Adding second-floor access to a shop starts with a code and site review—not with choosing an elevator. In the United States, some altered facilities are exempt from the federal requirement to install an elevator, but the exemption has defined limits and exceptions. If an accessible route is required, a LULA or platform lift is not automatically an acceptable substitute for a passenger elevator. Have a qualified design professional and the local authority having jurisdiction review the building before selecting equipment or setting a budget.
Does a shop need an elevator to reach its second floor?
Not every two-story shop is required to install an elevator under the federal ADA rules. For certain altered facilities, the elevator exemption applies when the facility is less than three stories or has less than 3,000 square feet per story. The rule has exceptions, including shopping centers and shopping malls, and it does not remove a covered business’s other accessibility obligations. The U.S. Department of Justice sets out the exemption and its exceptions in its Title III regulations.
Whether the exemption applies depends on the actual facility and project. The regulations define a shopping center or mall using the number and arrangement of sales or rental establishments, so a shop that looks independent may still need closer review. The floor’s use—customer sales, employee-only space, storage, or another purpose—also belongs in the project’s accessibility review; the title alone cannot establish the answer.
Federal ADA standards are only part of the approval picture. State elevator rules, local building and fire codes, egress provisions, the adopted code editions, and the project’s classification as an alteration, addition, or new construction may affect what can be installed. Ask the authority having jurisdiction (AHJ)—the local agency responsible for reviewing and approving the work—and a qualified architect or accessibility professional to assess applicability.

Which equipment can provide the route?
First determine what the project is legally permitted or required to use. Then compare equipment that fits that determination. The U.S. Access Board’s Chapter 4 guidance on elevators and platform lifts explains the relevant distinctions.

The Access Board states: “Freight elevators cannot be used in lieu of a passenger elevator to provide an accessible route between stories or mezzanines.” A freight unit should therefore not be treated as a customer-access solution where a passenger route is required.

What building information should you gather?
A field survey gives the design team and elevator contractor the information needed to evaluate feasibility. Gather what is available before requesting recommendations; the final measurements and code analysis should be verified by qualified professionals.
- Building and project: location, number of stories, floor area per story, current use, and whether the work is an alteration, addition, or new construction.
- Second-floor use: whether the space serves customers, employees, storage, or another function, and how it connects to the rest of the shop.
- Potential equipment route: possible shaft or lift locations, floor-to-floor travel, structural openings and capacity, pit depth, overhead clearance, and available utility connections.
- Access and building systems: potential cab or platform clear dimensions, door locations, approach and controls, fire protection, egress, and any construction conflicts.
- Approval and operation: the AHJ, applicable accessibility and elevator code editions, permit sequence, service coverage, and maintenance arrangements.
These details affect both compliance and construction scope. Manufacturer descriptions of retrofit products can help identify possible configurations, but they do not establish that a product is approved for a particular shop.

How should you compare LULA products and other options?
Compare products only after confirming the permitted equipment type. Manufacturer specifications are examples, not independent performance findings or proof of local approval. For instance, Delta Elevator describes its Delta 9000 LULA as a retrofit-oriented commercial product and lists a maximum capacity of 635 kg, a cab size of 1.67 square metres, and a speed of 0.15 metres per second. Federal Elevator describes its Serenus as a hydraulic LULA for new or existing buildings, including low-rise commercial applications. The company lists a standard travel distance of 25 feet, which it says may be increased where code permits. Check the current specifications and confirm the proposed travel with the AHJ. For any proposed system, ask the design professional and contractor to evaluate the product against the building survey and local requirements. Useful comparison points include passenger classification, usable cab or platform dimensions, door locations, pit and overhead, floor-to-floor travel, controls, construction impacts, permitting, service availability, and maintenance. No cost or installation schedule can be estimated reliably without a location, site conditions, defined scope, and contractor quote.
