What to do when paint, cement or bitumen is delayed or unavailable

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When a specified paint, cement or bitumen product is late or unobtainable, stop and establish the facts before buying a replacement or changing the sequence of work. Record the order and delivery evidence, identify the activity that is blocked, check the contract’s notice and substitution rules, and obtain written technical approval for any alternative. A shortage may support a request for time or cost relief, but it does not automatically create an entitlement or make another product acceptable.

The practical response is the same whether you are a project owner, main contractor or trade contractor: prove the shortage, measure its effect, protect quality, and keep commercial and technical decisions separate.

1. Pin down exactly what is unavailable

“Paint,” “cement” and “bitumen” describe broad families of products. The first task is to identify the precise item that cannot be obtained and the requirement it must satisfy.

  • Record the manufacturer or source, product name, grade, colour, mix designation or other identifying information in the specification.
  • State the quantity required, the date it was ordered, the original promised delivery date and every revised date.
  • Ask the supplier for a written explanation of the shortage, not just a telephone estimate. Ask whether the latest date is firm, whether a partial delivery is possible and whether another warehouse or approved distributor has stock.
  • Keep the purchase order, acknowledgement, emails, call notes, delivery notices and photographs of any stock received.

Caltrans’ public-works shortage process specifically asks contractors to provide proof of order dates and evidence that they tried to obtain the material from alternate sources. That is a useful record-keeping standard even when your project is outside California.

Questions to send the supplier

  1. What exact product, grade and quantity are affected?
  2. What caused the delay, and is the explanation supported by a manufacturer or distributor notice?
  3. Is the revised delivery date guaranteed or only an estimate?
  4. Can you make a partial shipment, offer an equivalent product from another facility, or identify an authorised alternate source?
  5. Will the price, freight, shelf life or warranty change?

2. Map the schedule consequence

A late delivery matters commercially only when it affects planned work, access, completion or another contractual milestone. Mark the blocked activity in the current programme and identify its dependencies.

  • Name the task that cannot start or finish without the material.
  • Check whether the task is on the controlling or critical path, or whether available float absorbs the delay.
  • Record crews, plant, inspections, permits and follow-on trades that will be idle or displaced.
  • Update the programme with the supplier’s latest estimate and show the earliest realistic recovery date.
  • Notify the owner, contract administrator and affected trades promptly, even if the final duration is uncertain.

Caltrans illustrates why this distinction matters: its shortage-related treatment of nonworking days includes specified conditions such as an RFI and an effect on a controlling activity. Those conditions belong to that California contract-administration system; they are not a universal test for delay entitlement.

3. Read the contract before claiming relief

Find the clauses that govern delay, notice, extensions of time, price adjustment, substitutions, suspension, force majeure or exceptional events. Also check the specification, purchase obligations and document-control procedure.

  • Notice: determine what event triggers notice, who must receive it, the permitted delivery method and the deadline.
  • Evidence: identify required schedules, supplier statements, mitigation records, quotations and contemporaneous cost records.
  • Substitution: check who may approve a change, which technical submissions are required and whether a substitute changes the contract price.
  • Time and money: separate an extension-of-time request from a claim for additional cost; each may have different tests and notices.
  • Mitigation: note any duty to seek alternate sources, resequence work or reduce the effect of the delay.

Scottish Government procurement guidance advises contracting authorities to examine the contract and assess a request for relief against its requirements. The same discipline protects contractors: preserve rights by following the actual contract rather than assuming that a shortage automatically excuses performance.

California public works, Scottish public procurement, U.S. federal procurement and NSW residential building rules are different systems. Do not transplant a notice period, compensation rule or legal remedy from one into another. The governing contract and jurisdiction control.

4. Send a useful delay notice

A first notice should be factual and timely, not an argument about liability. Include:

  • the specified material and affected quantity;
  • order date, promised date, revised estimate and the supplier’s written explanation;
  • the activities and milestones at risk, with the current programme reference;
  • steps already taken to find another source or partial shipment;
  • alternatives being investigated and approvals that will be requested;
  • the next information date and a reservation of any contractual rights, if the contract requires that wording.

Follow with updates when the supplier changes its estimate, an alternate source is found, a technical submission is made or the programme impact changes. Keep one controlled record so the owner, designer and trades are working from the same facts.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

5. Obtain technical approval before changing material

Availability is not proof of compliance. The designer, engineer, owner or other authority named in the contract must determine whether another product meets the intended performance and application.

Caltrans’ Construction Manual, Section 3-806B, states: “If the contractor asks to be allowed to substitute the unavailable material with available material, the resident engineer must seek assistance from those responsible for the design.” This is a California public-works instruction, but it expresses a sound control: the person responsible for design should assess a proposed substitution.

Information for a substitution submission

  • technical data sheet, safety information and product certification;
  • comparison with every relevant specification requirement;
  • compatibility with substrates, reinforcement, coatings, sealants, aggregates, binders or adjacent materials;
  • installation method, curing or drying conditions, storage limits and shelf life;
  • test results, warranties, environmental or fire requirements and maintenance implications;
  • price, lead time and the effect on the programme.

Do not place a substitute on the work because it is described as “equivalent” by a salesperson. Obtain the required approval in writing before delivery or installation, and record any conditions, mock-ups, tests or inspection hold points.

6. What the evidence supports for cement and concrete

U.S. Environmental Protection Agency procurement guidance identifies recovered-material ingredients that agencies may consider in cement and concrete where the project permits them:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • coal fly ash;
  • ground granulated blast-furnace slag (GGBF slag);
  • cenospheres; and
  • silica fume.

EPA says selection should be based on performance requirements, availability and price, and does not recommend one recovered material universally. These are ingredients used in cement or concrete procurement decisions, not automatic replacements for bagged cement or approval for every mix. Confirm the mix design, strength development, durability, exposure class, curing regime and project specification with the responsible technical authority.

7. Paint and bitumen: do not assume a generic replacement

The reviewed official guidance does not establish a generally suitable substitute for an unspecified paint or bitumen product. Paint performance can depend on substrate preparation, coating system, colour and gloss, dry-film thickness, chemical exposure and warranty requirements. Bitumen work can depend on binder grade, temperature, aggregate, pavement design, weather and testing requirements.

For either material, ask the specifier to identify a conforming product or approve a formal project change. If no compliant source is available, document the decision to wait, redesign, or omit the work; do not silently downgrade the specification.

8. Compare options on the same decision record

Use one comparison for every proposed course of action. A lower purchase price is not an advantage if it creates rework, fails testing or moves completion later.

Decision factor Alternate source of the specified product Approved substitute Resequencing while waiting
Specification and performance Still uses the specified product; verify source authorisation, batch and certification. Requires technical comparison and written approval before use. Preserves the specified product; verify that exposed or temporary work is protected.
Availability and delivery certainty Confirm actual stock, allocation and transport date; obtain evidence rather than a verbal promise. Confirm manufacturing capacity, testing and approval time as well as delivery. Depends on unaffected work, access, labour and plant being genuinely available.
Price and contract treatment Check freight, escalation and any price-adjustment clause. Record price difference and whether a variation is authorised. Assess remobilisation, extended preliminaries and disruption records.
Programme effect Insert the reliable delivery date and test whether controlling work recovers. Include submission, review, testing and lead-time activities. Show dependencies, float, access constraints and the return to the original sequence.
Inspection and workmanship Verify storage, batch traceability and required inspections. Set additional tests, mock-ups or hold points required by the approval. Maintain inspection and assurance for work performed during the wait.

9. Resequence work without creating a second problem

Use the delay period for unaffected work only after checking dependencies and site constraints. Scottish site-assurance guidance recommends assessing how shortages affect delivery while maintaining inspection and assurance measures that protect specified quality and workmanship.

Checks before moving another task forward

  • Does the task require the same access, scaffold, crane, storage area or specialist crew?
  • Will early work block delivery routes or make the eventual material installation harder?
  • Are temporary works, weather exposure, security and public safety adequately controlled?
  • Will inspections, tests, curing, drying or hold points still occur in the required order?
  • Could the change create abortive work when the delayed material arrives?

Update the programme and daily records when the sequence changes. Record why the change was made, who approved it and any additional cost or time effect.

10. Keep the client and trades aligned

Give the owner or client a short, regular status report containing the evidence and the decision needed. State what is known, what remains uncertain and who must approve the next step.

  • material, quantity and specification;
  • supplier explanation and current delivery estimate;
  • blocked activity and effect on controlling work or milestones;
  • alternate-source and substitution investigations;
  • technical, commercial and programme approvals outstanding;
  • next update or decision date.

For NSW home-building consumers, government advice is to work with the builder or tradesperson; it notes that alternative materials, products or project changes may be suggested. That advice does not authorise a change by itself. Confirm the agreed change, price and programme in the form required by the NSW contract and applicable law.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

11. Protect records, payment and quality

Keep a chronological file containing orders, supplier messages, alternate-source quotations, notices, programme revisions, labour and plant records, approvals, delivery dockets, inspection reports and photographs. Mark which costs are committed, which are estimated and which arise only from a chosen mitigation option.

Continue inspection and testing on work that proceeds. A shortage does not relax requirements for workmanship, curing, coating thickness, compaction, temperature control or other specified checks. If an inspection cannot occur because the material is missing, record the hold point rather than treating it as waived.

12. A practical decision sequence

  1. Evidence: obtain the supplier’s written position and complete the order and delivery record.
  2. Impact: mark the blocked activity, controlling-path effect, milestones and foreseeable costs.
  3. Contract: issue any required notice and check delay, substitution, price and documentation clauses.
  4. Sources: ask for partial delivery, alternate authorised sources and firm transport dates.
  5. Technical review: submit any proposed substitute to the responsible designer or engineer.
  6. Programme: evaluate resequencing with safety, access, quality and rework controls.
  7. Decision: obtain written commercial and technical approval before changing the work.
  8. Follow-through: update stakeholders, preserve records and verify every inspection and delivery condition.

What this means for your project

The defensible response to a delayed or unavailable material is disciplined triage, not an improvised product swap. Establish the shortage, show its effect on controlling work, comply with the project’s notice rules, and let the designated technical authority decide whether an alternative can perform. Cement and concrete procurement may offer suitable recovered-material ingredients when performance, availability and price support them; no comparable general replacement is established here for unspecified paint or bitumen. Until the contract, specification and jurisdiction are reviewed, treat entitlement to extra time or money as an open question and keep building decisions documented.

Product prices and availability are accurate as of the date/time indicated and are subject to change. Any price and availability information displayed on Amazon at the time of purchase will apply.
