There is no single rule that makes either the builder or contractor pay whenever a construction project in India runs late. A homebuyer’s delayed-possession claim against a promoter follows the Real Estate (Regulation and Development) Act, 2016 (RERA); a project owner’s dispute with a contractor usually turns on the contract, the cause of delay, and the evidence.
First identify the parties and the legal route

These routes should not be conflated. RERA addresses the relationship between an allottee and promoter in a covered real-estate project. In a construction procurement dispute, the contract’s time, notice, extension, damages, and dispute-resolution terms are central. The Indian Contract Act provides a framework for compensation for breach; it does not make a particular payment automatic just because a deadline was missed.
Can a homebuyer get compensation if the builder delays possession?
Under section 18(1) of RERA, when a promoter fails to complete or hand over possession in accordance with the agreement for sale by its specified date, an allottee who chooses to withdraw may seek return of the amount received, with prescribed interest and compensation as provided under the Act. An allottee who remains in the project may claim interest for each month of delay until possession is handed over.
The applicable prescribed interest rate depends on the relevant state’s rules. There is no single monthly rate that should be stated as applying throughout India. Section 19 also gives allottees rights to project information, including stage-wise completion schedules. The agreement, project circumstances, applicable state rules, and the relevant authority’s process all matter to an individual claim.

What happens if a contractor misses the completion date?
For an owner-employer and contractor, the first step is to read the executed contract and any amendments. A missed date alone does not determine who bears the cost. The parties’ rights depend on what caused the delay, whether the contract provides relief for that cause, and whether the required notices and procedures were followed.
- Contractor-attributable delay: The contract may allow the employer to impose liquidated damages, subject to its wording, any cap, and the legal rules on compensation for breach.
- Employer-caused delay: The contractor may be entitled to an extension of time and, if the contract and evidence support it, additional costs.
- Events beyond either party’s control: The contract determines whether these events qualify for an extension, cost relief, both, or neither.
Sections 73 and 74 of the Indian Contract Act, 1872 concern compensation for loss or damage caused by breach and compensation where a sum is named or a penalty stipulated. A liquidated-damages clause is not, by itself, proof that the full stated amount is payable. Contract language, causation, notices, and the evidentiary record remain relevant.

How do liquidated-damages rates vary?
Rates found in a government release or an individual contract are examples, not a national default.

The different figures are a reason to check the actual agreement rather than assume a standard rate. The reported URC Construction v. Airports Authority of India dispute also illustrates that extension, escalation, and prolongation claims depend on the wording and administration of the parties’ contract. An extension—particularly one described as provisional or reserving rights—does not by itself settle every question about liability or damages.

When can a contractor claim extra costs for employer-caused delay?
Where the employer’s actions prolong the work, a contractor may seek costs associated with the extended period, but the claim is not automatic. A 2021 article by CPWD Superintending Engineer Swapnil Pathak identifies possible heads such as increased labour or material costs, extended site overhead, idle machinery or labour, productivity loss, head-office overhead, and profit. Whether any head is recoverable and how much can be established depend on the contract, proof, and circumstances.

- the contract, amendments, programme, and approved extensions;
- timely notices, employer instructions, variation orders, and extension correspondence;
- dated progress schedules and contemporaneous analyses of the delay;
- invoices, payroll, site-overhead records, and evidence of idle resources or lost productivity.
Keep records tied to particular events and periods. A total-cost figure without evidence linking the extra time and expense to the alleged cause may not establish the claim.

For an allottee and promoter
- Identify the possession date in the agreement for sale and whether the project and allotment fall within the relevant RERA framework.
- Determine whether the allottee intends to withdraw or remain in the project; section 18 provides different remedies for those choices.
- Check the applicable state rules for the prescribed rate and the relevant authority’s process.
- Preserve the agreement, payment records, project communications, and possession-related correspondence.
For an employer and contractor
- Check the completion date and milestones, notice deadlines, extension-of-time procedure, and qualifying delay events.
- Read the liquidated-damages rate and cap alongside exclusions, variation provisions, and dispute-resolution terms.
- Build a dated record of instructions, notices, progress, extensions, resources, and costs.
- Separate delay periods by cause. A claim or deduction should connect the relevant event to the time or loss said to have resulted.
No national statistic on construction-delay frequency or compensation outcomes is established by the cited materials. Nor do the example contract rates establish what is payable in a particular dispute. Liability and recovery depend on the governing route, applicable rules or contract, the cause of delay, and the supporting evidence.
