The City of Bayswater adopted a tree retention policy on 26 August 2025, passing it by a 5–4 vote, according to PerthNow. The reported compromise targets some mature trees affected by larger developments and subdivisions, while excluding properties with a single house from the approval requirement described in the report. The City confirms adoption subject to minor modifications; anyone assessing a particular site should check the final policy and its application before removing or interfering with a tree.
What did Bayswater Council decide?
The City’s policy-review page records that Council considered submissions and adopted the advertised policy, subject to minor modifications, on 26 August 2025. PerthNow reported the vote as 5–4 on 5 September 2025. The news report describes the intended effect and key thresholds, but the City’s available review and FAQ pages do not establish every operative clause or any later amendment. The report should therefore be read as a summary, not as a definitive legal test for a property.
The policy followed a draft consultation launched in November 2024. That announcement described proposed amendments to provide greater protection for existing private trees and support canopy in new developments; it was not the final policy.
Which trees and properties are covered, according to the report?
Reported regulated-tree dimensions
PerthNow described a regulated tree as one that is more than 8 metres tall, has a trunk circumference of at least 1.5 metres and a canopy of 6 metres, and is not a weed. These are the dimensions reported in 2025, not a substitute for checking the exact definitions and measurement rules in the final adopted policy.

Reported approval trigger and single-house exclusion
The report says development approval is required to remove or interfere with a regulated tree, and that the policy does not apply to properties with a single house. It describes the policy as aimed at larger developments and subdivisions. The precise result for an individual property may depend on the final clauses, the site’s zoning and development activity, and which authority makes the decision.
For those reasons, the report alone cannot answer whether a particular owner needs approval. Check the final policy and seek confirmation from the City before acting. Developers should likewise confirm the requirements for the site and decision-maker rather than assume every large tree is covered.

Why was the policy described as a compromise?
Deputy Mayor Elli Petersen-Pik presented the measure as a limited step rather than a blanket ban on tree removal. As quoted by PerthNow, he said: “This policy in front of us is not perfect, it will not capture all trees, it should not capture all trees and we will not stop all free canopy being lost on private property. That’s not the intention,” adding, “But we will hopefully stop some.”
Mayor Filomena Piffaretti raised concerns about restrictions on private land. PerthNow quoted her saying government should “keep their hands off” people’s private property and: “It’s concerning to me when I hear comment that people should be prevented from cutting down a tree in their backyard.” She also called the proposal a “compromised position,” noting that some wanted stronger protections and others wanted less.

Other councillors argued the measure did not go far enough. Councillor Nat Latter said it did not have the impact she wanted, including because it “does not prevent people from cutting down a tree in their backyard.” Councillor Giorgia Johnson told PerthNow that most calls to her office concerned development sites where trees were cleared, and said tree canopy mattered to neighbourhood amenity. She also objected that many trees would remain unprotected in single-residential development and where the decision-maker was not the City.
What does the policy mean for a construction or subdivision project?
The reported scope is selective: a qualifying tree may trigger approval in the development context described by PerthNow, but the report says single-house properties are outside that requirement. It also notes limits where another decision-maker is involved. Do not treat the reported dimensions as the only site test or assume that City approval is the only relevant requirement.

- Identify the proposal type and whether it involves development or subdivision.
- Check the final adopted policy for tree definitions, measurement method, exemptions and application to the site.
- Confirm the decision-maker and approval pathway for the proposal with the City.
- Establish whether the planned work is removal or another form of interference covered by the policy.
This sequence is a prudent way to verify scope, not a complete statement of the City’s application process or a replacement for the final policy.

The City says it is working toward 20% canopy coverage by 2035 and encourages private landowners to plant trees. Its guidance recommends considering a tree’s mature size, available space, and distance from buildings and services, and provides suggested species and planting advice. That planting guidance is separate from the retention policy and does not change whether approval is required for a particular removal.

PerthNow quoted Petersen-Pik as saying that “more than 80 per cent” of tree canopy had been lost on private land. The report does not identify an underlying study or original statistical source for that figure, so it should be understood as his stated rationale, not as an independently verified finding.
