Assuming the house is in Vietnam, the absence of a construction permit does not by itself rule out certification of house ownership. The route depends on when the house was completed or held, whether a permit was legally required, what ownership documents exist, and whether the house and land face disputes or other restrictions. These rules concern certification of the house; they do not automatically establish rights to the underlying land.
Which rules apply?
This article addresses household and individual house owners under Vietnam’s 2024 Land Law, based on an English integrated text published by Thư Viện Pháp Luật, a legal-document repository. Article 148 sets out evidence and routes for certifying house ownership; Article 151 identifies some cases where a certificate is not issued. The English text is not an independently verified official English translation. Confirm the current Vietnamese-language official text and the procedure used by the competent local authority before acting.

The applicant category matters: the provisions discussed here concern households and individuals, and should not be assumed to apply identically to companies or other applicants. Certification of a house and recognition of land-use rights are separate questions.

What ownership evidence may be relevant?
Article 148 lists instruments that can support certification, including a construction permit where one is required, certain records of house ownership or transactions, and an effective decision of a court or competent authority. The right evidence depends on the history of the house; a missing permit is not the only issue the authority may assess.

Purchased, donated, exchanged, or inherited houses
For a house acquired by purchase, donation, exchange, or inheritance from July 1, 2006 onward, Article 148 and Article 31 of the implementing decree refer to a written transaction document under housing law. If the house was purchased from a real-estate business that built houses for sale, the relevant evidence is the sale or purchase contract.
The decree describes different evidence for some older transfers, including commune-level certification. Because the applicable proof turns on the transaction date and history, do not assume that the post-July 1, 2006 document rule covers every transfer.

No listed ownership document
For Vietnamese individuals without the specified house-ownership papers, Article 31 of the implementing decree describes written confirmation from the commune-level People’s Committee. Depending on the house’s completion date, the confirmation concerns when construction was completed and whether it complied with the applicable planning conditions. For a house completed from July 1, 2006 onward, the decree calls for confirmation that it was not subject to a construction permit and met the planning conditions described there.

What if the house owner does not own or hold rights to the land?
A house owner who is not the land user may need to provide house-ownership evidence plus documentation establishing a lawful basis for building on the parcel. Article 148 and Article 31 refer to documents such as a land lease, capital contribution agreement, business cooperation agreement, or written consent from the land user to construct the house. The relevant agreement or consent must be notarized or certified as required, and land-use-right documents are also required under the implementing text.
House ownership certification should not be treated as a grant of land-use rights. The applicant’s position on the land must be established separately.

How to assess the likely route
The following is a general reading of the cited provisions, not a complete application checklist. Local forms, evidence requirements, and handling can vary.

Establish that the property is in Vietnam and that the applicant falls within the household or individual provisions discussed here.
- Establish the house’s history. Identify when it was completed or held, how it was acquired, and whether there is a dispute over the house.
- Determine whether a permit was required. Check the rules applicable to the house’s location, construction type, and relevant time. Do not infer exemption merely because no permit is available.
- Collect existing ownership and transaction evidence. Locate permits, purchase or other transaction documents, inheritance or donation papers, and effective court or competent-authority decisions that may apply.
- Ask about the appropriate written confirmation if documents are missing. Ask the competent commune-level body about confirmation of completion date and planning compliance. If a required permit was not obtained, ask the district-level construction authority about its written determination that the house meets conditions for existence.
- Establish the applicant’s land position. If the applicant is not the land user, identify the required agreement or consent and the land-use-right documents.
- Check for other barriers. Review disputes, land restrictions, planning issues, and other disqualifications before treating certification as likely.
What can prevent certification?
Meeting a route for a house without a permit does not guarantee that a certificate will be issued. Article 151 of the 2024 Land Law lists cases where title is not issued, including certain land that is disputed or subject to enforcement measures and specified categories of property attached to land. The particular land status and any other statutory restriction therefore need to be checked alongside house evidence.

The cited provisions do not establish a universal processing timeline, fee schedule, application form, or evidence checklist for every locality. They also do not say that paying a fine alone resolves ownership certification, or that a permit can always be obtained retroactively.
