1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteFor most public roads and pavements in Scotland, the local council is responsible. The main exception is the trunk-road network, including motorways and designated trunk A-roads: Scottish Ministers are responsible, with Transport Scotland arranging delivery through contracted operating companies.
Drainage depends on the asset and where it sits. Councils maintain drainage on local roads and public highways; Transport Scotland manages drainage on trunk roads; Scottish Water’s public drainage duty covers rainwater from roofs and paved ground within property boundaries; and landowners manage surface water on their own land. A private road may be the responsibility of its owner. If you cannot identify the route or drain, start with the council, which can usually confirm who manages it.

Responsibility at a glance
The following distinctions are the quickest way to identify the right organisation. “Local” means a road administered by a council rather than a trunk route; “trunk” means a route formally included in Scotland’s trunk-road network, not simply any road carrying an A-road number.

| Local public road or pavement | Relevant local council | Road surface, footway and associated public-highway maintenance on most Scottish routes |
| Motorway or trunk road, including footways and drainage assets | Scottish Ministers, delivered through Transport Scotland and contracted operating companies | Maintenance and operation of assets included in the trunk-road network |
| Road drainage and gullies on a local public highway | Local authority | Routine upkeep of drainage serving the public road |
| Drainage on a motorway or major trunk road | Scottish Ministers through Transport Scotland and its contractors | Trunk-road drainage and related assets |
| Rainwater from roofs and paved ground within a property boundary | Scottish Water for the public drainage duty | Public drainage of qualifying runoff from property surfaces |
| Surface water on private land | Landowner | Managing runoff so it does not create flooding problems for neighbours |
| Private road | Potentially the road owner | Responsibility depends on ownership and any private maintenance arrangements |
These categories describe the normal allocation of responsibility, not an automatic decision about a particular defect. A drain can look like a road gully while actually serving a private system, and a road can change from council control to trunk-road control at a defined boundary. Confirm the asset with the authority before arranging work or pursuing liability.

Local roads and pavements: what councils normally maintain
Local councils are responsible for most public roads and pavements in Scotland. That usually includes the carriageway, kerbs, footways, signs and road gullies on roads that are not part of the trunk network. The council’s roads or roads-and-transport service is therefore the correct first report for a pothole, broken pavement, damaged kerb, sunken cover or blocked gully on an ordinary public street.
Potholes and carriageway defects
Report the exact location, direction of travel and lane affected. A nearby house number, junction, postcode, lamp column or map pin helps the roads team find the defect. Explain whether the hole is in the traffic lane, at a junction, in a cycle facility or beside a kerb. Photographs taken from a safe position can help, but do not stand in a live lane to obtain one.
Damaged pavements and footways
The council normally deals with cracked, lifted or uneven paving on a public footway. State whether the obstruction affects the whole width, creates a trip edge, blocks a dropped kerb or prevents wheelchair or pushchair access. A path inside a housing development, school, business site or private estate may not be adopted highway; the council can explain the status if it is unclear.
Public-road gullies
A gully at the edge of a public road is generally part of the road-drainage system. Councils handle drainage of local roads and public highways, including routine gully maintenance. Report repeated flooding, a missing or broken grate, a gully that is full of silt, or water that remains after rainfall. The council may inspect the connection and determine whether another asset owner must intervene.
Trunk roads and motorways: why the road number is not enough
Scottish Ministers hold responsibility for the trunk-road network. Transport Scotland manages delivery, normally through operating companies appointed for particular routes. The network includes motorways and designated trunk roads, together with their associated footways and drainage assets.

An A-road number by itself does not prove that a route is trunk. Some A-roads are local-authority roads, while others are trunk roads. Use the official trunk-road list or map, or ask the council to confirm the status. Traffic Scotland publishes the map and identifies operating companies, but assignments and contact channels can change, so check the current information when reporting.
What to report on a trunk route
For a motorway or confirmed trunk road, use the responsible route operator or Transport Scotland’s current contact route rather than the council’s ordinary pothole form. Include the carriageway direction, junction number, slip-road name, marker-post number or nearest landmark. On a high-speed road, report an immediate hazard as soon as it is safe to do so and do not attempt to clear debris yourself.
Scale of the trunk network
Traffic Scotland reports a trunk-road and motorway network of 3,507 kilometres. It represents 6% of Scotland’s roads but carries more than one third of all traffic and 60% of heavy goods vehicles. The page does not state a publication year for those figures, so they should be treated as a description of the network at the time of publication rather than a current annual measurement.
Who maintains which drains?
“The drain” is not a single legal or physical category. Responsibility turns on what the drain serves and where the relevant asset lies.
Drainage serving a local public highway
Road gullies, channels and other drainage assets that serve a local public road are normally the local authority’s responsibility. This covers routine upkeep of highway drainage, not every pipe or chamber visible beside a road. A blocked gully may be a council matter; a private connection beneath a frontage may not be.

Drainage on motorways and trunk roads
Transport Scotland’s trunk-road asset management includes drainage. Scottish Ministers remain the responsible authority, with work delivered through the appointed operating companies. Report a trunk-road drainage problem through the route operator or Transport Scotland, giving precise location information.

Rainwater from roofs and paved areas within a property
The Scottish Government’s surface-water responsibilities guidance identifies Scottish Water’s public drainage duty for runoff from roofs and paved ground within a property boundary. This is different from a road gully. If rainwater from a building or yard is not draining, first establish whether the problem is in the public drainage system or in private gutters, channels, pipes or storage serving the property.
Surface water on private land
Landowners are expected to manage surface water on their land so that runoff does not cause flooding problems for neighbours. This may involve maintaining private ditches, culverts, soakaways, channels, yards and other drainage features. The duty does not transfer to the council merely because water eventually reaches a public road.
Unidentified drains
Appearance alone cannot establish ownership. A grate near a kerb may be highway drainage, a private connection, or part of a wider system. Ask the council or Scottish Water to identify the asset before instructing repairs, excavating, or alleging that an authority has failed to maintain it. For flood-risk questions, the Scottish Environment Protection Agency has a separate role in flood-risk management; that role does not make it the routine maintainer of every road or private drain.
How to identify the responsible body
- Pin down the location. Record the street, postcode, nearest junction, direction of travel and a map reference or photograph taken from a safe place.
- Classify the route. Decide whether it is an ordinary council road, a motorway or trunk road, or a private road. Do not rely only on an A-road number.
- Classify the asset. Is it a carriageway, pavement, public-road gully, property drain, public sewer, private surface-water system or land drainage feature?
- Contact the council first when uncertain. Official public guidance says the council can explain what it can do and identify the manager when another body is responsible.
- Escalate to the route operator or Scottish Water when the classification points there. Give the same precise location and explain why you believe the issue concerns a trunk route or property drainage.
- Keep the reference number and photographs. They provide a record of what was reported and allow you to add information if the defect worsens.
Private roads and unadopted streets
A private road may be owned by an individual, residents’ association, housing company, developer or another private body. The owner, or the parties named in a maintenance agreement, normally arranges repairs and pays for them. Public access does not by itself make a road publicly maintained.

If residents are unsure whether a street is adopted, ask the council to confirm its road status. The council may be able to identify the owner or explain which records or agreements are relevant, even when it is not responsible for carrying out the repair. Do not assume that a council gully on the edge of a private road proves that the whole road is adopted.

A report starts an inspection and prioritisation process; it is not a guarantee of immediate repair or an admission of liability. Authorities may make a temporary repair, add the location to a programmed scheme, monitor it, or refer it to another asset owner after inspection. The response depends on the defect, risk, route category, weather and available work programme.
For urgent danger—such as a collapsed pavement exposing a deep void, a missing motorway cover, flooding that makes a road impassable, or debris in a live traffic lane—use the authority’s emergency reporting route. If there is an immediate threat to life, call emergency services. Keep yourself and others away from traffic and unstable ground while waiting.
Maintenance responsibility is not the same as legal liability
The fact that an authority maintains a road or drain does not, by itself, prove that it must compensate someone for injury, vehicle damage or flooding. Liability can depend on the exact asset, inspection records, notice of the defect, the applicable legal test and the facts of the incident. The responsibility summaries from mygov.scot, Transport Scotland and the Scottish Government explain who manages categories of infrastructure; they do not decide a contested claim.
For a claim or dispute, preserve photographs, dates, witness details, receipts and the report reference. Ask the authority or asset owner for an asset-specific response. Obtain independent legal advice if the loss is significant or responsibility remains disputed.

Current guidance and changing information
The clearest general public guidance is the mygov.scot “Roads and pavements” page, last updated 27 January 2025. Transport Scotland’s 2026 road asset plan sets out the statutory and delivery division between trunk and local roads and the assets included in trunk-road management. Traffic Scotland’s map and operator information, along with contact details and contract assignments, are time-sensitive; check the current versions when making a report. The Scottish Government’s surface-water responsibilities annex is a policy summary and should not be treated as a case-specific ownership determination.
Common situations
A pothole on a residential street
Report it to the local council’s roads service with the street, postcode and exact position. If the council confirms that the street is trunk, use the route operator or Transport Scotland instead.
A blocked grate beside a public road
Start with the council for a local road or with the trunk-road operator for a motorway or trunk route. Explain whether the grate is in the carriageway, footway or a private frontage.

Water running from a driveway onto the road
Identify whether the source is a private surface-water system, a public drainage connection or highway drainage. The landowner manages surface water on private land; the council manages local highway drainage; Scottish Water’s public duty concerns qualifying runoff from roofs and paved ground within the property boundary.
A damaged footway on a major A-road
Check trunk status rather than assuming the council is responsible. A designated trunk A-road is handled through Transport Scotland and its operating company, while a non-trunk A-road may remain a council road.
Flooding affecting several properties
Report the immediate road hazard to the road authority and separately identify the source of property or land drainage. Councils, Scottish Water, landowners and SEPA have different functions, so one report may not resolve every part of the problem.
