Can You Trim a Neighbor’s Tree Hanging Into Your Yard? What to Check First

Whether you can trim a neighbor’s overhanging branches depends on local law. Check the boundary, permits, and tree status before cutting, and consider an arborist for risky work.

Sometimes—but the answer depends on where you live. Some jurisdictions allow you to trim branches that cross onto your property, usually only as far as the boundary and at your expense. That is not a universal rule. Protected-tree rules, permits, uncertain boundaries, tree ownership, and the risk of damaging the tree can all change what you may do. Check your local requirements before cutting; when practical, speak with your neighbor first.

What the rules say depends on your location

There is no single rule for every property. Official guidance from several places shows a common approach—limited trimming back to the property line—but each source applies only within its own jurisdiction.

England GOV.UK says you can trim encroaching branches or roots only up to the property boundary. Permission may be needed for trees in conservation areas or protected by a tree preservation order. Boundary disputes can be difficult. GOV.UK
Florida UF/IFAS describes Florida authority allowing an adjoining owner, at their own expense, to trim encroaching branches or roots up to the property line. The handbook discusses different liability considerations for healthy and dead trees that fall. These are Florida-specific rules, not a general rule for other states. UF/IFAS
Pennsylvania The Pennsylvania General Assembly Local Government Commission’s 2025 Municipal Deskbook says Pennsylvania law recognizes a right to trim overhanging limbs to the property line, even without damage. Arlington County, Virginia The county says no county ordinance requires a neighbor to prune overhanging limbs and recommends discussing the issue. This is county guidance, not a statement of all Virginia law. Arlington suggests considering a qualified arborist’s risk assessment in some cases and checking insurance before work begins. These examples are not interchangeable. Find the rule for the property’s actual jurisdiction before relying on a general “trim to the line” principle.

Check the boundary, tree ownership, and hazards

  • Locate the legal boundary. A fence is not necessarily the surveyed property line. If the line is uncertain, disputed, or the trunk sits on it, pause and seek local property or legal guidance. GOV.UK specifically warns that boundary disputes can be difficult.
  • Assess immediate danger from a safe distance. If a limb appears to pose an imminent threat, contact the appropriate local emergency or tree authority. Do not climb, reach across the boundary, or approach utility lines; get direction from the relevant utility or local authority.
  • Distinguish the limb from the tree’s condition. Encroachment alone does not establish that the tree is unhealthy or that its owner is liable for damage if it falls. UF/IFAS discusses different treatment for healthy and dead trees under Florida law; do not apply those rules outside Florida.

Check permits and other property rules before pruning

Even where limited self-help pruning is recognized, separate restrictions may apply. GOV.UK says permission may be needed for a tree in a conservation area or protected by a tree preservation order. The Texas State Law Library notes that local ordinances may require permits for larger trees or certain species, and that HOA or POA restrictions may apply.

Ask the city or relevant local authority whether the tree is protected, whether a permit is required, and whether it is a street or public tree. Check applicable deed restrictions and association rules as well. Requirements depend on location and tree status, so do not assume a neighbor’s consent alone satisfies them.

How to handle the problem without making it worse

  1. Document what is happening. Take dated photos from your property and note any damage or safety concerns.
  2. Talk with the neighbor where practical. Explain the issue and share photos. Suggest a joint inspection or an arborist’s opinion rather than beginning with a demand. The Texas State Law Library and Arlington County both encourage discussion as a practical first step.
  3. Ask the local authority about restrictions. Confirm protected status, permits, conservation rules, and any public-tree requirements before arranging work.
  4. Choose a proportionate response. If local law permits it and the work is small, reachable from your property, and unlikely to harm the tree, limited pruning may be an option. Keep any cut within the boundary. For large, high, hazardous, or structurally important limbs, consult a qualified arborist instead of attempting the work yourself.
  5. Keep records and seek local advice if needed. Save written communications, permit responses, photos, and any arborist report. For serious damage, a safety issue, or an unresolved disagreement, consult a local lawyer rather than relying on a general rule.

When to bring in an arborist

Get professional advice if the branch is large or high, appears unstable, could affect the tree’s structure, or is part of a dispute about risk or responsibility. Arlington County recommends considering a qualified private arborist’s risk assessment in some cases and checking that the arborist has insurance before work begins. A professional assessment can also help clarify whether the concern is simply overhang or a broader tree-health problem.

For any work, confirm the contractor’s qualifications and insurance, and make sure required permissions are in place. A hand pruning saw is relevant only for small, reachable branches after local rules are checked; it is not a reason to tackle hazardous or elevated work yourself.
