A promised handover date is not always a guaranteed completion date. When buying a new-build home, first establish which date is only an estimate, which date is binding under the contract, and whether a long-stop or sunset date gives you a way out after an excessive delay. Then test the practical consequences: could your mortgage offer expire, will you need to extend a tenancy, and what happens to your deposit if the date moves?
The answer depends on the contract and jurisdiction. UK, New South Wales (NSW) and Victorian rules use different terminology and protections, so advice for one location should not be treated as a universal rule. A conveyancing solicitor or property lawyer in the relevant jurisdiction should explain the actual contract before you exchange or sign.

Why new-build completion dates move
Developers usually give buyers a forecast based on the work remaining, expected labour and materials, inspections and approvals. That forecast can change. An estimated finish date may move later, and UK government home-buying guidance specifically advises buyers to ask what happens if the expected finish is delayed or brought forward.

Common causes are explanations, not automatic excuses
- NSW government guidance identifies shortages of materials and skilled workers as possible contributors to delay.
- Consumer Affairs Victoria discusses inclement weather and breaks in continuity, such as time for a concrete slab to cure, as foreseeable delay categories in Victorian domestic building contracts.
- Permits, inspections, utility connections, certification and other approvals can affect when a home is legally ready, even if most visible building work appears complete.
These examples are not exhaustive and do not automatically entitle a builder to extra time. Ask the developer to identify the actual cause, the work affected, the expected duration, the remaining critical tasks and the contractual provision being relied on.
Three dates you must distinguish
Sales conversations often use “completion”, “handover” and “finish” interchangeably. Your contract may not. Put every date into one of these categories and ask your conveyancer to explain the defined terms.
| Date or term | What it usually means | Questions to ask |
|---|---|---|
| Estimated finish or handover date | A forecast that can change as construction progresses. | When was it last updated? What work and approvals remain? How will changes be reported? Can the developer bring completion forward? |
| Contractual completion or finish date | The date or deadline described in the signed contract. Its legal effect depends on the wording, conditions and permitted extensions. | Is it binding, or subject to a stated allowance or trigger? What counts as completion? What notice is required for an extension? |
| Long-stop or sunset date | A final date after which the contract may give a party a right to end the transaction or take another specified action. | Who may terminate, how is notice served, can the date be extended, and what happens to the deposit and other costs? |
In UK guidance, a long-stop date can be written into the contract to permit withdrawal after long delays. That does not mean every contract has one, or that the buyer can cancel immediately when an estimate slips. Read the actual clause and follow its notice requirements.

Before you sign or exchange: the delay clauses to check
Exchange of contracts in England and Wales is a legal commitment. NSW and Victorian building and off-the-plan contracts have their own requirements and terminology. Before signing, have a qualified local adviser answer each of the following in writing where possible.
1. What date controls?
Ask whether the stated date is an estimate, a fixed contractual date, a date calculated from a trigger, or a date subject to extensions. In Victoria, a domestic building contract may tie the start date to permits or another contractual trigger rather than the day workers first appear on site. A similar distinction may matter to the calculation of the finish date.
2. What does “complete” mean?
Find out whether completion requires practical construction only, or also occupation certificates, inspections, utility connections, landscaping, title registration and other approvals. Ask how minor unfinished items are treated and whether they can remain after legal completion under a defects process.
3. Which events allow extra time?
The clause should identify delay events, the time allowance for each, and the method of calculation. Victoria’s consumer guidance says foreseeable delay types should be accounted for and the allowed time stated. Check whether the builder must prove the event, mitigate its effect, give notice and provide a revised date.

4. What notice must you receive?
Look for a required delivery method, deadline, evidence and content. A useful notice should identify the cause, the affected work, the extension claimed, the revised expected date and any action required from you. Do not assume an informal email or phone call changes the contract.

5. Is there a long-stop or sunset date?
Check the exact date, the trigger for counting time, any permitted extension and the consequences. NSW off-the-plan guidance specifically tells buyers to ask whether sunset or completion dates can be extended and what delay costs or penalties may apply. A clause that allows an extension is materially different from one that gives only the buyer a termination right.
6. What happens to the deposit?
Ask whether a withdrawal at the long-stop or sunset date returns the deposit, whether deductions are permitted and how notice must be served. The answer is contract- and jurisdiction-specific; do not rely on a sales representative’s verbal assurance.
7. Can completion happen earlier?
UK guidance tells buyers to consider both a delayed and an earlier expected finish. Ask how much notice the developer must give, whether your lender can complete on that timetable, and whether the home must meet the same completion conditions.

How to track a moving forecast
Do not wait for a missed date before asking for evidence. Request a written update at agreed intervals and keep a dated record of every forecast and notice.
- Request the current programme. Ask for the latest expected finish date, the remaining work, inspections and approvals, and the activities on the critical path.
- Ask what changed. Require a plain-language explanation of the delay, when it began, who or what is affected and whether the cause is continuing.
- Test the revised date. Ask how the developer calculated it, what assumptions it makes and what contingency remains.
- Match the notice to the contract. Check that the claimed extension uses the contract’s stated event, allowance and notice procedure.
- Update your own plan. Record the latest date in your mortgage, tenancy, removals, storage and leave arrangements, while keeping a contingency period.
A forecast without the remaining work and approvals is difficult to evaluate. Progress photographs can be useful, but they do not replace the contractual definition of completion or required certificates.
Mortgage, rent and moving consequences
Mortgage offers can expire
UK government guidance warns that mortgage offers last for a limited period and may need refreshing if a build is delayed. Ask your lender, before exchange, how long the offer and any rate lock remain valid, whether an extension is available, what fee or re-underwriting may apply, and what happens if your financial circumstances or the valuation changes.
Do not assume a lender will preserve today’s rate until the developer is ready. A delayed completion can require a new offer, updated documents or a new valuation. The lender’s written terms, not a general promise from the developer, control your borrowing.

Temporary accommodation may continue
If you are selling a home, ending a tenancy or booking removals, build a contingency plan. A delayed handover can mean extra rent, storage, hotel costs, mortgage interest on another property or repeated moving arrangements. Ask the developer whether any compensation is promised; do not treat compensation as automatic unless the contract or applicable law says so.
Use a decision date
Set a personal date before your contractual long-stop or sunset date at which you will reassess affordability and plans. At that point, obtain an updated mortgage position, tenancy cost and completion forecast, and ask your adviser whether any notice or protective step is needed. A personal decision date does not change the legal deadline.
Jurisdiction-specific points
England and Wales: contract, exchange and long-stop wording
GOV.UK’s “How to buy a home” guidance says the contract is central when an expected finish date changes. It describes a long-stop date as a contractual provision that can permit withdrawal after long delays. Have your legal representative explain the exchange commitment, the contractual completion definition, extension clauses, mortgage-offer timing and the procedure for serving any notice.

It also recommends considering a snagging inspection after construction and before completion. UK practice and remedies can differ by contract and by the part of the UK involved, so obtain advice for the property’s location.
New South Wales: off-the-plan sunset dates and delay costs
NSW government guidance for off-the-plan buyers says to check whether sunset or completion dates can be extended and what extra costs or penalties may apply when building starts late. Before signing, discuss the timeframe and budget, understand the extension mechanism and confirm what happens to the deposit if the relevant date is reached.
NSW guidance on home-building delays identifies materials and skilled-worker shortages as possible causes and advises checking required Home Building Compensation cover for qualifying work. These points do not determine the rights under every off-the-plan contract. A NSW conveyancer or property lawyer should review the precise sunset clause, notice requirements and termination consequences.
Victoria: allowances for foreseeable delay
Consumer Affairs Victoria says domestic building contracts should account for foreseeable delay allowances, including inclement weather and continuity breaks such as time for a slab to cure, and should state the allowed time. It also explains that the contractual start date may be linked to permits or another trigger rather than the first day workers attend the site.
Those rules concern Victorian domestic building contracts. They should not be applied automatically to an off-the-plan purchase or to a completed-home contract elsewhere. Ask a Victorian adviser which provisions apply to your document and whether a claimed extension has been calculated and notified correctly.

What to do when the date slips
- Read the contract immediately. Locate the completion date, extension events, notice clause and long-stop or sunset provision.
- Request a formal update. Ask for the cause, work affected, revised date, approvals outstanding and contractual basis for the extension.
- Notify your lender. Give the lender the revised forecast and ask whether the offer or rate lock remains valid and what documents are required.
- Protect accommodation. Extend a tenancy or storage booking only after checking cancellation terms and likely costs. Keep receipts for delay-related expenditure.
- Take legal advice before serving notice. A wrongly timed or informal notice can affect termination and deposit rights.
- Keep communications factual. Save contracts, plans, notices, emails, photographs, inspection reports and a dated chronology.
If the developer refuses to explain the delay, claims an extension outside the contract or proposes a new date that creates serious financing risk, escalate to a qualified conveyancing solicitor or property lawyer in the relevant jurisdiction. Do not assume that a delay automatically permits cancellation, damages or refusal to complete.
Handover, inspection and snagging
A snagging list records defects, incomplete work and items that do not match the specification. UK buyer guidance recommends arranging an inspection after the home has been built and before completion. You can inspect yourself or use a professional snagging survey provider, then report the issues to the developer.
Prepare for the inspection
- Take the signed specification, plans, finishes schedule and any agreed variations.
- Check rooms, external areas, fixtures, doors, windows, plumbing, heating, ventilation and visible workmanship.
- Photograph each issue and label its location and date.
- Separate safety or water-ingress concerns from cosmetic items so urgent defects are clear.
- Send a numbered list through the contract’s stated communication channel and keep proof of delivery.
Before making an offer, ask what will be fixed before completion, what may be completed afterwards and how disputes are handled. A snagging report does not automatically postpone legal completion or create a right to withhold payment. Whether an issue affects completion depends on the contract and local law.
Practical questions for the developer
- What is the current expected finish date, and when was it last reviewed?
- Which construction tasks, inspections, certificates and utility connections remain?
- What caused any slippage, when did it start and is the cause continuing?
- How is the revised date calculated, and what contingency remains?
- Which contractual extension clause applies, and when will formal notice be issued?
- Can completion occur earlier, and how much notice will you provide?
- What is the contractual long-stop or sunset date, and can it be extended?
- If that date is reached, what happens to the deposit, costs and termination rights?
- When can I inspect or commission a snagging survey?
- How will defects be recorded, prioritised and remedied?
Planning without misleading averages
There is no official construction-duration or new-build delay-rate figure in the material available for this topic. Do not use a generic build-time range as a promise for your site. Ask for a project-specific programme and identify the assumptions behind it.
For context only, the UK Ministry of Housing, Communities and Local Government’s 2026 home-buying and selling reform roadmap reports around 120 days from an accepted offer to completion and around one in three transactions falling through. Those figures describe the wider home-transaction process, not the time needed to construct a new home and not a new-build delay rate. They should not be used to forecast your build.
When professional help is worthwhile
Have a conveyancing solicitor or property lawyer explain the contract before exchange or signing, especially where the date is subject to extensions, a sunset clause can be extended, or your financing depends on a narrow completion window. An independent snagging survey can provide a systematic record of unfinished work and defects, but it does not replace legal advice.
For a live dispute, use a qualified professional who is licensed or authorised in the property’s jurisdiction. The correct remedy may involve a contractual notice, negotiation, a statutory process or a claim; choosing the wrong step can jeopardise deposit and termination rights.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsThe Bottom Line
Plan around the contract, not the sales estimate: identify the binding completion mechanism, extension rules and long-stop or sunset date; confirm how a delay affects your mortgage and accommodation; and document defects before handover. Because the legal effect differs between the UK, NSW and Victoria, obtain local advice before signing, serving notice or attempting to withdraw.
