When a delivery is late, short, damaged or the wrong specification, first establish exactly what is missing, preserve dated evidence, notify the party responsible for supply in writing, and show which scheduled work is affected. Then agree a documented recovery plan or variation. Your contract and local law—not a general rule about construction delays—determine notice deadlines, extension rights, payment consequences and available remedies.
Act immediately: a practical response sequence
- Check the load against the order. Compare each item, specification and quantity with the purchase order, confirmation and packing slip. Separate shortages from visible damage, incorrect products and items that fail the stated specification.
- Preserve evidence at delivery. Photograph pallets, labels, damage, the vehicle and the delivery paperwork with the date visible where possible. Note any carrier reservation, refusal or exception on the delivery record and keep a copy.
- Send written notice as soon as the gap is known. Address the owner, builder, supplier or subcontractor that the contract makes responsible for procurement or coordination. State what arrived, what remains outstanding, when the balance is needed on site and which work is affected.
- Update the programme. Record whether work stopped, whether another task can proceed, and whether the missing item controls a later activity or completion. Record decisions, dates and the people who made them.
- Review any proposed substitute before use. Check drawings, specifications, approvals, safety, compatibility, warranty, cost and programme effect. Obtain the required design, owner or authority approval and a written variation where the contract requires one.
- Escalate through the contract. If the responsible party will not provide a credible plan, use the contract’s notice and dispute procedure and obtain advice specific to the project jurisdiction before withholding payment, accepting a price change, terminating or claiming damages.
Make the shortfall precise
Record the delivery facts
A statement such as “the timber was short” is difficult to act on. Create a line-by-line record showing the item description, required specification, quantity ordered, quantity delivered, quantity still missing, delivery date and condition. Include the order number, supplier confirmation and the date the balance is required at the site.

| Record | What to capture | Why it matters |
|---|---|---|
| Product identity | Manufacturer or product name, grade, size, finish and drawing or specification reference | Distinguishes a true shortage from a nonconforming delivery |
| Quantities | Ordered, delivered, rejected or damaged, and remaining balance | Shows the exact recovery requirement |
| Dates | Order date, confirmation date, promised delivery, actual delivery and required-on-site date | Helps assess whether ordering and notice were timely |
| Condition | Crushing, moisture, contamination, broken packaging or other visible defects | Preserves a separate quality claim instead of treating it as a quantity issue |
| Work effect | Task waiting, alternative task available, stand-down, remobilisation or storage | Connects the delivery event to measurable programme consequences |
Keep a contemporaneous project diary
Western Australia’s Building and Energy guidance recommends keeping a diary of progress, weather and contractor contact, together with copies of communications. Its published wording is: “Consumer Protection recommends keeping a diary regarding the work progress, weather conditions and contractor/supervisor contact, but at a minimum make sure you take notes on all discussions with the builder or builder representative and keep copies of any written communications.” A dated digital log is sufficient; a purchased logbook is not required.

Notify the right party in writing
Identify procurement responsibility
The correct recipient depends on the contract and procurement arrangement. An owner-furnished item may be the owner’s responsibility; a builder-procured item may be the builder’s; a specialist package may sit with a subcontractor. Send the notice to the contractual contact and copy the project manager or other person who controls the programme. Keep proof of sending and delivery.
Include the information needed for a decision
- Project name and order or purchase reference.
- Items and specifications received, missing, damaged or incorrect.
- Quantity outstanding and the date it is needed on site.
- Specific work activity that cannot start or finish, and the next affected activity.
- Any practical alternative task that can proceed without the material.
- A request for a confirmed delivery date, cause of the shortfall and recovery plan.
- A request to identify any proposed substitute, added cost, approval requirement or programme change.
Ask for a written answer rather than relying on a telephone promise. Do not promise your own client an unverified arrival date; report the supplier’s confirmation and its conditions.
A concise notice format
Subject: Material shortfall — order reference and required recovery plan
Order reference: [reference]
Item and specification: [description]
Quantity ordered / received / outstanding: [figures]
Delivery date and condition: [date and observations]
Required on site: [date]
Affected activity: [task and programme reference]
Please confirm in writing by [date] the cause, firm delivery date, recovery measures and any proposed substitute. No substitute will be used until the required approvals, price and programme effects are agreed in writing.
Show how the shortage affects the programme
A late delivery is not automatically a completion delay. Identify the activity that needs the material, its planned start and finish, and whether it controls the next work or the contractual completion date. Record whether labour or plant stood idle, another crew was moved forward, storage or extra handling was required, or a remobilisation became necessary.

Caltrans’ public-works manual provides a useful documentation example: when assessing a claimed physical shortage, it seeks proof of order dates and evidence that alternate sources were investigated, and asks whether the shortage affects a controlling activity. That is an agency-specific procedure, not a universal rule for private projects, but the same evidence helps explain causation.
- Keep the baseline programme and each update showing the affected activity.
- Mark the date the material became critical, not merely the date the supplier missed a promise.
- Record reasonable alternate-source enquiries, including price, lead time and specification differences.
- Separate direct site costs from an alleged extension of the overall completion date.
Evaluate substitutes and schedule changes before agreeing
An alternative product may keep work moving, but it can alter compliance, design loads, fire or structural performance, appearance, durability, warranty and downstream compatibility. New South Wales guidance notes that alternatives can help resolve delays while changing cost and quality. Treat the proposal as a decision requiring review, not as permission to relax the specification.
| Comparison question | Evidence to obtain | Approval to confirm |
|---|---|---|
| Specification compliance | Datasheet, grade, dimensions, test results and drawing comparison | Designer, certifier, owner or authority approval where required |
| Programme effect | Confirmed availability, freight time and installation sequence | Revised activity dates and any extension or acceleration instruction |
| Total cost | Purchase price plus freight, storage, handling, waste and remobilisation | Who pays and the written variation value |
| Quality and warranty | Manufacturer warranty, service life and compatibility with adjoining work | Warranty treatment and responsibility for future defects |
Before ordering or installing a substitute, record the approved product, revised price, completion-date effect, warranty position and any changed performance requirement. Written variations are specifically recommended in Western Australian guidance; follow your own contract’s form and notice deadline.

Check the contract before payment or a delay claim
Read the clauses covering who supplies materials, inspection and rejection, notice method and deadline, extensions of time, variations, progress payments, delay damages, dispute resolution and termination. A clause may require notice within a particular number of days or in a specified form; no general deadline can be supplied without the governing contract and jurisdiction.
New South Wales guidance advises continuing agreed progress payments for completed work, checking the contract before accepting an extension or price change, and explaining the reason for any extension request. Do not withhold payment for unrelated completed work, accept a revised price, terminate or assert damages without contract-specific and local advice.
Who is responsible for the delay?
Responsibility turns on procurement duty, ordering conduct, the cause of the shortage, its effect on the programme and the contract’s risk allocation. The following framework helps organise the facts; it is not a universal legal test.

| Situation | Questions to answer | Records that help |
|---|---|---|
| Owner-furnished materials | Did the owner provide the item by the agreed date and specification? | Owner’s purchase order, delivery promise and site requests |
| Builder or main contractor procurement | Was the item ordered on time, correctly and with required deposits or credit? | Order confirmation, payment record, supplier correspondence and alternatives checked |
| Subcontractor package | Did the subcontract include procurement, and did coordination information arrive in time? | Subcontract scope, approved submittals and programme notices |
| Supplier or carrier failure | Was the order accepted and paid, and did the supplier miss its confirmed date? | Confirmation, dispatch record, tracking, shortage report and written explanation |
Caltrans’ manual says its physical-shortage analysis does not cover a shortage caused by untimely ordering, failure to make a requested down payment or lack of credit. That rule applies to its construction work, not every private contract. It illustrates why order timing, payment status and reasonable alternative efforts must be documented before assigning blame.

A short delivery and a delivery that fails inspection are different events. List the missing quantity separately from items that are wrong, damaged or unapproved. Quarantine questionable products so they are not incorporated while responsibility is being decided.

On a private project, follow the contract’s inspection, acceptance and rejection provisions.

If you are the builder or contractor
Tell the owner or project manager promptly what is delayed, why, and what evidence supports the explanation. Provide the order date, supplier confirmation, shortage details, alternatives investigated and the affected programme activities. Submit an extension or variation through the contract’s required notice process and state assumptions clearly. Do not represent a hoped-for delivery as a firm date.
For public works, apply the agency’s own shortage and time-adjustment rules. A detailed manual such as Caltrans’ may require evidence that the order was timely, credit or deposits were available, alternatives were sought and the shortage affected a controlling activity.
Escalate proportionately when communication fails
Use the agreed notice and dispute path
Start with the contractual contact, then issue the formal notice required by the contract. Keep the chronology, invoices, receipts, photographs, delivery records, programme updates and all attempts to resolve the issue. Mediation, adjudication, expert determination or court proceedings may be available, but the correct route and time limit are jurisdiction-specific.

In New South Wales, consumer guidance recommends attempting resolution with the builder, retaining the contract and financial records, and then approaching Building Commission NSW if the issue remains unresolved. In Western Australia, government guidance treats late completion primarily as a contractual matter and directs consumers toward legal advice or its dispute-resolution process after direct discussion fails. These are regional pathways, not a universal process for every project.
Put industry-wide figures in context
A New South Wales Government page displays historical figures attributed to Australian Bureau of Statistics data from March 2022 and a Procore Builder Survey: 113,943 total dwelling approvals in New South Wales since 2020, a 15.4% national increase in housing-construction materials, and 36% of builders reporting rising material costs as a significant challenge. The displayed attribution does not state the survey year for the 36% figure. These numbers describe historical context, not 2026 market conditions, and they do not determine entitlement on an individual project.
