There is no nationwide answer. The city or county where the sidewalk sits controls the result through its code, repair program and enforcement notice. In many jurisdictions, the owner of the adjoining property must arrange and pay for repairs even though the sidewalk lies in a public right-of-way. Other jurisdictions assign particular damage to the city, offer city-performed work, or share costs. The damage’s cause, who built or accepted the sidewalk, the wording of a notice and permit rules can all change the outcome.
Start with the local rule, not the ownership of the street
A sidewalk can be public infrastructure while the adjacent owner remains responsible for its condition. Sacramento, for example, says sidewalks are in the city right-of-way but local law places repair duties on property owners. The fact that pedestrians use the walk, or that the street belongs to the municipality, does not by itself establish who must pay.

Responsibility is usually determined by a combination of:
- the city or county code for the exact address;
- whether the municipality built, accepted or otherwise owns the sidewalk;
- the cause of the defect, such as ordinary wear, a private tree, a public tree, utility work or subsidence;
- the repair notice, response deadline and any challenge procedure; and
- permit, design, contractor and cost-sharing requirements.
Municipal webpages are useful starting points, but a notice or a significant assessment should be checked against the operative code. Rules for sidewalk repair are not automatically the same as rules for snow removal, vegetation, curb ramps, curbs, gutters, construction or injury liability.

What “responsible” can mean
Before deciding who is responsible, separate four different questions:
- Who must keep the sidewalk safe? A maintenance duty may require the adjacent owner to correct a dangerous condition.
- Who must arrange the work? A city may require the owner to hire an approved contractor, obtain a permit or follow municipal specifications.
- Who pays? The owner may pay directly, be billed after city-performed work, or qualify for a local cost-sharing program.
- Who bears injury or property-damage liability? That is a separate, fact-specific legal question. A repair duty does not automatically resolve every negligence or liability claim.
Keeping these questions separate prevents a common mistake: treating “public sidewalk” as a promise that the city will inspect, repair and pay for every defect.
When the cause of damage changes the answer
City infrastructure
Some codes shift responsibility to the municipality when its own infrastructure caused the defect. Seattle says the city handles damage caused by city infrastructure, including a city-owned tree or sewer line. San Diego lists city utility work among causes for which the city is responsible.

Tree-root rules vary sharply. San Diego identifies right-of-way trees as a city-responsibility cause. Sacramento takes the opposite approach for its sidewalk-repair duty: the owner’s obligation applies even when roots from a city tree caused the defect. Do not assume that proving a public tree caused lifting will transfer the bill; ask the local department for a written determination.

Private trees, age and ordinary wear
San Diego places ordinary wear, private-tree damage and deterioration from age in the homeowner-responsibility category. Other cities may use different definitions or assign inspection and repair duties differently. Photographs, root locations, prior utility work and the date of construction can help establish the cause under the local rule.
Subsidence, heat and other listed causes
San Diego’s published categories include grade subsidence and heat expansion as city-responsibility causes. Those categories are local examples, not a national standard. A different jurisdiction may classify the same physical condition as an owner obligation.

The following examples show why an address is essential. They illustrate local policies rather than a rule that applies across the United States.

|---|---|---|
| Seattle | Adjacent property owners maintain sidewalks and make repairs. | The city takes responsibility when city infrastructure, such as a city-owned tree or sewer line, caused the damage. An owner must obtain a permit before repairing. |
| Portland | Owners of abutting land are responsible for constructing, maintaining and repairing adjacent sidewalks. | The city can issue a repair notice. The owner may repair, hire a contractor, or allow the city to perform the work and then be billed. |
| Sacramento | Property owners repair defective sidewalks; the city maintains curbs, gutters and pedestrian curb ramps. | The owner duty applies even when city-tree roots caused the defect. Work must follow city specifications and permitting rules; the city may arrange work and collect the cost. |
| San Diego | Responsibility depends on the type and cause of damage. | City-owned property, heat expansion, city utility work, grade subsidence and right-of-way trees are listed as city responsibility. Ordinary wear, private trees and age damage are listed as homeowner responsibility. A right-of-way permit is required. The page reports that a fee holiday ended July 1, 2026. |
| Oklahoma City | A sidewalk in a public area is not necessarily a city responsibility. | Eligibility depends on residential status and other criteria. A qualifying repair program can provide city labor, equipment and materials when the owner contributes 50% of project cost. Sidewalks not constructed by or formally accepted by the city remain the owner’s responsibility. |
These policies also show why curb and gutter assumptions are risky. Sacramento expressly separates them: the city maintains curbs and gutters while property owners repair sidewalks.

What to do when you receive a repair notice
A notice is not merely an informational letter. It may start a deadline, authorize city-performed work, or create a charge if you do nothing. Read every page and attachment, including diagrams and specifications.
- Record the deadline. Save the date received, response date and department contact information. Ask whether the deadline can be extended while responsibility is investigated.
- Confirm the exact defect. Compare the notice’s address, frontage, measurements and photographs with the site. Determine whether it covers sidewalk panels, a driveway apron, curb, gutter, curb ramp or another feature.
- Ask for the legal and technical basis. Request the code section, inspection record, repair standard and explanation of which owner or segment is covered.
- Raise a possible cause exception promptly. Provide evidence of city utility work, a public tree, construction activity or subsidence if the local policy treats that cause differently.
- Check challenge rights. Some programs provide an objection, hearing or review process. Follow the notice’s method and deadline rather than relying on an informal phone call.
Keep the original notice, envelopes, emails, photographs and written responses. If the city later bills you, those records can show what was alleged, when you responded and what option you selected.
Permits, specifications and contractor choices
Do not remove or replace concrete before checking the city’s requirements. Seattle requires a permit before an owner repairs. San Diego requires a right-of-way permit. Sacramento directs owners to city specifications and permitting rules. A contractor’s ordinary driveway or patio practices may not satisfy a sidewalk standard.

Before work starts, verify:
- the permit type, application path, inspection stages and close-out requirement;
- approved dimensions, slope, cross-slope, jointing, concrete strength, accessibility and restoration details;
- utility-marking, tree-protection and traffic-control requirements;
- whether only licensed or prequalified contractors may work in the right-of-way;
- who schedules inspection and who corrects failed work; and
- whether the city offers its own contractor or a cost-sharing alternative.
Obtain a written scope and itemized estimate. Clarify whether it includes permit fees, traffic control, root management, disposal, restoration of landscaping and inspection corrections. Keep invoices and proof of payment.

City repair and cost-sharing options
Some cities let an owner choose city-performed work instead of hiring privately. Portland describes an option to allow the city to repair and bill the owner. This can simplify access and specifications, but the notice should explain how the amount is calculated and when payment is due.
Oklahoma City describes a different model for qualifying residential work: the city can provide labor, equipment and materials while the owner contributes half of the project cost. Eligibility is program-specific, so confirm residential-status, construction-acceptance and other conditions before assuming the 50% contribution applies.
A city program is not the same as a universal reimbursement right. Ask whether assistance is limited by funding, frontage, defect type, application order or geographic area, and obtain written confirmation of your share before authorizing work.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsIf you believe the city, not the owner, caused the defect
Build a cause record rather than relying on a general statement that the problem is “the city’s.” Photograph the defect from several angles, mark its location, and collect dates for nearby utility cuts, street projects, tree planting or drainage changes. Look for utility covers, patch seams, root heave patterns and prior inspection markings. Ask the relevant public-works, utility or urban-forestry department to identify the asset and its maintenance history.

Submit the evidence through the city’s stated process and request a written decision. Continue tracking the repair-notice deadline while the inquiry is pending; an investigation does not necessarily suspend enforcement. If the city denies responsibility, ask which code provision controls and whether an administrative review is available.
Sidewalk repairs and injury claims are different issues
A maintenance assignment does not answer every question after someone trips or falls. Notice, inspection, causation, comparative fault, governmental-immunity rules, lease terms and insurance can affect a claim, and those rules differ by jurisdiction. Preserve the condition with dated photographs, witness details and incident records. For a serious injury, threatened assessment or disputed liability, consult a lawyer licensed where the property is located and provide the code, notice and photographs.
A practical checklist before authorizing work
- Identify the city or county boundary and the exact sidewalk segment.
- Read the municipal code and official repair-program page for that address.
- Match the notice’s deadline, measurements and department to the site.
- Investigate whether a public tree, utility, city project, subsidence or another listed cause changes responsibility.
- Confirm permit, specifications, utility, accessibility and inspection requirements in writing.
- Compare private-contractor, city-performed and cost-sharing options.
- Document the existing condition and retain notices, determinations, permits, estimates and invoices.
The reliable answer is therefore local: the city may be responsible for some causes or programs, but an adjacent owner often remains the party required to maintain and repair the walk. Only the governing jurisdiction’s code and the facts at the property can determine which rule applies.
