What to Know Before Buying a New Construction Home in Honolulu

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Before you sign for a new-construction home in Honolulu, verify the actual project in Honolulu’s permit records, establish what inspections and final approvals have occurred, and have a Hawaiʻi real-estate attorney review the complete purchase contract and disclosures. Then model the entire ownership cost—not just the advertised price—including financing, taxes, insurance, association charges and possible construction-period uncertainty. A city inspection confirms regulatory review of permitted work; it does not replace buyer-specific advice from an independent inspector, engineer, lender or attorney.

Start with the exact parcel and project record

Marketing material can describe a home as “approved,” “nearly complete” or “move-in ready” without showing which permits, inspections or agency approvals support that description. Ask for the street address, tax-map-key information, project name, permit numbers and the legal seller. Use those identifiers to check the City and County of Honolulu Department of Planning and Permitting (DPP) record and compare it with the plans and disclosures you receive.

As an Amazon Associate I earn from qualifying purchases.

DPP’s residential function reviews permit submissions for single-family homes, two-family dwellings, duplexes and associated accessory structures. Its organization page also identifies separate reviews for zoning, coastal areas, site development, subdivision, flood, traffic, wastewater and related matters. The page explains how to request access to permit files and records: DPP organization and contacts. Request the record for the actual address rather than relying on a builder’s general description.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Documents to request before making a binding offer

  • Approved building and grading plans, permit numbers and any amendments.
  • Evidence of required agency approvals or clearances shown in the permit application.
  • Inspection history, correction notices and the status of permit closeout.
  • Subdivision, condominium or planned-unit-development documents, if applicable.
  • Current project disclosures, public reports and the complete proposed purchase agreement.

DPP’s FAQ describes ePlans routing, agency approvals, permit-fee calculations, inspection scheduling and closeout. Those procedures make the permit file useful for checking what was applied for, what was approved, what inspectors required and whether the permit is closed: DPP frequently asked questions. A permit number without a closeout or final approval is not the same as a completed home.

Ask the seller or agent to identify every permit associated with the lot, not just the primary building permit. A separate grading, demolition, accessory-structure or site-work permit may affect drainage, retaining walls, driveways or utilities. Compare the approved plan set with the sales plan: room count, square footage, parking, decks, solar equipment and accessory structures should be consistent. If the project is a condominium or planned development, request the recorded declaration, bylaws, budget, reserve information and any public report that applies to the unit.

DPP explains that permit fees are based on the fair market value of construction work and permanent equipment. A fee calculation is not a valuation of the finished home, but it can help you understand whether the file describes a minor alteration or a substantial new build. Keep copies of the records you relied on, including the date retrieved, because a project can receive amendments or additional approvals while construction continues.

Understand inspections and final approval

Honolulu’s residential code provides for final inspections after permitted work is complete and before final occupancy. Some specialized work also requires independent special inspectors during construction, with code-specified exceptions. Read the inspection record to see which inspections were required for this project and whether they passed or remain open. The governing provisions are in Honolulu code §16-1.2.

City inspections versus your own inspection

Municipal and special inspections test compliance with the approved plans and code. They are not a comprehensive condition report prepared for your interests, and they do not determine whether finishes, drainage, grading, equipment operation or workmanship meet your expectations. Ask the contract whether you may hire an independent, qualified home inspector, when that inspector may enter, and what happens if access is delayed until after substantial completion.

For a home still under construction, an inspector may offer separate visits—for example, during framing or mechanical rough-in and again before closing. The useful scope depends on the construction stage and the inspector’s qualifications. A private inspection does not transfer the builder’s contractual responsibilities or guarantee that every concealed condition can be observed.

Clarify who receives the inspection report and whether the builder must respond in writing. Ask how punch-list items are documented, who decides that they are complete and whether unresolved items permit a closing delay, an escrow holdback or another remedy. If the agreement requires notice of defects within a short period, calendar that deadline. An inspector can explain observed conditions, but an attorney should explain whether a condition is a contractual breach or supports a repair, credit or cancellation request.

Floodplain and elevation documentation

For parcels in flood-prone areas covered by Honolulu code, a licensed Hawaiʻi land surveyor must document elevation when the lowest floor is placed, before additional vertical construction, and again at completion. This is a targeted requirement, not a rule for every Honolulu lot. Check the address against current flood mapping and ask for the applicable elevation certificates or survey documentation when the parcel is covered.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Flood status can affect design approvals, insurance pricing and the timing of construction. Ask whether the project received the required elevation documentation and whether any conditions remain open. Do not assume a neighboring lot has the same designation; confirm the actual parcel and the project’s records.

Read the purchase contract as a construction-risk document

New construction is sold under project-specific documents. Read the complete purchase agreement, every incorporated exhibit, public report and amendment before signing. Have a Hawaiʻi real-estate attorney explain provisions that affect your money, deadline and remedies; a resale form or a general contractor rule may not answer the legal questions raised by a developer sale.

Terms that deserve line-by-line review

  • Deposit: Amount, escrow holder, payment schedule, permitted uses before closing, release conditions and refund triggers.
  • Completion: The stated completion or closing deadline, allowable extensions, notice requirements and what counts as substantial or final completion.
  • Late delivery: Cancellation rights, damages, interest, relocation costs and whether an extension is automatic or requires your consent.
  • Specifications: Included appliances, fixtures, finishes, landscaping, energy equipment and the process and price for buyer changes.
  • Warranty: Covered components, exclusions, claim deadlines, notice method and whether a manufacturer warranty is separate.
  • Disputes: Mediation, arbitration, venue, attorney-fee provisions and any limits on claims.
  • Shared obligations: Homeowners-association or condominium dues, budgets, reserves, assessments, maintenance responsibilities and design rules.

Do not treat a brochure, model-home display or verbal promise as part of the deal unless the promise is written into the contract or an incorporated specification. Keep a dated copy of every plan, allowance, change order and communication.

Make a deadline chart from the signed agreement. Include the dates for each deposit, loan application, appraisal, selections, inspection, notice of defects, cancellation election and closing. Identify whether a deadline is measured in calendar days, business days or days after a notice. Ask how amendments are delivered and whether an email acknowledgment is enough. Missing a notice deadline can change your options even when the underlying construction problem is genuine.

Know how Hawaiʻi contractor disclosures may apply

Hawaiʻi Revised Statutes §444-25.5 requires a licensed contractor, before contracting for home construction or improvements, to explain homeowner and project-participant lien rights and the homeowner’s option to demand bonding, including how a bond protects the homeowner and its approximate expense. It also requires a written contract containing prescribed information, signatures and execution before work begins. The statute defines “homeowner” to include owners or lessees of residential property, including condominium or cooperative units: HRS §444-25.5.

Whether and how those requirements apply to your particular developer purchase depends on the parties, transaction structure and facts. Ask counsel to analyze the agreement rather than assuming the statute automatically creates a bond, lien waiver or cancellation right for every new-home purchase.

Construction delays and deposits: rely on your documents

Project stage is a major risk distinction. A completed home lets you inspect existing work and set a closing date. An under-construction home offers more visibility but leaves schedule and completion risk. A presale may require you to commit while design, financing, approvals and construction remain in progress. Compare the stated deadline, extension clauses and remedies before choosing among them.

A Hawaiʻi condominium public-report example illustrates why the exact paperwork matters. The sample describes a completion deadline and circumstances in which purchaser deposits under a binding sales contract may be used before closing for specified project costs; it also describes cancellation as one possible remedy in the example’s language. It is an older, project-specific report, not a universal rule or promise of recovery. Obtain the current report and contract for your project and have them reviewed: sample condominium project report.

Questions to ask about a late delivery

  1. What date is legally binding, and is it a completion date, a notice-to-proceed date or an estimated closing date?
  2. Which events permit extensions—weather, labor, materials, government action, buyer changes or financing?
  3. Must the seller give written notice, and how much notice is required?
  4. Can you cancel and receive the deposit, and are there deadlines or election procedures?
  5. May the seller use deposits before closing, and what escrow controls or disclosures apply?
  6. Who pays temporary housing, storage, rate-lock extensions or other delay costs?

Ask for a written construction-status update before each major payment. Confirm whether the stated completion date is still realistic, which inspections remain, and whether any change orders affect price or schedule. Keep enough cash for rent, storage, rate-lock extensions and moving costs if the home is not ready when expected. Do not make a nonrefundable travel, lease-termination or sale-of-another-home decision solely on an informal estimate.

Compare project alternatives using the same scorecard

When you have more than one new home or project under consideration, use written evidence instead of a broad “new is better” assumption.

Comparison What to verify
Project stage Completed, under construction or presale; stated delivery date; extension language; remedy for delay.
Deposit exposure Amount, escrow holder, permitted pre-closing use, refund triggers and cancellation procedure.
Approval evidence Permit status, inspection results, special-inspection records, final approval and flood documentation where applicable.
Total cost Loan rate and fees, down payment, closing costs, property tax, homeowner’s insurance and association or maintenance charges.
Financing fit Income and purchase-price limits, owner-occupancy rules, leasehold terms and resale restrictions.
Included value Finish package, allowances, change-order prices, warranty scope, association budget and dispute terms.

A lower contract price can be outweighed by higher association dues, a leasehold obligation, expensive upgrades or a deposit that is difficult to recover. A completed unit can reduce schedule uncertainty but may offer less ability to select finishes. The right choice depends on your cash reserves, move-in deadline, tolerance for construction risk and financing eligibility.

Use the same assumptions for every option. Compare the lender’s annual percentage rate and fees, not just the advertised interest rate; compare the same down payment, tax estimate, insurance quote and association charges. For a presale, test a higher eventual payment and a later closing date. For a completed home, budget for immediate maintenance and any items excluded from the builder’s warranty. Record which figures are estimates and ask when each will be updated.

Check Hawaiʻi first-time-buyer and other HHFDC financing

The Hawaiʻi Housing Finance and Development Corporation (HHFDC) describes several pathways, including the Equity Pilot (a 0% 30-year second mortgage), a leasehold pathway, the Hale Kamaʻāina mortgage program and the Mortgage Credit Certificate. Eligibility can involve age, Hawaiʻi domicile, income, no majority interest in real estate, occupancy and property requirements. Availability and detailed rules can change, so use the current HHFDC homebuyer guidance and apply through a participating lender.

Hale Kamaʻāina details to confirm

HHFDC’s Hale Kamaʻāina FAQ, updated September 4, 2026, describes competitive fixed-rate 30-year mortgages through participating lenders and says the program’s target is a rate at least 50 basis points below market. The actual difference depends on prevailing rates. Potentially eligible property types include new and existing single-family homes, townhomes, planned-unit developments and condominiums, subject to income and purchase-price caps, occupancy and other rules. The FAQ states that amendments concerning a second mortgage were still pending when published; do not promise a second mortgage or quote a rate without a current lender determination: Hale Kamaʻāina FAQ.

Ask a participating lender to confirm eligibility for the exact project, especially if it is leasehold, a condominium or an assisted-affordable unit. Verify income and purchase-price caps, owner occupancy, required counseling or documentation, and whether the lender can close on the project’s expected schedule. A preapproval is not a guarantee that the finished property will satisfy underwriting or appraisal requirements.

Budget for the construction timeline

HHFDC’s 2026 homebuyer page gives a general application-to-closing timeframe of one to four years for new-construction projects. That is program guidance, not a prediction for every Honolulu development. A long timeline can affect rent, rate locks, employment, household plans and the expiration of lender documents.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
HHFDC illustrative figure How to interpret it
3–5% down payment Example guidance on the 2026 HHFDC page; not a universal lender requirement.
$5,000–$10,000 closing costs Illustrative budget range from HHFDC, not a Honolulu market survey or guaranteed quote.
$500 good-faith deposit Illustrative HHFDC example; your contract may require a different amount.
$11,000–$25,000 down on a $500,000 unit HHFDC’s example calculation, not a commitment for your loan.

HHFDC notes that monthly ownership costs include the mortgage, HOA or maintenance fees, property taxes and homeowner’s insurance. Build a lender worksheet that also includes utilities, maintenance reserves, parking or storage charges, special assessments and any lease rent. If the unit receives assisted-affordable financing, read deed restrictions: HHFDC describes owner-occupancy requirements, possible state rights of first refusal and shared-appreciation obligations for relevant assisted units. Those restrictions do not apply to every new home.

Use a staged due-diligence checklist

Before submitting an offer

  • Obtain the parcel address, permit numbers, project disclosure and proposed contract.
  • Get an independent lender’s estimate of cash to close and monthly payment under current rates.
  • Ask whether the home is fee simple or leasehold and identify all association entities.
  • Confirm the contract’s inspection, financing, appraisal and cancellation contingencies.
  • Ask which finishes, appliances, parking spaces and storage areas are included rather than shown only in the model.

During contract review

  • Mark every deadline for deposits, financing, selections, inspection, closing and notices.
  • Match each promised feature to a specification, allowance or signed change order.
  • Identify who bears overruns, upgrade costs, taxes and association charges before closing.
  • Ask counsel to explain arbitration, warranty claims, lien rights, bonding language and deposit remedies.
  • Confirm how construction updates, amendments and notices must be delivered.

Before closing

  • Recheck DPP inspection status and final approval for the actual address.
  • Complete the permitted independent inspection and document defects with photographs and written notices.
  • Confirm the certificate or approval required for occupancy, utility connections and access roads.
  • Compare the closing disclosure with the contract, including loan fees, prepaid taxes, insurance and association charges.
  • Obtain warranty instructions, appliance manuals, keys, codes and a written punch-list completion plan.
  • Verify that promised repairs and change-order credits appear in the final settlement documents.

Common mistakes and practical fixes

“The permit means the home is finished.”

A permit authorizes work under approved plans; it does not prove every item is complete or that final approval has been issued. Fix: obtain the inspection history and closeout evidence.

“The model home is the specification.”

Models often contain upgrades. Fix: price every selection in the signed specification and change-order schedule.

“A government inspection replaces my inspection.”

Code inspections serve regulatory purposes. Fix: ask for independent inspection access and understand the agreement’s deadlines.

“A program example is my guaranteed loan.”

HHFDC figures are illustrative and eligibility is fact-specific. Fix: obtain a current determination from a participating lender and preserve cash for delays or changes.

“The deposit is always refundable if the builder is late.”

Remedies depend on the actual contract, project report and applicable law. Fix: identify the deadline, extension rules, cancellation process and escrow provisions before signing.

“The advertised monthly payment is the ownership cost.”

A mortgage quote may omit association dues, taxes, insurance, lease rent, parking, maintenance or assessments. Fix: build a complete monthly budget and test it against a delayed closing or higher insurance cost.

Make the decision only after the evidence matches the contract

A sound Honolulu new-construction purchase has a traceable chain from parcel to permit, inspection, final approval, contract, financing and ownership budget. If one link is missing—such as an unexplained permit status, an open-ended completion date, unclear deposit use or an unaffordable association obligation—pause and obtain professional advice before becoming nonrefundable. The address-specific records and documents, not the label “new,” determine the risk you are accepting.

Frequently Asked Questions

How do I check permits for a new construction home in Honolulu?

Ask for the exact address, tax-map-key information and permit numbers, then request the DPP permit file and compare approved plans, agency approvals, inspection history, correction notices and closeout status. DPP’s organization page explains residential records access, and its FAQ describes ePlans routing, inspections and closeout.

Should I get an independent inspection on a new construction home?

Consider a qualified private inspector if the contract permits access. City and special inspections address code compliance, not every condition important to a buyer. Depending on the stage, separate framing, rough-in and pre-closing visits may be useful.

What happens to my deposit if the builder is late?

There is no universal answer. Read the completion deadline, extension clauses, escrow terms, permitted pre-closing use, cancellation procedure and notice deadlines in your contract and current project disclosures. Have a Hawaiʻi attorney interpret the remedies.

Can a first-time buyer use an HHFDC mortgage for a new Honolulu home?

Potentially. HHFDC describes programs for eligible borrowers and says Hale Kamaʻāina may cover new single-family homes, townhomes, PUDs and condominiums, subject to income, price, occupancy and other rules. Apply through a participating lender for a current determination.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

How long can a new-construction purchase take with an HHFDC program?

HHFDC’s 2026 homebuyer page gives a general one-to-four-year application-to-closing timeframe for new-construction projects. It is program guidance, not a guaranteed schedule for a particular development.

What costs should I include beyond the purchase price?

Include the down payment, closing costs, mortgage, property taxes, homeowner’s insurance, HOA or maintenance fees, utilities, maintenance reserves, parking or storage charges, special assessments and any lease rent. HHFDC’s examples—3–5% down, $5,000–$10,000 closing costs and a $500 good-faith deposit—are illustrative, not universal.

Does every Honolulu lot need flood-elevation certificates?

No. Honolulu code’s elevation documentation requirement targets covered flood-prone areas. Confirm the actual parcel’s flood status and request the survey or elevation records when the project falls within the applicable area.

What should I ask for before signing a presale contract?

Request the current project disclosure or public report, complete contract and exhibits, deposit and escrow terms, binding completion date, extension and cancellation provisions, finish specifications, warranty, association documents and financing requirements. Have local counsel review the package.

The Bottom Line

Before making your Honolulu new-construction deposit nonrefundable, match the exact parcel to DPP records, confirm inspections and final approval, understand every delay and deposit provision, and obtain a current lender review of the total ownership budget. Use qualified local professionals when the records, contract or financing terms are unclear.
