Building Permit vs. Zoning Approval: What Each One Allows

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

In brief: Zoning approval answers whether a proposed use and site arrangement fit local land-use rules. A building permit authorizes construction under approved plans and applicable building and safety codes. A project may need both, one, or a sequence of related approvals, and zoning review may be integrated into the building-permit application or handled separately. The only reliable way to identify your requirements is to describe the property and proposed work to both your local planning or zoning department and your building department before starting.

The core difference

Think of the two reviews as answering different questions about the same project:

As an Amazon Associate I earn from qualifying purchases.

  • Zoning approval: “Is this use and site development allowed here?”
  • Building-permit approval: “May this construction proceed under the approved plans and applicable construction and safety requirements?”

Zoning rules typically address land use, density, height, setbacks, parking, lot coverage and, in some locations, design requirements. Building-permit review addresses how the work will be constructed, including the building and safety requirements that apply to the plans. The City of Berkeley summarizes the distinction this way: “Most development is regulated under two different codes: the Zoning Code and the Building Code.”

Those questions overlap, but neither approval automatically substitutes for the other. A zoning approval does not, by itself, give you permission to begin construction. Conversely, a building permit does not necessarily cure a use, height, setback or parking conflict under the zoning code.

What zoning approval decides

Land use and site fit

Zoning review examines the relationship between the proposal and the parcel’s land-use rules. Depending on the municipality and zoning district, reviewers may check whether the proposed use is permitted, conditionally allowed or prohibited; how many homes or other units are allowed; the building’s height and scale; required setbacks from property lines; parking; lot coverage; and applicable design standards.

This review can apply to more than a new building. A change of use, an addition, a new parking arrangement, an exterior site improvement or another change to how land is used may trigger zoning review even when the construction itself is limited.

Administrative clearance or discretionary approval

A conforming, by-right proposal can often receive an administrative zoning clearance after staff verify that it meets the applicable rules. Other proposals require additional planning review because they do not fit the rules automatically or because the local code requires a decision-maker to exercise judgment. Los Angeles, for example, describes by-right, administrative and discretionary planning routes. A discretionary entitlement must be approved before a building permit can be obtained there.

“By-right,” “administrative,” “conditional,” “variance,” “development permit” and similar labels are local terms. Do not assume that a label used in one city has the same legal effect in another.

What a zoning document does—and does not—authorize

A zoning certificate, clearance or permit documents that the land-use proposal satisfies the applicable planning rules, subject to its conditions. It may establish that the proposed use is allowed, confirm the approved site arrangement or authorize a specified zoning-related improvement. It is not necessarily construction authorization. Portland identifies zoning permits for some development that does not require a building permit, which illustrates why the two approvals cannot be treated as interchangeable.

What a building permit decides

Construction under approved plans

A building permit is the local authorization to carry out the construction described in the submitted plans after the required technical reviews. The building department checks the work against the building code and related safety requirements that apply to the project. Depending on scope, those reviews may involve structural, mechanical, electrical, plumbing, energy, accessibility, fire or other specialist requirements.

Los Angeles describes zoning plan check as one component of a building-permit plan check alongside structural, mechanical and other safety reviews. That arrangement shows how zoning and building-code review can appear in one permit workflow without becoming the same legal question.

Scope matters

A permit covers the work and plans approved by the issuing authority. Changing the footprint, structural system, use, exterior configuration or other material feature can require revised plans, an amended permit or a new approval. The permit does not grant a blanket right to perform unrelated work elsewhere on the property.

Construction authorization is still local

Some jurisdictions require a separate zoning approval before accepting or issuing a building permit for a particular project. Others perform zoning clearance as part of the building-permit application. Still others use a planning approval with its own conditions and then require a separate building permit. Ask the building department exactly what must be approved before work, inspections and occupancy can proceed.

Building permit vs. zoning approval: side-by-side

Question Zoning approval or review Building-permit review
Primary decision Whether the proposed use and site development fit local land-use rules. Whether the described construction may proceed under approved plans and applicable building and safety requirements.
Typical rules examined Use, density, height, setbacks, parking, lot coverage and some design requirements. Building, structural, mechanical and other construction and safety requirements applicable to the work.
Projects that can trigger it New development, additions, changes of use, site work, parking changes and other land-use changes; exact triggers are local. Construction or alteration that the jurisdiction subjects to a building permit; exact exemptions and thresholds are local.
Separate or integrated? May be a separate zoning permit or clearance, or may be completed within a building-permit application. Usually issued through the building department after required plan reviews, which may include zoning clearance.
Typical sequence May precede a building permit, run concurrently with it or be unnecessary for a particular scope; the municipality determines the sequence. Must be obtained before performing work that requires it; prerequisites can include planning approvals and approved plans.
Decision path May be administrative/by-right or may require discretionary planning action. Technical plan review and permit issuance under the adopted construction codes, with additional reviews as required.
Does it alone authorize construction? No. A zoning approval is not automatically construction authorization. Only for the permitted scope and subject to inspections and other local requirements.

The table describes the distinction illustrated by municipal guidance; it is not a universal form or naming system. Your city or county may combine steps, use different titles or require additional approvals.

How the approvals can relate to each other

Integrated zoning clearance in a building-permit application

Berkeley says zoning review may occur with the building-permit application. For a by-right project, approval can constitute a Zoning Certificate. In this model, one application may be routed to multiple reviewers, but the zoning and building-code questions remain distinct.

Separate zoning approval before the building permit

Some projects need a separate zoning permit or planning entitlement first. Berkeley notes that certain projects require a separate zoning permit. Los Angeles states that a discretionary entitlement must be approved before a building permit can be obtained. If your proposal needs that kind of decision, do not assume that filing a building-permit application starts construction authorization.

Zoning work without a building permit

Portland uses zoning permits for certain development that does not require a building permit, including specified parking-area work and some site improvements. The city’s examples and thresholds are local. This is why asking only “Do I need a building permit?” can miss a planning requirement.

Concurrent or staged review

A municipality may allow applications to move through planning and building review at the same time, or it may require one approval before the next review begins. Even when applications are filed together, a condition in the planning approval may have to be satisfied before permit issuance, inspection or occupancy. Obtain the jurisdiction’s written sequence for your project rather than relying on a general rule.

What the municipal examples show

Berkeley, California

Berkeley expressly distinguishes its Zoning Code from its Building Code. Its zoning rules address matters such as use, setbacks, height, parking and some design requirements, while building-code review addresses construction standards and safety. Berkeley says zoning review may be part of a building-permit application, with approval constituting a Zoning Certificate for a by-right project, while some projects require a separate zoning permit.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For a Berkeley project, ask whether the proposal is by-right, whether zoning clearance will be handled inside the building-permit application and whether a separate zoning permit is required before that application can proceed.

Los Angeles, California

Los Angeles zoning review covers subjects including density, use, scale, height and setbacks. A by-right project may be submitted to the Los Angeles Department of Building and Safety for a building permit with zoning clearance among the required reviews. Other projects may need administrative or discretionary planning review. Los Angeles states that a discretionary planning entitlement must be approved before a building permit can be obtained.

The practical question is not merely whether a permit application exists; it is which planning route applies and whether any entitlement or condition must be completed first.

Portland, Oregon

Portland’s guidance demonstrates that a zoning permit can apply to development that does not require a building permit. Its examples include specified parking-area work and some site improvements, with local thresholds and definitions. A small physical change can therefore have a planning requirement even when it is exempt from building-permit review.

Calgary, Alberta

Calgary uses the term “development permit” for a planning approval in guidance about its review process. The guidance describes a development permit as relevant where a proposal does not meet land-use bylaw rules or where the authority otherwise requires one. “Development permit” is not interchangeable with “zoning permit” or “building permit” everywhere; confirm what the local Calgary approval covers and what additional permits remain necessary.

How to determine what your project needs

  1. Describe the proposal precisely. Write down the property address, existing and proposed use, floor area, number of units, height, footprint, setbacks, parking changes, site work, utilities and whether the work changes structure or occupancy. Include photographs or a simple sketch if available.
  2. Contact the planning or zoning department first. Ask what zoning district applies, whether the use is permitted, what site standards will be checked and whether the work requires a zoning clearance, zoning permit, development permit, conditional approval, variance or other planning action.
  3. Ask whether the route is by-right or discretionary. Find out whether staff can approve the proposal administratively or whether a hearing, public notice, design review or another decision-maker is involved. If discretionary approval is required, ask what must be approved before a building-permit application can be issued.
  4. Contact the building department with the same description. Ask whether the proposed work requires a building permit and which trade or specialty permits may also apply. Confirm whether zoning clearance is collected through the building-permit application or must be obtained separately.
  5. Request the sequence and prerequisites in writing. Ask which approvals can be filed concurrently, which must come first, what documents each department needs and whether conditions must be satisfied before permit issuance, inspections or occupancy.
  6. Prepare coordinated plans. Keep the site plan, floor plans, elevations, use description and technical drawings consistent. A change made to satisfy one review can affect setbacks, height, area, structure, egress or other requirements in the other review.
  7. Submit the correct applications and pay the applicable fees. Fees, forms, review stages and payment timing are set by the local authority. Do not infer a fee, deadline or processing time from another city.
  8. Read every condition and approval limit. Record the approved use, dimensions, conditions, expiration dates, required inspections and any restrictions on construction or occupancy. Ask before deviating from the approved plans.
  9. Start only after all required construction authorizations are issued. A planning approval, zoning certificate or application receipt is not proof that construction may begin. Verify that the building permit and any other required permits are active for the work you intend to perform.

Common mistakes and how to avoid them

“I have a zoning approval, so I can build.”

A zoning approval addresses land use and site compliance. It may not authorize structural work, utilities, life-safety systems or other construction. Confirm the building-permit requirement and wait for the applicable construction authorization.

“Every project needs two separate permits.”

Not necessarily. Zoning review may be integrated into a building-permit application, and some zoning permits cover work that does not need a building permit. The number and names of approvals depend on the municipality and scope.

“Zoning always comes first.”

Some jurisdictions require a planning approval before a building permit; others perform zoning clearance during building-permit review. Ask for the local sequence instead of assuming one universal order.

“A building permit overrides a zoning problem.”

Building-code approval does not automatically authorize a use, height, setback, density or parking arrangement that violates zoning rules. Resolve land-use issues through the planning process.

“A small project cannot need planning approval.”

Portland’s examples show that certain site or parking work can require a zoning permit even without a building permit. Size alone is not a reliable test.

“The same permit name means the same thing everywhere.”

Calgary’s “development permit” terminology and Berkeley’s “Zoning Certificate” illustrate why labels need local definitions. Ask what legal decision the document represents and what it does not authorize.

“An application receipt means work can start.”

Filing an application is not approval. Begin only when the authority confirms that all required construction permits and prerequisites are issued for the proposed scope.

Questions to ask your local officials

  • What is the property’s current zoning designation and allowed use?
  • Does the proposal change use, density, height, setbacks, lot coverage, parking or exterior design?
  • Is the proposal by-right, administrative or discretionary under your local process?
  • Do I need a zoning clearance, zoning permit, development permit, variance, conditional approval or another planning decision?
  • Can zoning review be submitted with the building-permit application, or must it be completed first?
  • Does any part of the work need zoning approval but not a building permit?
  • What building, trade, fire, accessibility, energy or other technical permits apply?
  • Which documents, plans and site information are required for each application?
  • What conditions must be met before permit issuance, inspections or occupancy?
  • Which approved dimensions, uses and conditions must remain unchanged during construction?

When professional help may be useful

A straightforward, conforming project may be manageable with direct guidance from the local planning and building departments. A project involving a use change, unusual site constraints, multiple parcels, discretionary review or significant conditions can be harder to coordinate. In those cases, an architect, qualified contractor, permit expeditor or land-use consultant may help assemble plans and track submissions. Hiring one is optional, does not replace the authority’s decisions and does not guarantee approval. Check the person’s local qualifications and experience with the specific municipality.

A practical decision rule

Ask two separate questions before work begins: Is the proposed use and site arrangement allowed? and Is the construction itself authorized under approved plans and safety codes? The first question belongs to planning or zoning review; the second belongs to building-permit review. Because Berkeley, Los Angeles, Portland and Calgary use different combinations of approvals and terminology, provide both departments with the property’s location and a complete description of the work, then follow the written local sequence.
