BSR’s official guidance says applicants for higher-risk buildings must clearly and comprehensively demonstrate compliance with building regulations. In practical terms, the application should identify each relevant aspect of the project, connect it to applicable standards, codes or other documents, and explain why those references apply. Merely listing standards leaves BSR to infer the compliance case. Official guidance on expected application detail and common shortfalls was published on 22 June 2026; applicants should use the regulator’s current guidance and preparation resources rather than assume the reported rejection stance provides a shortcut. How does this relate to legacy applications?
In January 2026, BSR said 29 legacy new-build cases remained. It was assessing whether further engagement and peer reviews could lead to successful outcomes, or whether rejection followed by a fresh submission would be more appropriate. The October report’s emphasis on rejecting only where approval is not realistically achievable is consistent with greater restraint in cases that may still be resolved, but the cited material does not establish a direct policy link between the two accounts. What do recent Gateway 2 figures show?
BSR’s June–August 2026 performance dataset covers England, was updated on 15 September 2026 and is correct as of 31 August 2026. The categories are separate: the percentages and median times below should not be combined into a single Gateway 2 approval rate or treated as a direct comparison of like-for-like projects.

BSR also reported improvement over the year after its Innovation Unit began handling new-build applications: the new-build approval rate rose from 39% to 92%, while median approval time fell from 43 to 22 weeks. For remediation, approvals rose from 47% to 89%, and median decision times fell from 43 to 33 weeks. BSR attributes the trends to operational changes; these figures do not show that the reported rejection stance caused the improvement.

The historical January dataset used a different measure and period. For the 12 weeks ending 23 January 2026, BSR reported 698 decisions, a 16-week median decision time, 15% rejections, 32% approvals, 39% invalid applications and 13% withdrawals. What should applicants do if BSR raises concerns?
The reported approach is not a substitute for a strong compliance submission. Applicants should make the reasoning and evidence easy to assess, using the regulator’s published requirements and addressing identified shortfalls directly. BSR’s published data also reflects distinct outcomes—approval, rejection, invalidation and withdrawal—so an application that is not approved should not automatically be described as rejected.
