What to Know Before Building a Custom Home in the Florida Keys

A vacant lot is not a guarantee you can build. Check land use, habitat, ROGO allocation, flood rules, utilities, and permits for the specific parcel first.

Before designing a custom home in the Florida Keys, confirm that the specific parcel can support one. A vacant lot is not proof of buildability: jurisdiction, land-use rules, habitat limits, residential allocation, flood requirements, utilities and outside-agency approvals can all shape whether—and where—you may build.

Can you build on a vacant lot in the Florida Keys?

Only parcel-specific due diligence can answer that. Start by identifying whether the property is in unincorporated Monroe County or within a municipality; county rules and permit services should not be assumed to apply identically everywhere. For a county parcel, use Monroe County’s Building Department resources to research parcel records and permit history.

Review the parcel’s future land-use designation, zoning or land-use district, density, setbacks, open-space requirements, clearing limits, habitat mapping, easements, deed restrictions, and prior permits or code cases. Monroe County’s Planning Department Research Guide points readers to the records and land-development topics to investigate; the county’s Environmental Resources material explains why habitat and environmental rules can constrain development.

Check active, completed, and expired permits and any code cases before relying on an existing structure or assuming prior work was approved. The county distinguishes newer online records from permits processed before October 1, 2022, which remain in a legacy system. Ask the county how to locate the relevant record if it is not in the current online portal.

Do you need ROGO approval in Monroe County?

Monroe County administers residential ROGO, a competitive permit-allocation system intended to direct growth toward areas with infrastructure and away from velocity zones and environmentally sensitive habitat. ROGO status is one part of feasibility; allocation does not replace land-development, building, flood, or other permit requirements. Check the county’s Planning and Environmental Resources information and confirm the parcel’s status with county staff before purchasing or committing to a design.

As of October 4, 2026, the county says the final quarter of the current market-rate allocation pool closed July 13, 2026. Residential building-permit applications submitted after June 12, 2026 will continue to be accepted and reviewed, but applicants cannot submit a ROGO application until a new allocation period begins under amendments still in process. The county anticipates July 13, 2027, but that date is not guaranteed. Verify current rules and any parcel-specific allocation or transferable development rights directly with the county.

How high does a Florida Keys home need to be elevated?

There is no single elevation requirement that can be applied to every Keys parcel. Monroe County Emergency Management says the entire county lies in a floodplain and reports countywide base flood elevations ranging from 6 to 17 feet above mean sea level. That range is not the required elevation for an individual lot. Obtain the property’s flood zone and applicable base flood elevation, then have qualified design professionals confirm the home and mechanical-equipment elevations required for that site.

The county’s Building Responsibly guidance recommends knowing the flood zone, elevating buildings and equipment above flood levels, and using flood openings where required. Coordinate with the Building Department or floodplain official before finalizing plans. Flood exposure can also affect insurance; Monroe County says its participation in the National Flood Insurance Program’s Community Rating System has garnered 25 percent residential-plan discounts in unincorporated Monroe County. That is not a guaranteed premium for every policy, so confirm current terms with an insurer.

Can the space under an elevated house be living space?

Do not count below-base-flood-elevation space as habitable floor area unless the approved plans and applicable rules expressly allow the proposed use. County guidance describes lower enclosures as limited to access, parking, or limited storage, and warns that finished lower areas may be unpermitted and subject to enforcement. Check the approved plans and current requirements for an existing home or proposed design before enclosing or finishing that space.

Is sewer available at your lot?

Confirm wastewater service for the exact parcel, rather than assuming that nearby homes establish availability. The Florida Department of Health in Monroe County says central sewer is almost universally available and parcels where it is available must connect. Remaining septic systems are rare in the Keys and are required to be performance-based treatment systems. Ask the provider and county about the connection point, capacity, fees, and any conditions for the lot.

Separately verify water service, electric provider and connection, road access, drainage, and any extension obligations with the relevant provider or agency. Availability and connection costs are site-specific; the official information cited here does not establish a utility-cost figure for an individual property.

How do you get a Monroe County building permit?

After feasibility is established and plans are coordinated, the permit applicant must submit the required package and obtain approvals before construction. Monroe County states: “Before commencing construction, the contractor, owner, or builder must apply for a permit.” County reviews can involve planning, environmental, structural, plumbing, mechanical, electrical, floodplain, and fire requirements. Other agencies may also need to approve the project, and the applicant remains responsible for coordinating with them.

  1. Confirm jurisdiction and parcel status. Check the county or municipal boundary, land-use and habitat constraints, ROGO status, flood information, utilities, and permit or code history.
  2. Develop site-specific plans. Work with qualified design professionals to address the buildable envelope, flood elevation, access, utilities, and applicable environmental requirements.
  3. Register and submit through the county’s online permitting system. Use Monroe County’s Building Department page for account registration, submission references, permit searches, inspection scheduling information, and the fee estimator.
  4. Resolve reviews and outside approvals. Respond to county review comments and obtain any approvals required from other agencies before work proceeds.
  5. Schedule inspections and complete the project. Keep approved plans available for inspections and follow the county’s scheduling instructions. The county says permit holders are emailed when a Certificate of Occupancy is ready.

A limited exemption effective July 1, 2026 applies to some single-family work under $7,500, subject to restrictions including not being in a flood hazard area and not involving structural, electrical, plumbing, mechanical, or gas work. It is not an exemption for a new custom home and does not remove Land Development Code obligations.

What should you compare when choosing a lot or building team?

Compare parcels using documented, site-specific facts rather than asking only whether a lot is “buildable.” Useful comparison points include:

  • Jurisdiction and confirmed land-use designation
  • Buildable area, habitat constraints, setbacks, clearing limits, and easements
  • ROGO or other allocation status and timing
  • Flood zone, applicable elevation, and lower-enclosure limits
  • Sewer, water, electric, access, and drainage arrangements
  • Prior permit records, expired permits, and code cases
  • Site-specific estimates for design, approvals, utilities, foundation, and construction scope

When evaluating a builder or design team, verify Florida licensure and insurance, experience with elevated coastal construction, familiarity with Monroe County reviews, and who is responsible for outside approvals. Ask how allocation contingencies are handled in the contract. The official sources establish the importance of these checks but do not endorse or rank particular providers.
