Before demolition, deliveries, or deposits, you and the contractor should sign a dated written agreement that identifies the parties and property, defines the work and materials, states the price and payment milestones, sets estimated start and completion dates, assigns permit duties, and captures every promise made during bidding. Fill every blank, make later changes in signed writing, and keep a complete copy. Contract, licensing, deposit, permit, and cancellation rules vary by state and locality, so use this as a practical U.S. checklist and verify requirements with the authorities where the project is located.
Why a written remodeling contract matters
A remodeling contract turns a conversation and an estimate into a record of what each side agreed to do. The Federal Trade Commission (FTC) says a home-improvement agreement should be clear and concise and cover the “who, what, where, when, and cost” of the project. A written document also gives you something specific to use when a finish, deadline, allowance, or payment is disputed.

State and local law may require particular language, license information, deposit limits, disclosures, lien notices, or cancellation forms. No general checklist can identify every mandatory clause without knowing the project’s jurisdiction, type, financing, and signing location. Even where a written contract is not required, ask for one and do not allow work to start until both parties have reviewed and signed it.
1. Identify the parties, property, and authority to sign
Start with the legal identities of everyone responsible for the agreement. A trade name alone can make it difficult to establish who owes performance or who should receive a formal notice.

- Homeowner: the full names of all owners who are parties to the agreement and the address for notices.
- Project property: the complete street address, unit or lot number if applicable, and a description of the areas included in the work.
- Signing authority: the name and title of the contractor representative who is authorized to bind the business, plus the date each party signs.
Independently verify a license with the relevant state or county office when licensing applies. Ask the contractor for proof of current insurance and check references and complaint information rather than relying only on verbal assurances. The FTC recommends these checks as part of hiring a contractor.
2. Define the scope so “complete” has a measurable meaning
The scope section is the contract’s working map. Describe what will be demolished, removed, repaired, installed, tested, cleaned, and left in place. A sentence such as “renovate the kitchen” is too vague to resolve what happens to cabinets, wiring, flooring, drywall, appliances, and debris.
Describe each area and task
- Name every room, exterior area, structure, or system covered by the project.
- List demolition and protection work, including what is removed, salvaged, stored, or protected from dust and damage.
- Describe installation and finishing tasks in an order that follows the work: framing, plumbing, electrical, insulation, drywall, cabinetry, flooring, painting, trim, fixtures, testing, and cleanup where applicable.
- State what is expressly excluded. Exclusions can be as important as included work, particularly for structural repairs, hazardous-material abatement, landscaping, utility upgrades, appliance connection, and restoration outside the work area.
- Specify who supplies each item: homeowner, contractor, or a named subcontractor.
Name materials and performance requirements
When a product is known, record its manufacturer, model or product line, size, color, grade, finish, and required performance specification. If an exact selection is not yet made, identify the allowance and the deadline for choosing it. Include installation standards or drawings when they control the result, and attach them to the signed agreement so a later version cannot silently replace them.

If a salesperson or contractor made a promise in a call or meeting about labor, materials, cleanup, access, or a feature, write it into the contract or an attachment. The FTC specifically advises including promises made during conversations.

- One-Handed Loading - Keep one hand free with a 1/4 in. hex chuck that accepts 1 in. bit tips
3. State the price, allowances, and included costs
Put the agreed contract price in a prominent location and explain exactly what it includes. Identify whether the price is fixed, an estimate, cost-plus, or a combination. A number labeled “estimate” should not be presented as a guaranteed final price unless the agreement makes it one.
| Cost item | What the contract should say |
|---|---|
| Total contract price | The amount for the defined base scope, with taxes, labor, delivery, disposal, supervision, and ordinary overhead identified as included or excluded. |
| Allowances | The dollar allowance, the item it covers, whether labor to install it is included, and how the price changes if the selection costs more or less. |
| Unfixed work | The method for pricing work that cannot yet be measured, such as a unit rate, time-and-material rate, or written quotation before authorization. |
| Potential extra costs | Known conditions that could affect cost, such as concealed damage, utility relocation, or code-required upgrades, with a process for approving them. |
Record every labor and material cost promise made during a call, visit, or sales presentation. If the contractor says a fee is included, identify it rather than leaving the statement outside the contract. Make clear whether permit fees, design fees, engineering, testing, temporary protection, storage, and final cleaning are included.
4. Set dates, phases, and access expectations
Include estimated start and completion dates, as FTC consumer guidance recommends. For a complex project, add phases or milestones such as demolition, rough inspections, drywall, cabinet installation, substantial completion, and final completion. State how the schedule is affected by owner selections, material availability, inspection delays, weather, or events outside either party’s control.

- Identify who provides utilities, parking, storage, temporary toilets, security, and a safe path through occupied areas.
- State how delays will be reported and how an agreed extension is documented.
- Define substantial completion and final completion if those dates trigger payments or the punch list.
Dates should be realistic estimates, not promises the evidence cannot support. If the contractor will use subcontractors, require the schedule to account for their work and inspections.

5. Tie payments to completed work
Write the deposit, each progress payment, the due date or triggering event, and the amount or percentage. The FTC contractor guide recommends a payment schedule for the contractor, subcontractors, and suppliers and says progress payments should be contingent on defined amounts of completed work.
| Payment term | Detail to specify |
|---|---|
| Deposit | Amount, due date, what it funds, and any state or local limit that applies. |
| Progress draws | Completed milestone, inspection or evidence required, amount due, and process for identifying incomplete work. |
| Selections and allowances | When the homeowner pays for an upgrade or receives a credit for a lower-cost selection. |
| Final payment | Whether it follows substantial completion, completion of the punch list, delivery of closeout documents, or another defined event. |
Do not pay the entire contract amount up front. Deposit limits and other payment restrictions differ by jurisdiction, so check local law before agreeing to a percentage. The contract should also say where and how payments are made, what invoices must show, and how disputed amounts are handled without stopping payment for work that is undisputed.
6. Assign permits, inspections, and code responsibilities
State who obtains every required building, electrical, plumbing, mechanical, zoning, or other permit and who pays the associated fees. The FTC guide specifically recommends including the contractor’s obligation to obtain necessary permits when that is the agreed arrangement.

- Require permit numbers and inspection results to be shared with the homeowner.
- Clarify who corrects failed work and whether correction costs are included when the failure results from the contractor’s work.
- Do not assume a contractor’s statement that “no permit is needed” is conclusive; confirm with the local building department.
Permit requirements depend on the project and jurisdiction. A contract can allocate responsibility between the parties, but it does not excuse either party from complying with applicable law.

7. Require signed change orders for changes and hidden conditions
Remodeling often reveals conditions that could not be seen before walls or floors were opened. Protect both sides by requiring a written, signed change order before changed work begins whenever practicable.
Each change order should identify:
- the original scope being changed;
- the added, deleted, or substituted work and materials;
- the increase or decrease in price, including taxes and allowances;
- the schedule impact and any revised milestone; and
- the signatures and dates of the homeowner and authorized contractor representative.
If immediate action is needed to prevent damage, require prompt written notice describing the condition, temporary measures, and a not-to-exceed amount until a full change order can be signed. This written-change recommendation is practical risk control; the FTC checklist does not prescribe a particular change-order clause.

If the contractor offers a workmanship warranty, state its duration, what it covers, exclusions, the notice method, and the response or repair process. Manufacturer warranties for appliances, windows, roofing, or equipment are separate; identify who registers them and who gives the homeowner the warranty documents.

Define completion and punch-list procedure
- Explain how the homeowner reports incomplete or defective items.
- Set a reasonable process for inspecting and correcting punch-list work.
- State whether a portion of the final payment is held until listed items are completed, subject to local law.
- Describe the condition in which the site must be left: debris removal, surface cleaning, touch-up work, removal of temporary protection, and return of keys or access devices.
List closeout documents
Specify the documents delivered at completion, such as final inspection approvals, receipts, product manuals, maintenance instructions, warranties, lien releases or waivers where applicable, and copies of approved change orders. Local law may govern the form and timing of lien documentation.

9. Understand the conditional three-business-day cancellation notice
FTC guidance says a contract should include a written statement of a three-business-day cancellation right when the agreement was signed in the home or somewhere other than the seller’s permanent place of business. That is a conditional federal Cooling-Off Rule situation, not a universal three-day right for every remodeling contract.
Before relying on a cancellation deadline, confirm whether the transaction qualifies under the federal rule and whether state law provides a different or additional right. The contract should explain the method and address for sending a cancellation notice if a right applies. Do not describe the period as available merely because a project is residential or because the homeowner changed their mind.
10. Compare bids and draft contracts on equal terms
Obtain multiple written estimates when practical, then compare what each document actually promises. The lowest headline price can be higher after exclusions, allowances, missing permits, or a front-loaded payment schedule are accounted for.

11. Complete a final review before signing
- Read the entire agreement and every attachment, including fine print on the reverse side.
- Fill every blank. If a section does not apply, write “not applicable” rather than leaving it open.
- Check that names, addresses, license information, price, allowances, dates, payment milestones, and scope match the final negotiation.
- Confirm that verbal promises appear in the contract or a dated attachment.
- Verify the contractor’s license and insurance independently and confirm permit responsibility with the local authority.
- Ask questions and request corrections in writing; do not sign under pressure or while material terms remain undecided.
- Make sure both sides sign and date the same complete version before work or payment begins.
- Store the signed contract with estimates, plans, receipts, photographs, correspondence, permits, inspection records, and change orders.
The FTC’s consumer advice is direct: do not start work until you have reviewed and signed a written contract. A knowledgeable friend or attorney can optionally review an unusually complex, high-value, financed, or disputed agreement; that review is not a requirement for every homeowner.
12. If a problem develops after signing
First compare the disputed work or invoice with the signed scope, payment milestone, and change orders. Notify the contractor in writing, identify the specific clause or missing work, and propose a concrete cure and date. Keep communications factual and preserve photographs and receipts.
If the issue cannot be resolved, consult the state or local consumer-protection, licensing, or building authority about available complaint and dispute-resolution processes. USAGov maintains a directory of state consumer protection offices. For a major dispute, lien threat, injury, or contract with financing or unusual liability terms, consider advice from a construction or consumer-law attorney licensed in the project’s jurisdiction.
