Responsibility usually follows the land or infrastructure involved: a private owner normally arranges investigation and repair on a private parcel, while the authority that owns or maintains a public road, sidewalk, or parcel handles a hazard there. A failing public utility, a known infrastructure defect, or a boundary dispute can create shared or different responsibility. Insurance may pay for private-property assessment or repairs, but only when the policy and facts satisfy its coverage terms. Because sinkhole rules are jurisdiction-specific, first identify the exact location, ownership and cause, then notify the appropriate authority, insurer and emergency services when safety is at risk.
Start with the location and the asset at risk
Do not assign responsibility from a photograph alone. Establish whether the opening is inside a private parcel, within a public right-of-way, on a public facility, or beside infrastructure such as a water, sewer or stormwater line. A road that the public uses is not necessarily owned or maintained by the same body. The authority responsible for a provincial road can differ from the municipality responsible for a local road, as Nova Scotia’s guidance illustrates (Government of Nova Scotia sinkhole guidance).

| Situation | First contact | Who normally coordinates action | Facts that can change responsibility |
|---|---|---|---|
| Sinkhole entirely on a private parcel | Property owner and property insurer | The owner arranges assessment and repair | Insurance wording, a regulated activity, a private drainage failure, or an encroachment across a boundary |
| Public road, sidewalk or public right-of-way | Emergency services or law enforcement for immediate danger; road or public-works department | The agency that owns or maintains that road or right-of-way | Provincial versus municipal classification, a utility failure, or a nearby private defect |
| Public park, civic parcel or other public facility | The agency managing the parcel or facility | The public owner or its maintenance authority | Cause, lease or easement terms, and whether another agency’s infrastructure is involved |
| Possible water, sewer, stormwater or other public-utility failure | Public-works or utility department, plus the landowner if on private land | The utility owner may investigate and coordinate work | Proof of the failed system, the location of the line, and local liability rules |
| Incident involving state and municipal infrastructure | Both relevant authorities | Responsibility can be joint under local incident classifications | Which asset caused or is affected by the subsidence |
This table describes the common process reflected in government guidance, not a universal legal rule. A title plan, survey, recorded easement, road inventory and utility map may be needed to establish the boundary.
Private-property sinkholes: the owner normally leads
Florida’s Department of Environmental Protection (DEP) states plainly that “sinkholes on private property are the responsibility of the property owner” (Florida DEP Sinkhole FAQ). Pennsylvania DEP gives the same basic allocation: landowners ultimately are responsible for repairs on their property (Pennsylvania DEP guidance). In practice, the owner must arrange a competent investigation, obtain any required approvals and hire the firms that perform stabilization or rebuilding.

1. Make the area safe before investigating
Keep people, children, pets and vehicles away. Mark and secure the opening with visible barrier tape or a temporary barrier, but do not treat a barrier as a repair or as proof that the ground is stable. Do not enter the hole, stand on its rim or send someone down to inspect it. If the opening is under or near a building, pool, retaining wall or utility, evacuate the affected area when there are signs such as sinking floors, sagging, separating finishes or cracking walls. Call emergency services when anyone is in immediate danger, a structure may collapse, or the hole threatens traffic.
2. Notify the property insurer promptly
Contact the insurer before authorizing major work when the sinkhole is near a structure or pool, or when structural damage is visible. Florida DEP says a property policy may cover sinkhole evaluation and repair in some circumstances, but coverage varies by policy and insurer. Ask what emergency measures are permitted, which evidence must be preserved, whether the insurer requires a particular engineering assessment, and how to document the loss. A denial or reservation of rights is not a determination of who owns the ground; it is a coverage decision under that policy.
3. Arrange a qualified assessment
Use a qualified geotechnical or structural professional to determine whether the feature is a sinkhole and whether a building or utility is endangered. A visual depression can also result from other subterranean events, so appearance alone does not establish the cause (Florida DEP Sinkhole FAQ). Keep dated photographs, measurements, rainfall or drainage observations, utility bills and records of cracking or movement. Do not remove soil or fill the opening before the professional and insurer have documented it unless emergency responders direct temporary action.
4. Check what public agencies can and cannot do
Florida DEP explains that no Florida government agency has general responsibility or authority to inspect private-property sinkholes, although some local water management districts may have staff who can check certain suspected events. Pennsylvania DEP may investigate a report, but agency involvement does not mean the department will pay for repairs when the event was not caused by a DEP-regulated activity. Treat an agency inspection as information or regulatory work, not a promise of funding.
5. Get the repair scope and approvals in writing
Ask the professional to identify the suspected mechanism, the affected area, the risk to structures and utilities, monitoring needs and the proposed repair sequence. Confirm permits, excavation controls, utility locates and access rights with the relevant local authority. If the feature crosses a boundary or an easement, notify every affected owner before work begins. Keep contracts, engineering reports, invoices, permit records and completion photographs; they may be needed for an insurance claim, sale or later dispute.

Public roads, sidewalks and public land
For a hazard on public land, report it to the authority that owns or maintains the asset. Florida DEP advises contacting law enforcement about a dangerous hole and the city or county road department to initiate road repair (Florida DEP Sinkhole FAQ). Use the emergency route first when the opening threatens traffic, pedestrians or a structure; routine online reporting can follow once the area is protected.

Identify the road authority
Ask specifically whether the road is municipal, county, provincial or state controlled. Nova Scotia directs reports about provincial roads to its transportation department and reports about municipal roads to the municipality (Government of Nova Scotia sinkhole guidance). Similar divisions exist elsewhere, but names and boundaries differ. A municipality may maintain a road under an agreement while another government owns it, so record the department that accepted your report and its reference number.
Provide usable location information
- Give the street name, nearest address, lane or shoulder, travel direction and a landmark or map pin.
- Describe the opening’s approximate size, whether it is growing, and whether pavement, sidewalk, guardrail or a building is deforming.
- Report water flow, sewer odour, broken pipes, flooding, exposed cables or other clues to an infrastructure failure.
- Send photographs from a safe distance and state when they were taken.
Do not move cones, barricades or road-closure devices placed by the authority. A public agency may need to close lanes, inspect utilities, arrange an engineering assessment and choose a repair method under its own safety and procurement rules.
When a public utility or infrastructure defect is involved
Cause can shift responsibility even when the hole appears on private land. Lafayette Consolidated Government identifies public-property location, a failing public utility and a known public-infrastructure issue as circumstances in which the city or parish may be responsible (Lafayette Consolidated Government erosion guidance). If a private drain, abandoned well, broken service line or construction activity is implicated, the owner or operator of that system may instead be responsible under local law.
Report suspected water, sewer or stormwater involvement to the relevant utility or public-works department and to the parcel owner. Ask for a work-order number, the utility map or locate result, and the department’s findings. Avoid excavating around a suspected line yourself: undermining a pipe or cable can enlarge the void and create a separate hazard.

Some jurisdictions formally classify incidents involving public assets. The City of Tshwane’s categorization recognizes municipal responsibility for certain incidents on municipal property caused by or affecting municipal services, and joint responsibility in some state or municipal infrastructure cases (City of Tshwane incident categorization). That is a local framework, not a rule that automatically applies in another country, state or municipality.
How ownership, cause and maintenance records affect a dispute
Ownership is not the only test
A private parcel can contain a public drainage easement, and a public road can be damaged by a private pipe or development next door. Check the deed, survey, plat, easements, right-of-way plans and maintenance agreements. Ask the road department or utility to confirm its asset boundary in writing. If the opening straddles two parcels, notify both owners and avoid unilateral filling or excavation.
Establish whether it is actually a sinkhole
Natural dissolution, subsidence over old workings, leaking drainage, washout and failed underground structures can produce similar depressions. A qualified professional should distinguish these conditions because the responsible party, repair design and insurance response may differ. Government databases or inspections can document an event, but they do not by themselves guarantee a repair payment.
Preserve evidence of notice and timing
Keep a timeline showing when the defect was first observed, when each authority and insurer was notified, what was said, and what temporary protections were installed. Save emails, call logs, photographs, survey data, utility responses and invoices. This record helps establish whether an agency had notice, whether damage worsened after notification and which work was emergency mitigation rather than permanent repair.

Who pays: owner funds, insurance and public assistance
On private land, the starting assumption is that the owner pays for investigation and repair. Insurance may reimburse covered costs, subject to the policy’s exclusions, deductible, proof requirements and causation analysis. Ask the insurer in writing before work begins whether emergency stabilization, engineering fees, contents, temporary accommodation and permanent repairs are treated differently.

Public responsibility does not mean a private owner automatically receives public money. Pennsylvania DEP reports no special aid funding for large sinkhole bills and says it has no legal recourse to help repair a sinkhole that was not caused by a DEP-regulated activity (Pennsylvania DEP guidance). A public authority may repair its road or utility while leaving damage on an adjoining private parcel to that owner and the owner’s insurer.
Where a contractor, utility operator or neighboring landowner may have caused the void, do not admit liability or sign a release before obtaining professional and legal advice. Responsibility can depend on negligence, statutory duties, easements, construction records and local limitation periods.
Safety and reporting checklist
- Protect people. Keep everyone out, secure the perimeter and evacuate an affected structure when movement or cracking is visible.
- Call emergency services. Use the emergency number for imminent collapse, trapped people, exposed utilities or a road hazard.
- Locate the asset. Confirm the parcel, right-of-way, public facility and nearby utility ownership.
- Notify the right contacts. Tell the private owner and insurer, road or public-works authority, utility department and emergency services as the situation requires.
- Document safely. Photograph from stable ground, record dimensions and keep a dated communication log.
- Obtain professional assessment. Use a qualified geotechnical or structural professional and preserve the insurer’s required evidence.
- Confirm authority and funding. Get written confirmation of who will investigate, who will arrange the repair and what insurance or public program, if any, applies.
- Use permits and utility locates. Do not excavate, fill or rebuild until the required approvals and underground-service checks are complete.
Florida transaction disclosure after a paid claim
Florida has a specific disclosure rule for a later sale: the 2024 statute says a seller of property with a paid sinkhole claim must disclose before closing that the claim was paid and whether the proceeds were fully used to repair the damage (Florida Statutes, section 627.7073 (2024)). This is a transaction-specific Florida requirement, not a general rule for every jurisdiction. Verify the current statute and obtain advice from a Florida real-estate professional before relying on it in a sale.
Examples that show why local verification matters
Official guidance differs in detail because each authority controls different land and infrastructure. Peterborough City Council, for example, said a specific Henry Penn Walk issue involved privately owned land and was the freeholder’s responsibility rather than the council’s; that statement applies to that case, not to every private sinkhole (Peterborough City Council explanation). Comparing that example with Florida’s private-owner guidance, Nova Scotia’s road split and Tshwane’s joint infrastructure classification shows why a national answer cannot replace a parcel-specific determination.
Before assuming that a government agency will repair the hole, ask four questions: Who owns the ground? Who maintains the road or facility? What caused the void? Which policy, easement or local rule allocates the cost? The documented answers determine the next responsible contact.
