Starting rule: consider a variance when a project needs limited relief from a specific zoning standard and local law allows that relief for the property. Consider rezoning when the project needs a different zoning district, a newly permitted use, or a substantial change to development rights. You cannot simply choose whichever route seems easier: the governing ordinance determines what relief is legally available. Confirm the parcel’s zoning, plan designation and application rules with the local planning department before filing.
The essential difference
Zoning controls what may be built on a parcel and how it may be built. Typical rules address permitted uses, building height, setbacks, lot dimensions, density, lot coverage, parking and access. Ontario describes zoning by-laws as legally enforceable instruments that implement official-plan policy, while Toronto explains that its by-law sets standards used to obtain a building permit.

A variance is generally property-specific relief from one or more of those standards. The zoning district stays in place, but an adjustment or appeals body may allow a narrower setback, a modest height departure or another dimensional exception when the ordinance’s tests are met. DeKalb County, Georgia, describes a variance as limited relief from a specific zoning requirement. Henrico County, Virginia, likewise says its variance process does not change the zoning or the uses permitted in the district.

Toronto identifies changes in land use and significant increases in height or density as examples. Ottawa uses a residential-to-commercial conversion as an example of a zoning by-law amendment, while a smaller setback or height departure may fit a minor variance.

Those descriptions are a practical orientation, not a universal legal definition. One jurisdiction may call a request a minor variance, another a special exception, conditional use, planned development or zone change. Some laws allow only dimensional variances; others restrict or prohibit “use variances.” The parcel’s ordinance controls.
Choose the route by isolating the exact conflict
Start with the rule your proposal does not meet, rather than with the name of an approval. A building-permit problem alone does not identify the correct application.
- Confirm the current controls. Obtain the current zoning map, zoning text and applicable official or comprehensive plan for the parcel. Check overlays, combining districts, historic controls, environmental constraints and any site-specific conditions.
- Describe the departure precisely. Separate use, height, setback, lot coverage, density, parking, access, lot area and other issues. List the required standard, your proposed value and the reason for the difference.
- Ask whether the use is permitted. If the proposed use is prohibited in the district, a variance may be unavailable. Check whether the ordinance instead provides a conditional or special-use permit, or whether a zoning amendment is required.
- Measure the scale of change. A narrowly tailored dimensional departure commonly points toward a variance. A new use, a different district or a substantial expansion of height or density commonly points toward rezoning in the municipal examples cited here.
- Check the plan before choosing rezoning. A zoning change generally must be consistent with the official or comprehensive plan. If the plan does not support the proposed use or intensity, a plan amendment may be needed first, or the proposal may not be supportable.
- Ask planning staff to identify the legal path. Request the local application name, decision-maker, hearing requirements, notice area, submission checklist, appeal rules and whether more than one approval is needed.
When a variance is the better fit
A variance is designed for a limited exception tied to the physical facts of a particular parcel. It is not a general mechanism for changing the community’s land-use policy. The underlying district remains, and the relief should be no broader than necessary.

- A building cannot meet the ordinary side or rear setback because of an unusual lot shape, topography, easement or other physical condition.
- A modest height, lot-coverage or parking adjustment is needed while the use remains permitted.
- Strict application of a dimensional standard would prevent reasonable use of a constrained parcel, and the local law recognizes that circumstance.
These are examples, not automatic entitlements. A proposed use that the district expressly forbids may not be legalized through a variance. California’s reference states that counties and general-law cities may not grant use variances authorizing a land use otherwise prohibited in a zone. Other jurisdictions use different terminology or rules, so read the local text.

Variance standards are jurisdiction-specific, but recurring questions include:

- Does an exceptional physical condition or other special circumstance affect this parcel?
- Is the hardship or practical difficulty caused by the property rather than by the applicant’s avoidable design choice?
- Is the requested relief the minimum necessary?
- Would the approval harm neighbors, public safety, traffic conditions or the public welfare?
- Would the variance preserve the purpose of the zoning ordinance and remain consistent with the applicable plan?
DeKalb County lists five criteria: exceptional physical condition, minimum relief, public welfare, undue and unnecessary hardship, and consistency with the ordinance’s purpose and Comprehensive Plan. Utah’s Ombudsman guidance describes five criteria that include property-specific special circumstances and hardship not necessary to achieve the ordinance’s purpose, and says all five must be met under that framework. Utah’s test should not be transplanted into another jurisdiction.
Henrico County describes a restrictive hardship standard and distinguishes conditional-use permits for uses that are listed as potentially allowed in a district. A desire for a more profitable design, by itself, should not be presented as the required hardship unless the local law expressly treats that fact differently.
What to assemble for a variance application
- The parcel identification, current zoning, survey and a site plan showing property lines, existing structures, proposed work and every required and proposed dimension.
- A table identifying each standard, the code section, the required measurement and the requested relief.
- Photographs, topographic information, easements, utility constraints or other evidence explaining the parcel-specific condition.
- A design comparison showing why a smaller request, relocation or redesign would not solve the problem.
- Statements addressing each local criterion, including neighborhood effects, drainage, fire access, traffic, privacy and compatibility with the ordinance’s purpose.
- Any required owner authorization, application forms, filing fee and notice materials specified by the local office.
When rezoning is the better fit
Rezoning changes the legal framework for the parcel. It is the usual route when the proposal needs a different district, a use not allowed in the current district, or a major change in development permissions. The new classification may apply a full existing district or a site-specific set of rules, depending on local law.
Situations that commonly point to rezoning
- Changing a residential parcel to commercial or another fundamentally different use category.
- Introducing a use that is not listed as permitted or conditionally permitted in the current district.
- Seeking a substantial increase in height, density, floor area or intensity that cannot be justified as a narrow dimensional exception.
- Moving from one district’s development standards to another district’s standards for the entire project.
Ottawa’s guidance illustrates the distinction: a residential-to-commercial change is an example of a zoning by-law amendment, while a smaller setback or height departure may be handled as a minor variance. Toronto describes rezoning as a formal process that changes the rules applying to a property and identifies land-use changes and significant height or density increases as examples.
Plan consistency and broader impacts
Rezoning is a policy and land-use decision, not merely a correction to a site dimension. Ontario says council can consider a zoning change only when the new use is allowed by the official plan. Greensboro lists plan goals, infrastructure effects, the proposed district and proposed conditions among its review considerations. If the plan does not support the requested use or intensity, verify whether a plan amendment must precede the zoning amendment.

Typical rezoning sequence
- Pre-application meeting. Discuss the concept with planning staff and confirm the current district, plan designation, required studies and whether a plan amendment or separate conditional-use approval is needed.
- Define the requested district or text change. Show the current zoning, proposed zoning, permitted uses, dimensional standards and any site-specific conditions.
- Submit the application package. Include the plan set, concept layout, project description, ownership information and studies required by the jurisdiction.
- Staff review and revisions. Respond to comments from planning, engineering, transportation, utilities, fire, environmental or historic staff as applicable.
- Public and stakeholder consultation. Follow the jurisdiction’s notice, posting, mailing, meeting and hearing rules. Toronto describes staff review followed by public and stakeholder consultation.
- Commission or committee recommendation. Some jurisdictions refer the proposal to a planning commission or similar body for a recommendation.
- Legislative decision. The authorized council, board or other legislative body decides whether to approve, modify or refuse the amendment, subject to local law and appeal rights.
Variance and rezoning compared
| Question | Variance | Rezoning |
|---|---|---|
| What changes? | Relief from a specified requirement for a particular property; the underlying district generally remains. | The zoning classification or applicable zoning rules change. |
| Typical issue in the cited municipal examples | A smaller dimensional departure, such as a setback or height adjustment, subject to local criteria. | A use change or substantial change in height or density. |
| Primary legal or planning test | Property-specific criteria often addressing uniqueness, hardship or practical difficulty, minimum relief, public impact and the ordinance’s purpose. | Consistency with the official or comprehensive plan and the jurisdiction’s zoning-amendment criteria. |
| Typical decision process | An adjustment, appeals or board-of-adjustment body; the exact authority and hearing rules vary. | Planning staff and often a commission review, followed by a legislative decision; the exact authority varies. |
| Main caution | It may not authorize a prohibited use, and the criteria can be stringent. | Plan consistency, public review and broader land-use impacts can limit eligibility. |
Official examples—and why they are not universal
Municipal procedures demonstrate the range of possible systems. They should be used as illustrations, not as rules for another parcel.
Toronto, Ontario
Toronto describes a minor variance as an exception from the zoning by-law and rezoning as a process that changes the rules for a property. Its guidance says staff review rezoning applications, consult the public and stakeholders, and make a recommendation to City Council, which decides whether to approve, modify or refuse. The page records a modification date of July 20, 2026.
Ottawa, Ontario
Ottawa identifies a residential-to-commercial change as an example of a zoning by-law amendment and a smaller setback or height departure as a possible minor variance. It advises applicants to discuss the proposal with staff before applying.
DeKalb County, Georgia
DeKalb lists five variance criteria: exceptional physical condition, minimum relief, public welfare, undue and unnecessary hardship, and consistency with the ordinance’s purpose and Comprehensive Plan.

Utah
The Utah Ombudsman’s guidance describes five variance criteria, including special circumstances tied to the property and hardship that is not necessary to achieve the ordinance’s purpose. It states that all five must be met under that framework. A different state or municipality may use another test.
Henrico County, Virginia
Henrico describes a restrictive hardship standard and states that variance relief cannot change zoning or permitted uses. It distinguishes conditional-use permits for uses listed as potentially allowed in a district.
Maricopa County, Arizona
Maricopa County’s directive, revised May 4, 2026, routes rezoning to the Board of Supervisors after a Planning and Zoning Commission recommendation, while variances go to the Board of Adjustment. Another jurisdiction may assign both matters to different bodies or use a different sequence.

Common mistakes and how to correct them
Calling a prohibited use a “small variance”
A small building footprint does not make a prohibited use eligible for a variance. Identify the use classification first and check the ordinance’s use-variance rules. If the use is not allowed, discuss conditional-use and rezoning options with staff.
Applying for a variance to avoid a plan conflict
A variance does not substitute for a plan amendment when the proposal conflicts with the official or comprehensive plan. Test plan consistency before investing in a rezoning package.
Requesting more relief than the site requires
Overbroad requests weaken the minimum-relief case. Redraw the plan, quantify each departure and explain why alternatives do not work.

Even a technically eligible application can face concerns about traffic, drainage, privacy, fire access, utilities or compatibility. Address those effects in the initial plan instead of waiting for public comments.
A practical pre-filing checklist
- Parcel address, legal description and current zoning map designation.
- Official or comprehensive plan designation and any overlay or special district.
- Exact proposed use, building dimensions, density, parking count and access plan.
- Code sections that the proposal meets and those it does not.
- Determination of whether each conflict is a use issue, a dimensional issue or a broader district change.
- Confirmation of conditional-use, special-exception, plan-amendment or other available mechanisms.
- Survey, concept plan, photographs and site constraints supporting the chosen route.
- Required studies, ownership authorization, forms, fees, notice materials and submission format.
- Decision-maker, hearing and consultation requirements, appeal route and expiration or vesting rules.
- List of separate building, site, environmental, access, utility and historic approvals.
Questions to ask the planning department
- What is the parcel’s current zoning and plan designation, including overlays?
- Is the proposed use permitted, conditionally permitted or prohibited?
- Which exact standards are exceeded or not met?
- Does local law allow a variance for this type of request, and what criteria apply?
- Would a conditional or special-use approval be more appropriate?
- If rezoning is required, is the requested district consistent with the plan?
- Would a plan amendment, site-plan review or another approval be required first or in parallel?
- Which body decides the application, and what public notice, consultation and appeal rules apply?
- What plans, surveys, studies and forms must accompany the filing?
- Can staff provide a written zoning determination or pre-application record for the proposed concept?
Bottom line for a proposed project
Use the variance track for legally available, narrowly tailored relief from a specific standard where the property’s conditions satisfy the local variance test. Use rezoning when the project needs a different district, a newly allowed use or a substantial change in permitted intensity, and the proposed change is supportable under the applicable plan. The decisive step is not comparing which application appears faster; it is matching the project’s exact conflict to the mechanism authorized by the parcel’s ordinance. Local planning staff should confirm that route before design, financing or construction commitments are finalized.
