Do not accept a higher cement charge on trust. First establish whether you accepted a fixed quote, an estimate, an allowance or a contract with a valid escalation clause; then ask the builder in writing for the exact contractual basis and an itemized calculation. The result depends on your contract and local law, so obtain local consumer or construction-law advice before withholding payment, signing an addendum or ending the project.

Start by freezing the decision, not the project

A builder’s message saying that cement has become more expensive is a request for review, not proof that the total price has changed. Reply promptly so the project does not drift, but do not sign a revised quote or approve an extra payment until you can connect the request to the agreement you made.

  • Collect the original quote, every revision, the signed contract (if there is one), drawings, specifications, allowances, invoices and messages.
  • Mark the date you accepted the quote, the date work began and the date the increase was requested.
  • Check whether the proposed increase relates only to cement or also includes delivery, tax, labour, quantity, specification or a change in scope.
  • Keep a call log. After a phone conversation, send a short email recording what was said and ask the builder to correct anything inaccurate.

Do not assume that paying an invoice, signing a variation or allowing work to proceed silently has the same legal effect everywhere. If a payment deadline is approaching, get jurisdiction-specific advice before withholding money.

Identify what you actually agreed to

The label on the document matters less than its wording, but these categories usually lead to different questions.

Accepted fixed quote

In UK Citizens Advice guidance, accepting a quote generally creates a contract at the agreed price. If the work and terms have not changed, a later material-cost assertion may not, by itself, authorize a higher charge under that guidance. Read the whole agreement for qualifications, however: a document called a quote may still contain an escalation or variation term.

Estimate

An estimate is an approximation rather than a guaranteed final price. Citizens Advice says a customer can dispute a final bill that is substantially above what was expected, but what counts as substantial and what remedy is available depend on the contract and applicable consumer law. Ask the builder to identify the assumptions behind the estimate and which assumption changed.

Provisional sum or material allowance

An allowance records an amount or quantity that was not finally known when the price was prepared. Determine whether the contract allows the actual, evidenced cost to replace the allowance, whether a builder’s margin is added, and whether you had a right to approve the supplier or specification. An allowance is not automatically an unlimited right to increase the contract total.

Escalation or price-adjustment clause

Find the exact trigger and calculation. A usable clause should say which materials are covered, what base date or index applies, whether there is a threshold, how the increase is calculated, what notice is required and whether you can reject a change or end the contract. A clause that simply lets the business raise the price whenever its costs rise may be vulnerable to fairness challenges. UK government guidance warns that a broad unilateral term can give a business a “blank cheque” to impose higher costs without consent, particularly where a significant or unexpected change is imposed on a fixed, short-term contract.

Client-requested or unforeseen scope change

If you changed the design, quantity, finish, delivery location or timing, the resulting cost may be a genuine variation. The builder should still identify the change, price it separately and obtain whatever approval the contract and local law require. Extra work needed to correct the builder’s own mistake is a different issue from a cement-market increase.

Demand a transparent calculation

Ask the builder to point to the clause or agreed variation that supposedly permits the increase. Then request documents sufficient to reproduce the arithmetic. A practical request includes:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • the original cement allowance, quantity and supplier price used in the quote;
  • the revised, dated supplier quotation or invoice;
  • the quantity actually ordered or expected to be used and the unit price;
  • delivery, handling, taxes and any supplier discounts shown separately;
  • the formula connecting the difference to the requested change in your contract total;
  • confirmation of any other labour, specification, programme or scope change included in the figure.

This is a verification request, not an assertion that every jurisdiction requires a builder to disclose each document. The US Federal Trade Commission recommends written estimates and contracts that state scope, materials, schedule and price; those records also make a disputed calculation easier to examine.

Use a written, non-committal response

Keep the tone factual. You can adapt this message to your contract and jurisdiction:

Please identify the contract term or approved variation that allows the proposed cement-price change and explain how it applies to this project.

Please provide the original cement allowance or supplier quote, the revised supplier quote or invoice and its date, the quantity, delivery costs and an itemized calculation showing how the requested amount was derived. Please confirm whether any labour, tax, specification, quantity or scope change is included.

I am reviewing this request and have not approved a revised price. Please do not treat the changed amount as accepted unless I confirm it in writing.

The wording is a communication prompt, not a legal notice guaranteed to preserve rights. Avoid signing an addendum or paying the disputed difference before understanding whether doing so changes your position. Preserve the original files, not just screenshots, and back up the communication trail.

How the rules differ by location

No single answer applies to every building contract. The following official guidance illustrates the differences; it does not replace the law where your project is located.

United Kingdom

Citizens Advice distinguishes an accepted quote from an estimate and explains that accepting a quote generally fixes the agreed price. Its guidance also treats a substantially higher final bill under an estimate as potentially disputable. UK Department for Business and Trade guidance on fair consumer contracts says significant or unexpected unilateral price changes are especially concerning in fixed, short-term contracts and that a business should not have an unrestricted power to impose more cost without consent.

United States

The Federal Trade Commission advises consumers to use written estimates and contracts covering scope, materials, dates, price and promises, to keep records, and to try resolving the issue with the contractor before seeking outside help. The FTC expressly notes that contract requirements vary by state. A state law, licensing rule or home-improvement statute may therefore add notice, lien, cancellation or payment requirements that are not in a generic contract guide.

Victoria, Australia

Consumer Affairs Victoria says a signed major domestic building contract can generally be changed only in specified circumstances and ordinarily requires a written Variation Notice agreed by both parties before work on the variation starts. The scheme has defined exceptions, including certain small client-requested changes. Those Victorian requirements should not be presented as rules for other Australian states or countries.

New South Wales, Australia

NSW Government guidance says that, in most cases, a contractor cannot charge more unless there is a genuine scope change or another reason allowed by the contract or building laws. It also says a contractor may not charge for extra work needed to rectify a problem caused by the contractor. These statements are NSW-specific and must be checked against the contract and current local legislation.

Compare the choices before you respond

A builder may offer several ways forward. Compare them against the written agreement rather than choosing solely on the headline price.

Option Questions to answer Risks to record
Pay the proposed increase Does a clause or approved variation authorize it? Is the calculation supported by dated supplier evidence? Is the new total and payment schedule written? You may waive an objection, accept unrelated extras or pay more than the contract permits.
Reduce or change the work Which quantities, finishes or specifications change? Does the saving exceed the cement difference? Who approves revised drawings and warranties? Lower performance, delayed approvals, warranty exclusions or later rework.
Use a different material or supplier Is the substitute technically compliant? Does it alter strength, curing, appearance, warranty or inspection requirements? Non-compliance, failed inspections or a dispute over who bears future defects.
End or suspend the arrangement What termination, cancellation, deposit, demobilisation and notice terms apply? Can another builder take over safely? Delay, additional procurement cost, a claim for breach or a payment dispute.

Put any chosen option in a signed written variation that states the revised scope, total, schedule, materials, warranties and treatment of deposits. Do not rely on a text message that leaves those points open.

If discussion does not resolve it

  1. Follow the contract’s dispute procedure. Check notice addresses, response periods, negotiation steps, mediation or adjudication provisions and any requirement to continue undisputed work.
  2. Contact the appropriate consumer or building authority. Use the agency or licensing body for the place where the work is located; explain whether the issue is a quote, variation, payment, defective work or licensing matter.
  3. Obtain local construction-law advice. This is particularly important before withholding a scheduled payment, terminating, changing locks, engaging a replacement builder or allowing work to stop where substantial sums or deadlines are involved.
  4. Protect the site and evidence. Photograph delivered materials and work in progress, store plans and invoices, and arrange a written record of the project status if the relationship is ending.

The FTC recommends trying to resolve the matter with the contractor first and then seeking appropriate outside help. A local adviser can tell you whether a demand, payment, notice or termination would preserve or damage your rights.

Questions that prevent a second dispute

  • Was the cement quantity measured from the current drawings, and who approves a change in quantity?
  • Does the contract use a published index, the builder’s actual invoice or another method to measure escalation?
  • Is the builder claiming only the net material difference, or also adding overhead, margin, finance or delay costs?
  • What happens if the supplier’s price falls before procurement?
  • When must notice be given, and what happens if notice is late?
  • Will accepting a partial payment, continuing work or signing a revised schedule be treated as acceptance of the new price?

For future quotes: prevent ambiguity before signing

Ask for a quote that identifies cement type, grade, quantity, supplier assumptions, delivery and taxes, the validity period and every allowance. Require a written method for changes: who may authorize them, what notice must contain, how the price is calculated and whether work can begin before approval. Keep the signed scope, plans, schedule and promises together. Consumer Affairs Victoria’s quote guidance and the FTC’s home-improvement advice both emphasize defining scope, materials, price and commitments in writing, although their legal requirements apply in their respective jurisdictions.

Most importantly, separate three questions in every conversation: what the original deal says, what physical change is now proposed and what amount the evidence supports. That separation makes it easier to negotiate a fair adjustment when one is justified and to challenge an unsupported increase without arguing about market headlines.
