What to Know Before Renting in a Newly Built or Redeveloped NYC Apartment Complex

Verify legal occupancy, continuing construction, and rent-regulation status before signing a lease in a newly built or redeveloped NYC apartment complex.

Before signing a lease in a newly built or redeveloped New York City apartment complex, verify that the building is legally approved for residential occupancy, find out what construction will continue after you move in, and check the rent-regulation status of the specific apartment. Ask to see the current Certificate of Occupancy (CO) or Temporary Certificate of Occupancy (TCO), search the address in city Department of Buildings records, review any Tenant Protection Plan (TPP), and get promises about work, amenities, and services in writing.

A new building can still have active construction, and its appearance alone does not tell you whether a particular apartment is regulated. No city record or general guide can answer every property-specific question without the address, apartment number, lease, and management documents. Use the checklist below to verify what applies to the place you are considering.

Confirm the building is approved for residential occupancy

A building’s new appearance, leasing activity, or nearly finished lobby does not establish that it is legally ready for residents. The NYC Department of Buildings (DOB) says no one may legally occupy a building before DOB issues a CO or TCO. The certificate identifies the building’s legal use and permitted occupancy. Ask management for the current document and check that it authorizes residential use and the occupancy relevant to your apartment. DOB’s Certificate of Occupancy guidance explains the city’s requirements.

This is a threshold check, separate from deciding whether the apartment is comfortable or whether the lease terms suit you. A leasing representative’s assurance that the building is “ready” is not a substitute for the actual certificate. Request to see the document and verify what it says rather than relying on a description of the building’s status.

If management presents a TCO

A TCO can permit occupancy, but it is temporary. Ask when it expires, what steps remain before a final CO is issued, and whether any of those steps could affect residents. The timeline and expiration are specific to the property; do not infer them from the building’s age or leasing schedule. Verify the document rather than relying only on a verbal explanation.

Compare the document management provides with the current status shown in city records, where available. If you cannot tell whether the certificate covers residential use or the occupancy relevant to the apartment, ask management to explain in writing or seek help interpreting the record before you commit. No standard TCO duration or universal schedule for conversion to a final CO is published, so ask about the particular building rather than assuming a date.

Find out what construction will continue after move-in

“New” does not necessarily mean construction-free. Work may continue in apartments, common areas, or elsewhere in the building after residents move in. In an occupied building, the TPP explains how the owner and contractor will address protections such as exits, fire safety, dust and debris, pests, noise, structural safety, and essential services. The plan is tied to the work being done, so a general notice may not describe every active permit.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

DOB says that permit applications for construction, alteration, and partial demolition in an occupied building with a dwelling unit require a TPP. The plan is meant to describe how tenants will be protected while work happens. It addresses egress, fire safety, health requirements, housing standards, structural safety, noise limits, and essential services. Ask for the plan that applies to the current work; do not assume an old or generic notice covers every project or permit in the building.

Check permits and the Tenant Protection Plan

  1. Search the building address. Use DOB’s Buildings Information System (BIS) or DOB NOW public portal to look for permits and available plan information. DOB says tenants can find TPP information through these systems. DOB’s Tenant Protection Plan guidance describes the plan, and its tenant FAQ provides additional guidance.
  2. Ask management to identify the work. Request the current TPP and the active permits relevant to the building. Ask what work remains, where it will happen, when it is scheduled, and whether the work or access routes could change.
  3. Compare the plan with what you are told. Ask about work days and hours, dust and debris controls, pest measures, exit routes, fire-safety arrangements, noise, and possible interruptions to utilities or other essential services.
  4. Get practical arrangements in writing. Ask who will notify residents about outages, how much notice they expect to give, what alternatives are planned, and whom to contact if work differs from the schedule or protections described.

Ask specifically whether heat, hot water, water, gas, electricity, elevators, entrances, or outdoor areas may be interrupted or affected. Find out whether construction will limit access to amenities or common areas and whether those spaces are actually open now. A planned opening is not the same as present availability.

For each active project, useful details include the area affected, anticipated schedule, resident access routes, and the protections the TPP describes. Ask whether construction is expected to change your route to an entrance or elevator, or limit use of common or outdoor spaces. If management says that work will be completed before move-in, ask for the expected timing in writing and compare that assurance with the permit and plan information available to you.

Inspect the building at a useful time

Visit when you can observe conditions that may be less apparent during a quick showing. Notice construction noise, odors, dust, blocked access, elevator queues, and unfinished common areas. A visit can help you assess day-to-day conditions, but it cannot establish code compliance or replace checking city records. Ask which amenities are open, whether access is included in the rent, and what the lease says about outages or delayed openings. Treat verbal assurances as items to confirm in writing.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Use the visit to compare what you see with what you were told: Are common areas finished or still being worked on? Are entrances, elevators, or outdoor areas being used for construction access? Is there visible dust or debris, or noise that would matter during your normal schedule? One visit cannot predict every future condition, but it can surface follow-up questions. If you have concerns, ask management to address them before signing and keep its response with your lease records.

Check whether the specific apartment is rent stabilized

Do not infer rent regulation from a building’s age or appearance. Some apartments in buildings constructed or extensively renovated on or after January 1, 1974, may be rent stabilized when qualifying tax benefits or other programs apply. The New York State Attorney General’s Residential Tenants’ Rights Guide identifies benefits such as 421-a and J-51 as examples; this is a conditional category, not a blanket rule for new construction.

Ask in writing whether the particular apartment is rent stabilized, whether a tax benefit or regulatory agreement applies, and what rent and renewal terms will govern. If the answer is unclear, consult the state Division of Housing and Community Renewal (DHCR) or request the apartment’s rental history. NYC HPD’s Tenant Rights and Responsibilities page directs tenants who are unsure about regulation status to DHCR and its rental-history process.

Make the question unit-specific. A building’s overall age, marketing language, or another resident’s lease does not establish the status of the apartment you are considering. Ask management to state the unit’s status and the rent and renewal terms that will apply. If the response does not resolve your question, use DHCR resources or request the apartment’s rental history rather than assuming that all units in a new or redeveloped complex have the same status.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If the apartment is not regulated, the lease and applicable notice rules govern. If it is rent stabilized, the NYC Tenant Bill of Rights describes protections that include limited rent increases and renewal rights. Good Cause Eviction may also apply to some units. Coverage depends on the apartment and tenancy; a general guide cannot determine the status of a particular lease. Confirm which protections apply to your situation, and seek tenant assistance or legal advice if you need a determination for a specific dispute.

Read the lease alongside the building’s public records

Review the lease and the NYC Tenant Bill of Rights information for provisions on deposits, housing quality, eviction, harassment, and any applicable rent stabilization or Good Cause protections. Compare the written lease with what you were told about construction, amenities, access, services, and renewal terms. If an important promise is absent or unclear, ask for written clarification before signing. For a fact-specific disagreement, seek city tenant assistance or legal advice.

Pay particular attention to promises that affect daily use of the apartment: whether an amenity is available now, whether access may be limited, and what happens if an essential service is interrupted. No standard rent discount, fee, or compensation for unfinished amenities or construction disruptions is published. Do not assume one applies; ask what the lease says and get any additional agreement in writing.

Compare candidate apartments using the same questions rather than ranking them by “newness” alone. Consider whether each has a final CO or a TCO, and what the document says about terms and expiration; how much work remains and how long it is expected to last; what protections and service arrangements the TPP describes; whether amenities and access routes are usable; what rent-regulation status and renewal terms are verified; and whether the lease matches verbal assurances. There is no responsible way to choose a “best” building without a specific address and lease.

What to do if a problem starts after move-in

Document construction and service problems with the date, time, exact location, what happened, and any safety or service impact. Keep copies of messages to management and retain the 311 complaint number if you report a condition. A clear record makes it easier to explain whether the issue is recurring, where it occurs, and what you have already asked management to address.

Dust, air quality, and construction noise

NYC311 accepts reports about construction dust, including dust inside an apartment or common area. For construction-noise complaints, DOB guidance directs tenants to the Department of Environmental Protection (DEP) through 311. DOB guidance also directs renters to 311 and relevant agencies for construction-dust concerns. Use NYC311’s Indoor Air Quality guidance for dust and air-quality reporting information.

When reporting, give the building address, where the dust or noise is occurring, the dates and times, and any immediate safety or service impact. Keep the complaint number and note any follow-up. If construction conditions differ from the TPP or what management described, save relevant messages and identify the specific work or area involved when you contact the appropriate channel.

Frequently asked questions

What is a Tenant Protection Plan (TPP)?

A TPP describes the steps the building owner and contractor will take to protect tenants when construction or renovation happens while tenants are living in the building. It addresses protections such as exits, fire safety, dust and debris, pests, noise, structural safety, and essential services. The plan is tied to the work, so check which permits and work areas it covers.

Where can I find the Tenant Protection Plan?

DOB says tenants can look for TPP information in the Buildings Information System (BIS) or DOB NOW public portal by searching the building address. Ask management for the plan and active permits that apply to the work, then compare them with the public information available. A generic notice may not cover every permit or project.

Who should I call if I have a complaint about construction noise?

DOB’s tenant guidance directs construction-noise complaints to the Department of Environmental Protection through 311. For construction dust or indoor air-quality concerns, NYC311 provides reporting guidance as well. Note the address, location, dates, and effect of the problem, and keep the complaint number.

Can I move into a building with a TCO?

A TCO can permit occupancy, but it is temporary. Ask to see the current TCO, confirm that it authorizes residential use and the relevant occupancy, and ask when it expires and what remains before a final CO. The expiration and remaining steps are property-specific.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Are apartments in new buildings rent stabilized?

Not automatically, and not necessarily never. Some apartments in buildings constructed or extensively renovated on or after January 1, 1974, may qualify when tax benefits such as 421-a or J-51, or other programs, apply. Ask about the specific unit and verify through DHCR or its rental-history process if uncertain.
