Who Is Responsible for Road Maintenance: State, County, or City?

Road maintenance generally belongs to the agency with jurisdiction over the specific road segment. Here’s how to identify it and report a problem.

In the United States, the agency responsible for maintaining a road is generally the one with jurisdiction over that particular road segment. It may be a state department of transportation (DOT), county or township road authority, city public works department, another public authority, or a federal land agency. The road’s name, number, or location within city limits does not by itself identify the maintainer.

How road maintenance responsibility is divided

Road ownership, routine maintenance, and responsibility for a specific feature or problem can be assigned differently. A government may own a road while another agency performs some maintenance under state law or an agreement. Check the responsible agency for the exact segment and issue rather than inferring responsibility from the road’s appearance or route number.

State roads and highways

State DOTs have statewide transportation planning, programming, and project implementation roles. They own and maintain many state highways, and in some states they also administer, maintain, or operate roads that are locally classified, including county roads or city streets. A state route sign is a good reason to ask the DOT first, but the sign alone does not prove which agency handles every repair.

County, township, and city roads

Local governments own most public-road mileage nationally, but that broad pattern does not determine who maintains a particular road. Depending on state law and local government structure, responsibility may belong to a county road department, township, municipal public works department, road district, authority, or state agency. Counties have limited or no road responsibility in some states.

Federal roads and funding

Federal agencies manage roads on federal lands, and federal funding supports many road projects. But a road’s federal-aid designation does not change its ownership: state and local governments retain ownership and maintenance duties for those facilities. The Federal Highway Administration states that “the designation of a public road as a Federal-aid highway does not alter its ownership as a State, county, or city street” in its User’s Guide, Highway Statistics 2021.

As historical context, FHWA reported that local governments owned 77.4% of public-road mileage and state governments owned 18.7%, based on 2014 data. Those figures are not a current 2026 estimate and cannot identify the agency responsible for a particular road.

How to find the right agency for a road problem

  1. Pin down the location. Note the road name and the nearest address, intersection, or mile marker, along with the state and county or municipality. Responsibility can change along a route, so identify the specific segment.
  2. Check official road records. Look for a road jurisdiction or maintenance map from the state DOT, and check the county or city highway or public works department’s road list or reporting service. FHWA’s Highway Statistics publications provide ownership tables, but they are not guaranteed address-level repair lookups.
  3. Use the route as a starting point, not proof. For a signed state or U.S. highway, contact the state DOT to verify the maintaining authority. Federal-aid status and route numbering do not establish that the federal government handles routine maintenance.
  4. Start local for local streets. For a street in a city or town, contact its public works department first. Outside incorporated areas, check the county or township road authority. These are practical first contacts, not universal rules.
  5. Ask for the agency responsible for that segment and issue. If the first office says the road belongs elsewhere, ask which agency owns or maintains that exact section and where to report the problem. A road passing through city limits is not necessarily maintained by the city.

Who handles a pothole, sign, drainage problem, or snow?

The correct contact can depend on the issue as well as the road. FHWA says state and local highway agencies—not FHWA—select, install, operate, and maintain traffic-control devices on public roads, including Interstates and U.S.-numbered highways. That rule concerns traffic-control devices; it does not establish who is responsible for every pavement repair, drainage feature, or snow-clearing task.

When you report a problem, give the precise location and describe the issue. Ask whether that agency handles the specific work or can direct you to the office that does. Ownership, routine maintenance, and responsibility for a particular feature should not be assumed to be the same.

Why the answer varies by state

State laws and local arrangements determine which public body is responsible. Roads can be transferred, and agencies may share or assume functions through maintenance agreements. Some state DOTs maintain roads under local jurisdiction, while some counties have little or no road responsibility. The general rules here apply across the United States, but identifying a particular road’s maintainer requires checking the relevant state and local records.
