Pasadena’s October 6, 2026 City Council agenda scheduled a first reading of a proposed ordinance that would exempt qualifying Eaton Fire repairs from the city’s construction tax. The agenda confirms that the measure was set for consideration—not that it passed or is in effect. Until the City confirms adoption and publishes final rules, owners should treat the exemption and its eligibility terms as unconfirmed.
What Pasadena is considering
The proposed uncodified ordinance addresses the construction tax on certain residential repairs related to the Eaton Fire. Pasadena Now reported that the city’s construction tax is 1.92% of the value of structures included in a building, swimming pool, or similar permit. If adopted as proposed, an exemption could reduce the tax on qualifying work. The October 6 agenda does not establish the final scope, effective date, or whether the Council approved the measure. Pasadena Now reported that waiving the tax would reduce city revenue, but the cited fact sheet did not estimate the total fiscal impact. The same report said the Eaton Fire damaged or destroyed 185 structures in Pasadena, most of them single-family homes and accessory structures; it attributed that figure to a City Attorney/City Prosecutor Department fact sheet. Who might qualify—and what remains uncertain
The agenda identifies a proposed exemption for qualifying Eaton Fire repairs, but the final ordinance text was not confirmed in the available municipal materials. As a result, the complete eligibility rules for the tax exemption are not established here. In particular, do not assume that rules for a separate fee-reduction program automatically govern this tax proposal.

Standing-home fee reductions are a separate program
A City agenda recap dated August 17, 2026 described an expansion of fee reductions for eligible standing homes with documented Eaton Fire-related damage. That program specified a home in a mandatory evacuation order or evacuation warning area, owner-occupancy as of January 7, 2025, and a professional report verifying fire-related smoke or ash damage. Earlier rebuild terms are historical context
A proposed 2025 ordinance for rebuilding red-tagged structures included terms such as owner-occupied single-family properties and condominium units, applications by the same owner or a family member, like-for-like reconstruction, and exclusion of new detached structures that did not exist before the fire. It also described tax payment if the property was sold to a non-family member before final inspection. What if an owner sells before final inspection?
Pasadena Now reported that an owner would have to pay the construction tax if the property were sold to a non-family member before final building inspection. Because the final 2026 ordinance text and implementation guidance are not established, owners should confirm the sale condition directly against the enacted ordinance before relying on it or making a sale decision. - Check the City Clerk’s record of council action after the October 6, 2026 first-reading agenda item to determine whether the ordinance was adopted.
- Obtain the final ordinance and confirm its effective date, eligible repair work, applicant and property requirements, and any sale-before-inspection condition.
- Ask the relevant City department how the adopted rules apply to the specific permit and property before including a tax exemption in a project budget.
