Use a variance when your project generally fits the current zoning district but cannot meet a specific rule such as a setback, height, lot-coverage, parking, fence, or buffer standard. Ask about rezoning when the proposed use or density is not allowed in the parcel’s current district. That is the usual U.S. starting point, not a parcel-specific legal conclusion. Definitions, eligibility rules, decision-makers, findings, notice requirements, and appeal rights come from the applicable state law and local code.
The fastest way to avoid filing the wrong application is to identify the exact rule that blocks the proposal, then ask the local planning or zoning department which process has authority to address it. A project can need more than one discretionary approval, and zoning approval does not automatically authorize construction.

Start with the exact mismatch
Do not begin by choosing a form labeled “variance” or “rezoning.” Begin with the parcel’s current zoning district, the applicable zoning text and map, and a written description of what the project would do. Then identify the precise conflict.

When the use is prohibited or the density is not allowed
If the district does not permit the proposed use at all, or permits it only at a lower intensity than the project requires, ask whether the code provides for rezoning, conditional zoning, a special or conditional use permit, or another use-approval process. A variance may not be able to create a use that the district prohibits. Virginia law, for example, defines a variance as a reasonable deviation from specified lot and building requirements and expressly excludes a change in use; Virginia treats a use change through rezoning or conditional zoning instead. Other states and localities must be checked separately.

When the use is allowed but the design misses a dimensional rule
If the use is permitted but the site cannot comply with a setback, height, lot-coverage, parking, fence-height, buffer, or similar dimensional requirement, ask whether a variance is legally available. First test whether a redesign, lot adjustment, parking arrangement, or other by-right solution can meet the rule. A variance is discretionary relief, not a shortcut around an inconvenient design choice.
When several conflicts exist
A single project can involve both kinds of mismatch. For example, a proposed commercial building might need rezoning for its use and a variance for a side-yard setback. Tell staff every known conflict and ask whether applications can be coordinated, whether one approval must precede another, and whether a comprehensive-plan amendment or site-plan review is also required.
What a zoning variance does
A variance grants limited relief from one or more requirements in the existing zoning ordinance. The parcel remains in its current district; the approval changes how a particular rule applies to that site or proposal. The scope is controlled by the local ordinance and by the legal findings the decision-maker must make.

Requirements differ, but local laws commonly focus on physical conditions of the property rather than the owner’s preference or financial convenience. DeKalb County, Georgia, describes factors including physical conditions, the minimum relief necessary, public welfare, hardship, and consistency with the spirit and purpose of the ordinance. Those are that county’s criteria, not a nationwide checklist.
- Site conditions: unusual lot shape, topography, size, access, or other physical characteristics may be relevant.
- Minimum relief: the request should be no broader than needed to solve the documented constraint.
- Hardship: the code may require a legally defined hardship and may distinguish property-based hardship from a self-created condition or a desire for a more profitable design.
- Neighbor and public effects: drainage, light, noise, traffic, privacy, safety, and impacts on adjoining properties may be examined.
- Ordinance purpose: the request must fit the regulation’s underlying purpose rather than defeat it.
Read the local test before designing the application. A strong architectural plan cannot cure a request that the ordinance makes ineligible for a variance.
Examples of issues commonly routed to a variance
Depending on the local code, examples can include a reduced building setback, a small increase in permitted fence height, relief from a lot-coverage cap, a buffer adjustment, or a parking deviation. The same topic can be handled differently elsewhere, so treat these as examples to discuss with staff, not as an entitlement to relief.

What a variance does not do
A variance does not automatically change the parcel’s zoning district, approve a prohibited use, waive every development standard, or replace building and safety approvals. Conditions may be attached, and the approval may be tied to a specific plan, owner, use, time period, or construction sequence under local law.

What rezoning does
Rezoning changes the parcel’s zoning classification. Maryland’s Department of Planning describes rezoning as a classification change that can alter the uses or density allowed on the property and generally must be enacted by local government through administrative procedures such as public hearings. Once effective, the new district’s rules apply, subject to any conditions and later development approvals.
When rezoning is the likely route
- The current district does not permit the proposed principal use.
- The project needs a different use category, intensity, lot standard, or development pattern that the current district cannot provide.
- The code offers conditional zoning or a planned-development district as the appropriate way to establish the proposed use and commitments.
Rezoning is not a guarantee that the project will be approved. It is a request to change the regulatory framework, so the reviewing body may consider broader planning and public-interest questions than it would for a narrow dimensional variance.
Typical rezoning review
Local factors may include consistency with the comprehensive plan, compatibility with surrounding development, transportation and utility capacity, environmental effects, public services, site design, neighborhood impacts, and whether conditions are enforceable. The exact test comes from the local code and state law. A rezoning may also require a comprehensive-plan amendment if the requested district conflicts with the adopted plan.
Variance and rezoning compared
| Question | Variance | Rezoning |
|---|---|---|
| What changes? | Relief from one or more requirements in the existing ordinance, subject to local authority and findings. | The parcel’s zoning classification changes, potentially changing allowed uses or density. |
| Common trigger | A permitted use or project is blocked by a dimensional standard, depending on local law. | The project needs a district or allowed use different from the current classification. |
| What is reviewed? | Local variance tests such as site conditions, hardship, minimum relief, neighboring effects, and the ordinance’s purpose. | Local rezoning factors such as plan consistency, compatibility, infrastructure, environmental effects, and public review. |
| Who decides? | Often a board of adjustment or board of appeals; confirm the local assignment. | Often a legislative or governing body, sometimes after planning-commission review and recommendation. |
| Plan check | Confirm the requested rule is legally eligible for variance and identify remaining permits. | Confirm that the comprehensive plan supports the change and whether a plan amendment or other approval is needed. |
This comparison is a general framework drawn from state and local examples. It does not replace the ordinance governing your parcel.
A practical decision process
- Locate the controlling documents. Use the local government’s official zoning map, parcel record, zoning code, overlay regulations, adopted comprehensive plan, and application guidance. Confirm the district, overlays, special standards, and any pending map amendments.
- Describe the project precisely. List proposed uses, floor area, units, height, setbacks, lot coverage, parking, access, landscaping, buffers, signs, operating hours, and other regulated features. “A small commercial project” is not specific enough for reliable routing.
- Match each feature to a rule. Record the code section that allows or blocks each feature. Separate use permissions from dimensional, procedural, and performance standards.
- Ask staff for the correct path. Request a pre-application meeting if available. Ask whether the issue requires a variance, rezoning, conditional zoning, special-use approval, administrative adjustment, text amendment, or no discretionary relief.
- Confirm the decision-maker. Ask which board or governing body has authority, whether a planning commission recommendation is required, and who can impose conditions.
- Check plan consistency. Compare the requested district and intensity with the adopted comprehensive plan, future-land-use map, neighborhood plan, and infrastructure policies. A project can be consistent with one document and inconsistent with another.
- Map the parallel reviews. Ask about site-plan or development-plan review, subdivision, access permits, environmental review, stormwater, land-disturbance, historic-preservation, building, fire, health, utility, and sign approvals.
- Prepare evidence for the applicable test. For a variance, document physical conditions, the smallest workable relief, impacts, and ordinance purpose. For rezoning, address plan consistency, compatibility, infrastructure, public services, environmental issues, and enforceable conditions.
- Follow notice and hearing rules. Confirm filing deadlines, required drawings, mailed notices, posted signs, newspaper or online publication, staff reports, hearing dates, and opportunities to respond to conditions or objections.
- Do not rely on an unapproved assumption. Do not start work or commit to construction that depends on discretionary relief until the required approvals are final and any appeal or waiting period has been addressed.
The comprehensive plan and zoning code are different checks
The zoning code answers what is legally permitted today in the district. The comprehensive plan expresses adopted policy about future land use, growth, transportation, housing, environmental protection, and public facilities. New York environmental guidance emphasizes that a proposal can be consistent with one and not the other.

A rezoning request that conflicts with the comprehensive plan may require a plan amendment, a stronger justification, or a different project. Even where the code permits an action, plan inconsistency can influence staff recommendations, commission findings, governing-body decisions, environmental review, and litigation risk. Ask the planning department to identify the applicable future-land-use designation and whether a formal amendment is required.
Who decides, and why the local assignment matters
Authority is not uniform across the United States. New York Department of State guidance notes that municipalities allocate zoning responsibilities among local boards in different ways and may use coordinated review. Confirm the assignment in the local code rather than relying on a neighboring city’s process.
Maricopa County, Arizona example
Maricopa County’s “Routing of Planning Cases – DD-3005-01,” revised May 4, 2026, assigns rezoning decisions to the Board of Supervisors after Planning and Zoning Commission review. It assigns variance decisions to the Board of Adjustment. This illustrates a routing pattern, not a rule for every Arizona jurisdiction or every county.
Maryland example
Maryland’s state planning agency describes rezoning as a classification change generally enacted by the local governing body after procedures such as hearings. Board-of-appeals responsibilities and detailed rezoning criteria operate through local arrangements.
DeKalb County, Georgia example
DeKalb County’s Zoning Board of Appeals guidance lists physical conditions, minimum relief, public welfare, hardship, and consistency with the ordinance’s spirit and purpose among its variance considerations. It also states that the board is not merely deciding whether a project is desirable; it must determine whether the request meets the legal standards for a variance.
“The Board is not only considering whether the project is desirable. It must determine whether the request meets the legal standards for a variance.”

DeKalb County Zoning Board of Appeals guidance
Brevard County, Florida example
Brevard County’s planning and zoning FAQ describes requirements outside the Board of Adjustment’s authority and identifies a separate rezoning path. The practical lesson is to ask staff what the variance board cannot decide, not just what it can.
Other approvals remain after zoning
Zoning relief is only one layer of development authorization. DeKalb County states that variance approval does not replace building, land-disturbance, historic-preservation, development permits, inspections, or other approvals. Similar sequencing issues arise elsewhere.
- Site or development plan: confirms layout, circulation, landscaping, grading, utilities, and engineering details.
- Building and fire permits: address structural, accessibility, life-safety, and code compliance.
- Environmental and stormwater review: may be required for wetlands, floodplains, erosion, drainage, tree removal, or construction disturbance.
- Access and utilities: driveway permits, road improvements, water, sewer, and capacity commitments may be separate.
- Historic or design review: may apply to listed properties, districts, or protected features.
- Subdivision or parcel actions: a lot split, consolidation, easement, or plat can require a separate filing.
Ask whether these reviews run concurrently or depend on a final variance or rezoning decision. Approval of one application does not imply approval of the others.
Common project situations
A house addition crosses the rear setback
If the home and addition remain a permitted residential use and the only conflict is the rear-yard setback, a variance may be the relevant question. The application would need to address the lot’s physical constraints and the minimum relief needed. A redesign that stays within the setback may avoid discretionary review.
A warehouse is proposed in a residential district
A variance is generally not the first assumption when the principal use is prohibited. Ask whether rezoning, conditional zoning, a special-use process, or a different district is available. Review comprehensive-plan consistency, traffic, utilities, noise, lighting, and environmental effects.

The answer depends on the local code. Some jurisdictions allow a parking variance or administrative reduction; others require shared parking, transit credits, a special-use approval, or a different site design. Identify the exact parking rule and its relief mechanism before filing.

A project needs a new district and a height exception
Expect multiple approvals unless the local code provides a unified planned-development process. Ask whether the height issue can be addressed through the rezoning conditions or still requires a separate variance, and confirm which approval must be decided first.
The future-land-use map does not support the requested district
Ask whether a comprehensive-plan amendment is required and whether the jurisdiction will process it with the rezoning. Treat plan consistency as a separate decision question, not as an automatic result of filing a zoning-map amendment.
Frequent mistakes and how to correct them
Calling every exception a variance
Some codes reserve variances for dimensional standards and prohibit use changes through that process. Correction: quote the exact use and dimensional provisions and ask staff to identify the legally available application.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsArguing only that the project is profitable or desirable
Variance boards apply legal findings, not a popularity test. Correction: document the property-specific condition, the smallest relief, measurable impacts, and consistency with the regulation’s purpose.
Ignoring overlays and private restrictions
Floodplain, historic, environmental, airport, corridor, design, and other overlays can add rules. Deed restrictions, covenants, and easements are private or separate constraints that zoning approval may not remove. Correction: obtain a complete title and regulatory review.
Assuming a plan designation equals zoning permission
A future-land-use map or comprehensive-plan category does not necessarily authorize today’s use. Correction: check both the plan and the enforceable zoning text.
Filing before confirming the decision-maker
A rejected or misrouted application costs time and may affect deadlines. Correction: obtain written routing instructions, required forms, filing fees, hearing dates, and completeness requirements from the responsible department.
Recommended Free Tools
Starting construction after a zoning vote
A zoning decision may be appealable, conditioned, or incomplete without site, building, environmental, or engineering permits. Correction: wait until all required approvals are final and permits are issued.
Questions to take to the planning department
- What is the parcel’s current zoning district, overlay status, and adopted future-land-use designation?
- Which exact code section blocks the proposed use or design?
- Is the issue a variance, rezoning, conditional zoning, special or conditional use, administrative adjustment, text amendment, or a by-right redesign?
- Can this jurisdiction grant a variance for the specific rule and use involved?
- What findings must the decision-maker make, and what evidence is persuasive?
- Which board or governing body decides, and is a recommendation required?
- Is a comprehensive-plan amendment needed?
- What notice, hearing, posting, mailing, and publication steps apply?
- Which site, environmental, access, utility, building, fire, historic, stormwater, or subdivision approvals are separate?
- Can applications be coordinated, and which approval must be obtained first?
- What conditions, expiration dates, recording requirements, or appeal periods apply after approval?
Bottom line for choosing the route
Choose the route based on the rule that fails, not on which application sounds easier. A permitted use blocked by a site-specific dimensional constraint may fit a variance if the local law allows it and the required findings can be proven. A prohibited use or a materially different intensity usually points toward rezoning, conditional zoning, or another use-approval process. Because authority and standards vary by jurisdiction, have the planning department confirm the complete path before you spend money on plans, hearings, or construction commitments.
