A below-grade waterproofing warranty is only as broad as its written promise. A “lifetime” heading may cover one treated foundation wall while excluding the slab, wall-floor joint, drains, excavation, interior finishes, or leaks caused by grading and hydrostatic pressure. Before relying on any warranty, identify who issued it, map the exact assembly and leak paths it covers, read every prerequisite and exclusion, and check the remedy, dollar cap, notice procedure, and transfer rules.
What a below-grade waterproofing warranty actually is
Waterproofing warranties are contracts or legal guarantees, not general promises that a basement will remain dry under every condition. The document should identify the party making the promise, the work or material covered, the period of coverage, and what the issuer will do if the stated performance fails.

Four kinds of promises commonly appear in a basement project. They can overlap, but they are not interchangeable:
- Contractor guarantee: The installer promises that its specified work will meet stated performance conditions, often subject to maintenance, access, drainage, and notice requirements.
- Manufacturer product warranty: The material maker warrants a listed membrane, coating, drainage board, or accessory. Product warranties may replace material without paying for labor, excavation, interior restoration, or a diagnosis of the leak.
- System warranty: A manufacturer or approved program covers a defined assembly installed according to its details, sometimes requiring registration, an approved applicator, and specified companion products.
- Statutory new-home warranty: Local law may impose a time-limited promise on a builder or new-home vendor. Its scope and deadlines come from the applicable jurisdiction, not from a product brochure.
SOPREMA’s U.S. warranty materials, for example, distinguish platinum and standard foundation waterproofing system warranties from a limited warranty for foundation waterproofing products. That separation illustrates why “manufacturer warranty” is not one universal form. The issued document, project registration, installation method, and stated terms control.

Identify the issuer and the document that controls
Start with the signed warranty, contract exhibits, product data, installation instructions, and any registration certificate. Marketing language such as “lifetime protection” is not a substitute for those documents. Confirm:
- the legal name of the warrantor and the responsible installer;
- the project address, owner, and date coverage starts;
- the products, accessories, and installation details incorporated by reference;
- whether coverage depends on an approved or certified applicator;
- registration deadlines and documents needed to activate coverage; and
- the governing law, venue, and any required dispute process.
If a contractor guarantee and a manufacturer warranty both exist, keep them separate. A product warranty may respond to a material defect while the contractor guarantee addresses workmanship. Neither automatically pays for damage that the text excludes.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesMap the covered assembly and every possible water path
Draw a simple plan of the foundation and mark exactly what was treated. A warranty that names “exterior vertical foundation walls below grade” does not necessarily cover the slab, wall-floor joint, footings, penetrations, window wells, drains, sump equipment, or untreated portions above or below the membrane.
Vertical walls
Look for boundaries: north, south, east, and west elevations; wall heights; steps in the footing; additions; and areas hidden by porches or garages. A defined treated area is easier to enforce than a promise covering “the foundation” without a drawing or measurement.
Floor and wall-floor joint
Water rising through a slab or appearing at the cove joint can have a different cause from leakage through a vertical wall. Unless the warranty expressly includes the slab, joint, underslab membrane, perimeter drain, or a water-control system, do not assume those paths are covered.
Joints, cracks, and penetrations
Check treatment details for construction joints, tie holes, utility penetrations, form lines, cracks, and pipe sleeves. Later drilling, anchors, windows, doors, decks, or other openings may be excluded unless they were approved and resealed under the warranty procedure.

Drainage components
Exterior membranes often depend on free-draining backfill, protection board, footing drains, discharge piping, sump pumps, and functioning outlets. Determine whether those components are included in the warrantied system or merely prerequisites supplied by others.
Read exclusions and prerequisites as carefully as the coverage paragraph
Exclusions define the conditions under which the promise stops. A reviewed Tremco sample residential warranty is a useful example of the level of detail to expect; it is not an industry-wide form or a guarantee of current terms for any project. The sample limits coverage for conditions including:
- cracks or structural defects greater than 1/16 inch, subject to the document’s detailed wording;
- inadequate drainage systems, systems that do not meet local code or good construction practice, or drainage media without functioning drainage;
- grading that fails to carry water away or allows water to enter above the treated area;
- insufficient hydrostatic resistance at the wall base or floor;
- defective or poorly directed gutters and downspouts;
- openings, alterations, or penetrations made after installation;
- use of an unapproved applicator; and
- certain construction techniques identified in the warranty.
These examples show why a claim can fail even when a membrane itself is intact. Before signing, assign responsibility for grading, roof runoff, drain installation, sump operation, backfill, protection during construction, and later penetrations. Ask whether routine maintenance—such as keeping gutters clear and maintaining the discharge line—is a condition of coverage.
Understand the remedy, cap, and costs you may still bear
A warranty can promise a repair without promising to make you financially whole. Find the exact remedy language and identify who pays for each stage:

- excavating and exposing the exterior wall;
- removing and reinstalling soil, paving, landscaping, or decks;
- repairing or replacing membrane and drainage components;
- removing and restoring drywall, flooring, insulation, or finishes; and
- temporary relocation, storage, mold remediation, or consequential damage.
The Tremco sample states a maximum responsibility of $3 per square foot or $10,000, whichever is lower. That formula is a term of that sample, not a market average. A project with expensive excavation or interior restoration could exceed such a cap, so compare the cap with realistic access and restoration costs.
Check whether the cap is per incident, per area, or aggregate over the warranty term. Look for exclusions of consequential, incidental, or indirect losses; a requirement that the issuer be allowed to inspect before repairs; and a right to choose repair, replacement, refund, or another remedy. Do not authorize destructive work before following the notice and inspection procedure unless emergency measures are necessary to prevent immediate damage.

“Lifetime” does not mean every leak forever
“Lifetime” can describe the life of a product, the life of the original owner, or a renewable program subject to registration and maintenance. The operative terms are the start date, duration, covered event, exclusions, cap, and transfer clause. A lifetime label does not automatically extend to all basement surfaces, future owners, or every cause of water entry.
Transfer after a sale
Read transfer requirements before closing. The reviewed Tremco sample allows transfer only when stated conditions are met, including a transfer request and a processing fee submitted within 60 days after the sale closing. Those are sample-specific terms; another warranty may prohibit transfer, require approval before closing, or impose a different fee and deadline. Obtain written confirmation that the buyer is covered and retain proof of submission.

Local law can create rights that are different from a contractor’s promise or a product warranty. The scope, deadline, and procedure depend on the jurisdiction.
Wisconsin example: written basement waterproofing guarantees
Wisconsin Administrative Code ATCP 110.09 defines basement waterproofing guarantees broadly and requires a covered guarantee to be provided in writing before final contract execution. The writing must clearly state the promised performance and period and identify the responsible seller or person. Under that rule, remedial work must begin within 45 days and be completed within six months after notice. The rule permits dampness to be excluded only when the written agreement and bold disclosure meet its conditions. These requirements apply to the regulation’s covered transactions; they should not be generalized to another state.
Ontario example: new-home vendor warranty
Ontario Regulation 892, section 14, provides a qualifying new-home vendor warranty against water penetration through the basement or foundation. Claims are limited to a two-year period ending on the second anniversary of possession. That statutory new-home protection is not the same as a contractor warranty for later waterproofing work and does not establish a two-year rule elsewhere.
For an actual dispute, verify the current text, definitions, limitation periods, notice method, and any non-waivable consumer protections in the place where the property and contract are located.

Code compliance and membrane standards are not the same as a warranty
The 2024 International Residential Code Chapter 4 distinguishes foundation dampproofing from waterproofing. It calls for waterproofing exterior foundation walls that retain earth and enclose below-grade interior spaces where a high water table or other severe soil-water condition is known, subject to the chapter’s provisions. The IRC is a model code, not automatically the law everywhere. Confirm the locally adopted edition, amendments, occupancy classification, and site conditions.
ASTM D7832/D7832M-24 is an active guide covering performance attributes and test methods for reinforced or laminated waterproofing membranes applied to below-grade walls. Its scope excludes, among other systems, cementitious, integral, and bentonite systems and membranes under slabs. ASTM cautions that laboratory results cannot precisely predict installed performance because soil chemistry, design, materials, and workmanship vary.
ASTM’s guide states: “A waterproofing membrane should maintain its watertight integrity for the life of the building in a continuously or intermittently moist environment and may be subject to continuous or intermittent hydrostatic pressure.” That is a performance objective in a standard guide, not a warranty or a promise that a particular basement will remain dry.
How to compare two waterproofing offers
Put the competing documents side by side and answer each question in writing:
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
- Scope: Is it a product-only promise, a contractor guarantee, or a system warranty? Which walls, joints, slabs, drains, penetrations, and elevations are included?
- Cause: Are hydrostatic pressure, cracks, roof runoff, grading, drainage failure, maintenance, and later alterations treated as covered causes or exclusions?
- Remedy: Who diagnoses the leak, excavates, pays for access, removes finishes, and restores the property?
- Limits: Is there a per-area, per-incident, or total-dollar cap? Are consequential damages excluded?
- Duration and transfer: When does coverage start, how long does it last, must it be registered, and can a buyer assume it?
- Claims: What notice method and deadline apply? Must the issuer inspect before repair, and what records must you preserve?
- Jurisdiction: Which statute and locally adopted code apply, and do they provide protections the contract cannot waive?
Prefer a marked site plan and a detailed scope over a broad slogan. If a salesperson’s explanation conflicts with the written warranty, request a corrected document before work begins.
Claim procedure: preserve evidence and follow the contract
- Stop avoidable damage: Protect contents, keep people away from electrical hazards, and take reasonable emergency measures. Record what you did and why.
- Document the event: Photograph or video the water path, date and weather, affected finishes, sump and drain condition, gutters, downspouts, grading, and any recent excavation or penetration.
- Notify the correct party: Use the address, portal, or method specified in the warranty. Include the property, owner, installation date, suspected location, and requested inspection.
- Preserve records: Keep the contract, warranty, registration, invoices, change orders, drawings, maintenance logs, photographs, and correspondence.
- Allow inspection: Do not conceal or permanently repair the suspected area before the issuer has the contractual opportunity to inspect, except for necessary emergency stabilization.
- Request a written determination: Ask which provision applies, whether the claim is accepted or denied, the proposed remedy, the cap calculation, and the schedule for work.
- Escalate carefully: If the response misses a statutory deadline or conflicts with the written promise, consult the applicable consumer-protection agency, building professional, or construction attorney.
Questions to settle before signing
- Does “waterproofing” include the slab and wall-floor joint, or only named vertical walls?
- Who maintains and repairs drains, sumps, gutters, downspouts, and grading?
- What happens if a later contractor drills through the treated wall?
- Is interior damage covered, and is excavation included in the remedy?
- When must a leak be reported, and who pays for diagnosis?
- Can the warranty transfer to a buyer, and what deadline, fee, and approval apply?
- Which local code edition and statutory warranty rules govern this project?
Answer those questions in the contract itself, not only in a proposal or conversation. The strongest warranty is the one that clearly identifies the assembly, the water-entry conditions, the remedy, and the procedure you can actually follow.
