What to look for in a property developer’s track record before you buy

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A convincing property developer track record is evidence of homes actually completed, infrastructure delivered, planning promises met and defects resolved—not a glossy portfolio or a list of permissions. Before reserving or exchanging, verify the developer’s legal identity, compare approved plans with built schemes, test whether it has the capacity and finance to finish your project, and understand your contract, warranty and insolvency protection.

What a meaningful track record looks like

Start with delivered outcomes. A scheme that was announced, marketed or granted planning permission has not yet proved that the developer can build it. For each previous project, establish whether work started, how many homes were completed, whether delivery was phased, and whether any permission appears to have remained unimplemented. Government planning guidance for England says a delivery record, including a history of unimplemented permissions, can be relevant when assessing whether development is deliverable. It also points to practical progress such as ground works and units started or completed.

Evidence you find What it demonstrates What it does not demonstrate
Planning application or permission Consent was sought or granted for a described scheme. That construction will start, finish, or match the approved design.
Ground works and started units Physical delivery has begun on the specific site. That the developer has enough cash or capacity to complete every phase.
Completed homes and infrastructure A verifiable delivery outcome that can be inspected. That later phases, defect handling or customer service will be equally successful.
Marketing claims or a portfolio page How the developer presents its experience. Independent proof of completion, quality or compliance.

Use the local planning register for each site, not just the developer’s own description. Record the permission reference, approved number and type of homes, conditions, reserved matters, amendments, commencement notices and completion evidence. Visit completed schemes where possible and compare the built layout, access, landscaping and communal facilities with the approved drawings.

How to investigate previous developments

Identify what was promised and what was delivered

Make a simple project-by-project schedule. Put the permitted homes in one column and the homes visibly completed in another. Note the original timetable, actual completion, phases that remain unfinished and any infrastructure that arrived later than the homes. A delayed phase is not automatically proof of misconduct, but an unexplained pattern of stalled permissions is a material warning for a buyer or investor.

Check the legal entities, not only the trading name

Ask for the exact legal entity selling your home and compare it with the entity named on the planning application and permission. A project may use a special-purpose subsidiary, while a better-known parent appears in marketing. Do not infer that the parent company guarantees the subsidiary’s obligations. An independent conveyancer should check title, ownership, planning matters, searches and the sale contract.

Speak to people who can verify delivery

Inspect occupied schemes and, where appropriate, ask residents or managing agents how communal areas, roads, drainage and landscaping were completed. Treat informal comments as leads rather than proof. The strongest evidence remains the planning record, physical inspection, completion documentation and terms agreed in the contract.

Look for capacity, not just a long list of projects

A developer can have completed small schemes yet lack the people, funding or contractors for a larger or technically difficult site. Ask who will manage construction, which contractors are appointed, how many units are being delivered concurrently and whether the developer has a realistic plan to let or sell the homes. Site constraints, access, utilities, contamination, abnormal ground conditions or unresolved ownership can delay a scheme even when permission exists. Ask how each constraint is being addressed and what contingency has been allowed.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Check the current scheme against its planning approval

For the property you are considering, confirm that permission is extant and identify every relevant condition. Check whether pre-commencement conditions were discharged, whether work began before a deadline, and whether later applications changed the design, tenure mix, unit count or phasing. Compare the sales plan with the approved drawings rather than assuming the brochure is current.

Infrastructure and planning obligations

Find out when roads, drainage, open space, schools, affordable housing, play areas and other obligations are due. Ask which works are secured by a planning obligation, condition or agreement and who is responsible for delivery. In a written answer on 29 June 2026, Housing Minister Matthew Pennycook said local authorities should consider infrastructure-delivery risks and whether bonds are appropriate. That is a planning and decision-making expectation, not a guarantee that every obligation will be completed before your home.

Match progress to commitments

Where documents are available, compare the latest site progress with the approved phasing plan and infrastructure timetable. A site that has foundations but no visible progress for an extended period deserves a written explanation. Ask whether utilities, highways approvals or land ownership are holding up completion and whether the contract gives you a remedy for delay.

Use viability information carefully

A published viability assessment can reveal the assumptions behind a scheme, but it is not a personal guarantee that the developer is solvent or that your home will be finished. Planning viability guidance is written primarily for English plan-makers and decision-makers; use it as a checklist of questions, not as a consumer credit rating.

Inputs worth examining

  • Development value: the assumed sales or rental value of the completed scheme.
  • Development costs: build costs, professional fees, finance, contingencies and infrastructure.
  • Land value: the amount attributed to the site and the assumptions supporting it.
  • Landowner premium: any premium or return assumed for the landowner.
  • Developer return: the margin or return treated as necessary for the project to proceed.

Check the date, scope and sensitivity of these assumptions. A public summary may aggregate or withhold commercially sensitive figures, so the absence of a granular number does not by itself show misconduct. Look for whether the conclusion still works if sales values fall, costs rise or the programme slips. Ask the developer to explain funding arrangements, drawdown conditions and contingency in terms you can understand; have your adviser assess the implications.

Protect yourself through the legal identity and contract

Before paying a reservation fee or deposit, instruct an independent conveyancer. The UK Government’s How to buy a home guide advises independent financial and legal advice. Your conveyancer should verify the seller’s identity, title, planning permissions, searches, service-charge arrangements, restrictions and the exact terms of the purchase contract.

  • Confirm who owns the land and who is obliged to build and transfer the property.
  • Check whether the seller can substitute a company, assign the contract or change the specification.
  • Read provisions on completion dates, notice to complete, rescission, compensation and a long-stop date.
  • Establish what happens to your deposit if the developer becomes insolvent or the scheme is not completed.
  • Ask whether roads, landscaping and communal facilities will be adopted, managed or maintained privately.

A developer-recommended solicitor or mortgage adviser is optional. Ask whether a referral fee is paid and compare independent alternatives. A recommendation is not an assurance that the adviser is independent or that the contract is favourable.

Assess build quality and defect handling

A good record includes what happened after handover. Ask how previous buyers reported defects, who inspected them, average response times, and whether recurring problems affected multiple homes. Distinguish a minor snag from a structural or safety issue, and ask for evidence that roads, drainage, fire-safety measures and communal systems were signed off.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Arrange an independent snagging inspection

Consider a snagging survey after construction and before completion, subject to the contract and site access rules. A surveyor may identify incomplete finishes, damaged fittings, poor seals, uneven floors, drainage problems or defects that are difficult to see during a short viewing. A snagging report does not replace the conveyancer’s legal checks or the warranty provider’s process.

Agree the reporting route

Get in writing how to report defects, the response target, emergency contact and escalation route. Keep dated photographs, emails and inspection reports. Your contract should explain whether the developer must return to remedy defects, whether access is required, and what happens if work is not completed by the agreed date.

Understand warranty, deposit and insolvency protection

The UK Government’s How to buy a home guide states: “Most new build homes have a 10-year warranty for major structural problems and a 2-year warranty for general defects, but this may not cover the whole of the property and any attached land.” Treat those periods as a description of common arrangements, not a promise that every part of your purchase is covered.

In his written answer to Parliamentary Question 11300 on 29 June 2026, Housing Minister Matthew Pennycook said: “Nearly all new-build homes are issued with a 10-year new-build warranty which may protect homeowners against builder insolvency leading to failure in completing the build.” He also said: “The government expects all developers to build high-quality homes, delivered according to their planning approval, and to treat customers fairly.” These statements describe expected standards and possible protection; they do not establish that a particular developer will perform well.

Questions for the warranty provider

  • Who is the provider, and is the policy issued before you exchange or complete?
  • What is covered during the initial defects period and during the structural period?
  • Are deposits, advance payments, alternative accommodation or insolvency-related completion costs covered?
  • What exclusions apply to attached land, garages, retaining walls, communal areas, appliances and consequential loss?
  • How do you notify a claim, and what deadlines or inspection requirements apply?

Read the policy itself, not only the developer’s summary. Ask your conveyancer whether the warranty, deposit arrangements and contract work together if the developer fails before completion.

Compare developers on evidence, not reputation

There is no authoritative UK-wide score for developer delivery rates, defect rates or customer satisfaction. Build your own comparison from like-for-like schemes and record the source and date of each item.

Comparison question Evidence to collect Why it matters
How much was delivered? Announced, permitted, started and completed homes for comparable schemes. Separates marketing capacity from demonstrated delivery.
Were projects delayed? Permission dates, commencement, phase completions and explanations for gaps. Shows programme reliability and the effect of constraints.
Was approval followed? Approved drawings, conditions, obligations and completed infrastructure. Tests compliance with the scheme residents were promised.
How were defects handled? Documented reporting route, response evidence and unresolved recurring issues. Indicates the likely experience after completion.
Can this scheme be finished? Funding, contractors, site constraints, ownership and viability assumptions. Capacity is project-specific; a past success is not a guarantee.
What protection exists? Warranty provider, exclusions, deposit cover, long-stop and delay clauses. Defines your remedies if quality, timing or solvency goes wrong.

A practical check before each commitment

  1. Before reserving: obtain the legal seller’s name, planning reference, current price list, specification, estimated timetable, warranty details and reservation terms.
  2. During the cooling-off or reservation period: search the local planning register for the current and previous schemes; check conditions, amendments, obligations, progress and infrastructure timing.
  3. Before exchange: have an independent conveyancer review title, searches, planning, contract, deposit protection, warranty exclusions, delay provisions and the long-stop date. Confirm your mortgage offer remains valid for the expected completion window.
  4. Before completion: inspect the home, arrange snagging where permitted, record unfinished works and obtain written commitments for outstanding items. Confirm the warranty certificate and procedures.
  5. If progress stops: ask for a written explanation, notify your conveyancer and lender, preserve every record, and check the contract and warranty immediately rather than relying on verbal assurances.

Red flags that warrant independent advice

  • The seller will not identify the exact legal entity or explain its relationship with the planning applicant.
  • Marketing shows permissions but no verifiable completed or active projects.
  • Several permissions appear unimplemented, or earlier phases remain unfinished without a clear plan.
  • The sales layout differs from approved plans and staff cannot produce the relevant amendment.
  • Infrastructure, access or ownership is unresolved, yet completion dates are presented as fixed.
  • Viability information omits its assumptions or treats projected value as certain.
  • You are pressured to use a recommended adviser, pay a non-refundable deposit or exchange before receiving the contract and warranty documents.

None of these points alone proves that a developer will fail. Together they justify slowing down, obtaining documents and taking independent legal and financial advice.

Geography and limits of the guidance

The planning-deliverability and viability principles described here come from guidance for England. The UK Government’s home-buying overview covers England and Wales and directs buyers to separate guidance for Scotland and Northern Ireland. Planning registers, building standards, consumer remedies and warranty practice differ by jurisdiction, so use the rules and professional advisers applicable to the property’s location.
