Who Is Responsible for Clearing a Blocked Drain Near a Road Construction Site?

For a blocked gully serving an adopted public road in England or Wales, report it first to the highway authority responsible for that road. The authority normally controls or maintains highway drainage and has statutory powers to cleanse it. If roadworks caused the blockage or interfered with the drain, the contractor or developer may also be liable for corrective work or costs, but being next to the drain does not by itself establish responsibility.

The answer depends on four facts: what kind of drain is blocked, who owns or adopted it, which body manages the road, and what evidence connects the blockage to the construction activity.

Start with the drain, not the construction site

“Drain” can describe several different assets. A highway surface-water gully at the kerb is not the same thing as a private property drain or a public sewer. Each may have a different owner, maintenance route and legal framework.

What you can see Likely asset First reporting route Who may maintain it
Kerbside grate taking rainwater from an adopted road Highway surface-water gully and connecting highway drain The highway authority for that road Usually the local highway authority, or the trunk-road authority
A pipe or drain serving one property, within its boundary or private access Private drain The property owner, landlord or managing agent The owner or parties sharing the private system
A foul or combined sewer serving multiple properties Public sewer The relevant water and sewerage company The sewerage undertaker, subject to local asset boundaries
A drain inside a construction compound or temporary site system Site drainage or temporary works The site operator, principal contractor or developer, while also reporting any public-road hazard to the authority The party controlling the site system under its project arrangements

Local boundaries are not identical everywhere. Newport City Council, for example, distinguishes highway surface-water drains from private foul drains and private sewers. Medway Council similarly separates road gullies from public drains and sewers. Use the relevant council’s drainage or highways page, or the utility’s reporting route, to confirm ownership rather than relying on the appearance of a grate.

Highway gullies

A gully in the carriageway or at the edge of an adopted road is normally part of the highway drainage system. It may be blocked by silt, leaves, litter, construction sediment or other material. The highway authority is the practical first contact even when roadworks are taking place beside it.

Private drains and public sewers

A drain serving only a private building, yard or access can remain the owner’s responsibility. A sewer serving several properties may fall to the water and sewerage company. A council may redirect you if the asset is outside the highway network, so include the exact location and what the drain appears to serve in your report.

Which authority handles the road?

Road status changes the reporting route.

Adopted local roads

For an ordinary adopted street, report the obstruction or blocked gully to the local council’s highways or street-drainage service. “Adopted” means the road is maintainable at public expense; it does not mean every nearby drain is publicly owned.

Motorways and major A roads in England

Motorways and A roads managed by National Highways in England use National Highways’ reporting route rather than the local council’s routine highways form. If you are unsure whether the road is a National Highways route, give the road number, direction of travel and nearest junction when making contact.

Scotland, Wales and Northern Ireland

GOV.UK’s road-obstruction guidance provides separate routes for major roads in Scotland, Wales and Northern Ireland. Do not assume that the English statutory arrangements or a council’s English process applies across every UK jurisdiction. Follow the road authority identified for the location.

Section 100: powers over highway drains

Section 100 gives a highway authority powers to construct drains and to clean and maintain them. Section 100(1)(c) states that the authority may “scour, cleanse and keep open all drains situated in the highway or in such land as aforesaid.” That is why a blocked gully on an adopted road should normally be reported to the highway authority.

The same section allows the authority to repair or reinstate work made necessary by unauthorised interference with a drain under its control and to recover its reasonable expenses. This is a cost-recovery power, not a rule that the nearest contractor must attend immediately whenever a blockage is noticed.

Section 41: the maintenance duty

Section 41 places a maintenance duty on the authority for a highway maintainable at public expense. The duty concerns the highway; whether a particular pipe, gully or connection is within that system still has to be established.

Why proximity is not proof

A contractor may have excavated near the drain without causing the obstruction, or sediment may have entered from an unrelated source. Conversely, a contractor may have covered a gully, damaged a connection, discharged silt, or failed to comply with a permit condition. The authority, project documents and evidence of what happened determine the eventual allocation of work and cost.

When a contractor or developer may be responsible

Construction activity can create a separate responsibility from the authority’s routine maintenance role. The strongest cases involve a clear connection between the works and the blockage.

Examples that can point to construction-caused interference

  • Fresh concrete, mortar, soil, aggregate, trench spoil or other site material is visible in the gully or downstream pipe.
  • A gully has been plated over, buried, damaged or disconnected during excavation.
  • Temporary site drainage has been directed into a highway gully without appropriate control.
  • The blockage appeared immediately after a specific operation, such as resurfacing, kerb installation or utility trenching, and records or photographs support that timing.
  • The works breached a highway permit, traffic-management arrangement or drainage condition.

These observations justify reporting a possible construction-related cause. They do not, on their own, prove legal liability. Avoid removing material or entering the work zone to gather evidence.

How costs may be handled

The highway authority may arrange an urgent inspection or clearance under its own maintenance process. If it concludes that unauthorised interference by a contractor or developer caused the work, section 100 can support recovery of reasonable expenses. A permit, licence, adoption agreement, development obligation or construction contract may also allocate duties between the authority and the project parties.

Situation Immediate practical action Possible ultimate payer
Routine silt or leaf blockage in an adopted-road gully Report to the highway authority Normally the authority’s maintenance budget
Construction material entering an authority-controlled drain Report to the authority and identify the nearby works Authority initially; contractor or developer may face recovery of reasonable costs
Damage caused by authorised works under a permit Report through the authority’s highways process and the site contact Depends on permit, contract and evidence
Private drain within a development or property Contact the owner, managing agent or site operator The private owner or project party controlling it
Public sewer surcharge or foul drainage problem Contact the sewerage undertaker The sewerage undertaker or another party if proven to have caused damage

How to report a blocked road drain safely

  1. Move to a safe observation point. Do not stand in a live carriageway, climb barriers or enter a construction compound. If you are driving, stop only where it is lawful and safe; a passenger can record details.
  2. Record the location precisely. Give the road name, town or locality, nearest junction, landmark, house number or chainage if known, and the direction of travel. Identify the side of the road and the exact gully, grate or low point.
  3. Describe what is happening. State whether water is ponding, flowing across traffic lanes, backing up, or entering a property. Note visible silt, concrete, soil, rubbish, a covered grate or damage, but describe these as observations rather than declaring fault.
  4. Identify the road authority. Use the local council for an adopted local road. Use National Highways for an English motorway or A road it manages. Follow the equivalent route for a major road in Scotland, Wales or Northern Ireland.
  5. Mention the works. Provide the project name, contractor or developer name shown on site signage, traffic-management reference, and the date or time you noticed the problem. Ask the authority to check whether the works have a permit or drainage condition.
  6. Attach safe photographs if available. Photograph from a pavement or other secure location, without entering the work zone or exposing yourself to traffic. A wide image showing the road and landmark can be more useful than a close-up alone.
  7. Keep the report reference. Save the case number, submission date and any response. If the water level or hazard worsens, update the same case and use the authority’s emergency route rather than submitting duplicate routine reports.

What to do when flooding is dangerous

A blocked gully can become a traffic hazard, but not every blockage is an emergency. If water is rapidly covering a lane, undermining the carriageway, entering buildings, exposing an open chamber or creating an immediate risk to people, use the highway authority’s emergency contact. Call emergency services where there is an immediate threat to life or a collision risk.

Do not lift a grate, rod the pipe, pour chemicals into it, shovel material into another drain or direct traffic around the obstruction yourself. Highway gullies can be deep, contaminated and connected to moving traffic. Interfering with the asset can also damage it or compromise evidence about the cause.

What information helps the authority decide responsibility?

Authorities need enough detail to locate the asset and distinguish a routine maintenance issue from construction-related interference. A useful report answers these questions:

  • Is the grate in the public carriageway, footway or a private access?
  • What road is it on, and who appears to manage that road?
  • What is the nearest junction, landmark or property?
  • What material or condition is visible?
  • When did you first notice the blockage, and has it changed after rain or construction activity?
  • Is there standing water, flooding, damage, an uncovered opening or a danger to traffic?
  • What roadworks are nearby, and what project or contractor information is displayed?
  • Do you have photographs taken from a safe place?

This information helps the authority inspect the correct gully, check its asset records, review permits and decide whether another body should attend.

Common mistakes to avoid

Assuming the contractor must clear it because the site is nearby

Report the public-road hazard to the highway authority even when construction appears to be the cause. The authority can coordinate with the site and decide whether cost recovery applies.

Assuming every roadside grate belongs to the council

Private estate roads, service yards and property drainage can sit beside a public highway. Confirm adoption and ownership before directing a report to the wrong body.

Reporting only a vague location

“Blocked drain near the works” may not identify the correct gully. Include the road number or name, direction, junction and a landmark.

Trying to prove fault by entering the site

Unauthorised entry can put you at risk and may disturb the evidence. Report what you can lawfully observe and leave inspection to the authority and site professionals.

Practical decision guide

  1. Is the blockage on an adopted public road? If yes, start with the road’s highway authority.
  2. Is the road a motorway or managed trunk route? Use the national trunk-road authority rather than the ordinary local-council route.
  3. Does the drain serve only a property or private development? Contact the owner, managing agent or site operator.
  4. Does it appear to be a public sewer or foul-drainage problem? Contact the sewerage undertaker.
  5. Is there evidence of construction material, damage or interference? Include those observations in the highway report and identify the project; do not assert liability as a fact.
  6. Is there immediate danger? Use the authority’s emergency route or emergency services as appropriate, without attempting a self-clearance.

Bottom line

For a highway gully beside road construction in England or Wales, the highway authority is generally responsible for receiving the report and arranging highway-drainage action. A contractor or developer may become responsible for remediation or costs if its work caused unauthorised interference, but that conclusion requires evidence and depends on the drain’s ownership, the road authority, permissions and project terms. Identify the asset, report through the correct road jurisdiction and leave physical clearance to the responsible professionals.
