prohibits specified trafficking-related conduct within federal contracting. Separate compliance-plan and certification requirements apply only in defined circumstances—not to every construction supplier. Under FAR 22.1701 and 22.1703, those additional requirements cover qualifying portions involving non-commercially available off-the-shelf (non-COTS) supplies acquired outside the United States or services performed outside the United States when the estimated value exceeds $700,000. The FAR text displayed as FAC 2026-01, effective March 13, 2026, also specifies due-diligence representations and annual certifications in the stated circumstances.

Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What construction safety duties affect the supply chain?
Under OSHA’s construction standard, employers must initiate and maintain programs needed to comply with applicable safety requirements. The standard calls for frequent and regular inspections of jobsites, materials, and equipment by competent persons designated by the employer, and restricts machinery operation to employees qualified by training or experience. Apply the standard and any more specific construction rules to the actual work and hazards.
Is a worker paid on Form 1099 necessarily an independent contractor?
No. Tax or contract labels do not settle worker status. For Fair Labor Standards Act (FLSA) purposes, the Department of Labor describes a fact-specific economic-reality analysis that considers the whole activity and whether the worker is economically dependent on the putative employer, rather than treating one factor as decisive. State tests and other laws may differ.

The DOL FLSA Advisor notes that guidance was revised in connection with a final rule effective March 11, 2024, and says the guidance will be updated. Because worker-classification rules and their status can change, check current federal and state requirements and obtain project-specific legal advice when classification or remedies are uncertain.
How should a project team organize compliance?
- Establish coverage: Review the funding statute or program, prime contract, incorporated clauses, and jurisdiction before treating a project as Davis-Bacon-covered.
- Set the applicable standards: Identify the current wage determination, covered classifications, and any state or local requirements for the project.
- Flow requirements through the chain: Put required clauses and wage determinations in subcontracts and require lower-tier flow-down.
- Check performance weekly: Review payroll information against actual duties, hours, classifications, rates, deductions, and wages paid; follow up on anomalies and missing classifications.
- Keep records ready for review: Retain payroll support and other required records under the applicable contract and program rules, and be prepared for agency review, site visits, or worker interviews.
- Check distinct obligations separately: Assess FAR trafficking provisions, OSHA construction duties, and worker-classification requirements under their own triggers rather than assuming Davis-Bacon coverage answers them.
For uncertain coverage, worker classification, or potential remedies, consult counsel familiar with the project’s funding and jurisdiction. Requirements may change; verify current wage determinations, contract clauses, FAR text, and state or local rules for the work at hand.
