BMC reportedly issued a show-cause notice to the L&T-HCC joint venture over the source and transport permissions for material used in backfilling on a section of Mumbai’s Coastal Road. The notice followed an October 1, 2026 inspection near Haji Ali toward PDP Garden. It is an allegation requiring a response—not proof of a final violation. L&T confirmed receiving the notice and said it would address the matter; the outcome has not been established in available reporting.
What prompted BMC’s notice?
Hindustan Times reported that the Brihanmumbai Municipal Corporation’s Solid Waste Management department inspected backfilling work near the Haji Ali Coastal area toward PDP Garden on October 1, 2026. Officials reportedly checked vehicle details and challans and traced the material to private building construction sites in Mumbai. BMC issued the notice to the L&T-HCC joint venture on October 5. The reported concern was not simply that material was reused. BMC reportedly questioned whether it came from a source permitted under the project’s tender conditions and whether the required permissions for transporting it had been obtained. The reporting describes excavation material used for backfilling or reclamation; calling it “construction debris” can obscure an important distinction between excavation material and construction-and-demolition (C&D) waste.
What did BMC ask the contractor to do?
According to Hindustan Times, BMC directed the contractor to stop using the disputed material until clearance was received. The notice reportedly asked the joint venture to provide records and explain why the material should not be rejected or removed at its own cost, and why further action should not be taken. - Transport permissions: valid permissions or NOCs for moving excavation material.
- Royalty records: challans documenting applicable royalty payments.
- Technical suitability: geotechnical test reports for the material.
These are the compliance questions the reported notice raises. The accounts available do not provide the actual notice, the underlying tender wording or the requested records, so they do not establish whether the material met the project’s requirements.
What is known about L&T’s response?
Hindustan Times reported that BMC officials said the contractor had not replied within the stipulated 72 hours. L&T’s spokesperson confirmed receipt of the notice and said the company was committed to compliance and resolving the matter promptly. The Times of India reported that BMC could take further action without an additional notice if it did not receive a satisfactory reply. Available reporting does not establish whether BMC later made a final finding, whether the material was removed, or what action followed.

The Times of India reported in April 2026 that BMC’s standard operating procedure distinguishes excavation material, such as soil, murum and earth, from C&D debris and requires them to be segregated at source. Its account describes requirements including vehicle tracking and project waste-management plans, and says the SOP provides for a maximum penalty of ₹25,000 per vehicle per instance for non-compliance. It also says BMC encouraged reuse of excavation material within city projects. That citywide reuse policy does not by itself show that this material source or its transport was authorized. In separate reporting, The Times of India said BMC began imposing a ₹25,000 penalty per violation from October 12, 2026 on vehicles transporting construction and excavation waste without an authorised active tracking system. This is a separately reported tracking-system penalty; it should not be conflated with the broader SOP penalty. The underlying BMC circular or notice is not reproduced in the available reporting. BMC’s official C&D Waste Services page lets residents request authorised collection and says dropping C&D waste is illegal. That public disposal guidance does not determine the permissions governing excavation fill for a major infrastructure project.

What remains unresolved
The available accounts summarize rather than reproduce the show-cause notice, project tender clause or any relevant court directions. They also do not establish the contractor’s full reply, BMC’s final determination, the material’s test results or the status of any disputed fill. Until those records or a final decision are available, the reported issue should be described as a dispute over source authorization, transport permissions and documentation—not as a proven unlawful disposal or a finding that the material was unsafe.
