The City of Melville’s 2024 support for Applecross Tennis Club floodlights was a recommendation, not final approval. The Minister for Environment signed the approval on 24 March 2026. It permits 12 towers serving courts 11–14, subject to operating limits and planning conditions; Sunday use is prohibited.
What was approved
The proposal covers 12 lighting towers at Applecross Tennis Club, 30 The Strand, Applecross, within the Swan Canning Development Control Area. Four towers are 10 metres high and eight are 8 metres high. The approved lighting plan is Musco’s plan dated 24 January 2024, and LEDs must not exceed 4000K correlated colour temperature. The City’s notice records the Minister’s approval, while the signed determination sets its scope and conditions: DBCA approval documents.
When the lights may operate
The determination requires timer control and sets different limits for scheduled League/Pennants games and other nights:

These are maximum operating windows, not an entitlement to run the lights throughout them. The no-use and Sunday restrictions apply regardless of the other time limits. The distinction between scheduled competition nights and other nights is part of the Minister’s determination.

Conditions before construction and use
Approval does not mean the club can immediately switch on the lights. The determination requires staged plans and verification:
- Before works: submit a Construction Environmental Management Plan to DBCA and obtain approval.
- Before use begins: obtain approval for an Operations Plan and provide a lighting audit demonstrating that the installation complies with the approval.
- Complete development within the approval period: the approval is valid for two years from 24 March 2026. If substantial on-site works have not commenced within that period, a new approval is required before commencing or completing development.
The approval’s expiry rule concerns commencement of substantial on-site works; the determination also states that a new approval is required before commencing or completing development if that threshold is not met within the two-year period.

How the City’s 2024 recommendation differs from the final decision
In August 2024, Melville Council supported sending a submission in favour of the proposal, subject to limits that included no Sunday use and a 10pm finish on scheduled competition nights. That was the City’s position as a referral body; it did not decide the application. The Minister signed the final determination on 24 March 2026, and DBCA says the application process is complete. The Council minutes and final determination are distinct stages, and the latter controls current operating conditions.
Views, amenity and the environmental assessment
DBCA’s final report considered environmental protection, lighting and noise management, and amenity. It described mitigation measures intended to reduce potential glare to residents and light spill toward the foreshore and river. The report also acknowledged that installing and using the poles would modify adjacent residents’ views. Those are assessment findings and predictions, not evidence of independently measured effects after the lights are in operation.

The phrase “significant views” reflects the wording of contemporaneous coverage, but the approval is not a finding that views will be unaffected. Nor does the available official record establish measured post-installation impacts on residents, wildlife or the river environment.
Why the club and residents disagreed
As reported in 2024, the club said lighting would let members play Tennis West pennants matches on their home courts. Councillors supporting the amended recommendation described it as a balance between club and community interests. Opposing councillors raised residential amenity, river views and wildlife concerns. These were positions expressed in the debate, not verified outcomes of operating the lights.

The City’s consultation record reported 145 submissions: 131 supporting the proposal, 13 objecting and one neither supporting nor objecting. That is a count of submissions received, not a representative survey or a measure of all residents’ views.

In Wilson v Peter Dans, Chief Executive Officer of DBCA [2025] WASC 457, the Supreme Court of Western Australia dismissed an application for judicial review on 31 October 2025. The challenge concerned whether the CEO had properly considered amenity when preparing a recommendation report. The Court addressed the legality of that recommendation process, not whether the floodlights were the best planning outcome; its decision also came before the Minister’s 2026 determination. The reasons state: “I therefore consider that the CEO has asked himself the correct question.”
