Who Is Responsible for Road Access and Drainage When Construction Affects a Property?

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

There is no single answer. Responsibility depends on the road’s legal status, who owns or adopted the drainage asset, the project’s approvals and agreements, and any easements or statutory drainage scheme. A developer may be responsible for temporary access, construction controls, design and installation, or reinstatement, while a highway authority, sewerage undertaker, municipality, private owner or assessed landowners may be responsible for long-term maintenance.

Start by identifying the road authority and the exact drainage asset. Then check the adoption or construction agreement, approved drainage and maintenance plans, permits, title documents and easements. If access is blocked or construction is causing flooding, report it promptly to the authority responsible for that asset and the project contact, while recording dates, photographs and the damage.

Why “the developer is responsible” is often the wrong answer

Construction can affect a property in several different ways. A contractor may close an entrance temporarily, excavate in a public highway, install a new culvert, alter the fall of a site, connect to a sewer, or redirect surface water. Each activity can trigger a different duty and a different responsible party.

  • Who must keep access safe during the works? This may be the contractor, developer or highway authority under a permit or traffic-management arrangement.
  • Who must build or alter the road or drainage? The approved design, planning conditions and construction agreement usually answer this.
  • Who must accept, adopt or reinstate the asset? Handover documents can transfer responsibility, but use by the public does not automatically prove adoption.
  • Who must maintain it after completion? That depends on ownership, adoption, a maintenance plan, a sewer or drainage bylaw, and any easements.
  • Who pays for damage? Liability depends on causation, the relevant law and the project documents. The existence of construction nearby does not by itself prove fault.

The first practical task is therefore to identify the asset and its governing authority, not to assume that every road or drain beside a building has the same owner.

Road access: construction duties and long-term maintenance are different

Public roads that have been adopted

In England, adoption is the process by which a road becomes maintainable at public expense under the Highways Act 1980, as amended. The Department for Transport’s road-adoption guidance is intended for highway authorities, planning authorities, developers, residents of private streets and prospective purchasers. It explains how new and existing roads can be adopted, but it does not make every apparently public route an adopted highway.

Ask the relevant highway authority for the road’s recorded status. Request the adoption plan, any construction or adoption agreement (often made under section 38 or a similar local process), and the limits of the highway. A road can be open to the public yet remain private, or only part of it can be adopted. A developer may still have obligations to construct it to an approved standard and keep it safe until handover.

Private or unadopted roads

If the road is private, maintenance may fall to the owner, a management company, frontagers or other parties named in a deed. Access rights may arise from an easement, a lease, a transfer document or long use. Construction that blocks a private entrance can therefore involve both practical access arrangements and private rights that the local highway authority cannot resolve for you.

Check who owns the road, who has the right to use it, and who must contribute to repairs. A planning permission does not automatically remove an existing access easement or authorize permanent interference with it.

Temporary closure, diversion and reinstatement

During works, the contractor or developer normally has to follow the approved traffic-management plan, permit conditions and any agreement with the highway authority. Those arrangements may specify barriers, signage, pedestrian access, emergency access, working hours, temporary surfaces and reinstatement. If the work is in the public highway, contact the highway authority’s street-works or highways team as well as the project contact.

England’s Department for Transport says its March 2026 code on coordination of works in the highway applies from 10 April 2026 and reflects 2026 permit-scheme changes. It concerns local authorities’ duty to coordinate highway works and undertakers’ duty to cooperate under the New Roads and Street Works Act 1991. It is not a general rule assigning responsibility for a private construction site or a private drain.

Drainage responsibility follows the asset, not simply its location

Highway drains, gullies and outfalls

A drain beside a road may be part of the highway, a private connection, a public sewer, a ditch or a culvert serving several properties. Worcestershire County Council’s technical guidance gives a useful local example: pipes carrying only surface-water runoff from an adopted highway are typically maintained by the Local Highway Authority. The same guidance highlights exceptions involving private connections, outfalls, rights to discharge, sewer adoption and drains located on private land.

That is local guidance, not a rule for every county or country. Confirm who owns the pipe, what water it carries and whether the road is adopted. A private pipe discharging into a highway drain can remain the private owner’s responsibility even when the receiving highway asset belongs to the authority.

Public sewers and private connections

A sewerage undertaker may own or maintain a public sewer, while a property owner remains responsible for private lateral drains, inspection chambers or connections outside the adopted network. Construction plans should show the connection point and any build-over, protection or diversion approval. If a contractor damages a public sewer, report it to the sewerage undertaker and the project team; if a private drain fails, the title documents and maintenance arrangements may control the remedy.

SuDS and on-site systems

Sustainable drainage systems (SuDS) can include permeable surfaces, swales, ponds, tanks, flow controls and inspection points. England’s national SuDS standards require completed-development management plans to identify the parties responsible for management and maintenance over the system’s lifetime. The responsible party may be a public body, management company, landowner or another operator named in the approved plan.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The standards also recognize that a system may be on private land or require access through private land. Where discharge crosses third-party land, evidence of the necessary easements should be in place for the life of the development. Approval of the design is not the same as proof that a future maintainer has lawful access.

Ditches, culverts and shared private systems

A ditch or culvert may serve a road, several properties or only one site. Maintenance can be allocated by an easement, covenant, drainage agreement or long-established practice. Before altering one, establish who may enter the land, who may clear it, and who bears the cost. A new driveway culvert can also require approval from the highway authority or a watercourse regulator, depending on the location.

Statutory municipal drains in Ontario

Ontario’s municipal-drain guidance distinguishes drains under the Drainage Act from municipal storm sewers and roadside ditches. For the statutory drains described in that guidance, the municipality is responsible for maintenance and repair, while assessed landowners can bear allocated construction and future maintenance costs under the applicable bylaw and engineer’s report. A municipality-authorized drainage superintendent or contractor may have rights to enter, inspect and carry out work.

Ontario also describes statutory procedures and the possibility of a prescriptive drainage right after long, qualifying use. These are Ontario-specific rules and must not be applied to a property elsewhere.

Easements can decide both access and drainage

An easement is a legal right benefiting one parcel or party over another. It may allow vehicles to pass, pipes to cross, a maintainer to enter, or water to discharge. A development can be technically well designed yet unlawful or unworkable if the necessary easements were never granted or have expired.

Wollongong City Council describes a drainage easement as land used by someone other than its owner to access drainage or related services. In its local development guidance, where a property drains downhill away from the road and needs an easement, the developer must negotiate with other owners before council approval. Its guidance also describes on-site stormwater detention, which temporarily stores runoff and reduces the rate sent toward other properties or the council system.

For any affected property, obtain the registered title plan and the wording of each relevant easement. Check its route, permitted use, maintenance obligation, notice requirements and whether it benefits a named owner, a utility or the public. Do not assume that a verbal promise by a contractor creates a permanent right.

How to investigate responsibility step by step

  1. Pin down the location. Record the property address, road name, affected entrance, drain, outfall, culvert or watercourse. Note whether the problem is on public or private land.
  2. Identify the road authority. Ask the municipality or county whether the road is adopted, partially adopted, private or subject to a pending adoption agreement.
  3. Obtain the project documents. Request the planning permission, highway or street-works permit, approved access and drainage drawings, traffic-management plan, construction agreement and conditions requiring temporary or permanent measures.
  4. Classify the drainage asset. Establish whether it is a highway drain, public sewer, private system, shared drain, ditch, culvert, SuDS feature or statutory municipal drain.
  5. Find the maintenance plan. For a development in England, ask for the completed-development SuDS management and maintenance plan and the named owner, operator or maintainer.
  6. Check rights over land. Review title registers, transfer deeds, easements, covenants and rights of discharge. Confirm that any third-party access needed for inspection or repair exists for the required period.
  7. Check handover status. Ask whether the road or drainage system has been inspected, adopted or formally transferred, and request the handover record. Until that point, the developer may retain construction or maintenance duties under the agreement.
  8. Document causation. Photograph conditions before and after work, keep dated correspondence, note rainfall and water levels, and identify exactly what changed. This evidence helps distinguish a pre-existing defect from construction-related impact.

What to do when access is blocked or water is causing damage

Immediate safety and access

  • For an emergency, tell the site manager and the highway or emergency authority immediately; do not enter an unsafe excavation or remove barriers yourself.
  • Ask for a safe, signed route for residents, pedestrians, deliveries and emergency services, and request the expected restoration date in writing.
  • If the road is public, report unsafe signing, an obstruction or defective reinstatement to the highway authority. If it is private, notify the owner or management body identified in the title documents.

Flooding or altered runoff

  • Tell the project team what changed, when it changed and which property or road is affected.
  • Report blocked highway drainage to the highway authority, suspected public-sewer problems to the sewerage undertaker, and a private or shared-system failure to the owner or management body.
  • Protect belongings and retain invoices, photographs and inspection reports. Do not undertake permanent works that could alter another party’s drain or discharge route without the required consent.

The correct complaint route and remedy vary by jurisdiction. An authority can investigate its own asset, but it may not decide a private easement dispute or determine civil liability for all damage.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Common mistakes that delay a solution

  • Assuming public use means adoption. Ask the highway authority for its records.
  • Calling every water pipe “the council drain.” Trace its ownership, destination and purpose.
  • Ignoring the lifecycle stage. Design, construction, temporary mitigation, handover and long-term maintenance can have different responsible parties.
  • Relying on a planning permission alone. The permission may require separate highway, sewer, easement or maintenance arrangements.
  • Overlooking access rights for maintainers. A drain cannot be maintained lawfully if the necessary easement was never secured.
  • Declaring liability before proving causation. Establish what changed and whether the construction caused the loss under the applicable law.

When specialist advice is justified

Obtain a locally qualified drainage engineer when the route, capacity, ownership or cause of flooding is disputed. A property solicitor or other local legal adviser may be needed for easements, private-road rights, title interpretation, compensation or a contested damage claim. Give the adviser the approved plans, permits, adoption or maintenance agreements, title documents, photographs and a chronology rather than relying on verbal descriptions.

For England, distinguish guidance that applies nationally from county-level practice. For Ontario, distinguish a Drainage Act municipal drain from a storm sewer or roadside ditch. For Wollongong, treat the council’s easement and detention guidance as local development requirements. In every location, the signed project documents and registered rights are more decisive than a general assumption about who “usually” maintains a road or drain.

A practical responsibility checklist

  • Road authority and adoption status confirmed
  • Construction or adoption agreement obtained
  • Temporary access and traffic-management arrangements identified
  • Drain classified by type, owner and discharge destination
  • Approved drainage drawings and maintenance plan obtained
  • Rights of access, discharge and repair checked in title records
  • Handover or adoption record confirmed
  • Changes, dates, rainfall, photographs and damage recorded
  • Correct highway, sewer, drainage or project contact notified
