blocked driveway

What to do when construction blocks your driveway or business entrance

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If construction prevents you from using a driveway, shop entrance, loading area or accessible route, first establish exactly what is blocked and who controls the work. Photograph the condition from a safe place, contact the site supervisor with a specific request for temporary access and a reopening time, then report unsafe or public-right-of-way obstructions to the responsible local authority. The correct remedy depends on your location, the permit, road ownership and the project’s traffic plan; there is no single nationwide driveway rule.

Identify the obstruction before you make a complaint

“The driveway is blocked” can describe several different problems, and each may involve a different person or agency. Walk the edge of the work area only if it is clearly safe; never enter an active work zone or move cones, fencing or equipment.

Driveway crossing or vehicle access

Is a trench, excavator, concrete truck, spoil pile or barrier stopping vehicles from crossing the driveway? Note whether the blockage is continuous or limited to particular hours. A contractor may be able to keep one side open, provide a plated or otherwise approved temporary crossing, or schedule short closure windows. Do not drive over an improvised surface unless the project team confirms it is designed and safe for your vehicle.

Business door, loading bay or deliveries

A business can remain technically “open” while customers cannot find a safe entrance or delivery vehicles cannot reach the loading area. Separate the issues: customer entry, accessible entry, staff access, deliveries, waste collection and emergency access. Each may require a different temporary route or time window.

Public sidewalk or street

If fencing, materials or vehicles occupy a sidewalk, travel lane or public parking area, the public agency that owns or permits that right-of-way may have inspection and enforcement authority. A blockage entirely inside private property is usually handled first through the owner, contractor or property manager, although local building, safety or accessibility authorities can still apply.

Document the condition without creating a safety risk

Good records make it easier for a supervisor or inspector to understand the problem and show whether it is recurring.

  1. Write down the location. Record the full address, the affected entrance or driveway, and the nearest intersection if the site is large.
  2. Record dates and times. Note when access became unavailable, each period when it reopened, and any announced end date.
  3. Describe the physical obstruction. Identify the equipment, excavation, fencing, parked vehicles or materials and whether a person using a wheelchair, mobility aid or stroller can pass.
  4. Photograph from a safe public or property vantage point. Include posted notices, permit information, project signs and the approach to the entrance. Do not step into traffic or behind barricades for a better picture.
  5. Copy project identifiers. Save the contractor name, site-supervisor number, owner or agency name, permit number and project number shown on signs.
  6. Record consequences factually. For a business, list missed delivery windows, cancelled appointments, inaccessible services or emergency-access concerns. Keep invoices, customer messages and delivery logs if the disruption continues.

Ask the project team for a safe, specific access arrangement

The site supervisor or project contact usually controls the day-to-day sequence of work. Contact that person before assuming the closure is unauthorized. Explain what you need, when you need it and what safe alternative would solve the problem.

Questions that produce an actionable answer

  • Who is coordinating access for this phase of the project?
  • Can vehicles use part of the driveway while work proceeds, or can an approved temporary crossing be installed?
  • What hours will the driveway or entrance be closed, and when is the next reopening?
  • Where should customers, delivery drivers and people needing an accessible entrance go?
  • How much advance notice will the project provide before each full closure?
  • Who should be called if the agreed route is blocked or unsafe?

For a business, give the team your delivery windows, opening hours, accessible-entry needs, waste-collection schedule and any emergency-access requirement. Ask for the answer in writing by email or text, including the expected restoration date. If the project has a community-relations or public-information contact, copy that person.

Use a clear request instead of a general objection

A useful message states the address, the exact access failure, the operational impact and the remedy you are requesting. For example: “The north driveway at 18 Example Street has been inaccessible since 8 a.m. today. Our accessible customer entrance and deliveries use this route. Please confirm a safe temporary route, the closure hours for the next seven days and the date vehicle access will be restored.”

Why project documents matter

Some contracts and permits contain access provisions that are more specific than general law. An Illinois Department of Transportation project specification, for example, requires the contractor on that particular project to keep driveways open by leaving at least half the driveway width available or using approved temporary access, maintain access to commercial and private property and coordinate each stage with affected owners. That is a project-specific specification, not a rule that applies across the United States.

Choose between the project team and a public authority

Use the route that matches who controls the obstruction. When responsibility is unclear, contact both and provide the same factual record.

Route Who controls it Best use What to provide
Project supervisor or contractor The crew, contractor or private owner directing the work Immediate scheduling, a temporary driveway or entrance, delivery coordination and restoration timing Address, affected access point, operating hours, safety or accessibility need, photographs and requested time window
Public road, public works or permit authority The city, county, transport agency or other body responsible for the right-of-way or permit Blocked sidewalk or street, unsafe traffic control, permit-compliance concern or a project team that does not respond Exact location, project or permit number, dates and times, photographs and the contractor’s response

A routine complaint is not an emergency call. Use emergency services only for immediate threats such as a collision hazard, fire access blocked during an incident or an exposed danger that cannot wait for normal reporting. For non-emergency issues, use the local public-works, road-authority, construction-permit or municipal reporting channel.

Report a public obstruction through the local channel

Local governments use different agencies and phone or online systems. Check the project sign and the authority’s website for the correct channel rather than assuming the contractor, police or a national agency handles every report.

New York City example

New York City’s Department of Design and Construction directs businesses with access or delivery concerns to call 311 and provide the project location and, if possible, the project number. NYC311 also accepts reports of construction barriers or equipment blocking public streets and sidewalks. The Department of Transportation can inspect permit compliance and issue violations where appropriate. These procedures apply to New York City; they do not establish a process for other municipalities.

What to include in a report

  1. State whether the obstruction is on a sidewalk, roadway, driveway crossing or private entrance.
  2. Give the exact address and nearest cross street.
  3. Identify the project, contractor and permit or project number from posted signs.
  4. Describe the safety, accessibility, delivery or emergency-access effect.
  5. Attach or retain photographs and note when you first contacted the project team.
  6. Request a reference number and write down the expected inspection or follow-up process.

Keep the reference number and every response. If an inspector finds the work permitted, ask what temporary access arrangement the permit requires and which office handles a continuing problem.

Treat pedestrian and accessible routes as a safety requirement

Vehicle access is only one part of the problem. A blocked sidewalk can force people into traffic, prevent wheelchair users from reaching a business and cut off a building’s only accessible entrance.

Caltrans’ August 2025 Construction Manual states: “The contractor is responsible for accommodating pedestrians through or around the work zone whenever the work disrupts pedestrian facilities.” The manual describes a continuous, unobstructed route and advance notice for planned sidewalk closures. This is California construction guidance; other jurisdictions may use different dimensions, approval processes or agencies.

When you contact the project team, identify the accessible route specifically. Ask where the alternate route begins, whether it has a firm and continuous surface, how it is separated from traffic and whether signs direct people to it. Report missing ramps, abrupt level changes, standing water, narrow passages or barriers that make the route unusable. Never accept a suggestion to “just walk around” if doing so requires entering the roadway or crossing an unprotected work area.

Source and place What it establishes Limit
New York City 311 guidance Sidewalk construction sites must provide a minimum 5-foot pedestrian walkway on the sidewalk or a protected pathway in the street; street construction sites must allow a minimum 11 feet for vehicle traffic. NYC-specific figures; the page does not state a publication year and the measurements should not be applied elsewhere without checking local standards.
Illinois Department of Transportation project specification On that project, the contractor must keep driveways open by retaining at least half the driveway width or using approved temporary access, maintain commercial and private-property access and coordinate each stage with owners. A project specification, not a nationwide entitlement.
New York City Department of Design and Construction Driveway access may be restricted for limited periods; businesses with access or delivery concerns are directed to 311 with the location and project number when possible. Municipal guidance for NYC projects.
England Department for Transport code The street-works coordination code applies from 10 April 2026 and guides local authorities and undertakers under the New Roads and Street Works Act 1991. Coordination guidance for England’s street works; it does not govern every country or construction on private land.

These examples show why a sign, permit condition or contract can matter more than a general statement found online. They also do not establish a universal right to uninterrupted driveway access, a guaranteed reopening deadline or automatic compensation.

Plan business continuity while access is restricted

Protect deliveries and collections

Tell suppliers exactly where to stop, whether a smaller vehicle can use an alternate approach and which hours are safe. Move recurring deliveries to a confirmed time window rather than relying on drivers to negotiate barriers. Give the project team a single staff contact who can coordinate each arrival.

Keep customers informed

Post the safe entrance and accessible route at the property, update appointment confirmations and tell customers how long the restriction is expected to last. Do not direct people through a route the supervisor or authority has not approved.

Preserve emergency access

Ask the project team and the relevant authority how fire, ambulance and utility access will be maintained. If an emergency vehicle could not reach the building, report that immediately through the local emergency or public-safety channel rather than waiting for the next routine inspection.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Track the operational impact

Maintain a dated log of closures, delayed deliveries, cancelled appointments and extra transport or staffing costs. The log documents what happened; it does not by itself create a right to reimbursement.

If the obstruction continues or causes loss

Escalate in stages: send the project contact your written request, report the public obstruction to the responsible authority, then ask that authority which formal review, permit-enforcement or accessibility process applies. Include your reference numbers and the project’s response.

Do not assume that a long closure automatically entitles you to damages. The applicable contract, permit, property documents and local law determine whether any claim exists. If the disruption is prolonged or you have documented financial loss, obtain advice from a lawyer or local adviser who handles construction, property or public-rights issues in your jurisdiction before asserting a compensation demand. The existence of an access problem alone does not establish a universal compensation remedy.

A practical checklist

  • Identify whether the blockage affects vehicles, the business door, deliveries, an accessible route or a public street or sidewalk.
  • Record the address, dates, times, equipment, barriers, signs, contractor and project number.
  • Take photographs from a safe location and never move traffic-control devices.
  • Ask the supervisor for an approved temporary route, closure schedule, advance notice and restoration date.
  • Give businesses’ delivery, customer, accessible-entry and emergency-access requirements in writing.
  • Report unsafe or public-right-of-way obstructions through the city, county or transport authority’s local channel.
  • Save complaint numbers, emails, photographs, delivery records and cost records.
  • Ask local legal or permit authorities about the applicable process before claiming that the closure is unlawful or that compensation is owed.
